Thank you for the updates grace-land.  I hope the prosecution gets it all together and soon!  It would be such a travesty of justice if Joran's legal team manages to weasel him free due to procedural errors.

Peruvian Judge asks Dutch reformulate indictment woman killed in 2010
AFP | Date: 09/16/2011

The trial began in Peru against the Dutchman Joran van der Sloot, confessed murderer of a student in May 2010, runs the risk of delayed after a judge asked the prosecutor to rephrase the charge of procedural errors, said Friday the Power judicial.

"The prosecution did not check the facts and circumstances that were the basis to justify the responsibility of the accused," a judicial statement on the case Van der Sloot

The Dutchman is accused as the perpetrator of the crime of simple murder and theft, to the detriment of Stephany Flores, 21, and is the prime suspect in the disappearance in Aruba in May 2005 by the American Natalee Holloway 18.

The court of the Third Criminal Chamber in Jail Inmates, chaired by Judge Flor de Maria Poma, warned that the prosecution, trial basis, to fill those gaps in order to initiate this phase of the trial.

Last Monday the court heard at a court hearing to Van der Sloot's lawyers of the victim and rule on the indictment, which calls for 30 years in prison for the accused, aged 23.

At that meeting the attorney for the particular complaint and demanded a life sentence called for the judge to return the indictment to the prosecutor Miriam Riveros, due to irregularities in its preparation.

The start of the trial date will be set once the prosecutor returned to court restated the accusation and that it is reviewed and approved by the judges of the case.

Thanks Grace.

It appears that the attorney for the Flores family was able to convince the judge that prosecutor's case was not in the best interest of justice for Stephany.

Could it that the prosecutor did not make it clear in her case against Joran that an investigation of the laptop revealed that it was never an rage factor as the defence claims?

Peruvian judges to decide on trial date for Van der Sloot
Published on September 12, 2011

His (Joran) defence team is looking to lodge a manslaughter plea which comes with a six to 20 year prison sentence. It says Flores' murder was an act of passion after she allegedly discovered information related to the Holloway case on his laptop.

But prosecutors and Flores' family are seeking a 30-year sentence, arguing the murder and robbing of the young woman was premeditated.

"Van der Sloot was hungry, Van der Sloot hadn't paid the hotel, Van der Sloot met a girl in the casino that he did not find attractive, but that had money. If you accept this evidence which is sustained by the prosecution we start to realize the murder of Stephany Flores was not a sudden reaction to her seeing information on his laptop pertaining to the Natalee Holloway case, we are warning that the prosecution's account shows this was a planned act," the Flores family lawyer, Edward Alvarez said.

Alvarez said there were also some discrepancies with the evidence presented in the case and the official charges of voluntary manslaughter.

"We have said there are inconsistencies in the prosecution's account and its accusations, between the evidence it uses and what it is asking for. These inconsistencies could bring about negative consequences at trial because it could result in a mistrial," Alvarez said.

Van der Sloot looking at 30 years

He (Joran) is claiming he killed Flores in a fit of rage after she found material relating to Natalee on his laptop.

Peruvian authorities say the real reason for the killing was robbery and that an examination of the laptop shows Stephany was killed well after the Holloway-related material was accessed.

I am thankful for advocates akin to the family of Natalee Holloway and the family Stephany Flores who are not intimidated ... who are motivated to challenge justice systems in their pursuit for justice.

At one point in time ... Natalee Holloway's parents and step parents joined forces ... appealed to the Aruban "powers that be" to replace the investigative team and the prosecutor who ... in their perspective .... were preventing justice from prevailing.

My Dad was an insurance agent and he had what he called "burial" policies on us kids. They were just a little $5,000.00 policy each. I'm sure that today a policy intended for such purpose would be worth a little more because it costs more to bury someone, but I agree, it's not about any policy.

I think it was insensitive to not inform Beth himself, since obviously she had to be informed by someone. IMO, the way it was handled was needlessly cruel.

Needlessly cruel--thanks, CBB, they are the words that I was looking for.  I have been trying to think carefully about this before I spoke.  It hit me like a ton of bricks (that Beth did not know beforehand).  I cannot imagine how Beth felt.  That woman has had to duck many oncoming missiles before, but this must have blindsided her, at an event, no less.

I realize that Dave is the grieving Father and I have always tried to remember that.  There is no excuse for doing it the way it was done.  I am not sure I agree with doing it lawyer to lawyer, this was an in-person (or phone), man up kind of thing.

You're absolutely right Sis, the petition was filed on June 21st, and had obviously been in the process at least since April; Beth finds out at a speaking engagement in Georgia in September?

NO EXCUSE.

The FAA, which monitors the safety of flights to and across the United States is not satisfied with the supervision of the local aviation Curaçao. The supervisor, Department of Aeronautics Curacao, so probably lose its category one status with the Americans.

There are two categories for the quality of supervision. Category 1 is for civil aviation authorities that meet all requirements. If something is wrong with one aspect, the Category 2 applies. Carriers from Category 2 countries may not run charters or new routes to the U.S.. If a country is placed in Category 2 may be carriers maintain no cooperation or start with U.S. airlines.

Currently gets a placement in Category 2 only Insel Air Curaçao airline: it operates scheduled services in addition to three U.S. cities also charter flights to the U.S.. Insel Air also works with U.S. Air.

According to the FAA lacks the Curacao Aviation Authority in its review: current knowledge on certain aircraft types, legislation modeled on security requirements, modern equipment and efficient inspection procedures.

The checks that are done well but the authority has several developments in the aviation internationsle not tracked. The FAA is therefore not only new equipment and better inspection procedures also see a plan for continuous training of inspectors.

Peru to beef up Joran van der Sloot charges

Published on 17 September 2011 - 4:38pm

Peru’s Public Prosecutor has been ordered to reconsider the charges is has brought against Dutchman Joran van der Sloot, who is accused of killing Peruvian student Stephany Flores in his Lima hotel room on 30 May 2010.

At the first public hearing, on 12 September 2011, Mr Van der Sloot was charged with murder and robbery. The Public Prosecutor called for a 30-year jail sentence and damages of 50,000 euros.

The lawyer for the victim’s family said the charges should not be “murder followed by robbery” but “robbery followed by murder”, which carries a life sentence. He also rejected the 50,000 euro compensation as insufficient.

The judge hearing the case has instructed the Public Prosecutor to reformulate the charges, which will delay the trial.

The way I am reading this, it is a good thing. The judge wants the Prosecution to be going after a life sentence instead of 30 years. Te judge also wants more $$ damages to be paid1

If I understand this correctly, a man from the Dominican Republic has served his sentence for murder and is to be released; but Aruba is stuck with him until they receive confirmation from the Domincan Republic that he is who he says he is.  So I guess that means he had a trial and everything without them knowing if his name is what he said it was?  His crime was committed while Jan van der Straten was the Chief of Police...

CRAZY imo!
