The event will as Shawnee Park Concession Stand on Rust Avenue in Cape Girardeau, Mo. The run will start at 8:15 a.m. and the walk starts at 8:30 a.m. A 1-mile family fun walk will start at 9 a.m.

Prosecutors respond to appeal of Waller threat sentence

Federal prosecutors have responded to Clay Waller's appeal of a five-year sentence imposed on him for a federal Internet threat conviction.

Assistant federal prosecutor Larry Ferrell responded to the appeal with a 69-page brief April 17.

Waller, 41, pleaded guilty Oct. 3 to threatening Cheryl Brenneke, his wife's sister and the guardian of his three children, on the Internet site Topix. After hearing emotional testimony from Brenneke and Ferrell's plea to significantly vary from the suggested six- to 12-month sentence, Judge Stephen Limbaugh imposed the maximum sentence of five years on Clay Waller.

In addition to sentencing him, Limbaugh said Waller more than likely murdered his wife, Jacque Waller, who has been missing since June 1.

Waller still faces the murder charge in Cape Girardeau County. A trial judge has yet to issue a writ requiring Clay Waller be returned from prison in Oakdale, La.

"With him being in federal custody, it will take a while," said Cape Girardeau County Sheriff John Jordan. "We expect to see paperwork on it in the next two to three weeks."

Jordan said he expects Waller to remain under maximum security while in county custody.

Scott Reynolds, who has represented Clay Waller in state court proceedings, said Friday he didn't have a time frame for when Waller would be brought back to Missouri.

As friends prepare tributes to Jacque Sue Waller, who went missing June 1 last year, prosecutors are trying to return her estranged husband James Clay Waller to Cape Girardeau County to face a murder charge. And Clay Waller continues the appeal of a five-year sentence for making an Internet threat against Jacque Waller's sister.

Authorities issued a murder warrant for Clay Waller on April 23, the same day he was charged with first-degree murder in connection to Jacque Waller's disappearance. Prosecutors filed a writ April 30, requesting he be transported to the county in the murder case.

"Getting any person from any prison, you have to file the proper paperwork," said Cape Girardeau County Assistant Prosecutor Angel Woodruff. "Now, it's up to the prison."

Sheriff's department spokesman Lt. David James said he is busy preparing for Clay Waller's return.

A little more than a year after his wife's disappearance, Clay Waller will make his initial court appearance on charges that he murdered her and tampered with evidence to hide the crime.

Waller will make his initial court appearance June 4 in Jackson, Cape Girardeau County Prosecuting Attorney Morley Swingle said. He will appear in front of Circuit Court Judge Gary Kamp at the county courthouse. Swingle said the purpose of the appearance will be to determine whether Waller will have a private attorney or a public defender and to establish a date for a preliminary appearance, which usually takes place within 30 days.

Clay Waller is accused of the murder of his wife, Jacque Waller, last June. Prosecutors allege he killed his wife after the estranged couple visited a divorce lawyer June 1. Jacque Waller never showed up that day at the Ste. Genevieve, Mo., home where she had been staying since March, and her abandoned Honda Pilot was found on the side of Interstate 55. Her body hasn't been found.

In a probable-cause affidavit, investigators said Jacque Waller had documented abuse and threats from Clay Waller over several years. Investigators also said Clay Waller was uncooperative in the investigation into his wife's disappearance and gave conflicting reports of what happened.

Clay Waller has maintained his innocence since Jacque Waller's disappearance.

Scott Reynolds, who has represented Waller on other state charges, said Friday that he's not yet been retained to represent Clay Waller on the murder and tampering charges.

"I want to represent him and he wants me to represent him, but I'm not paying for it out of my pocket," Reynolds said.

He said to defend Clay Waller, he needs resources to take depositions and hire expert witnesses.

"Without adequate funds, It would be like running a mule in the Kentucky Derby," Reynolds said.

A southeast Missouri man accused of killing his estranged wife has pleaded not guilty.

Clay Waller of Jackson entered the plea during a hearing Monday. His next hearing is scheduled for Oct. 22

Jacque Waller disappeared in June 2011 after the couple met to finalize divorce plans, and her body has never been found

Court upholds Clay Waller's federal sentence
Sunday, August 26, 2012

A federal appeals court on Friday upheld a five-year federal prison sentence handed down to Clay Waller for making threats over the Internet to the sister of his still-missing wife, Jacque Waller.

Clay Waller faces separate state charges in Cape Girardeau County of murder and tampering with evidence in connection with Jacque Waller's disappearance June 1, 2011. In October, Clay Waller pleaded guilty to threatening Cheryl Brenneke, his wife's sister, on the Internet site Topix and later received a maximum five-year sentence from U.S. District Court Judge Stephen Limbaugh.

The district court's decision to impose a maximum sentence was partially based on suspicion that Clay Waller murdered his wife, according to court documents. Three federal court judges agreed with that decision, stating that evidence the government presented to the district court at the sentencing hearing makes the district court's findings "plausible."

The Waller triplets turned 7 Sunday, as volunteers again searched another secluded spot for their missing mother. Their father, meanwhile, remained incarcerated awaiting a court date this week -- and eventually a trial -- on charges that he killed her and disposed of the body.

Clay Waller gets a jury trial date in 2013

42-year-old Clay Waller is set to go to trial in September 2013 for the death of his estranged wife.  His defense attorney filed a petition in Cape County Court for a new venue.

JACKSON, MO (KFVS) - Clay Waller will stand trial for the murder of his estranged wife Jacque Waller next year, and an outside jury will hear the case.

Waller was in court Monday morning at the Cape Girardeau County Courthouse in Jackson.

Both the prosecution and defense reached an agreement on change of venue.

Judge Benjamin Lewis set aside two weeks in September of 2013 for the trial.

A jury from Cole County, Mo will be brought to Cape County to hear the case.

Jury selection is set to begin in Cole County on September 5, 2013.

ST. LOUIS — Nearly two years to the day after Jacque Sue Waller was last seen alive, the body of the southeast Missouri mother of young triplets has been found.

 The Cape Girardeau County prosecutor's office issued a one-paragraph statement Thursday. It said police recovered a body on Wednesday that has been confirmed as Waller.

She was 39 when she disappeared on June 1, 2011. No information was released on where the body was found, and a woman answering phones at the prosecutor's office said no further comment would be made, citing an on-going investigation.
