If this is true, I'm so disappointed that Beth found out about Dave's petition in this way.  If Dave didn't want to let her know himself, he could have had his lawyer call John Q. Kelly and request that he notify her of the petition being filed and/or the court date before she was served.  It's just sad.

Father of Natalee Holloway Seeks Death Declaration

The father of missing Alabama teenager Natalee Holloway is asking a court to declare his daughter dead, six years after she vanished during a graduation trip to Aruba.

Mississippi insurance agent Dave Holloway filed the request in probate court earlier this summer, but court officials said Wednesday it could be months before any decision is reached.

An initial hearing on Holloway's request is set for Sept. 23, and state law mandates a second hearing before a decision is issued. Officials said Alabama law also requires that the request be advertised for months, meaning it could be after the first of the year before a final decision is issued.

The father's lawyer, Karen Hennecy, said Holloway "is seeking closure for this family."

"This is a normal proceeding for families when a loved one has been missing for an extended period of time," Hennecy said.

The missing woman's mother, Beth Holloway, said she was surprised her ex-husband filed the request.

"I only learned about this when I was handed the citation by a process server while addressing a large audience at a conference in Georgia," she said in a statement. "I don't know what this is about, or why Dave is taking this action at this time."

A spokeswoman for Beth Holloway declined comment on whether she would oppose the petition.

It just seems to me that at the right time, this would have been something that they all would have done in agreement, and together.  Maybe I'm just naive.  But it could have been one of the final things they did together regarding Natalee; and perhaps followed the determination decree with a memorial service for the entire family.

I've thought all evening about Natalee's graduation.  How Dave, Robin and the girls went to Beth and Jug's home before the graduation.  Natalee showing her little sisters her room.  None of them knowing what would come to pass.  I know that must have been so special for Natalee to have them all under one roof, even if it was just for a little while.  And hopefully that was a memory treasured by all later on. 

To me, this step should have been one that both parents took together, for Natalee.  If it's truly for closure.

It is said that a man is known by the company he keeps.  Considering Dave Holloway's close relationships with those who openly and despicable undermine the mother of his daughter ... I should not have been taken back by his lack of consideration in regards to this action.

Dave's desire to have Natalee declared dead after six years is understandable and his reasonings in the document posted by Klaas were solid but the "surprise" citation served to Beth was not the way to go.  It was cruel.

Anyways... as with other issues ... I know Beth will work through it all with grace.

Once again , as from the beginning when I first learned of Natalee's disappearance, I cannot fathom the pain that Dave and Beth must have in their hearts. Natalee Holloway's dad asks court to declare daughter legally "dead"

(CBS/AP) BIRMINGHAM, Ala. - The father of missing Alabama teen Natalee Holloway is asking a court to declare his daughter dead, six years after she went missing during a graduation trip to Aruba.

Dave Holloway, Natalee's father, filed the request in probate court earlier this summer, but court officials said Wednesday it could be months before any decision is reached.
Holloway wrote in a sworn statement that is was his "painful" belief that his daughter is dead and recounted the years spent investigating her baffling disappearance in 2005. He said there was no evidence to suggest Natalee is either alive or that she had run away from home.

Natalee's body was never found despite extensive searches both on Aruba and in the waters off the coast of the Caribbean island.

The request said the teenager didn't have a will and owned about $500 worth of personal property; it did not mention any life insurance policy.

An initial hearing on the request is set for Sept. 23 and state law mandates a second hearing before a decision is issued.

Dave Holloway's lawyer, Karen Hennecy, said Holloway "is seeking closure for this family."

Meanwhile, Natalee's mother, Beth Holloway, said she was surprised her ex-husband filed the request.
