U.S. Man Faces Aruba Judge in Case of Missing Woman
Published August 31, 2011

Gary Giordano of Maryland has been jailed nearly a month, since the disappearance of Robyn Gardner. Police and prosecutors on the Dutch Caribbean island need a judge's consent to keep holding him while they continue their probe.

Wednesday's hearing at a prison is closed to the public and news media. Solicitor General Taco Stein says prosecutors believe they have enough evidence to get another 60 days of detention. If the judge rules otherwise, prosecutors are expected to appeal.

A Mother's Anguish

Loving Natalee
A Mother’s Testament of Hope and Faith
By Beth Holloway

Pages 114/115:
Since entrusting Natalee's care to God, I welcome sleep when I can get it.  Nothing in my dreams is worse than my waking hours.  Ironically, sleep takes me out of the nightmare.  No question though, the lack of sleep is having an effect.  After holding it together all day, in front of others and in front of TV cameras, night is when emotions spiral out of control.

Feeling was unleased at the Cross, and it is a being of its own.  It can soothe me, and it can torment me.  It empowers me.  Yet I throw things when I'm alone in the room.  Shoes, Apples from a fruit basket.  Whatever is within reach when the urge strikes.  Sometimes the crying is inconsolable, and I hug the purple duffel bag.  Over and over I just hug it.

When Jug and I are in Natalee's room by ourselves, we kneel and pray together for her, staring at her picture on the bedside table.  We keep the light on.  Just like all parents do when they're waiting for their children to come home.

Another day passes.  And tomorrow and the next day and the next we'll put on our game faces and do it all over gain until we find her.

GEORGE "JUG" TWITTY, STEPFATHER OF MISSING GIRL: I hope, I pray to God that she walks through that door or that we find her somewhere. I don`t care if she`s, you know, in a crack house somewhere and she`s been drugged up for, you know, seven days or whatever. We can work with that. We can fix her. We can do whatever to get her back.

Giordano stood to collect on $1.5 million insurance policy

The judge likely will rule one of three ways at the end of Wednesday’s hearing:

Order Giordano held for another 60 days. This would start the clock ticking toward criminal charges being filed and a trial being held. There still could be a delay in a trial, but in general the trial would be expected to commence within two or three months.

Order Giordano released from prison on the condition he remain in Aruba. This would be an indication that police and prosecutors are continuing their case.

Order Giordano released from prison and declare he is free to leave Aruba. That would mean the judge has ruled the prosecutors didn’t present enough evidence to hold him.

The judge in the case issued two rulings: In the first, he agreed with prosecutors' request to extend the period of van der Sloot's pretrial detention by 30 more days.

But later Thursday, the judge issued another ruling that sided with the defense — an order to immediately suspend the execution of his earlier pretrial detention order.

Suspects in teen’s disappearance released

SAINT NICOLAAS, Aruba - All three suspects in the disappearance of an Alabama teenager were released from jail Saturday in a setback for the prosecution and the biggest blow yet to Natalee Holloway’s family.

Joran van der Sloot, an 18-year-old Dutchman, and two Surinamese brothers, Satish Kalpoe, 18 and Deepak Kalpoe, 21, were released on condition they remain in Dutch territory and be available to police for questioning.

Restrictions Lifted

Aruba court lifts curbs on three suspects in missing teen case
September 27, 2005

“An Aruban court has ruled that three suspects in the disappearance of Natalee Holloway can remain free without conditions.”

“Wednesday's ruling overturned an earlier decision that restricted the suspects' travel and required them to remain available to investigators. The appeals court said there was a "lack of sufficient grounds and serious suspicions" to keep the restrictions on the three men. Joran van der Sloot and two Surinamese brothers -- Deepak and Satish Kalpoe -- are suspects in the May 30 disappearance of the Alabama teen. They were released from jail on September 3rd on the condition they remain available for questioning.

Aruba Judge Keeps Gary Giordano in Jail 60 More Days in Robyn Gardner Case
ARUBA Aug. 31, 2011

A judge in Aruba ordered Gary Giordano, the lone suspect in the disappearance of Maryland woman Robyn Gardner, to remain in jail for another 60 days while police press their investigation.

Gardner's mother, Andrea Colson issued a statement after the judge's ruling saying, "We have faith and confidence in the Aruban Authorities and FBI, and know that they will fervently continue their efforts to find Robyn."

"This has been such a difficult time for all of us and your prayers have given us strength. We need to find our daughter. We pray that anyone who knows what happened that day will find the strength to contact authorities immediately. And we continue to ask everyone to keep praying for our Robyn so that she will be found soon," the statement said.

The Aruba prosecutor's office issued a statement urging "people who can give any information about the suspect... to contact the Aruban Police in person or via the special tip line 11141. Persons who want to volunteer information from outside of Aruba are asked to make use of the number 297-582-0695."

Considering Gary Giorgano is not the son an Aruban/Dutch elite ... could it be that justice will prevail for Robyn Gardner?.

HILL: The Aruban authorities continue investigating.

Beth, when you look at the steps that had been taken. They`ve stopped him. I mean he went passed the Aruban -- sort of arm of law and they were able to bring him back in. Do you get a sense that perhaps they`re doing a better job?

HOLLOWAY: I do. I`m still guarded though and I do hope they prove me wrong and show me what Dutch law can really do with a perpetrator on their island. I am very encouraged so far. So I just want to -- just see how this proceeds.

Aruba Judge Extends Detention of U.S. Suspect in Missing Woman Case
Published August 31, 2011 | FoxNews.com

AP

This undated handout photo, released by the Natalee Holloway Resource Center on Tuesday, Aug. 9, 2011, shows Robyn Gardner, 35, of Frederick, Maryland.

A judge in Aruba has ruled authorities can continue to detain a U.S. man while they investigate the presumed death of his travel companion.

 ::snipping2::

Giordano has been held nearly a month since he reported 35-year-old Robyn Gardner disappeared while snorkeling. The ruling extends his detention for 60 more days.

 ::snipping2::

The judge's ruling has not been made public, but a statement from prosecutors describes the decision.

"We have faith and confidence in the Aruban Authorities and FBI, and know that they will fervently continue their efforts to find Robyn," said Andrea Colson, Gardner's mother said in a statement following the sentence.

"We are grateful for their hard work and we are also grateful for the overwhelming support from communities all around the world. This has been such a difficult time for all of us and your prayers have given us strength. We need to find our daughter," she continued.

"We pray that anyone who knows what happened that day will find the strength to contact authorities immediately. And we continue to ask everyone to keep praying for our Robyn so that she will be found soon," she said.

Joran van der Sloot A TRADEMARK?
"Joran van der Sloot a brand?
Posted on: August 31, 2011

 ::snipping2::

It is true that the mother's name "Joran van der Sloot" is registered as a word mark in the European Union. The name "Joran" is not registered. I'm only assume that it was filed out of profound maternal love, to thus prevent certain people will misuse the name of Joran van der Sloot and that it is not registered to the name itself to exploit.

It is a misconception that with a trademark registration owned any use of that sign - especially if the sign consists of an existing name - can counter.

The European brands really offers protection only against the use of the registered word / character as a brand as a sign to distinguish goods or services - and not against the use of the sign as the name of a person. Even if the movie title "Joran" had been, it was difficult to counter, because a title not easily seen as a mark.

The Benelux Trademark (but now is not registered) program provides additional protection against uses other than as distinctive (and brand), such as business name, title or seconds as domain names. But such use should be prejudice or unfair advantage or use that can be drawn from the reputation or distinctive character of the mark.
Although Joran undeniably a certain reputation and distinctive name (everyone knows who he is), the use of the name as a title or name of a character not infringe.
After all, Joran van der Sloot has not been the brand of a particular product or service reputation or distinctive character, but the name was only known as a person because he was frequently in the news. That reputation and distinctiveness are not the purpose of trademark protection.

It is different if an artist because of his / her own performance a name / reputation on which his / her name as a distinctive point for his / her character and performance (services or related products).

From one of the article Janet posted, it looks like the drivers that were involved when Joran was fleeing are to be charged:

I thought he just had to be charged before the 18 mo. time period, not that the trial had to begin before that?  Maybe the bringing the charges are part of the trial process and it will be considered timely.  Otherwise, everyone had better get on the stick and get the trial going!!!
