ORLANDO, Fla. -- Judge Belvin Perry has called a recess until Tuesday in the Casey Anthony trial.
The order came after the two witnesses who planned to testify for the defense Monday were blocked by the prosecution because of discovery issues.

Perry said earlier that he was tired of the games being played by the attorneys. Before unleashing a sharp rebuke, he asked both prosecutor Jeff Ashton and attorney Jose Baez to look at the courtroom clock and read the time. Ashton said it was 9:25 a.m., and Baez said it was 9:26 a.m.

"That shows that the two of you will never agree on anything and never see anything the same way," Perry said. ::snipping2::

Vasco Thompson is a 'non-party' in Casey case
Filed today was a motion to quash the subpoena for Vasco Thompson, the man the defense listed as a late witness last week.

The motion, filed by attorney Matt T. Morgan, says Thompson is set to appear before Perry at 8:30 a.m. Tuesday.
It goes on to say Thompson "has no personal knowledge of facts relating to the alleged killing of Caylee Marie Anthony."
The motion calls Thompson's subpoena for trial "a misguided attempt to draw attention and publicity to an already highly publicized matter."
Thompson "believes that the defendant's subpoena for trial is only a delay, to create confusion in the evidence and a ploy to create an illusion of reasonable doubt," Morgan's motion says.
It adds that the subpoena "was filed in bad faith against the non-party Vasco Thompson" and creates an undue burden on him.
The motion asks Perry to quash the subpoena and enter "a protective order prohibiting the defendant, Casey Anthony, from further contact with" Thompson.  ::snipping2::

The drama of the summer continues in Courtroom 23 in Orlando as court watchers wonder if Casey Anthony, the Florida mom accused of killing her toddler, will take the stand in her own defense.
Legal analysts say she has little choice but to testify after her defense lawyer said in his opening statement that Anthony's daughter, Caylee, drowned in the family pool and her father helped cover it up. The lawyer, Jose Baez, told the jury that Anthony had been molested by her father as a child and that conditioned her to keep quiet about what happened to her daughter.

"She has to take the stand now," says George Parnham, a lawyer who defended Andrea Yates, the Houston mother who drowned her five children during a psychotic breakdown. "She has to explain this to the jury. They need to hear from her. You need to humanize your client."

Holloway said George Anthony told her Caylee’s death was an accident that snowballed out of control.

Typically, testifying about what someone told you is hearsay and not admissible, but Local 6 legal analyst Mark O’Mara said Holloway’s testimony would be allowed.

O’Mara said Holloway’s testimony could be used to impeach previous testimony by George Anthony that he knew nothing about Caylee drowning.

Holloway said she also does not believe the defense’s claim that George Anthony sexually abused his daughter, Casey Anthony, for years when she was a child.

Holloway said she knows it was wrong to grow so close to a married man, but she is strong enough to own up to it under oath.

Casey Anthony, 25, is on trial, charged with first-degree murder in Caylee's death. If convicted, she could face the death penalty.

Casey Anthony's defense team should resume calling witnesses this morning — one day after Judge Belvin Perry gave stern warnings to the attorneys in the first-degree murder case and abruptly adjourned court before lunchtime.

No witnesses testified Monday.

The proceedings, which unfolded without the jury's presence, centered on allegations that defense attorney Jose Baez violated court procedure by failing to fully disclose the opinions that his experts would testify about to the state.
Prosecutor Jeff Ashton said he was late in getting a report, opinions and other materials from Richard Eikelenboom, a Dutch forensic expert who specializes in "Touch DNA" involving small amounts of the genetic material.

Ashton said he intended to call for new sanctions against Baez for failing to disclose the information. ::snipping2::

Attorney Richard Hornsby told WESH’s Bob Kealing that  Judge Perry is partly responsible, because Cheney Mason should be acting as lead attorney for the defense.

“Judge Perry should be asking Cheney Mason: Why aren’t you handling more important aspects of this case?” Hornsby said. ”He [Perry] has Jose Baez, the inexperienced attorney, who’s commanding the trial and setting the schedule. Clearly, Jose isn’t ready for prime time.”

Attorney Jeff Deen, also on WESH, expanded on that idea: “Jose Baez stepped into the big leagues. He can’t step into the batter’s box and ask people to throw it underhanded.”

Hornsby added that Perry “should not be yelling at Jose Baez but be yelling at Cheney Mason. At the end of the day, Cheney Mason is the one who will be looked at as the lead attorney on appeal.”

Baez always comes up with excuses, and that’s the wrong way to respond to a judge, Hornsby said.

WKMG-Channel 6 legal analyst Mark NeJame compared Baez’s complaints to being caught speeding and saying that everyone is doing it. “Too bad, you got caught,” NeJame said.

NeJame added that Jeff Ashton is “a smart, able prosecutor who you don’t mess with. He does it by the rules.” 

And NeJame said that Perry was guided by one issue above all.  “The biggest thing here is to make sure she receives a fair trial,” NeJame said. ::snipping2::

ORANGE COUNTY, Fla. -- Casey Anthony's murder trial continues on day 35, and both the state and the defense will return to court by 8:30 a.m.

 

Perry is threatening Baez with contempt of court.

“We did not intentionally look at this order and say we're going to disobey it. Just the mere thought of it disturbs me greatly,” said Baez.

“It's evident there is a friction between attorneys. That is something I guess the Florida bar will deal with,” said Perry.

But at this point, any punishment for Baez before the trial ends is also a punishment for Casey.

“The judge is not gonna make any ruling that would cause this case to come back. But, he's going to do whatever is necessary to make Mr. Baez play by the rules,” said WFTV’s legal analyst Bill Sheaffe ::snipping2::

ORLANDO, Fla. -- A woman who said she had an affair with George Anthony after growing close to him during the search for his missing granddaughter has been subpoenaed to testify in his daughter’s murder trial.

Krystal Holloway received a subpoena to testify for the defense at 8:30 a.m. Tuesday. That does not mean she will be called on Tuesday.
In an interview with Local 6 reporter Tony Pipitone, Holloway said she is upset the defense used her as a "scapegoat” in its opening statements  ::snipping2::

ORANGE COUNTY, Fla. -- There were two major developments on Tuesday in Casey Anthony's murder trial. Tuesday marked day 35, including jury selection, in Casey's trial. She's accused of killing her 2-year-old daughter, Caylee Marie Anthony.

 

The state said Casey may have used another family's tragedy to come up with her story about Caylee dying in a swimming pool. Also on Tuesday, another error by the defense was so big, that it could win Casey a new trial if she's convicted.

Casey's lead attorney, Jose Baez, told the jury during his opening statement that Caylee drowned accidentally, and when George found her lifeless body at the bottom of the family's pool, he carried her to Casey and blamed her.

Also, the defense claims George, who Casey alleges sexually abused and bullied her for years, forced her to cover it up.

However, on Tuesday, prosecutor Linda Drane-Burdick told Judge Perry that the state has identified in computer records, searches and instant messages made from the Anthonys' computer.

"The data refutes that timeline," said Drane-Burdick.

However, Baez cried foul, saying it's too late for the state to introduce "new evidence."

"We got the hard drive, but that's everything judge," Baez said.

But prosecutors told the Judge Perry that the defense has had the hard drive for at least two years.

"It's not new evidence. I don't know how something could be new evidence when it was given to you," Judge Perry said.

While the defense called several forensic experts to the stand Tuesday, perhaps the most intriguing revelation of the day came from prosecutor Linda Drane-Burdick, when she informed the court that authorities are looking into whether Casey Anthony had any contact with an Orange County Jail inmate whose child died in a way very similar to the scenario laid out in defense attorney Jose Baez’s opening statement.

April Whalen’s 15-month-old son, Isaiah, drowned in her family’s pool on Christmas Day in 2007, and his body was found by his grandfather. Baez had claimed in his opening statement that 2-year-old Caylee Anthony drowned in the family pool on June 16, 2008 and was found dead by her grandfather George Anthony. ::snipping2::

Court is expected to be held 8:30 a.m. to noon. Perry earlier this week told attorneys to start arriving at 8:30 so they can take up matters before the jury is brought in at 9 a.m.

A forensic chemist testifying in the Casey Anthony trial said today that the car belonging to the Florida mom accused of murdering 2-year-old daughter Caylee did not test positive for human decomposition.


Michael Sigman, a chemist at the National Center for Forensic Science, said that air samples from Casey Anthony's car trunk tested positive mainly for gasoline. Chloroform and two other chemicals were present.

"I could not conclusively determine that the presence of those compounds indicated that there had been human remains in the trunk of that car," Sigman told jurors. ::snipping2::

ORLANDO, Fla. -- The murder trial of Casey Anthony, who is accused of killing her daughter, Caylee, resumed Wednesday, a day after the defense attacked forensics evidence previously offered by the prosecution.
Judge Belvin Perry said day 25 of the trial will only be a half-day because he has to attend a meeting.


The defense's first witness on Wednesday was Maureen Bottrell, a geologist/forensic examiner with the FBI, where she's worked for 16 years. Bottrell said her main duty is analyzing soil, rocks and gemstones.

In her report from March 4, 2009, Bottrell said she received items from Anthony's car and home, including a shovel and 22 pair of shoes. She also examined soil from the area where Caylee's remains were found.

Bottrell said the shoes could not be scientifically connected to the wooded area where the remains were found. She said under cross-examination, however, that doesn't mean the shoes were not ever worn at the scene. ::snipping2::

Casey Anthony Trial: Defense to question convicted kidnapper

Orlando, Florida - Defense attorneys in the Casey Anthony murder trial want to question convicted felon, Vasco Thompson, who served prison time for kidnapping.


They may get that chance today.

Thompson is scheduled to participate in a deposition at defense attorney Cheney Mason's office in Orlando. The meeting is set up for 1:30 p.m ::snipping2::
