HOUSTON—Ten years ago from Monday, Houston mother Andrea Yates drowned her five children in a bathtub. Now her attorney says she may be ready for release.

After two trials, Yates was found not guilty by reason of insanity. She’s been in a mental hospital ever since.

"She understands how she was a victim as well as those five kids and that the culprit in this case was mental illness," said her attorney George Parnham.

Parnham says the doctors in Kerrville - where she is living - say her mind is different too.

"She is well, I will tell you that. She is ready in my opinion," he said.

Parnham said Sunday that his client will come up for a process called recommitment in November, when the state will have to present its case to keep her in custody.

" [They’ll try to prove] that she is a danger to others, that she is mentally ill and without patient treatment she will continue to deteriorate," Parnham said. "That is basically not what her treating physicians are telling us."

Dear Lord! hopefully she will not be released and hopefully if she is, she is no longer able to procreate! I think when someone kills someone, especially a child and they are found to be mentally ill and are sent to a facility, they should never get out...jmo...

OMGosh, I really hope she does not get out... I had horrible nightmares for weeks after all of the details were released.  She does not deserve to get out and possibly have another child.  OH my, I am making myself sick thinking about it.

Ten years after Andrea Yates was first convicted of murdering her five children, the Clear Lake mother might soon be allowed outside the confines of a state psychiatric hospital to go to church, her attorney said Tuesday.

Defense attorney George Parnham said he expects Yates' doctors at Kerrville State Hospital to file a letter in the next week, asking the state district court in Houston to allow Yates, now 47, to leave the hospital for two hours weekly to attend services.

“We're now going to be asking for a pass for two hours,” said Parnham, who hopes eventually she'll be allowed to leave the state's care for good.

State hospital physicians consider a patient's possible risk to the community before recommending a “therapeutic” pass, the first step toward a life beyond the hospital.

Yates' attorney believes she has been ready for years to rejoin society, including getting a job and living on her own.

“I think she's ready for outpatient care,” he said.

Yates has been confined to the state psychiatric hospital since her second 2006 trial resulted in an acquittal after jurors found her innocent by reason of insanity. She was initially convicted of capital murder for the deaths of Noah, 7, John, 5, Paul, 3, Luke 2, and Mary, 6 months, in 2002 and sentenced to life in prison, before an appeals court granted her a new trial.

The doctor's letter will be sent to Judge Belinda Hill, who oversaw both trials.

Prosecutors, who never disputed that Yates was mentally ill, argued that despite the illness, she knew right from wrong, pointing to the minutes after the children's deaths when she called 911 and waiting until her husband left for work because she knew he would try to stop the drownings.

An appeals court threw out her 2002 conviction based on a forensic psychiatrist's erroneous testimony. In both cases, Parnham and attorney Wendell Odom urged jurors to find that Yates' mental illness led to the children's deaths.

Experts witnesses testified that Yates, who is very religious, drowned her children in an act of love to save their souls from eternal damnation.

The children's father, Rusty Yates, who has since divorced the mother of his children, remarried in 2008. He did not immediately return a call for comment to the Chronicle.

Kaylynn Williford, one of the prosecutors in the Yates case, declined to comment. Her fellow prosecutor on the case, Joe Owmby, is now in private practice.

HOUSTON (AP) — Doctors who have been treating a Texas mother who drowned her five children in 2001 are seeking permission for her to attend group outings with other patients in the psychiatric hospital, a newspaper reports.
Andrea Yates, who killed her five children aged six months to 7, is the only patient that has never been allowed to attend group outings with others at Kerrville State Hospital since 2006, when she was found innocent by reason of insanity for the deaths, her attorney, George Parnham, said.
A conference call between a judge, Parnham and hospital staff had been scheduled for Friday, but was cancelled because Parnham said he was not available, the Houston Chronicle reported.
The call will likely not be rescheduled before Yates' annual evaluation in the fall, he said.
"The doctors recommended (Yates) could benefit from passes for a couple of hours to attend picnics with other patients," Parnham told the newspaper.
The outings would be part of Yates' rehabilitation and she would be accompanied by staff and guards at all time, Parnham said.
Initially, Yates had been convicted in 2002 of capital murder in the drowning deaths of her five young children, Noah, 7; John, 5; Paul, 3; Luke, 2; and Mary, 6 months old. She was sentenced to life in prison. She was later granted a retrial and found innocent by reason of insanity.
In May 2012, a judge denied Parnham's request that Yates be allowed to attend church services outside the hospital.
The attorney did not give many details on Yates' life in the hospital, but said she has made greeting cards and aprons, which are sold anonymously at craft shows. The proceeds go to the Yates Children Memorial Fund, a group founded in 2002 to improve the mental health of mothers in the region.

BBM  Her retrial found her not guilty by reason of insanity, but still... she drown her five children.  Sorry, no outside activities.  Not even if supervised.  I realize it seems mean, but it's how I feel.  If she is capable of drowning little kids, she shouldn't be out.  JMHO

The Houston Chronicle reports reports Andrea Yates dropped her request Monday because of the public scrutiny it has drawn. Last month, the 49-year-old woman and her doctors at Kerrville State Hospital had asked for a day pass to participate in supervised outside activities, such as picnics.

Her attorney George Parnham says she's the only Kerrville patient who has never received a group-outing pass
