Well, 25 years later, I see she is willing to possibly perjure herself for her daughter.”

“She told me that Cindy and George are not being totally honest about that night. Lee was there, Cindy confronted Casey on June 15 and they ended up in an altercation and Cindy choked Casey, Lee pulled them apart, and Cindy called Shirley to tell her that Casey would never steal again and that she had choked her. Then Cindy called her mother Shirley the next morning and told her that Casey had taken Caylee and the car before anyone woke up and was gone. That’s still very horrifying to Shirley. She’s very aged now and the little girl’s death weighs heavily on her mind.”

If this is true, Shirley would've told LE.  I wonder if LE thought they'd have a hard time proving this considering how this family covers for each other?

What happens after Casey Anthony's defense team wraps up?
Closing arguments
After the jury instructions are read to the jury, one attorney for each side will be allowed to stand up and make a closing argument. In the closing argument each side attempts to explain the evidence in the manner most advantageous to their client. The state gets to give its closing argument first, followed by the defense. After the defense gives its closing argument the state gets one more chance to stand up, and rebut the argument the defense just provided. The rebuttal closing is supposed to cover only the argument the defense provided and not rehash the state’s entire argument. Lawyer’s refer to the order of the argument as the state having the “sandwich” because the state gets to wrap its arguments around the defense’s argument.

ORLANDO, Fla. — After more than 33 days of testimony, 400 pieces of evidence and sweeping promises from attorneys to prove how 2-year-old Caylee Anthony died, neither prosecutors nor defense attorneys have provided concrete evidence showing whether the girl was killed by her mother.

And when closing arguments begin Sunday, jurors won't forget what they were promised.


During opening statements in May, prosecutors said Caylee was suffocated with duct tape by a mother who loved to party, tattooed herself with the Italian words for "beautiful life" in the month her daughter was missing and crafted elaborate lies to mislead everyone from investigators to her own parents. Defense attorneys countered that the toddler accidentally drowned in the family swimming pool, and that her seemingly carefree mother in fact was hiding emotional distress caused by sexual abuse from her father.

However, a medical examiner never determined precisely how Caylee died, and 25-year-old Casey Anthony's DNA was not found with her daughter's skeletal remains when they were found in December 2008 in a wooded area near the Anthony family home. The defense team never offered firm proof of how the girl died, either, and never offered any evidence that Casey Anthony was molested by her father, George, who has firmly denied the claim.

"This is an emotional case and I think they made some promises early in the opening and they have not been able to deliver," said Tim Jansen, a former federal prosecutor and criminal defense lawyer in Tallahassee. "(The jury is) going to be very skeptical in their closing arguments. When I do my closing arguments, I can tell you right away if they are listening to me, if they are agreeing with me or if they turn the other way and it's not a good feeling to lose a jury."

On the eve of closing arguments, the Casey Anthony murder trial is ending exactly as it began – shrouded in mystery over what really happened to Ms. Anthony’s two-year-old daughter, Caylee
Nearly 100 individuals testified and more than 400 pieces of evidence were presented to the jury in a month-long trial. But it is still unclear precisely how the toddler died.

There’s been no confession, no eye witnesses have come forward, and investigators have found no direct physical evidence capable of telling the tale with scientific certainty.

Nonetheless, on Sunday morning in the Orlando courtroom of Chief Judge Belvin Perry, prosecutors will attempt to sidestep that glaring hole in their case while urging a jury of five men and seven women to find Casey Anthony guilty of the premeditated murder of her daughter.


If convicted, she faces a possible sentence of death by lethal injection.

Prosecutors have presented a theory that Ms. Anthony used chloroform to subdue her daughter and then murdered her by pressing pieces of duct tape over her mouth and nose.

They say she hid the body in the trunk of her car for several days until it began to decompose and smell. Then she dumped it in a wooded area about a quarter-mile from the family home. The skeletal remains were discovered six months later in December 2008. ::snipping2::

People pay their respects to Caylee as the Casey Anthony trial winds down

ORANGE COUNTY -- 
In the woods of Suburban Drive, there's a memorial with a patriotic theme, not far from where Caylee Anthony's remains were found on 2008.


On the eve of closing arguments in the trial of Caylee's mother, Casey, people are gathering, leaving flowers and stuffed animals and American flags, in honor of the little girl they never met, but fell in love with. This memorial is down the road from an original memorial that had been overloaded with stuff animals and toys, pictures, balloons and flowers. Some said they were upset that the original memorial had been taken down.

New ruling could be considered in high profile trial
 
In his 94-page ruling, U.S. District Judge Jose Martinez found that Florida's capital punishment rules are flawed.

In more legal terms, the Miami judge declared that the state’s death penalty is “unconstitutional because jurors are not required to make findings beyond a reasonable doubt on the aggravating factors that can increase a guilty defendant's sentence from life to death," the ruling stated.

“The defendant has no way of knowing whether or not the jury found the same aggravating factors as the judge," Martinez wrote in the ruling.

Indeed, the judge, unaware of the aggravating factor or factors found by the jury, may find an aggravating circumstance that was not found by the jury.”

Martinez said the Florida Supreme Court has not found that the state’s method of imposing capital punishment violates the Constitution, even in light of the 2002 U.S. Supreme Court decision he is citing.

Whether or not Chief Judge Belvin Perry, who has been presiding over the Casey Anthony case for the past 33 days, will follow the new ruling is yet to be seen, but he could attempt to modify jury instructions to comply with the decision, according to legal analysts.

“What this means is that death penalty cases in Florida could be challenged because it addresses fairness,” said Rob Lowell, a defense attorney in Atlanta, Ga. ::snipping2::

During the defense's closing argument Sunday afternoon, prosecutor Jeff Ashton bellowed an objection after attorney Jose Baez referred to Ashton as a "laughing guy" and pointed to him. Judge Perry sustained the objection and a sidebar was called. The attorneys then went behind closed doors with Judge Perry.

After reviewing the video of the "laughing guy," Judge Perry decided to give the prosecutors and the defense a warning. Judge Perry told Ashton and Baez and the other attorneys that any other incidents will result in their removal.

An angry Perry stopped Baez's argument after he referred to Ashton as "this laughing guy." Television showed Ashton smiling behind his hand at Baez's contention that the prosecution's forensic evidence was based on fantasy. One of Perry's written orders is that the attorneys not show emotion to the other side's statements.

Ashton apologized and said he tried to hide his expressions. Baez also apologized.

Earlier during the state's argument, Ashton said Casey wanted a relationship with her boyfriend, to go out with her friends and to live the carefree life she had before Caylee's birth.

"Something needed to be sacrificed, that something was either the life she wanted or the life thrust upon her. She chose to sacrifice her child," Ashton said during his 90-minute argument.

Ashton stated Casey had a choice saying, "A life tethered through a child or a life free." ::snipping2::

Prosecutors also said it is "absurd" to think her 2-year-old daughter drowned or that Casey's father, George Anthony, covered up Caylee Marie Anthony's death to make it look like murder.

Monday marks day 46, including jury selection, in Casey's trial. She's accused of killing Caylee. ::snipping2::
