(Aeronoticias) .- The College "B" of the Third Criminal Chamber Jail Inmates at the Court of Lima, left to vote the request in the oral report of the civil party lawyer. (CNN) -- The murder trial against Joran van der Sloot could be delayed if a three-judge panel honors a request from the victim's family to have his indictment sent back to the prosecutor's office, the Lima, Peru, Superior Court said Monday.

Edward Alvarez Yrala, the attorney for the family of Stephany Flores, told a three-judge panel that the indictment against van der Sloot had "mistakes," a news release from the court said.
 
It did not specify what mistakes Yrala referred to in his arguments.

The panel has 15 days to decide on Yrala's request. If a decision is made not to return the indictment to the prosecutor's office, a date will be set for van der Sloot to stand trial on murder and theft charges, the court said.

At Monday's hearing, the Flores family attorney also requested that van der Sloot face the maximum penalty if convicted.

The last paragraph of your posting relieves my concern that a delayed trial could result in the Stephany Flores case being dismissed.

The 6 1/2 year roller coast ride that we have been riding in regards to Joran van der Sloot is ongoing.

Stephany's family is determined to use the full extent of the law to bring justice for their beloved daughter.  I'm sure that they are receiving very good legal advice.   It might be that Joran's luck is running out?

Could it be that the Prosecutor did not comprehend that an investigation determined that Stephany was not on Joran's laptop as he claimed in his confession that supported the rage/passion defence?  Could this be the issue that attorney for Stephany's family is contesting.

Again ... I am thankful for advocates akin to Beth Holloway and Ricardo Flores who will challenge justice systems in their pursuit for justice.

Time and time again ... I have made a promise to myself not get on that roller coaster ride of hope and dispair again.  In other words ... the outcome will be what the outcome will be.  Time and time again ... I have broken that promise.

(CNN) -- Joran van der Sloot is willing to confess to a "simple homicide" charge in relation to the May 2010 death of a woman in Peru, but not to more serious charges that would carry longer prison terms, his lawyer said Monday.

Meanwhile, the victim's family asked a three-judge panel for a more stringent charge that could have the 24-year-old Dutch national's indictment sent back to the prosecutor's office -- a move that could prompt a delay in his trial, if the court assents -- the Lima, Peru, Superior Court said Monday.

Both the accused and the victim's family disagree with the indictment proposed by prosecutor Miriam Riveros Castellares. She is asking the panel to indict Van der Sloot on charges of qualified murder and simple robbery, which carry 28-year and 2-year sentences. He would also make a restitution payment of $73,000 to the victim's family.

Attorney Luis Jiminez Navarro and his client, Van der Sloot, did not attend the hearing due to what Navarro described as the massive media interest in the case. But the lawyer did submit his response to a proposed indictment in writing, asking for a simple homicide charge that could carry a maximum sentence of 20 years in prison.

He said, too, that his client would confess to this charge.

But the attorney for the family of the victim, Stephany Flores, told the three judges that the prosecutor's proposed indictment against Van der Sloot had "mistakes," a news release from the court said.

It did not specify what mistakes Edward Alvarez Yrala referred to in his arguments.

According to Navarro, Yrala asked the court to charge Van der Sloot with a charge akin to aggravated murder, which carries a maximum sentence of life in prison.

The panel has 15 days to decide on Yrala's request for a new indictment. If a decision is made not to return the indictment to the prosecutor's office, a date will be set for Van der Sloot to stand trial on murder and theft charges, the court said.

Baez simply wants a free trip to Aruba.  He'd fit right in.

I wonder if he took Casey for a romantic side-trip (uhhh paralegal). 

Can you blame his family?  Baez can get a known murderer off, this is cake to him, AND a free Carribean vacation.  Even though they use Dutch law, since it's close to South America and he's hispanic, he probably thinks there is no difference. 

Lawd!  Now were going to see his ugly mug all over the news again!
