“I agree that this practice is shameful, but tryig to convince the public that a non-profit has been started without full IRS non-profit status is not only misleading but illegal. I’ve yet to establish credence for the foundation named for my missing grandson, Kyron. I am in the dark for what should be and is being done on behalf of this little boy. I understand, too that the founder was awarded for his efforts to help other families who have lost a child to unknown or known circumstances. I wonder if this may be a situation of mistaken identity? If the foundation is ‘real’, great – I hope many benefit. I suggested back in month 3 of this tragedy that an effort be made to get as many people to donate a dollar so we could hire a private eye, attorneys and others to help establish Kyron’s whereabouts when it was apparent efforts were becoming fruitless and we were facing a cold-case status.
IMHO, this is not the way Kyron’s situation should be handled! I pray for Ky’s safe return to be very soon!”

I spent a couple of hours scanning for videos on Kyron's plight and found 7 pages of links. It threw me back to hearing in disbelief Desi's phone call declaring that Kyron had gone missing from school.
It's all too fresh in our memories, driving to Portland, Kelly in the back seat searching deperately on my phone for any news of an Amber Alert for him and getting frustrated when she couldn't. Hearing about the converging forces of the Sheriff, Oregon State Police, Portland Police, Search and Rescue teams and the FBI at Ky's tiny rural house was surrealistic. The feeling got worse when we arrived, met by Blackhawk helicopters scanning the area.
We met everyone in a daze, numbed by the ride, the this-can't-be-real feeling and wondering when we would see Kyron again, if ever. Terri was too calm, too detached to be anything but guilty of something very, very bad.

What's really sad about all this is the impact this has had on the other grandchildren - especially Ky's very best friend, good buddy, his cousin who wrote a letter to Santa to bring Kyron home again - he knows if anyone can do it, Santa can. If that doesn't tear at your heart .... AND, to think, Terri spent hours on Facebook while you could hear Search and Rescue outside calling Kyron's name and beating the bushes of the adjacent hillside and gullies ... AAARRGH!!!

Desi spoke with Jane of HLN (CNN) and read her letter to Terri yesterday. I think it caught Jane off guard as she sounded close to tears. Basically Desi said she's probably the only person Terri knows who will understand what was going on, having been married to Kaine. I think Kaine has made his bed and will have to live with his narcissistic controlling crap - his son, my grandson, is missing!

The two-year anniversary of Kyron's going missing is fast approaching.

Right after that, in October, is the two-year anniversay of the judge abating the divorce actions (he put 2 years on the abatement - will he increase the abatement time - can he increase the abatement time - or are fireworks going to start going off)?

Monty Reiser to obtain correction certification without performing necessary field work; and made inappropriate requests for Elliott, now with river patrol, to take Staton's daughter's class on a ride in a sheriff's boat. Elliott is seeking $1.5 million in damages.

"Instead of supporting an environment of truth and accountability in officers, Staton was going to preserve the status quo of turning a blind eye to misconduct in officers," the lawsuit said. Moore is now Staton's undersheriff.

(snip)  "I think that the conduct of the sheriff and the chief deputy are so outrageous, so offensive, that I think somebody needs to step in and clean up that office once and for all," said Burrows, Elliott's lawyer.

Staton said it's not unusual for officers to verbally describe their knowledge of certain tactics because of limited time to demonstrate all the training requirements.

After Elliott had raised safety concerns about Staton's request to take his daughter's elementary school class on a sheriff's boat ride, Staton said he cancelled that ride and temporarily suspended such rides. Staton said those types of rides had occurred in the past.

"I didn't want this to turn into an issue and it was developing into an issue," the sheriff said.  (snip)

I don’t doubt that Mr. Houze is taking great interest in these allegations against Sheriff Staton.
This could be looked at as a character/ethics of a man/Sheriff: a sheriff who is heading up the investigation of Kyron Horman.

 Recently I was in Portland and had the opportunity to share my son’s story with someone that hadn’t heard of it and as
always I was happy to talk about Kyron and share his story. It worries me that people don’t know about him or know what happened. It has nearly been two years and Kyron is still not home, this is unsettling for his entire family, and most especially for me. I thought this nightmare wouldn’t last through the night. I was very wrong. I want everyone to know that he is still not home and we all need to be responsible for sharing his story, because it only takes one tip, one person to crack this case open again and bring Kyron home. I have received a lot of gifts for Kyron in Medford and as many of you know we started an area a year ago called Kyron’s Pad. It includes many flowers, a plum tree, his bench and frogs of course. We have incorporated some of the gifts that we have gotten from his supporters and have updated some of the structures for Kyron. We will continue to share pictures with everyone and will add new items to his area. I continue to be amazed and surprised at the gracious nature of people and all of the thoughts and prayers we receive every day. Please continue to pray for Kyron’s safe return and spread the word, share the flyers and talk about him as we arrive at the 2 year mark since he was last seen.

WOODBURN, Ore. – New hi-tech billboards along Interstate-5 now feature photos of unsolved missing children cases.

That includes Kyron Horman, who vanished almost two years ago in Portland. Kyron was last seen at Skyline Elementary School, where he attended a science fair.

In reporting on the Etan Patz case, a CBS News video segment shows someone at a computer screen working on an age progression image of Kyron. At about 50 seconds into the video.

It's been almost 2 years since Kyron went missing and still there isn't any public news of where he may be. Why is that? What is really going on in this case? Is the case being delayed because there may be bigger fish to fry? Who knows. One thing I DO know is that Kyron is not home yet. Not one person has been named a suspect by MCSO as of this date. Not even in the alleged MFH plot.

One of the many things that have perplexed me in this case was, during the sting on June 26, 2010, a DEA agent accompanied Rudy Sanchez to the Horman home. Why a DEA agent? Well, IMO, it's possible he was there as a witness to more then just the MFH plot. Perhaps because of an investigation going on prior to Kyron going missing. It would make sense.  Is it possible the Rudy Sanchez is a long time informant?

Investigators clearly believed his story as it was the basis for an attempted sting on June 26th by MCSO including an undercover DEA agent. Sanchez, wearing a wire, demanded a $10,000 payment from Horman for services rendered, except Kaine was very much alive.

Anyway, below, I have pointed out some areas that have been publically documented and have led me to this opinion. I am NOT stating this is what MCSO does on a regular basis, but IMO, you have to question it.

Peter Bunch said he's asked for Terri Horman calls to 9-1-1, back to Dec 26th [Note: the Decemeber request my have been mispoken].  But was denied by Sheriff's office saying it's part of "ongoing Investigation." He's tried to serve the landscaper, Rudy Sanchez with subpoena for deposition, but prosecutors wouldn't give him contact information because of the "ongoing investigation."  Bunch said Terri called 911 when Sanchez showed up at her house wired "trying to talk to about something".  He also said Rudy Sanchez is an AKA (alias).

Besides blowing the whistle on Bryant, Clark and the three other people who'd helped him dispose of Pawloski and Schneider's corpses, Castro solved a 1998 shooting death of a former associate. Soon after Castro's arrest, documents show, he told detectives the 18-year-old man was killed when he, Castro and four other cronies robbed two Clackamas pot growers. With Castro's account the two growers were charged with murder, while Castro's four surviving cohorts were slapped with robbery indictments.

Castro's information burnished his credibility and made him more valuable as a witness than as a defendant.

PORTLAND, Ore. - Desiree Young, the mother of missing boy, Kyron Horman, plans to file a civil suit against the boy's stepmother, Terri Horman.

The lawsuit, which sources tell KATU News will be filed on Friday, accuses Horman of "custodial interference."

Under Oregon law, custodial interference involves keeping a person from their legal custodian "permanently or for a protracted period."

It's not clear what evidence Young will lay out in her lawsuit.

It's also important to note that this civil suit is different from a criminal indictment and was not brought by prosecutors. There is a lower burden of proof to find someone guilty in a civil suit compared to a criminal trial.

In a criminal case a defendant must be found guilty "beyond a reasonable doubt." However, in a civil case a defendant must only be found guilty based on a "preponderance of evidence."

"I explain to people as if you have a scale and drop one grain of sand on the scale, that's all you have to show for preponderance of the evidence. So it's a very low standard," said family law attorney Drew Bobzien. Bobzien is not involved with the Young lawsuit.

Young and her attorneys are filing the lawsuit now because there is a two-year statute of limitations on bringing a suit. Kyron was reported missing on June 4, 2010.

Even with the lawsuit, we shouldn't expect to see Terri Horman take the stand and testify about the case. She'll be protected by the Fifth Amendment of the Constitution against incriminating herself because she could still face criminal charges in the case.

"There isn't really any reason to think that any kind of evidence would shake out of the tree," Bobzien said.

Anything Horman says in a civil case could ultimately be used against her in a potential criminal case.

A judge, however, could allow the civil trial to proceed without Horman's testimony, which would make it difficult for her to defend herself.

Law enforcement sources told KATU that members of the Kyron Horman task force met once again on Thursday morning to discuss the latest developments in the case.

Kaine Horman Reacts: 'The gloves are off'

In reaction to the expected civil lawsuit, Kyron's father, Kaine Horman, said standing next to the Wall of Hope, "I think at this point in time, the gloves are off."

He says by nature, he's a patient person. But his patience is worn thin when it comes to the unanswered questions about his son and what happened to him - answers he believes Terri Horman holds.

June 4th has become a day we all remember in the KXL newsroom.  That is the day we all learned that a young boy named Kyron Horman was missing....he was last seen with his step mom at a science fair at Skyline School.  For months, his face was pasted all over the media and on billboards as police desperately searched for him.  His step mom, Teri Horman, became the focus of the investigation but charges were never filed.   Kyron's body has never been found.  His birth mom Desiree Young is now suing Teri Horman for custodial interference meaning that she has kept Kyron from her for an extended period of time.

I just had a thought.

This is a VERY smart move on the part of Desiree. Now, I'm not an attorney but, if Rosenthal brings up evidence in a civil trial, can't that be used in a criminal trial?

I was thinking this would prevent evidence from being quashed by a judge if it makes it to a criminal trial because it would already been recorded by the courts.

It will compel Terri to return Kyron. The demand is for $10 million dollars. Will amend the case for punitive damages. We will pursue anyone that helped her. They DEMAND that Terri tell them where Kyron is.

It could take a year if she fights the case. Terri will have 30 days to respond.

Terri Horman was the last person known to see Kyron alive at Skyline School on June 4, 2010. She has long been the focus of the investigation into his whereabouts, although she has never been formally named a criminal suspect.

I'm sure of one thing, Desiree is not going to give up. She is determined to find Kyron, one way or another. I think we know that TH most likely doesn't have a pot to pee in as far as money, and I'm sure Desiree and Rosenthal are aware of that. IMO, I think it's about working around criminally charged barriers to bring her son home.Hence, the civil suit.

That's what I was thinking, too...as long as MCSO has not formally cleared Terri, she won't be making any statements. 

Desiree asserts that "Terri" "kidnapped" Kyron.  Last I remember (it's fuzzy ha ha), Terri left Kyron at school and MCSO said there were witnesses that say Kryon after Terri left.  Kyron disappeared from school...on the school's watch.  Right?

With no indictment or arrest in the two-year disappearance of Kyron Horman, the boy's mother Friday turned to civil court, filing a lawsuit that contends Kyron's stepmother kidnapped the boy and asks a judge to compel her to bring him back, or divulge where his body was taken.

Terri Horman's lawyer, Stephen Houze, said he would not respond until he had thoroughly read the civil complaint.

VELEZ-MITCHELL: Tonight, a new development in the mystery surrounding the disappearance of 7-year-old Kyron Horman. You remember this case. We covered it so much.

It`s been two long years since little Kyron vanished from his school science fair. And now Kyron`s biological mother is putting the heat on the one person she believes knows what happened to Kyron, his stepmother Terri Horman.

Kyron vanished two years ago Monday after attending a school science fair in Portland. Stepmom Terri Horman brought him to school that day. She was the last person to see him.

Well, tonight Kyron`s mother is suing stepmom Terri Horman, -- you see stepmom right there -- for custodial interference because Desiree Young, the mother, says she believes the stepmom Terri Horman had something to do with her son`s disappearance.

YOUNG: I hope everyday that Kyron comes through the door and that we find him ok. I want that with everything. But with the information and the evidence I have been presented against Terri, I`m confident that she probably did something to him.

VELEZ-MITCHELL: Terri Horman has never officially been called a suspect or even arrested in this case. We reached out to her attorneys but have not heard back. Kyron`s dad is trying to divorce her, but it`s stuck in the courts right now.

During this investigation, Kyron`s dad found out that his former bodybuilding wife -- you see Terri there -- even allegedly tried to hire someone to kill him and she that also had a sexting fling with a gardener.

Straight out to Bruce McCain, attorney and former captain with a sheriff`s office -- very, very knowledgeable on this case; tonight, Bruce, what do we know about this lawsuit Kyron`s mother has filed?

BRUCE MCCAIN, ATTORNEY: Well, Jane, we haven`t actually seen it because it hasn`t yet quite been released to the public. But I can tell you already there`s going to be some major substantive problems for Desiree. Oregon actually has a statute that allows for a civil suit for custodial interference but it piggybacks on the criminal statute. It requires Desiree to do what the prosecutors have been unwilling to do and that`s actually to prove Terri Horman committed a crime.

And one of the elements that`s going to be very difficult in this case is that the first-degree custodial interference that Desiree has to prove requires a showing that Kyron was taken out of state. That`s going to be virtually impossible.

It also has a six-year statute of limitations. So we`re still curious why the lawyers are saying we had to do this right away. This really looks like it`s more along the lines of Kaine`s civil suit two years ago of trying to force Terri into some kind of a deposition, which she`ll never do; and to try to get some information out of her.

The likelihood of success in this is not very good.

VELEZ-MITCHELL: And Kaine is the father, by the way. Just for those who are unaware of all the players, Kaine is the dad.

MCCAIN: That`s right.

VELEZ-MITCHELL: Police told us today that this is not a cold case and that there`s a detective assigned to Kyron`s case. They wouldn`t comment on Terri Horman. Kyron`s mom has repeatedly made statements that she believes stepmom Terri had something to do with her son`s disappearance.

YOUNG: Terri, I feel like you are at a crossroads in your life. This is not going to get any easier for you. The police will not stop until they find Kyron. You will go to jail, and whoever has been helping you will either have to talk, or they will go to jail.

VICTORIA TAFT, HOST, "THE VICTORIA TAFT SHOW": Well, it looks to me Jane, as if it`s a place holder for something that is coming down the pipe. Maybe throwing everything against the wall and at least putting her marker down and saying, ok, something`s got to happen. Maybe they`re hoping that something will shake loose, some information. Maybe it will light a fire under the new district attorney who`s coming on board fairly soon. Maybe someone will say, we`ve got to do something, I know some information, and maybe they`ll call in, Jane.

VELEZ-MITCHELL: Kyron lived for the most part with his father and his stepmother Terri and their young daughter. Kyron`s biological mom Desiree would see him on weekends.

Desiree says she never realized how Terri felt about her son. Essentially Desiree feels that Terri hated her son. The stepmom took the 5th before a grand jury. She`s been questioned by police but she`s never been arrested.

Joe Episcopo, criminal defense attorney, she`s been silent. She`s been the focus of the investigation but she`s never been charged with anything. Is this one of these -- and I hate to say this because it breaks my heart -- no body, no case?

JOE EPISCOPO, CRIMINAL DEFENSE ATTORNEY: Well, as far as the civil suit, she`s going to take the 5th amendment. They`re not going to get anywhere on that. Even if they win $1 million they are probably never going to collect it. So I don`t think they -- you know, they don`t have a case either way.

Maybe they should have thought about the civil suit against the school. But I just think they`re going to have problems just because they say, well, she didn`t like the kid. That`s not enough to get a conviction in criminal court.

VELEZ-MITCHELL: Listen, over the past two years Kyron`s mom, Desiree, has resigned herself to the fact that her son is probably dead. She wants somebody to pay for it.

YOUNG: I just want her to see his face every single day. I want her reminded every single day of what she`s done. I want her to suffer. I want her to suffer as much as Kyron has.

And those billboards are a reminder that I will never stop. I won`t stop until we find him.

VELEZ-MITCHELL: Kyron`s dad and stepmother were standing at the school bus stop on the afternoon of June 4 waiting for Kyron to get off the bus. And he never did. There is the father and there is the biological mother. They had split up a long time ago when Kaine was living with the stepmother. They have since split up and they are in the midst of an ugly, ugly divorce.

Pat Brown, criminal profiler, will we ever learn the truth about what happened to this precious young boy?

PAT BROWN, CRIMINAL PROFILER: Well, it`s like every one of these other cold, cold, cold cases. They don`t have any physical evidence. They have suspicions. They have beliefs. I`m sure they are looking at Terri Horman. No question about it. But they`ve got nothing to work with that would lead to any kind of a prosecution.

So, unless something pops up one day, that`s not going to happen. And the civil suit, in my opinion, is kind of ridiculous because the only way to prove that she interfered with anything is to prove that she murdered the child.

I think it's a good possibility that you may be correct. I'm praying that this civil suit will bring out the cockroaches that have been in hiding.

I think we can say, without a doubt, IMO, that Terri is not going to say chit. Houze would be a looney tune to allow her to speak even though he can't force her to remain silent. She does have a choice to step forward and tell the court everything she knows, but most likely, that's not going to happen. JMO.

I can't believe that she hasn't seen her Kiara for two years and hasn't made a legal move to do so. ( As far as I know ).

IIRC, I believe we found out when the divorce case documents were flowing that not only can a LDT not be used in a civil case (cannot be used in "court"), but in one of Houze's responses he chastised one of Kaine's filings because it "mentioned" LDT which is against the law in a "formal document" because an LDT cannot be used in court.

Remember when Kaine filed his sworn affidavit in the divorce case and they mentioned LDT in that filing (maybe twice) and when Houze responded to Kaine's filing, Houze made it clear that it is "against the law" to mention the LDT because LDTs are not allowed in court.

Kaine Horman will not be at work Monday on the second anniversary of the disappearance of his son Kyron Horman.

He's reserving the day for media interviews about his son, who was last seen June 4, 2010. Over the past two years, Horman has spent countless hours reminding the public that his son is missing and that he's focused on finding him. The latest event was held Saturday, with a Run for Kyron at Cook's Park in Tigard.

The case captured the national spotlight for months as investigators searched for signs of the boy who disappeared from his elementary school, drawing attention from people as far away as Europe. His story has fallen below the radar, but Horman does everything he can to draw public awareness.

He thinks every public event -- and more are planned through the summer -- could help resolve the case.

Does he think Kyron is still alive?

"Yes, ma'am, I sure do," Horman said.

I have a MOO too.  According to Terri the bell went off and she watched Kyron head toward his classroom and then turned around and left.  While Tanner was coming up the stairs to the classroom, he saw Kyron going down saying he was going to see the "cool electric one".  The time is too short for anyone other than Terri to have told Kyron about the "cool electric one".  Terri sent him to his fate.

PORTLAND, Ore. - Kyron Horman would be 9 years old now that two years have passed since he was last seen June 4, 2010.

The National Center for Missing & Exploited Children produced an age-progressed image showing what Kyron might look like two years after he disappeared.

Kyron was 7 years old when he was last seen at a pre-class science fair at Skyline Elementary School on the outskirts of Portland.

I was looking at the age progression image and it would appear they have Kyron's jaw line more prominent than his pictures show two years ago, which I guess would be normal for a growing young man.  His face just looks so much fuller than I would have imagined. 

I hope that each night Terri's head hits her pillow, vivid, terrifying nightmares come to her.  May she not find a minute's peace until she tells the truth about Kyron.

Kaine Horman is waiting for his son to return. There's a banner in the living room that reads: "Kyron come home." Pictures of the bespectacled boy line the walls.

"I am not going to make a shrine for Kyron in my house, but I have stuff all over my house that has his face and name on it," Kaine tells PEOPLE.

Kaine has never given up hope and adamantly believes his son is alive. While he waits, he has made changes to his son's bedroom.

"My heart is with him all the time and I … wonder what he is like now. I wonder what he is into. I wonder what he enjoys," he says. "It makes me feel like I am keeping pace with him when I am updating stuff. It makes me feel like he is still there."

Kaine reads stories online and some commenters have chided him for not keeping things the same. He understands but he says he's going to do things his own way.

"What is right is completely up to me. He is my son," Kaine says. "There is no playbook for how you are supposed to feel. There is no playbook for how you are supposed to heal from it. There is no playbook for what you are supposed to do. Everybody is different."

"And the more he looked at it he realized it looked like scalp and human hair."

On Monday KOIN did hear from Jeffrey Dickerson with the Columbia County Sheriff's Office.
He confirmed "a fisherman pulled a wad of what appeared to be human hair out of the water"
on his fishing line. However, Dickerson said no scalp was attached.

The hair is being sent to the Oregon State Police Crime Lab for analysis. 

He said the Multnomah County Sheriff's dive team "could find nothing" to suggest a human
body was nearby.

Also, IMO, I don't Terri was on SI. We keep looking for any news that pops up praying that it will lead to bringing Kyron home, one way or another. We all want that. We all want that in every case don't we.

Unfortunately the hair belongs to someone, but I sincerely don't think it's him. JMO.

There were about 10 strands of light-brown hair, about five inches long, according to one of the fishermen, Steve Klinger. He said they weren't sure what to do about the catch, but they decided to call 911.

Sheriff Dickerson said the results might not come back from the crime lab for weeks.

I have been working on an update piece as it is, and then this- I personally do not believe what was recovered belongs to Kyron, but  I am very interested as the initial comment from a witness I spoke to was that it appeared to be "horsehair".

To my knowledge,  at this moment it cannot be concluded that what was found was not a wig, or a portion of same, although I have to believe we are not sending dive teams in at night if that were the case.

For me,  given the description and location,  I think it MAY be "D.A.D." related.
This is not the first time this launch was searched.

Okay, I’ve had something rattling around in my brain for days and I need to get it out of there!
A long time ago I used to check in at The Hinky Meter on Kyron’s case to see what folks were saying. At one point Valhall shared a long “Blog Post” that had been sent to her from a reader. This “blog post” had been written by someone using the handle “Red Squirrel” and in the post she had said how much she hated her stepson, wished he would die, etc. I believe it was posted on some step parent blog site, not sure where and I can’t find it now that the Hinky Meter has closed shop. Valhall had speculated that perhaps the Red Squirrel poster was TH talking about Kyron.
I am just wondering, were it TH that wrote it, well that would certainly be an item that would cause DY to say TH had an extreme hatred for Kyron. And I think LE would have been able to trace the poster’s url address, although I may be wrong about that. IDK if we talked about it here or not, does anyone else remember this?

The computer enhanced updated photos naturally, would only work if the child was still alive.  IMO they cause more confusion than anything else. I am not a fan of the enhancements.

I agree, the computer enhanced photos to show age progression leave a lot to be desired.

But the video in my post above has nothing to do with enhanced photos.

It's really worth a watch. It's about people actually in the same place as a missing child poster and the missing child showcased in the poster. And how people react to seeing the child.

Makes one think about the effectiveness of Missing Posters.

Kyron started calling me Momma when...Kyron started calling me Momma when he was 2 years old. Because I didn’t really like it when he first said it, I asked him why he was calling me that instead of Mom all of the sudden. He told me, “because you are a Momma and it is better than just a Mom.” Because he liked it so much I said it was okay and it kinda stuck . . . now I would give anything to hear him say that to me or yell it from the bedroom again.

Kyron’s Favorite Past time…. Ever since Ky...Kyron’s Favorite Past time….
Ever since Ky was a baby and Quinn was 8 we have danced together in our living room…we often turn up the music and just dance. It makes you smile. I often think of our dances and how much Kyron loves it. When it is hard, I can close my eyes and I still see him dancing in the living room with his brother playing air guitar to the music. I would occasionally play some new music just to see their reaction, the last one, New Kids on the Block. Oh yeah and Kyron loves “The Right Stuff”. Who would have thought they would make a comeback!

Kaine wanted our son to be named with a K, and that was hard to do with a boy’s name, we gave it a good college try to no avail. Kaine came up with the suggestion that we name him either Kermit or Kasper. And that was the day the frogs started; from that moment on everything was frogs, gifts, toys, shirts, etc. Ky loved it.

My brother was young, around 4...My brother was young, around 4 or so. After I finished using my chapstick I handed it to Kyron, thinking he might want to put some on his lips. As I turned back around to retrieve it from him I realized he had eaten the entire thing in one mouthful. Almost simultaneously as he is trying to chew it he is also getting that look on his face, as if to say, “What in the world kind of candy is this?” He says to me, “What kind of Starburst is this.” Well my mom and I laughed so hard that she almost drove off of the road. Kyron didn’t understand what was so funny until we told him it was chapstick, and Mom said, “Ky go ahead and spit it out, please spit it out, you don’t have to eat that.” Then he decided it was funny enough to laugh at too.
One of the stories we think of often when we think of Ky.

Before Kyron went missing he used...Before Kyron went missing he used to spend the night at our house quite often. My oldest son and him are the best of friends. Every time he would stay I would set up a cot to sleep on. Well Kyron always wanted to sleep on one of the bunkbeds instead because it was more comfortable, so at night time Kyron and Mayson would get together and convince Connor (my youngest son) that sleeping on the cot was the coolest thing and that he should sleep on it (this way Kyron would be able to have the more comfortable bed).

Why Kyron?:
It was almost September 2002 and we really hadn’t come up with an appropriate name for Kyron. We looked everywhere, in every book available. Well by the time I was 8 months pregnant, I had been in labor for a month, I was ready to be done being pregnant, I decided to go to a movie. I thought why not spend the afternoon in the air conditioning so I went to see the movie “Sum of All Fears.” Well there is an actor in the movie who spells his/her name “Ciaran”; well anyway I was trying to pronounce it in my head to figure out how you say it. Well I suddenly said “Kyron” and I went ooooh, I like that. Needless to say I told Kaine when I got home and he agreed, we decided that Kyron it was and we spelled it Kyron.

Well now....just what does TH think her son will say???  If he can shed light on why Kyron is missing can you imagine the torment he must feel about having to testify???!!!!  As a parent who would no questions asked, die for my child I could never, ever, ask him to stand in front of a court of law and lie for me if I was guilty of something!!!  Especially not in the case of his missing brother!  TH, if she does know something or did the crime herself, must take the stand and tell the truth and not put her child through the agony of having to hold bad secrets in and lie.  He will soon be old enough to leave the nest and talk freely so she better watch out!

Young filed a lawsuit that contends that Kyron's stepmother kidnapped Kyron Horman and asks a judge to compel her to bring him back, or divulge where his body was taken.

The lawsuit filed by Kyron Horman's biological mother, Desiree Young, asks a judge to order Terri Horman to return Kyron or, if he's dead, say where his remains are located. The lawsuit also seeks $10 million.


Terri Horman says in a brief filed late Tuesday that a criminal investigation is under way, and the civil suit should be stayed two years while it plays out.

Her lawyers claim it's an unfair effort by Young to get information that police could not get in the criminal investigation. They worry anything said in the civil case could taint a future jury pool if there's an arrrest down the line.

Missing Oregon child Kyron Horman breaks new legal ground

Recent civil court filings in the case of Kyron Horman, the 7-year old Portland boy who vanished more than two years ago, are significant far beyond the case itself.

This case is establishing legal precedent with every filing

These filings are the first under Oregon’s landmark child abduction statute, Senate Bill 1041, known as “Aaron’s Law”, which provides child abduction victims with new tools where the criminal and family law systems are unable to move forward, and yet there is a missing child.

With Aaron’s Law, Oregon became the first and only state in the nation where the crime of Custodial Interference in the First Degree creates a civil cause of action, the legal basis for a victim to hold abductors accountable for the damage their actions have inflicted on innocent children and families.

The attorney for Kyron’s mother made the first move, filing notice of a tort claim against Kyron’s stepmother. This filing was first in the state and first in the nation.

The nation’s criminal and family law systems treat the issue of time, the value of time in a child’s life and in the child’s relationships to parents and family, as if time has no importance.

Both systems also provide few tools or options for victims, who are usually put in the position of helpless spectators to processes that are failing to produce a missing child.

Aaron’s Law provides new tools to resolve and deter child abduction cases.

Aaron’s Law also recognizes that many child abductions involve multiple perpetrators, and is triggered by the Oregon Custodial Interference I statute that reaches to any person who takes, entices or keeps a child wrongfully, who provides planning, logistical or financial support to the abduction.

Did you notice on page 10-11 that James is going into the military in late August? I wonder how that will play out if he's deposed. Can he be deposed while in the military? If he can't, I'm curious if this was a legal maneuver.

I still say, as I have always said..that Terri Horman is dirty in all of this.  If Ms Horman was innocent she would have been ready for the custody trial, the divorce trial and now this civil case..by ready I mean chumping at the bit to have her version, her innocence proclaimed in a court of law.  But instead she has chosen to remain silent, and no longer has a husband, daughter ..nor anyone with a shred of common sense's belief that she did not participate in some way in Kyron's dissappearance.

I did notice that James was going into the military in August - meant to point that out...sorry.

At first I wondered if it was a legal tactic...but upon further thought I don't think so now.  It's a big step...for his future...and I'm sure he's spend many months making up his mind on this issue.  I think it will be good for him to get away and get his mind on other things...get some good training - and possibly college after the military.  Terri and her parents all have good educations and I would think they would inspire James.

That should be interesting...

GypsyDD, I totally agree.  If I was innocent, I wouldn't want any delay in shouting it from the tallest building.  To be away from my daughter all this time . . . there is no way in h$ll I would tolerate that.

If there is evidence that Terri had anything to do with Kyron's disappearance should she get off because LE is hoping for an unlikely break in the case?  Waiting two more years will indeed have an ill effect on a civil trial perhaps to the complete detriment of any type of justice being served.

IMO Desiree should be allowed to have her voice and evidence heard in a court of law.  She is a victim.  Let's protect her rights, too.  If she's wrong, and her evidence is not strong enough then so be it, Terri's name will be cleared.

PORTLAND -- A judge has denied the motion by missing Portland boy Kyron Horman's stepmother to delay the civil lawsuit filed against her by the boy's mother.

Desiree Young, Kyron Horman's mother, filed the civil suit nearly two years after Kyron Horman went missing.

Terri Horman, the boy's stepmother and the subject of Young's suit, was the last person known to have seen Kyron. He was 7 when he disappeared June 4, 2010. The civil lawsuit accuses Horman of kidnapping Kyron, by herself or with help.

Anywho..hoping those that do will keep us upto date on this. 

Poor James..I really wonder how much he knows..certainly if she was an alcoholic he would have seen evidence of that..unless he was already in bed when her drinking statrted.  And since he wasn't there since January of that year..he may not be albe to shed much light on Terri's demeanor after that point..meaning according to reports she sent him to his father..not the other way arround in January.

I see that she was hitting a breaking point..and being an alcoholic she possibly never had a real parenting bond with the younger two..

I think she knows what happened and helped along what happened..but I don't think James can shed much light on the situation..by that time he was removed to his Dad, at her request, I think that's when her life was starting to snowball.  And I do think she was involved in drugs and sex,as well as being an alcoholic and not your everday variety much more indepth and harsher..that's why their was not such a leap for her to imagine hiring someone she could seduce to murder her husband.  I think she was way over the edge of normal behavior and found like friends in drugs and sex..she certainly didn't waste anytime in her sexting once her daughter was taken from her..she was already on to her next conquest...bipolar is what I am imaging with other issues..that manifested in her trying to rid herself of her husband and step son to pursue her dark side..and if she lost her daughter so be it..we have seen no recourse from her to try to regain custody.

At the age of 45 I am growing quite fond of Twitter!  In my youth there was only arcade games and the beginning gaming and home computers, very beginning so I have missed out on lots.  Most of you know I'm still computer stupid but Twitter is a little easy to look at but I haven't Tweeted!  Just spectating as usual!  For those that don't have Twitter, here ya go but remember to read from bottom to top!

 A judge in the civil case against Terri Horman, the step-mother of missing boy Kyron Horman, issued an opinion on Tuesday in which he called Terri a “prime suspect” in the boy’s disappearance.

The opinion was issued as part of an ongoing civil case filed by Desiree Young, Kyron’s biological mother, accusing Terri of kidnapping Kyron and “intentionally interfering with [Young’s] parental rights.

The judge ruled the lawsuit can continue, although Terri Horman herself doesn't immediately have to answer any questions.

The civil suit and new opinion are separate from any criminal case. So far, police and prosecutors have not named a formal suspect in the two-year-old case.

This is, however, the first time anybody in the legal system has officially called Terri Horman a “suspect.”

Kantor's ruling was brilliant, addressing every angle, even Meisenheimer's earlier ruled abatement.  He deftly outlined where he expected the suit to go and why giving both sides 'rules of engagement' so to speak, and protecting the rights of both parties equally.

I'm fairly certain it was Terri's own attorney who labled her as the prime suspect and Kantor only mirrored that in his opinion.

America's Most Wanted was in town for a few days this week doing some shooting for an upcoming feature on the boy's disappearance.
 
Crews arrived on Monday and left Wednesday after filming at several locations, including the Multnomah County Sheriff's Office. The episode will air sometime next month.  (snip)

JANE VELEZ-MITCHELL, HOST: Tonight, strong words from a judge involved in the case of missing 7-year-old Kyron Horman. For the very first time a judge is calling Kyron`s stepmom, Terri Horman, quote, "prime suspect."

Tonight I will speak with Kyron`s father, Kaine Horman, and get his reaction to this latest development. Plus, we`ll find out where the search stands for this adorable little boy who`s been missing for more than two years. Where is young Kyron?

VELEZ-MITCHELL (voice-over): Tonight, is there finally a break in the hunt for missing little boy Kyron Horman? And who did a civil judge name as, quote, "the prime suspect" in the child`s disappearance? In an exclusive interview, I`ll talk to Kyron`s dad about what he thinks happened to his precious son.

And it`s like straight out of a soap opera. The man accused of faking his own drowning is now turning the tables and blaming his own son. Were they in cahoots to cash in on a life insurance policy, or is the son just the victim of the dad`s alleged scheme? And why did the soon-to-be ex-wife have husband Raymond Roth thrown in jail? I`ll talk to the lawyers on all sides tonight.

Plus, "JVM`s Most Wanted" tackles a brutal and unsolved murder. A woman known as the other Laci, gunned down in her car, and her killer still on the loose. I`ll talk to the desperate mother about the hunt to find her daughter`s murderers.

DESIREE YOUNG, KYRON`S MOTHER: Kyron is still alive.

UNIDENTIFIED MALE: Terri Horman, his stepmother, the last person known to seen him, told police they attended the Skyline School science fair.

UNIDENTIFIED MALE: When he walked by the hallway, I`m like, "Hi, Kyron."

He`s like, "Hi, I`m going to see this cool electric one."

I`m like, "All right, bye." And that was the last time I saw him. He never did make it back to class.

YOUNG: Please do not be afraid, because the police are going to find you.

UNIDENTIFIED MALE: Terri Horman`s cell phone records indicate she was not where she said she was on the day the 7-year-old went missing.

YOUNG: We implore Terri Horman to fully cooperate with the investigators to bring Kyron home.

UNIDENTIFIED MALE: Terri Horman has refused to answer investigators` questions, and she`s been evasive on a polygraph.

YOUNG: I`ve known her a long time. I know she`s lying.

VELEZ-MITCHELL: Tonight a new development in the ongoing search for 7-year-old Kyron Horman, who vanished from his elementary school more than two years ago, a case that garnered national attention.

For the first time in legal documents, somebody is now calling Kyron`s stepmother, Terri Horman, a prime suspect in little Kyron`s disappearance, and tonight in an exclusive interview, I will get reaction from none other than Kyron`s father, Kaine Horman.

This very sad saga, this mystery, began June 4, 2010, when little Kyron vanished from the school science fair. Kyron`s stepmom, Terri Horman, had brought Kyron to school that day, but the little boy never made it to class somehow. Kyron`s parents never knew anything was wrong until Kyron didn`t come home on the school bus that afternoon.

At first Kyron`s parents, who were divorced and both remarried, appeared to be united in their search for Kyron, standing side by side at the news conference. But that would be the only time they would appear together. And now it`s come to this.

YOUNG: I believe that Terri Horman knows where Kyron is. I believe that Terri Horman is responsible for where my son is.

VELEZ-MITCHELL: Kyron`s biological parents both believe that Terri Horman had something to do with their son`s disappearance, although she has never been charged.

KAINE HORMAN, KYRON`S FATHER: I believe that there`s some form of involvement. I don`t know to what level. It could be directly involved. And she`s responsible and she acted alone that day, or someone else is involved, either with her or even maybe potentially without her in light of something not breaking, coming forward quickly. This is going to be a marathon, not a sprint. This could go on for two, three, four years, potentially, without closure.

VELEZ-MITCHELL: Cops gave Terri Horman two polygraphs. They searched the house and her vehicle, and they told the public they doubted that this was a stranger abduction.

Then court documents revealed Terri was allegedly plotting to kill her husband Kaine Horman with a gardener she`d been sexting with while young Kyron was missing.

Throughout all the saga, one thing remained constant: Terri Horman never spoke out about Kyron`s disappearance. She never defended herself even. So where does the investigation stand now?

I`m joined by my very special guest, Kaine Horman, Kyron`s father.

Kaine, I know you`ve never stopped searching for your son. My heart goes out to you. What you have endured defies description. First of all, what do you make of this judge in the civil suit filed by your ex-wife, Desiree, against Terri, calling her a prime suspect? Do you think it changes the dynamic here?

HORMAN: I don`t think it changes it at all. I think it`s probably just a language thing. Probably more of an overreaction or, we`ll say, reading into records that are just indicating things that I think we all already know.

VELEZ-MITCHELL: How have you held up over these last couple of years? This was a saga that captured the entire nation. Everybody identified with your pain and wanted to find out what happened to little Kyron. We covered it repeatedly. And then it seemed like the case just went cold. What have these two years been like for you, Kaine?

HORMAN: Well, I`d say just from, I guess, the inside, looking -- you know, looking out, is -- the case has been far from cold. It`s been extremely busy. The investigators have been extremely active in following up with leads and tips that continue to come in, even over two years later. They haven`t given up. There`s been just a tremendous number of projects that they`ve worked on.

I think the difficulty is without the information leading us directly to where Kyron is, it`s more of a process of elimination than just going straight down the one path that leads to where he`s at. So for us it`s been, you know, it`s been a long two years, but it`s been a very fast two years. We`ve stayed very busy with projects and other things, like attending events in the different communities around the state and up and down the West Coast trying to keep involvement with the case, keep his name active as possible, in standing up with all of our fellow -- everyone in the communities that are supporting him and together just trying to keep this thing going and not letting it go.

And I think it`s been not just in our state or the West Coast but across the U.S. there`s communities all over who just don`t want to let this go. They want to see resolution just as badly as we do.

VELEZ-MITCHELL: Kaine, let me -- let me jump in, because I know you`re working very hard. But from the outside it seems like, well, there was a grand jury. There was all of this sort of anticipation that something was going to break, and then nothing did break that has been publicly revealed. Let`s recap and review what happened the day your son vanished. And then we`re going to talk about why you feel that progress has been made. Because from the outside we can`t see it, and we want to bridge that gap.

Kyron vanished from his school science fair on June 4, 2010. His stepmother, Terri Horman -- she`s got the red hair -- took him to school that day, and it wasn`t long before Kyron`s parents, biological parents, realized they didn`t know if Terri left him at the school or not. Listen to this.

VELEZ-MITCHELL: OK. Those are Kyron`s biological parents.

So here`s how the day unfolded. Stepmom Terri Horman reportedly left the school at 8:45 a.m.

At 9 a.m., Kyron is seen by another student.

At 1:21 p.m., Terri posts photos of Kyron on Facebook.

And then at 3:30 p.m., Kaine and Terri Horman meet at the school bus, but Kyron is not on it.

Now, we called and e-mailed Terri Horman`s attorney, but we never heard back.

So to go through that day, Kaine, you`re the father of this missing boy. We know that there were searches of a nearby island; saw the island. We know that there was a grand jury where a whole bunch of people, including a friend of Terri Horman`s, appeared. They were -- they were questioned. How come you`re saying there`s progress when we can`t see it from the outside? Is there any lead?

HORMAN: Well, again, it`s tough to answer. It`s all about -- it`s all part of an ongoing criminal investigation, and the details really are things that we can`t talk about. The investigators, while they`re looking for Kyron, it`s either a direct path there or it`s a process of elimination to get there. And like I said, without the person knowing where he`s at coming forward with that information, it`s extremely difficult to locate where he is.

So they`ve been working leads and tips. They continue to do that, and they`re trying to rule out other people at the school that day, other scenarios that could have played out that afternoon and really get down to what`s...

VELEZ-MITCHELL: Do you -- can I jump in? I just want to jump in. We`re looking at pictures of Terri with the red hair and your son. HORMAN: It`s either one of two things. And until they give us information, it`s hard to say. But either she took him from the school that day and did something with him or she took him from school and handed him off to somebody else. And until we -- until the criminal investigation determines what happened, we`re not really at liberty to say which way we`re leaning toward in the investigation at this time.

VELEZ-MITCHELL: Breaking news: Kyron Horman`s biological mother -- you just heard from her -- Desiree Young, has filed a civil lawsuit against Terri Horman. Terri Horman`s attorneys asked for the lawsuit to be delayed. The judge denied that request. Once again, the judge called Terri a prime suspect in the disappearance of Kyron in the court paperwork. Authorities have never said that, and she hasn`t been charged with any crime.

I want to go to Debra Opri, a criminal defense attorney out of Los Angeles. Essentially, this lawsuit filed by the biological mother of Kyron, says the judge should order the stepmother to either return Kyron or, if he is deceased, say where his remains are located. It seems unusual for a civil case to make that kind of demand. What can you tell us about that?

DEBRA OPRI, CRIMINAL DEFENSE ATTORNEY: Well, this is a civil litigation. It is detached and separate from different burdens and standards from the civil -- criminal investigation.

I don`t find it unreasonable or outrageous that the judge would say, "Here`s the foundation of what`s going into this case. I`m ordering you to return this child or tell us where you know he is."

The reason he`s doing that is he`s basically giving her an order. And if she does not satisfy that order and she ignores it, which she probably will, and later on the child is found, and there is a criminal investigation that shows she had something to do with it, she`s now in contempt of court on the civil action.

VELEZ-MITCHELL: Here are some very bizarre things. We learned in the days following little Kyron`s disappearance that stepmom Terri Horman was a former body-building contestant and that she was allegedly telling people at her gym that she was angry at her husband, Kaine, because he supposedly wanted Terri`s teenage son to move out of the house, and that Terri Horman was reportedly sexting with a gardener while Kyron was missing.

An unsealed restraining order revealed that Kaine was told by investigators that his wife, Terri, had actually plotted, allegedly, to kill him, and that she had allegedly offered the gardener she was sexting with a lot of money to kill Kaine.

So I want to go back to Kaine. This is the woman you were married to and that you had a child with, another child. Not -- not Kyron. Did you ever get a sense that there was other side to Terri Horman? Like you`re living with this stranger who has this dark side?

HORMAN: No. Not at all. No.

VELEZ-MITCHELL: Well, how is that possible? I mean, that somebody could be so different, allegedly, trying to get you killed, murdered, allegedly telling everyone that she`s furious that you wanted the -- her teenage son to move out of the house? This is prior to your son`s disappearance. Do you think that could have had anything to do with it? In other words, sort of tit for tat: "Oh, you want my son to move out, therefore -- I`m going to get back at you"?

HORMAN: You know, I don`t know. That information is not correct. So I honestly don`t know how to respond to that. I think that that information was basically built up after the fact. There was never a request, nor did I ever ask for her son to leave the house. That was her choice and her decision based on their relationship.

VELEZ-MITCHELL: Well, I hope you understand I`m just exploring this, Kaine, not in any way to put you in an awkward position. These are aspects of the case that have been publicly reported that we`re trying to clear up so that we can understand.

You`re saying, if I understand you correctly, that you believe your son may still be alive and that you feel there are two possibilities, that -- if so, what would the motive be to allegedly hypothetically hand your son off to another individual?

HORMAN: The motive, I don`t know. I honestly can`t say. There`s not been enough information that would tell us what frame of mind she was in and why she conducted herself in the way that she did that day. That`s, I think, something that we`re all curious about at this point. I -- honestly, I don`t know. I really don`t know.

VELEZ-MITCHELL: Where does it stand with your attempts to divorce Terri Horman?

HORMAN: Well, we started the process in late June of 2010. The filings and the responses basically carried over into November of 2010, where we did have hearings about moving forward with the case.

It was determined that we should abate the case, basically putting it on hold for a three-month period until January of 2011, at which time we had another hearing to talk about the best interests of all parties involved. A lot of the circumstances were talked about in the filing by the judge in the latest civil case that was filed yesterday.

And the points were reiterated in there as to why we evaded originally in the divorce proceeding, and we`ve been on hold ever since. That will come up, I believe, this November.

VELEZ-MITCHELL: These poor parents. Where is this precious young boy?

Let`s talk about the grand jury that was convened to look into Kyron`s disappearance. Now, the step-mom, Terri Horman, even her friends, at least one of them, were called before the grand jury. It`s not known what they said.

For example, one friend`s home was searched in the days following Kyron`s disappearance, because on that Friday afternoon that Kyron went missing, that friend reportedly left her job and couldn`t be reached for 90 minutes. That friend is not considered a suspect or a person of interest. But everybody even remotely connected to this case was put under the spotlight.

Bruce McCain, former captain of the county sheriff`s office there, can we get this down to plain English in turn terms of where this investigation stands and why is it that it is not a cold case? What are the possible leads here?

BRUCE MCCAIN, FORMER CAPTAIN OF MULTNOMAH COUNTY SHERIFF`S OFFICE (via phone): Well, Jane, what we`ve heard so far today from Kaine and everybody else, it`s really nothing new.

As far as the criminal investigation, there never has been an identifiable crime scene. We`ve talked about this over and over and over, which makes this case so frustrating for all in all.

Now what`s happening, you just mentioned the grand jury of two years ago. What`s going to happen in the civil case, Jane, is that Elden Rosenthal, the civil plaintiff`s lawyer, is going to start deposing some of these familiar names like DeDe Spicher. And they`re going to be put under oath to talk about everything they know.

And we all know that Terri Horman is never going to be deposed in the civil case. She`s got the right against self-incrimination. However, Jane, her words that she`s spoken to other people are going to come out. And while Kaine and Desiree, and the sheriff`s office, the D.A. and the public all have the same goal in mind, to find out what happened to Kyron, at some point the civil litigation is going to cross swords with the sheriff`s investigators and the P.A. over access to those criminal files and subpoena deputies into the courtroom.

VELEZ-MITCHELL: Debra Opri...
 
MCCAIN: So there`s going to be a point where there`s going to be a collision. And that`s where it`s going to get quite interesting here in Multnomah county.
 
VELEZ-MITCHELL: Debra Opri, criminal defense attorney, usually we hear about, for example, a wrongful death trial after a criminal trial, like the O.J. Simpson case. This is happening before any criminal case, because there is no suspect.

OPRI: The state of Oregon is interesting. Unlike the federal courts in most of the states, when you assert your Fifth Amendment right against self-incrimination, you cannot infer anything from your assertion of that constitutional right.

I agree and disagree with Mr. McCain on two levels. First, we have a civil action which you`re going to take depositions, but if they didn`t tell the police then, are they going to tell anybody now?

VELEZ-MITCHELL: And I`ve got to give Kaine the last word. Our hearts go out to you. Ten seconds. What do you want to tell America?

HORMAN: That our son is still missing. We`re doing everything we can to find him. And the pressure continues to be on. And don`t give up. We`re going to -- we`re going to get this done. We`re going to find him.

And Kyron, we`re going to find you. We love you.

VELEZ-MITCHELL: I pray that you are right. Thank you, Kaine Horman. Our hearts go out to you.

It sounds like Kaine is saying Kyron definitely left with Terri that morning.  It's been theorized that Kyron left Skyline with an unknown male suspect but Kaine implies that is not a consideration.

It's hard to believe she didn't take him from there but I still think she had someone lure him away, that she didn't drive away from Skyline with him.  Kaine says "we" but then says until "the criminal investigation determines what happened" maybe the "we" is just his and Desiree's theory.  I dunno, I just want this poor baby found!  Ya know, I really don't wanna think that this person that Ky lived with and supposedly loved him, lured him to the truck, immobilized him somehow and then either killed him, had him killed or passed him to some, God forbid, person to do evil things to him.  It's easier for me to think someone else did this.  I shouldn't fool myself I guess.

According to Marion County Sheriff’s Office public information officer Don Thomson, the remains were found about a mile from the water in a remote hunting area.

Thomson said there are no missing people in his county, and pointed to high-profile missing persons cases like Kyron Horman, the 9-year-old Portland boy who disappeared in June 2010, and Lori “Woody" Blaylock, the Bend woman whose husband murdered her in November 2010 and dumped her body in the North Santiam River near Marion Forks.

According to a press release, hunters found the skeletal remains off state Highway 22, near Niagara Park. That’s more than 25 miles from Marion Forks.

The bones have been sent to the medical examiner’s office. Thomson cautioned the remains might never be identified.

“It all depends on what we’re able to determine, on how many bones we collect," he said.

Sunday marked the 10th birthday of missing child Kyron Horman, who vanished from Skyline School in northwest Portland in June 2010 and hasn't been seen since.

Kyron's father, Kaine Horman, spent Sunday manning a booth at the Sublimity Harvest Festival, selling shirts and buttons to keep the search for Kyron going and to raise awareness about the missing boy.

Kaine Horman said he would celebrate his son's birthday with a cake and some presents with Kyron's half-sister. They live their lives as if Kyron could walk through the door at any moment.

"We miss him tremendously, just like we do every day. I wish he could be here and I wish he could have been here for the past birthdays that he has missed so far. It's time that we're not going to get back that he shouldn't have to miss," Kaine Horman said.

PORTLAND -- Kyron Horman's stepmother is adding a new face to her legal team; Attorney Mark Wagner will help defend Terri Horman in a civil lawsuit.
 
Wagner, from the Portland law firm Hart Wagner, specializes in civil defense work. According to his staff, Wagner was out of the country Monday and not available for comment.
 
Divorce attorney Peter Bunch and criminal defense lawyer Stephen Houze will also continue to represent Terri Horman.

A statement was released today by the Skamania County Sheriff's office in regards to human remains that were discovered near Turk Road in Skamania County.

Remains found by a property owner clearing brush near Washougal, Wash., are that of a 39-year-old man missing since 1980 who lived about a half-mile away.

Kenneth P. Stovner had been reported missing in April 1980 from his home on Belle Center Road, Skamania County Undersheriff Dave Cox said in a news release. An intense search at the time found no trace of him, Cox said.

Terri Horman's friend DeDe Spicher declines to answer any questions about Terri Horman in deposition

Desiree Young's lawyer has filed a motion asking a judge to compel DeDe Spicher, a friend of Terri Moulton Horman, to answer his questions after she refused to answer 142 questions during a deposition he took earlier this month stemming from Young's civil lawsuit against Horman.

Multnomah County sheriff's investigators looking into the disappearance of Kyron Horman, a second-grader who went missing from Skyline School on June 4, 2010, were interested in the whereabouts of Spicher on that day.

Spicher refused to answer any questions posed by Young's lawyers on Oct. 5 that involved Terri Horman, Kyron's stepmom, or Kyron -- each time asserting her Fifth Amendment constitutional right not to incriminate herself.

Spicher also refused to answer questions about where she was on June 4, 2010.

"Are you aware that Kyron Horman has disappeared?" asked Young's lawyer, Elden Rosenthal.

"I'm asserting my Fifth Amendment right," Spicher replied,  according to a transcript filed in Multnomah County Circuit Court.

Spicher even declined to identify a photo of Terri Horman, or whether she knew Terri Horman's husband, Kaine Horman , Young, or had ever met Kyron.

Young's lawyer, Elden Rosenthal, asked Spicher about her relationship with Terri Horman, including when she met her, if they ever worked out at the same gym together, if she moved into the Horman home after Kyron disappeared, and whether Terri Horman ever spoke to her about her relationship with Terri's husband or sons, Kyron and James Moulton.

In his motion filed in Multnomah County Circuit Court Monday, Rosenthal asks the court to compel Spicher to answer his questions. Rosenthal argued that the Fifth Amendment provides that "no person...shall be compelled in any criminal case to be a witness against himself..."

"Plaintiff believes that Ms. Spicher has inappropriately sought the protection of the privilege against self-incrimination," Rosenthal wrote. "The privilege is personal; it cannot be used to protect another person...Otherwise, the privilege could be used as a shield to protect a witness' friends, and to deny a civil litigant probative evidence."

Young's civil lawsuit accuses Terri Horman of kidnapping Kyron and asks a judge to compel her to bring him back, or divulge where his body was taken. The suit seeks $10 million in damages, with the option to seek additional punitive damages, and was filed three days before the two-year anniversary of Kyron's disappearance.

Two years ago, Multnomah County investigators searched Spicher's Tualatin condo, the garden property on Northwest Old Germantown Road where Spicher was working that day and her aunt's address as they sought to determine Spicher's movements.

In 2010, investigators also put out a flier with Spicher's photos on it, asking if anyone noticed her or Terri Horman between 9:45 a.m. and 1 p.m. on June 4, 2010.

On June 4, 2010, Spicher was doing gardening work for a homeowner in the Northwest section of Portland, and abruptly left about 11:30 a.m., when the homeowner and another person working at the home were ready to sit down for lunch. The homeowner tried calling Spicher on her cell phone, but got no answer, and Spicher returned to the house about an hour to 90 minutes later, detectives were told.

Spicher asserted her Fifth Amendment right when asked in the deposition about her actions that day.

No one has been charged in Kyron's disappearance and he has not been located.

Spicher did tell Young's lawyers during her deposition that she moved to her parent's house in Klamath Falls in September 2010 after losing a job. She said she now works for Skylakes Klamath Medical Clinic, helping coordinate patients' referrals to specialists.

Also in her deposition, Spicher said she had been doing a gardening internship for a woman in Northwest Portland in 2010. She identified the man she last was in a relationship with, and even gave her changing weight from the time she ran a marathon in 2008 to her current weight.

 
But Spicher declined to say whether or not she was paid for the work she did on June 4, 2010 at the garden property on Northwest Old Germantown Road home. She did say that she was receiving unemployment benefits at the time.

Rosenthal pointed out that Spicher, who gave an interview to People Magazine for a story that ran Aug. 17, 2010, also wouldn't answer any questions regarding direct quotations from the People interview, or whether she got paid for the interview.

Some of Rosenthal's questions were more probing and personal. He asked Spicher whether or not Terri Horman used steroids, whether or not Terri Horman ever had sex with Kaine Horman's friend Michael Cook who spent time at the Horman house after Kyron disappeared, and if Spicher is bisexual.

Each time, Spicher asserted her Fifth Amendment right, declining to answer..

On June 4, 2010, Terri Horman had driven Kyron to school for a science fair. She told authorities that she last saw him walking down the hall toward his classroom about 8:45 a.m. Kyron never made it there, but he wasn't reported missing until the afternoon, after his father, Kaine Horman, and Terri Horman discovered he wasn't aboard the school bus returning home.

Peter Bunch, Terri Horman's attorney, has characterized the goal of Young's lawsuit as an "end run" by Young and police to obtain information they couldn't get through the criminal inquiry into Kyron's disappearance.

I found it.  I'm on page 10 of 20.  Dear Lord.  The questions are telling... about what Desiree believes happened with her baby and about the flawed investigation.  LE did not subpoena or even ask for Dede's telephone or computer records even though she had unaccounted time that day.   ::MonkeyNoNo::

I know! How idiotic is that? WTH were they thinking, or rather not thinking of? This case has been screwed up from the very beginning. Shame on them.

Others have suggested this case may be related to Terri Horman supplying steroids to members of LE.  Relatively shortly after Kyron disappeared some officers were accused of using steroids and were either arrested or lost their jobs. 

I have to reconsider the possibility.  Wouldn't it be horrendous if a member or members of LE were responsible for the disappearance of this little boy?

Perhaps, DDS, is covering for more than one person?  This is all speculation on my part.  IMO

Just to clarify- DeDe has no way of knowing, unless it was shared with her and verifiable proof was presented, what records were or were not subpoened or gained by LE.  She responded to the question asked of her, which was if she had ever given LE permission to access, or if she turned them over, etc.

I do not believe for 10 seconds that LE does not have her cell records, and I believe they duped her hard drives on any electronics if they were included in the subpoena to search her residence.  Her online account access would also be transparent to LE review if LE had a subpoena for it as well.

I am on record to say that this was a botched investigation unfortunately, but facts are facts..

I now remember daddy was a member of a search team...for another case. 
He would have had connections and strings to pull, IMO.

PORTLAND, Ore. -- Another friend of Terri Horman has been subpoenaed to testify before a grand jury this week as the investigation into 7-year-old Kyron Horman's disappearance reached its 61st day.

Chelsea Aleshire, who identified herself as a close friend to Terri Horman, said she will appear in court Thursday. Aleshire spoke to Terri Horman on the day Kyron disappeared from Skyline School, but at the time they spoke, Aleshire was not aware that Kyron was missing, she said.

She has not spoken to Terri Horman since then, she said.

Aleshire is at least the second of Terri Horman's friends to have been subpoenaed. Eight days ago, DeDe Spicher appeared before the grand jury. Sources have said Spicher did not answer any questions. Kyron's birth parents, Kaine Horman and Desiree Young, have suggested she's not cooperating with the investigators.

The Oregonian newspaper reported this week that investigators have focused on Terri Horman's close circle of friends after learning one of them obtained new cell phones for her so she could avoid investigators' scrutiny.

In case anyone is interested, what I've finally been waiting for, Terri's FB page has been set to the Timeline phase. With FB, when you are forced into timeline, resets some security options.

I can't see DeDe doing anything but asserting her 5th amendment write to any questions asked wrt Desiree's civil suit; afterall, I remember when Desiree/Kain first talked publicly about DeDe and they said then they would sue her if she didn't tell them what they wanted to know. 

"Perhaps" DeDe can't tell them what they want to know because she, herself, doesn't know. 

I would think with the first comments by Desiree/Kaine and now DeDe being deposed wrt to Desiree's civil suit that DeDe would be concerned that anything she says will be spun.

Just saying....there's more than one way to look at this.

I agree in a sense, but if you look at the motion to compel, Rosenthal clearly states that she (DeDe) can't use the 5th Amendment when it's in response to her knowledge of another person. That person being Terri.

The hearing motion is set for 12/14/2012.

A protective order issued in the lawsuit filed by Kyron Horman's mother against Terri Horman said mental health records can be used in the case.

The records, however, will not be made public.

The lawsuit was filed by Desiree Young against Kyron's stepmother in June 2012. The boy has been missing since June 4, 2010.

The protective order filed in Multnomah County Circuit Court said any medical records, including but not limited to mental health records, can be used by the prosecution or the defense.

The protective order mandates any such records be sealed in an envelope at the conclusion of the litigation if they are retained in either attorney's files.

They then cannot be reopened except in connection with a subsequent legal malpractice action or other legal proceeding directly related to the current case.

PORTLAND -- The judge in the civil lawsuit involving the disappearance of Kyron Horman was expected to delay those proceedings against Terri Horman as the criminal investigation moves forward, a source told KGW Tuesday.

The source said that the civil case will be delayed for nine months after affidavits were filed by the Multnomah County Sheriff's Office and the District Attorney.

Maybe statements made by someone early on didn't check out when they did a further investigation, or a new witness that contradicts some prior statements?

So they're saying that future potential deposition witnesses to the civil suit "may" jeopardize the ongoing investigation. Who could those "potential people" be? The Multnomah County Sheriff's Office confirmed to Fox 12 they have new leads in the disappearance of Kyron Horman.

The revelation comes at the same time it was ruled a lawsuit filed by Kyron Horman's mother against Terri Horman will not move forward until at least November 2014.

Desiree Young's attorney filed a motion to abate the civil proceedings Monday. Judge Henry Kantor signed to abate the case until Nov. 26, 2014, according to Multnomah County records.
 
That means the case is under a holding pattern for the next two years.

A judge provided a brief, one-paragraph explanation Wednesday for his decision to delay Desiree Young’s civil suit against Terri Horman.

In an order signed Wednesday, Multnomah County Circuit Court Judge Henry Kantor stated that he granted a motion filed by the Multnomah County District Attorney’s Office requesting to delay the suit, “on the ground that allowing the case to proceed could impact an ongoing criminal investigation.”

Kantor wrote that he came to the decision after conferring with attorneys for both sides, an unnamed witness and prosecutors. 

The order halts the lawsuit until Aug. 1, 2013.

On Nov. 21, Kantor granted a request to seal the memorandum and affidavits that were submitted as part of the motion to delay the lawsuit, but did amend it to state that the motion could be subject to an additional request to have it unsealed.

The district attorney's office has declined to comment on the developments of the case. However, officials familiar with it, speaking on background, said there have been new leads that the Multnomah County Sheriff's Office would like to look at without the civil lawsuit getting in the way of any possible criminal case.

Yes, I have wondered about that...after all...her 2 year abatement with the divorce judge is now over.

Confusing to me is that it appears that information is opening in the "future"...like MCSO has a timeline of when that information might open....huh?...what kinds of reasons would be that the information can't open now but can...say...6 months down the road?

I think that just means a prima facie  was satisfied to allow the judge to abate it for the length of time that mirrors the filing deadline of the original tort from the date of the occurrance.

I have heard this being referred to as new information,  but while it may be new to the plaintiff ( I dont know), it is not new to LE or the DA whose original opinion in the matter was that he did not have a position.

His honor essentially reversed himself after hearing argument for abatement, which had already been the subject of an order.

That is pretty rare when we already knew their was a parallel criminal investigation.

So in your opinion you feel Desiree never thought that the defense would get access to her medical records?

 I would personally find that shocking if true, and poor prep by counsel, while I admit that burden is a big one, I just can’t see Rosenthal not availing the possibility of a woman who relinquished custody for years due to her stated “medically necessary treatment” outside the US. That is a matter of public record in 2 dockets. When filing a tort action seeking a reward of $10 million dollars, as I wrote in part I, you bet your azz the plaintiff is going to undergo nearly as much scrutiny as the defendant.

UNLESS- they orchestrated a calculated attempt to seek a default judgement- but again, that is not good faith when imo, the allegation never showed a prima facie to begin with. It worked for the TRO and continued to until now by TH not defending it, or not being able to defend it.

Abso-frickin-lutely. Guys, we predicted this, I am not at all surprised. I recently commented blatantly again that the suit would interfere with the prosecution of this case ( who else said that- Peter Bunch)

This info must prejudice the civil action in some way or Kantor reversed his earlier ruling in which HE HIMSELF contacted the DA and was told they had “no position.”

He also wrote in, subject to appropriate motion to unseal- his honor is a smartie, he knows how this looks.

Here’s thing, if it IS a witness to SZ, they KNEW this all along, and so did Desiree, ergo so did Rosenthal. Did defendant counsel argue against an abatement? That would be key.

I have always felt Desiree was ill-advised as to the possibilities of outcome for this suit, but I also understand she has had great faith in LE, as Kaine appears to as well, yet these two are clearly divided now as to their opinions on Kyron's status.

I don't understand that personally, but since neither of them are stationed outside the DA office as I would be, asking my attorney to file FOIA after FOIA if only to learn exactly what they consider the scope of investigation and require them to produce their basic "card catalog" of documents,  this case will sit right where it is, imo.

If their is no alternative evidence to the assertions by both Kaine and Desiree that Kyron is being held or secreted- I am beyond disbelief that as it is now evident and on record that this is an ongoing criminal investigation that  GAL has not been appointed by the court to protect Kyron's interests. 

Does anyone even know if a CPS investigation has been launched in this case?  Isn't that protocol?

I hope you had a horrible day.  I hope you kept hearing the voices of Kyron and your daughter while you sat around bored watching the neighborhood kids playing with their new toys.  I hope the day comes that the truth eats at you in such a way you can't find peace until you tell everything you know.  I really hope that day comes soon.

    I just saw that ICE made a child pornography bust.  There was mention of one guy in Portland arrested....Every time, since he disappeared I think of him when this happens.

I was just reading article  and immediately thought of Kyron also, AKmom.  Nothing mentioned re:  missing children  but from what was found they have retrieved videos and pics so perhaps some of the missing might be identified.

PACIFIC, Wash. (AP) — It's been nearly three years since Kyron Horman disappeared from a Portland school where his stepmother says she dropped him off.

An age-progression photo to show what he would look like now has been released in a poster from the National Center for Missing and Exploited Children.

The poster will get added publicity by being displayed on the Gordon Trucking fleet of trucks in Washington and Oregon.

Kyron's father, Kaine Horman, was at an event Monday at the trucking company yard in Pacific where the Washington State Patrol highlighted the latest addition to the Homeward Bound Program.
 
For Kaine, the photo is hard to process. Not having had the chance to watch his son grow, it's painful for him to imagine the boy nearly three years older.

"I have lots of friends who have kids about his age, and (I've been) watching them grow through the years and just trying to imagine what he's (Kyron is) like now," he said.

No arrests have been made in Kyron's disappearance.

His mother, Desiree Young, is suing the stepmother, Terri Horman, seeking a court order to force her to say what happened to him.

Among the supporters of the missing boy's parents is Melissa Baum, whose own daughter, Lindsey Baum, has been missing since June 2009. Lindsey's image is also featured on trucks traveling the country.

Kyron Horman, missing since age 7, has been in the Homeward Bound program since 2011. This age enhanced photograph will now be displayed. Kyron was last seen June 4, 2010 in the Portland area.

I’ve been sitting here thinking about the letter Desiree read to Kyron this morning on the news, and my emotions have been all over the place. On one hand I ache for Desiree, for Kyron and that void in my heart that only he can fill. That desperate longing and grief that makes you feel as though you can’t even breathe, the why that can never be answered.

But I’ll admit it has slowly turned to anger and I don’t want to be the bigger person today. I don’t want to bite my tongue. I hate the silence on this page and in the news like Kyron is being forgotten. I hate that I had to stop the memories, but mostly I hate the reason I had to do it. Only truly disgusting and cold hearted people could take something so pure and innocent and make it ugly, and I won’t let you do that to Kyron. I won’t let you taint his beautiful memories with your evil and vicious thoughts, he deserves better than that.

I wish things were different, that the world was different. Kyron has some amazing followers. There are a few of his pages that I follow and it’s wonderful to see the posts faithfully everyday. Thank you for not forgetting him and moving on to the next story. Thank you for fighting for him and keeping his face out there. It is people like you that prove there is still good in this world, and that is what will bring Kyron home.

The father of Kyron Horman filed a motion to delay his divorce case with Terri Horman.

Kaine Horman's attorneys filed a motion to stay the dissolution proceedings on Friday. A hearing is now set for Feb. 4.

More than two and a half years after Kyron Horman's disappearance, his father wants to delay his divorce hearings while his estranged wife wants to proceed.
 
On Monday morning, Kaine Horman's attorneys Brett Engel and Laura Rackner asked a Multnomah County judge to delay his petition to divorce his estranged wife, Terri Moulton Horman, for another six months.

Terri Horman's divorce attorney Peter Bunch argued against any postponement, and also objected to any interference by the district attorney's office.

"Two years, seven months – that's how long it's been," Bunch told the court. "That's a long time."

Bunch suggested the divorce proceedings go forward, with limitations placed on what questions can be asked of Terri Horman and on the state's ongoing criminal inquiry into Kyron's disappearance.

But Engel questioned how the court could decide whether or not it's in the best interest of the couple's daughter Kiara, now 4, to have contact with her mother, without knowing whether or not Terri Horman was responsible for Kyron's disappearance.

"If (Kaine) believes this woman is responsible for Kyron's disappearance, do you think he'll feel good about providing spousal support?" Engel asked in court.

Kaine Horman was present in court Monday; Terri Horman was not.

Jude Henry Kantor said he would rule in about two weeks, after seeking some detailed information about what subjects Bunch would allow Terri Horman to be deposed on, if the divorce proceeding was allowed to continue.

When Desiree brought her civil suit to court I felt that she had every right to do so.  It seemed that two years was long enough for her to wait out the investigation.

I also feel that Terri has the right to proceed with her divorce.  She should also not have to wait into the unforseeable future with no end in sight for this investigation. 

In the same breath, she cannot choose what questions she will and won't answer if they pertain to the divorce and the safety of Kiara.  So, yes IMO, she does have the right to proceed however not if she's not able to speak on her own behalf.  That could potentially put Kiara's safety at risk.

Amys Sister, I agree with you.  She should be able to proceed, but she can't pick and chose the the questions.
Kiara's safety is paramount.

when Kaine used the criminal investigation as reason to stall divorce, it seems
that the TMH team are trying to say put up or shut up and on with the divorce

A Multnomah County judge has delayed the pending divorce case between Kaine Horman and estranged wife Terri Moulton Horman until Aug. 1, court records show.
Kaine Horman's attorneys in February had asked for the delay, while Terri Horman's lawyer argued against any postponement.

The Multnomah County District Attorney's office also supported the delay to preserve the integrity of the ongoing criminal investigation.

Judge Henry Kantor issued his ruling this week, more than two months after hearing oral arguments on Feb. 4.

Kaine Horman had petitioned for a divorce from his wife, shortly after his son, Kyron Horman, disappeared on June 4, 2010, from Skyline School.

The second-grader was last seen at Skyline School after his stepmom, Terri Moulton Horman, drove him to school for a science fair. While no arrests have been made, investigators have focused intently on Terri Horman.

 Kaine Horman had filed for divorce June 28, 2010, two days after investigators informed him that his wife had discussed with a landscaper an alleged murder-for-hire plot to kill him about six months before Kyron's disappearance.

Ohio women being found gives hope to Kyron's mother

MEDFORD, Ore. -- When Desiree Young heard the news about the missing Cleveland women found after ten years, it gave her more of something she's never let go of -- hope.

"Some people have answers and some people don't," Young said. "Even when you do have answers, to know that the possibility is out there that they can be found after that many years is phenominal."

Young's son Kyron Horman has been missing for almost three years. Kyron was last seen in Portland in June of 2010.

Since then Young hasn't given up the search, and is now working with investigators to form a special team in the Rogue Valley to find missing children.

She says officers here need that special training.

"If we ever had a missing child -- big cases like Kyron's here in southern Oregon we wouldn't be prepared," Young said. "And I think it's important for us to learn from our mistakes.

It's disappointing that there was no C.A.R.T. in place when Kyron went missing.  The first few hours are so important in a missing person investigation--and, of course, the proper training of le and detectives in the area--in my opinion.

It was three years ago today seven year old Kyron Horman vanished. The last person to see him alive was his step mom, Terri Horman. She and Kaine Horman are in the process of getting divorced and Kyron's biological mother, Desiree Young has filed a 10 million dollar civil suti to get Terri to speak up about Kryon's disappearance.  The civil suit is headed to court in August with any proceeds going to help other families who have lost children. Terri Horman, who is considered a person of interest in the case,  moved back to her childhood home in Roseburg more than a year ago. At first she was spotted around town and in the neighborhood. PORTLAND – Tuesday marks three years since Kyron Horman, who was seven years old at the time, vanished from Skyline Elementary school.

In an interview with KGW, Kyron's father Kaine said it was hard to believe three years had passed, but that he was still hopeful he’ll see Kyron again.

“There’s so many things I’d want to say. The last thing that I told him is that I loved him and I’d tell him the same thing,” Kaine said Monday. “I love you, man. Life’s not the same. And we miss you. And we’ve got so much to do together still.”

Kyron disappeared from Skyline school on June 4, 2010. His stepmother, Terri Horman, drove him to school that day. She later told investigators she last saw him walking down the hallway toward his classroom.

She was never arrested or charged, but Kaine Horman and Kyron’s mother have long said they believe Terri had something to do with the disappearance.

A Multnomah County judge has set a hearing for July 30 to allow Terri Moulton Horman's lawyers the opportunity to argue against the one-year renewal of a restraining order that her estranged husband obtained against her last month.
 

On July 30, Judge Henry Kantor will also request an update on the status of the delayed divorce proceedings between Kaine Horman and Terri Horman, and of the civil lawsuit that is pending against Terri Horman by the mother of missing Kyron Horman, Desiree Young.

Last month, Terri Horman's lawyer, Peter Bunch, said in court that his client intends for the first time in three years to contest the restraining order. Bunch argued that the allegations in Kaine Horman's petition for a new restraining order were based solely on "hearsay.''

Yet whether the judge will allow depositions to proceed remains unclear, considering that the couple's pending divorce proceedings were placed on hold until Aug. 1.

According to court records, Judge Kantor has set morning hearings, starting at 9 a.m. July 30 on the pending Horman divorce and Desiree Young's civil suit.

That would be followed by a hearing on Terri Horman's motion to contest the restraining order, with time set aside in the afternoon, starting at 2 p.m., for additional court proceedings in the case.

Desiree Young, the mother of missing boy Kyron Horman, plans to deliver a statement Tuesday on her civil case against the boy's stepmother.

Her statement will be read in downtown Portland at 11:30 a.m.

Young filed a $10 million lawsuit against Terri Horman in June of last year. She said she wants Terri Horman to face justice in the 2010 disappearance of Kyron Horman.

Desiree Young, the mother of missing Portland boy Kyron Horman, is dismissing her civil suit against Terri Horman because she said her case can't move forward without compromising the criminal investigation.

Young filed a $10 million lawsuit against Terri Horman in June of last year. She said she wanted Terri Horman to face justice in the 2010 disappearance of Kyron Horman.

But in a statement at the Justice Center in downtown Portland, Young announced Tuesday she is dismissing the case.

"Because my civil case cannot move forward without the police files, it is with great disappointment that I make this difficult decision," Young said.

She said the district attorney's office and police investigators have the same goals in bringing Kyron Horman home, and she fears her civil case could "get in the way of these goals."

Houze/Bunch will now file motions for visitation.

So, DeDe testified before the Grand Jury within the past couple of weeks.

It's being made to sound like DeDe "finally agreed to testify before the GJ".

I'm rusty on this case, so correct me if I'm wrong, but I seem to remember that when DeDe appeared before the GJ the first time, that DeDe was not asked any questions or very few questions at that time, and it was intimated that she would be called in the future.

So, IIRC, then this was the first time that DeDe really was questioned by the GJ.

PORTLAND -- Kyron Horman’s mother, Desiree Young, told Newschannel 8 that a team of volunteers will search for the boy at an undisclosed location on Saturday.

While she didn’t say where they would be looking, she did say that the effort will include a team of K-9 units. Young also told KGW that she will speak to the media once the search has ended.

Horman has been missing since June 4, 2010. He was last seen at his school, Skyline Elementary, and was taken to class that day by his stepmother, Terri Horman. Kyron was seven years old at the time of his disappearance.

State and local police, along with the FBI, have searched repeatedly for him without success, and to date, no one has been charged in his disappearance.

The Multnomah County Sheriff’s Office told Newschannel 8 that it was aware of the search, and that they hope the volunteers find something that helps to bring Kyron home. They also said that their investigation is ongoing.

(CNN) -- Kyron Horman has been missing since June 4, 2010, but his mother is not giving up.

Desiree Young and volunteers spent "two solid days of searching" for her son this weekend, she said in a news conference Sunday in Portland, Oregon, calling the search "successful."

More than 100 volunteers, along with 10 search dog teams from around the country, joined the search effort in the Portland area, looking for evidence that might help solve Kyron's disappearance.

Kyron was 7 years old when he went missing. He was last seen by his stepmother, Terri Horman, who told police she had dropped him off at his school, Skyline Elementary.

Young was optimistic about the latest search, telling reporters, "we found a lot of things, and possibly evidence," but declined to give details, citing the ongoing criminal investigation.

Everything searchers found will go to law enforcement for further examination, she said.

Though Portland law enforcement was not part of this search, Young said she has been working closely with police and has been keeping them informed.

Terri Horman's friend DeDe Spicher declines to answer any questions about Terri Horman in deposition

Desiree Young's lawyer has filed a motion asking a judge to compel DeDe Spicher, a friend of Terri Moulton Horman's, to answer his questions after she declined to answer 142 questions during a deposition he took earlier this month stemming from Young's civil lawsuit against Horman.

Multnomah County sheriff's investigators looking into the disappearance of Kyron Horman, a second-grader who went missing from Skyline School on June 4, 2010, were interested in the whereabouts of Spicher on that day.

Spicher declined to answer any questions posed by Young's lawyers on Oct. 5 that involved Terri Horman, Kyron's stepmom, or Kyron -- each time asserting her Fifth Amendment constitutional right not to incriminate herself.

Spicher also declined to answer questions about where she was on June 4, 2010.

"Are you aware that Kyron Horman has disappeared?" asked Young's lawyer, Elden Rosenthal.

"I'm asserting my Fifth Amendment right," Spicher replied, according to a transcript filed in Multnomah County Circuit Court.

To Janet- not sure if you have had time to read my new piece,   I apologize for the length but there was no way I could shorten the content, and I still have a continuation, however-

It is an untrue statement to say that DeDe did not cooperate and answer questions.  She did so several times, and told everything she knew.  I do not think a US citizen should be bullied into taking a polly and make no mistake, they bullied her until she gave in,  but she has told them the same exact thing since day one.

At the Grand Jury hearings in June, 2010 ... it does appears that DeDe Spicher did open up and testify to some incriminating evidence regarding the morning Kyron Horman disappeared.  Her attorney stated at that time he would not be surprised if Terry Horman was arrested.

Could it be that DeDe may be the smoking gun that will bring this case to a close?  Could there be a plea deal that compelled DeDe to reveal more?

PORTLAND, Ore. -- DeDe Spicher, identified as a close friend of Terri Moulton-Horman, was called before a grand jury Monday in Multnomah County as part of the ongoing investigation into the disappearance of her step-son Kyron Horman.

Spicher's attorney told NBC Dateline that he would be "surprised" if Terri was not arrested in the case.

Grand jury proceedings are not open to the public or the media. However, Spicer's attorney did confirm that his client was subpoenaed to testify but did not give any testimony under oath Monday. He said she could be called back to testify in the future.

PORTLAND, Ore. -- DeDe Spicher and Terri Moulton-Horman were both unaccounted for during the same period of time the day Kyron Horman disappeared, based on information revealed by investigators and on information from KGW sources.

Sources tell KGW that DeDe Spicher, a close friend of Terri's, was doing gardening work not far from the Horman family home on the day Kyron disappeared, but was unaccounted for during a three-hour period from 10 a.m. to 1 p.m. She could not be reached by cell phone during this time either, according to sources.
 
Sources also tell KGW that, during the period of time DeDe was unaccounted for, her car remained at the property where she had been gardening. According to sources, that detail is significant because, if DeDe left the property as investigators believe, she would have had to leave in another vehicle.

The person who owns the house where Spicher gardened, who is cooperating with investigators, told investigators she called Spicher on her cell phone but she didn't answer, the source told KGW. A person who was working with Spicher, who is also cooperating with investigators, told them of trying to unsuccessfully find Spicher. Both people have told investigators they have no idea where Spicher was during that period of time.

Now, after emerging Tuesday morning from a closed-door status hearing before Judge Henry Kantor, Young and her attorney Elden Rosenthal confirmed that they've dropped the civil suit.

"It is with great disappointment that I make this difficult decision'" Young said.

Young spoke out on the steps of the Justice Center, the same site where she announced the filing of the civil suit a year earlier.

When announcing the civil suit a year ago, Rosenthal pledged to use all the tools that are afforded to him in a civil case "to peel away the layers of mystery surrounding Kyron's disappearance.''

For the civil case to proceed, Rosenthal said both parties to it would need to review the criminal investigative file and documents.

"We don't want to do anything to impede the case," Rosenthal said.

Asked if he could have foreseen this a year ago when he filed the civil suit amid the ongoing criminal inquiry, Rosenthal declined comment.

“In order for my lawyers to move forward with the case at this point, it would be necessary for them to seek access to the police criminal investigation files,” Young said. “My lawyers have advised me that the Oregon Public Records Disclosure Law does not provide the release of ongoing police investigation files.”

“I don’t want anything to compromise the ongoing investigation for Kyron,” Young said. “For these reasons, I have instructed my attorneys to dismiss the civil case.”

Interesting info, in light of ... the truth. 

Sad how many good readers/posters were bullied and run off, from here and elsewhere, who simply kept suggesting that folks look outside the box, to something other than what the public was being led to believe.  Especially those of us who know for fact all about that particular LE, and the way they have conducted business in the past. 

Sadder yet is that even if an independent team is assigned at this point, it's probably too late to find out what happened with Kyron.  The investigators, from the first moment on.. ie: the supposed crime scene -- the school.. allowed/demanded folks to tromp all over, thus destroying any and all possible evidence in those critical first hours of searching. Remember how, in the first few hours they were telling parents/visitors to meet back at the school to report in, sign in, be questioned?  Remember how, many of us were wondering why are they having them meet back at the school?  And why no statement from the school themselves, early on?  (ever?)  Seems to many that it went from that into coverup mode very quickly, which seemingly was allowed or encouraged (?) by LE themselves.

Shaking head sadly... Tears for Kyron, and those who love him. 

 

I can't help but believe that Kyron Horman's parents had valid information regarding DeDe Spicher ... valid information that formed the foundation of their joint statement.

Kyron Horman case: DeDe Spicher says she's 'unofficially' cleared in boy's disappearance

A friend of Kyron Horman's stepmother, DeDe Spicher, claims she has been unofficially cleared of suspicion in connection with the boy's disappearance, according to a crime blog.

Spicher told blinkoncrime.com that she testified before a Multnomah County grand jury in July, passed a polygraph test and agreed to an immunity deal with prosecutors.

She said she doesn't know anything about the 7-year-old's disappearance in June 2010 and hasn't spoken to Kyron's stepmother, Terri Moulton Horman, since March 2010. Spicher said she doesn't believe the stepmother is involved.

Spicher also proclaimed her innocence in a 2010 interview with People magazine.  

Spicher declined comment when contacted by The Oregonian Wednesday. She referred all questions to her attorney, Chad Stavley, who also declined comment.

In an online article, Dede Spicher claims she has passed a polygraph, signed an immunity deal with prosecutors, and agreed to "tell all" before the grand jury investigating the case.

Those new details were first reported in theonline blog blinkoncrime.com.

Spicher spoke exclusively to the website’s editor-in-chief but KGW independently confirmed the interview took place.

In the article, Spicher says she's been unfairly portrayed and that she has been cooperative with investigators. She says her only request was that her attorney be present during police interviews, and that her account has never wavered.

Spicher claims she had nothing to do with Kyron's disappearance and she was at work the day he disappeared from Skyline School on June 4, 2010. Spicher told People Magazine in 2010 she and Terri had "nothing to hide."

Spicher says she was first called before a Multnomah County grand jury in July of 2010, but prosecutors never asked her any questions.

Two months ago, she appeared again, this time testifying for five and a half hours. Afterward, she agreed to take a lie detector test.

"She passed a polygraph, you know, confirming everything that she has been saying which frankly everything she has been saying for the past three and a half years was true," said S. Christina Stoy, Editor in Chief of blinkoncrime.com in an interview with KGW.

The online article says that, as recently as last week, investigators talked to Dede Spicher about conducting a sting on Terri Horman. Spicher declined.

Spicher says she hasn't spoke with Kyron's stepmother in three years, and she doesn't believe Terri is responsible.

In an October 2012 deposition, Spicher pleaded the 5th to a number questions about the Kyron case. The questions ranged from Kyron's disappearance to whether she was a friend of Terri Horman

Judge renews restraining order against Terri Horman

PORTLAND, Ore. - The father of Kyron Horman, a young boy who disappeared three years ago at the age of 7, was granted a renewed restraining order against his estranged wife.

Kaine Horman filed for divorce from Terri Horman shortly after the disappearance of his son, Kyron Horman, but those proceedings were delayed and the two are still married. Terri was the boy's stepmother.

Terri Horman's lawyers argued against renewing the restraining order, saying Kaine Horman's petition was based on hearsay. But the judge signed it anyway, based in part, he said, on the notion that it had already been granted three years in a row and circumstances between Kaine and Terri have not changed much.

Terri Horman's lawyers said she plans to contest the restraining order renewal, which is a first. She has not contested it previously.

In November, prosecutors convinced a judge to put a halt to a civil suit brought by Kyron's biological mother, Desiree Young. Prosecutors claimed the suit could hurt their investigation.

Last June, Young filed a $10 million civil suit against Terri Horman, hoping to force Horman and her friend, Dede Spicher, to testify under oath about what happened to Kyron.

But Spicher invoked her Fifth Amendment right against self-incrimination more than 140 times during a deposition.  A judge was getting close to ruling whether Spicher can remain silent and that's when the Multnomah County district attorney and sheriff's office asked the judge to halt the civil case before she could be forced to take the stand, triggering immunity in a criminal case.

She has never said she is certain that Th is not hiding something.   What she has said is that she had no information about whether she is or not, and she herself was not involved with anything surrounding Kyron's disappearance nor did she have any info about anyone else who might.  If Terri knew something, or was involved, she never shared it with DeDe nor did she involve her.  This was concluded to be truthful via her polygraph exam.  It was no different than what she told investigators from her first interview.


This is my opinion as to why I believe DDS did not participate in a sting.  For starters, they asked her to do so outside the presence of her counsel when she had just fulfilled her last obligation under her agreement, which was for transactional immunity.   LE spent 3 years hounding this woman, the prosecutor threatened to charge her on more than one occasion and to be perfectly clear-  she had not spoken or been in touch with TH since July 2010.  Three years later these investigators were of the opinion that TH, who is represented as well, was going to take her call and spill her guts after the world already knew she had testified before the grand jury?  

I do not believe that for a minute.  

I believe that LE had so alienated her with their tactics and disbelief of her that when she passed the polygraph they were stunned.   She had a very reasonable concern that said "sting" was a way to entrap her into a fresh new hell with them.   I completely and totally agree with her in that regard and that is partially why she has spoken out finally.  She has a genuine fear that truly NOT having the answers LE was so sure she did, and allowed them to keep TH as their suspect three years later, that someone was going to have to tell the bus it was bust.  She wants her story to forward the investigation appropriately.

I know I hear people say, well she should have just done it you never know.  Respecfully, I am here to tell you I would absolutely never have put my civil liberties in the hands of these men for anything.

Can anyone imagine how desperate a situation this investigation must be in at this point?  It needs oversight immediately.  I would not at all be surprised if the Dept of Justice  alerts MCSO that they are investigating the investigation.  They should.  

Otherwise, someone has to step in and say we may be looking in the wrong place, and have been all along and start over.

In terms of immunity,  I believe they all agreed to immunity because they believed she had answers she was not giving them to protect her 5th ammendment right against self-incrimination.  They were wrong because she never knew anything and they did not believe her.  She could have chosen to sit in the chair and plead the 5th for every question, so in that sense, I do think they at least intended for her testimony to help a true bill against TH.     Again, I would have done the same in her position.  If you know upfront that the intention of LE is to charge you with something instead of excluding you as a POI, what choice would anyone have?

They [LE] shoulder this blame, imo.

Thanks Blink.  I may be a sceptic regarding DeDe but I do appreciate all your efforts encompassing the Kyron Horman case.

I could have it all wrong but ... when I read the archives I am still a believer on so many levels that DeDe played a part in the disappearance of Kyron Horman.  I am one with Kyron's parents.  Could it be that when all is said a done ... a plea deal will be negotiated with with LE and DeDe's testimony will blow this case wide open?

Coincidence?  Both Terri and DeDe are off the grid between 11:15 AM and 1:00 PM on the morning Kyron went missing.  Terri claims she was driving rural roads with Kiara who had an ear-ache.  DeDe claims she was hidden amongst tall grass; preoccupied with her gardening task beside the road when a co-worker called out in an attempted to locate her.  Then there were the words of your very own sources:

Spicher is a long time friend and workout companion of Horman’s.

Then on Thursday night, Kyron’s biological parents released a statement that said law enforcement told them that Spicher is not cooperating with them.

Desiree Young's lawyer has filed a motion asking a judge to compel DeDe Spicher, a friend of Terri Moulton Horman's, to answer his questions after she declined to answer 142 questions during a deposition he took earlier this month stemming from Young's civil lawsuit against Horman.

I hope all is well with you. I've been so busy this past year, but I'm finally catching up with everything Kyron.

Yes I do have opinions and input with the latest info; from the recent civil suit being dismissed, to the recent Dede and the prior blog release. For now, I will refrain from commenting. It will come though.

I commend Desiree for taking things into her own hands and focusing on searches for Kyron. These K-9 teams, along with the Klaas Foundation are fabulous for volunteering their time to help bring Kyron home and I'm so thankful for their efforts.

I also thought it was great to hear that the gofundme site that is raising money for the searches, will be posting an accounting of their dollars spent so far. Something Kaine has not done.

That would be a true statement if you think about it. Having concurred with you on that, I don't post on blogs or websites. Don't have a twitter account. Yes I do have FB with a VERY small group of people on my friends list (40), and the majority of them are friends from back east. I don't know the last time I commented about Kyrons case on there, but it has been a long time. I had been out of the loop for quite a  while because I've been so busy. I doubt very seriously if Blink is in that circle of friends, so that is why I said something. Didn't want to ignore her post.  ::MonkeyWink::

11 years ago you came into my life, you saved me that day. You taught me to cherish all of the moments in life even if they are, at times, difficult to get through. You taught me that, "this too shall pass." You also taught Quinn and I how to hug more and to cherish those little moments.

I remember our jokes about our "little" family, but we can always smile and laugh at our small tight knit little family. No matter how small or big, family is the most important thing. They get you through the hard times.

I was talking about your laugh the other day and I could almost hear you as I remembered how you and Quinn just look at each other and make one another laugh. I'm a lot like you Sassi.  No Twitter, lots of FB friends but we don't discuss Kyron.  SM and BOC are the only places I've gone the last three years for my information about this lost sweet baby.  I went to the anti Terri page once but it was so vicious I did not go back... just didn't seem like a good place to get facts.

Until today.  I just went to Tom's FB page and read his posts about Dede's interview.  I went to the anti Dede page and read the posts there.  Dare I say it... Tom's posts actually make sense.

What bothers me is that no one but Blink is willing to talk about this man who removed Kyron from the school!  Until Desiree, Kaine, Tom, the anti's, the media, LE are willing to admit that a stranger actually took Kyron then they become less credible.

Sassi, you had received some information about the person who walked out of Skyline with Kyron.  You got some heat for doing so and I'm wondering if in spite of that you would be willing to talk about that again?

I have not seen TJ FB page. Do you have a link to it? There are so many Tom Jones' in Oregon. I saw one that is in Klamath but he looks too old and I didn't see anything about Dede on his page. I won't comment on that until I read it. You can surely understand that.

As far as your comment about "a stranger" taking Kyron from the school, factually, we don't know that. Kyron could have met this person at some point. He spoke his name and Kyron responded.

Regarding the "heat" and it's influence on me making comments or thoughts about that day, I'm not sure how to answer that. From the very beginning, this case was about finding Kyron. That was my focus. Yes I released information that was not public, but I did it for the main purpose of bringing Kyron home. It does not help Kyrons case if this response is revisited.

You had what you thought was a valid description of the suspect.  I am at a loss as to why this description and the fact that Kyron left with a male is being withheld, which is why I asked.  How can revisiting this information not help Kyron?

Perhaps Kyron knew the man who took him, that is a good question and one many of us have wondered.

You have to realize that I was blatantly tore to shreds by posting that info prior. Soon after, I left the Kyron thread and started working on other cases, of which I have made tremendous strides. I have not forgotten about Kyron. Not for one day. Not for one minute. My hands are tied and I hope that you can put yourself in my place and understand my hesitation.

Kyron deserves to be brought home. You, along with many others, have continued this fight. I admire you for that. With that said, I haven't given up on him or his case. I just want harmony withing the discussion.

I may be wrong, and please correct me if I am, but it seems like you are feeling angry because I'm not coming out and giving exact details of what I was told. I have over 1,000 emails on this case from various people. Some are theories, and some are source related. Do you want opinions or do you want facts as I know them? I'm certainly confused. YOU asked me and I responded.

I quickly scanned that FB link of TJ and I can tell you, without a doubt, that is NOT TJ. I followed him from the very beginning and his verbiage and use of words were, well let's just say, of a lower education. He used a lot of curse words and many, many misspellings. Everyone has a pattern to the way they write/post. This is NOT TJ.

It's some idiot that wants to try and light a fire under Blink and she's smart enough to ignore it. Just giving you my opinion.
