With the scribble that Baez just did on that paper is exactly the reason why the VIDEO needed to be allowed. Look how Baez drew Caylee ,,, as nothing more than scribble, much like what his client thought of her as well.

Watch for Baez to be selling is artwork on Ebay after the trial. IDIOT!

It irritates the heck out of me that the jury got to hear Baez's question to Dr. Warren about his showing the video to gain "emotion", but they never got to hear him answer it!

3:15pm Friday June 10, 2011 Court is in session.

This is a matter taken up without the presence of the jury.

JBP says the Florida Supreme Court found in it's opinion, that a balancing test of the trial judge, only when the prejudicial out-weighs the probative value.  It can inflame the jury's emotions.  The trial court needs to find the need for the evidence, etc, etc.  The trial court must exclude evidence that prejudicial must outweigh probative value.  This evidence shows the placement of duct tape over the skull.  The defense cites 2 cases, the first is to do with a reconstruction of an accident, the court in that case that it's 403 analysis demonstrated no blood, no sounds and they found no error by the trial court admitting the animation to the jury.  The next case cited by the defense was Brandon Pest Control Case.  This case involved a video tape that was of approx. 15 min duration that was taken at the resident in question.  It showed a demonstration of pest control and had computer generated animation along with narrations.  The court concluded that the narrations were self serving and should  not be used.  It however does not go through a 403 analysis.  In looking at the factors located in McDuffy.  One the court needs to make a issue of the placing of the duct tape on Caylee Marie Anthony, also there is a non-descript photo of Caylee Marie Anthony and a photo of the skull of Caylee Marie Anthony and the jury has already seen photos of both.  Unfortunately evidence in homicide cases are not so nice, however this tape does not suggest an emotional basis for a verdict.  Both sides have debated the relevancy of the duct tape. The court concludes that the trial of fact needs to determine.  Therefore based upon the evidence placed before this court, the witness will be able to testify and pursuant to Pierce, he will give the following limited instruction:  The expert is giving this opinion. This expert's opinion of which they believe they are an expert, you can believe all or part of the testimony. Does the defense want this instruction to be given to the jury?  Yes, but we still have our objections in place.  The prosecution did not tell them they were going to use it but the defense knew about the witness.  He is going to allow the tape to be shown to the jury.  Baez is cautioning the judge that this witness is cumulative because he co-authored a report with Dr. Shultz.  Jeff Ashton says that they had no objection to what Dr. Shultz said.  Baez says to improperly bolster Dr. Shultz's opinion.  The judge says it is only cumulative after 2.  Returning the jury........
