The jury has to be fuming over all this defense nonsense...they've in essence sealed Casey's fate, which was inevitable anyways, IMHO
Is the jury in the courtroom?  I thought they were still in the back.

next it will be close to lunch so the jury will probably just go to lunch....

Despite all the defense atty jokes there are pretty strict ethical guidelines that all attorneys have to follow.  That is despite the actual court order in this case.  There is no excuse for this.  Almost all states require an ethics exam (professional responsiblity) along with passing the bar to practice law.

This is why it took Baez eight years to get his bar card.

That exam is called the MPRE and I know it is required in Florida because my husband just became licensed to practice law in Florida and he had to take it. Also, most states have ethics boards that make sure the attorneys there are following ethical guidelines.

usually they are two seperate tests.  but really, I don't see why he doesn't value his license more...

THE COURT RULES THIS VIOLATION IS NOT INADVERTENT

Therefore, finds that the discovery violation was willful.

Next issue is if it was trival or substantial, DNA....not trival

The court finds that it is not trival but substantial.
Next issue, did it have an adverse effect to the other side
Court ordered a deposition - if the witness had offered a report with his opinion then this court would not have given the State the opportunity to take his deposition.
The question is whether this witness should be excluded regarding DNA, requiring a Frye hearing
All of the cases dealing with this says the remedy is EXTREME

COURT RULING   At this juncture in time the court will not be able to testify on this issue of DNA anaylsis on decompositional fluid in trunk of car.  Defense can file motion for a Frye hearing & the court then on Wed evening or Thurs evening at conclusion of day's testimony, one hour break later will conduct a Frye hearing.  Judge will decide if it meets Frye.   I will not permit his testimony at this time

At first I thought we were looking at the top of her skull in the upper right corner.

Maybe that's why they didn't pixelate because it was hard to see? Very strange that they didn't.

Strange that some think it's difficult to see. It was the first and only thing I saw when the pic was first posted this morning. It's as if Caylee's calling out...I've looked at it so many times now and see other evidence included, such as, the Whitney laundry bag off to the right, I believe you can also see some remnants of the duct tape...
