This is the case JP referred to today and suggested the attorneys look at it.

HUGGINS v. STATE

John Steven HUGGINS, Appellant, v. STATE of Florida, Appellee.

No. SC02-2364.

-- December 02, 2004

It is an interesting read and it deals with a defendant trying to get testimony in without taking the stand.  I am still reading it.....

Sunny, this is so bizarre.  I saw this case on a crime show.  I know about all of the evidence, what happened.  How he lit her on fire, how he badly spray painted the car. How the jewelry was in an outlet.  I know so much of the evidence.  It must of been on TV show, I don't remember ever reading about this, or having a reason to.  What a weird, small, small world

I wonder if this has to do with the "gem" that he wanted the prosecutors to find:
 ::snipping2::
See Kelly v. State, 857 So.2d 949 (Fla. 4th DCA 2003);  Werley v. State, 814 So.2d 1159 (Fla. 1st DCA 2002);  Llanos v. State, 770 So.2d 725 (Fla. 4th DCA 2000).   Two of those decisions cite the following treatise passage concerning the functionally identical federal evidence provision:  “A defendant who chooses not to testify but who succeeds in getting his or her own exculpatory statements into evidence runs the risk of having those statements impeached by felony convictions.”
 ::snipping2::

http://caselaw.findlaw.com/fl-supreme-court/1268716.html

Magic, small world for sure. Could be... I am still trying to find the correlation to things JB asked......

The case explains Judge Perry saying 'pubic hair' from the bench today.

yep....I sure did a double take when he said that..... it looks like Bill Shaeffer believes JP will allow the felony convictions to come in..interesting that JP was the judge and Jeff the prosecutor on the Higgins case....and that the conviction was uphelp by the FL Supreme Court....so if JB stupid enough to try to have her conviction overturned

Yep..I had goggled Jeff and Perry together back when JP took over the case..and that case came  up....the point being that appeals happen all the time in DP cases..but rarely are they overtuned.    And actually the guy is still on death row I beleive, and still appealing..with must be awful for his vics family to have to keep reliving this.

Baez is so out classed in this case with Jeff, Linda and Mr George.  I wonder if part of JP's point to Baez was that he needs to pick his battles..he seems to let things pass that might have merit, open doors himself that should remain shut from a defense point of view ..and then object to things that have little to no merit.

Certainly Casey will appeal if she is found guilty..but I think that those appeals will not float..Baez needs to make Mason work a little harder and take more of a share in this defense other then watching the clock for 5 pm cocktails.

DANA - In my opinion, Casey was putting Caylee to sleep in the trunk of the car.

I believe that the heat is too intense in May and June in Florida.  Caylee would
have died from the heat in the trunk of that car. IMO

You're probably right Magnolia.  Could be that is exactly how Caylee died though.

wendy just said she thinks kc could be aquitted

I just heard that too and that there is reasonable doubt because they don't have cause of death.  How about duct tape over both her nose and her mouth?  Still in place, after months in a wet, dark swamp.  Who else would put duct tape on Caylee?  How about the huge amount of chloroform found in the trunk?  She is also saying that their is not even a remote chance that Casey would testify.  She said the state better have more than they said in the opening statements.  She thinks the state better have "nefarious" places that Casey took Caylee during the time she should have been working.  I am in shock.  Yikes!!!!!!!!!!

Does this have to turn into a sex crime murder to get Casey convicted?  I am so confused.  Yay, Blink is on next.  Now time for some common Monkey sense.  Monkey Devil! Monkey Devil! Monkey Devil!

Has this question been answered  before?

- since there is no nanny, since Cindy did not always have Caylee, where was that child for hours, days, evenings, on end?   With all of the publicity anyone caring for the child would have come forward or at the very least brought into the case via KC.

-has anyone even asked KC where this child was during the times before her death?

Terro

IMO Caylee was either with Casey or Casey had the car "babysit" her.  Remember, Casey wasn't working.

Also I swear there was a time when they found an unoccupied apt where Z Gonzales had looked and so did Casey, am I crazy or was there a time when we tossed the idea around that she put Cayee in that apt, drugged her and left her there? Otherwise I agree xanax, possibly chloroform and the car

Island... I think you are right, we did toss that idea around, and also I seem to recall an empty house down the street or something. I also think xanax, chloroform and the car are a very big possibility...

Just a thought here.... We know that Casey was driving Tony's Jeep for a while and the question is where did she put her car? She would have to leave it somewhere where it wouldn't be discovered.

Remember all the pings on her cell? Some were really in strange places. I remember one where it hit near a dumpster in the back of a business district. Hmmmm wonder if she just parked back there till she had to return the Jeep?

I have thought that too.  There have been several cases where children have been
left in school buses when the other children went into the school.  They died from
the heat.

I wonder if she ever drugged her and just left her at home alone.  Didn't we hear once how the BabyProof doorknob was reversed in either her room or Caylees?  Meaning that it was on the inside doorknob so that she couldn't leave the room...

Casey Anthony Curses: I Got Arrested on a 'Whim'

Quote
Several jurors winced every time Casey used the F-word, the biggest reaction coming when Casey was hearing saying, "Nobody in my family is on my side. … That's all they care about right now, finding Caylee."

The entire jury stared at Casey; a couple of them seemed to scowl. Casey stared straight forward, not looking at anyone and showing no emotion.

So Casey actually printed out Any's resume. Why? It's not like she really worked at Universal. Could it be she was planning on assuming Amy's identity and skipping town? Perhaps Amy might have conveniently disappeared if Cindy hadn't intervened. A new Amy probably would have showed up in California or some other location, replete with resume, identity, passport. Casey's identity was in her car. Casey was set to become a missing person along with her dead daughter.

OH my gosh, she even printed out Amy's resume!?!?! That's messed up, even if Amy didn't dissappear I bet a new Amy would have surfaced in another state.

Does anyone know the last timeline involving Mark Hawkins? I thought there was a meet up in his and Casey's future, one where she was going to him?

According to this computer forensics report, the Anthony's computers were seized and searched beginning July 16th, 2008.  Page 12 and 13 of their report shows a photo file (Mark Hawkins) was created on July 15th, 2008.  Was he always in the picture or is it possible she was hoping he'd unknowingly be her way out?

Could explain why, at bedtime, she wouldn't sleep in her own room.

I wonder if they can show that the duct tape was cut with a (kitchen) knife, instead of a scissors....or torn.

Blink on the phone probably isn't reading here.  My guess is if Cindy was that loud yes, the jury would hear her.

http://blogs.orlandosentinel.com/entertainment_tv_tvblog/2011/05/casey-anthony-emotional-cindy-stone-faced-casey-defense-blunder.html

Casey Anthony: Emotional Cindy, stone-faced Casey, defense blunder?
Quote
Bristow said that Casey Anthony sat “stone-faced” through the first two 911 calls and “started losing it” during the third 911 call. WFTV-Channel 9’s Kathi Belich said, “As emotional as Cindy was, Casey was just as unemotional. Her expression was stone cold and once the jury left, she was angry.”
Quote
WFTV’s Belich explained that the state said the defense opened the door to Casey’s criminal record when Baez asked Cindy Anthony about Casey’s lies about the toddler’s father and relatives of Zanny the nanny. ”Prosecutors argued the defense made Casey’s credibility an issue without even calling her to the witness stand, which means prosecutors can tell the jury she’s a convicted felon,” Belich said.
