Nurse convicted in suitcase murder case

NEW BRUNSWICK, New Jersey (AP) -- A jury convicted a nurse Monday of killing her husband and placing his body parts in three suitcases she tossed into Chesapeake Bay.

Melanie McGuire, who sobbed as she heard the verdict, was convicted of murder, desecration of a corpse, perjury and a weapons offense.

She was acquitted on two counts of hindering prosecution and falsifying evidence. Authorities charged that she wrote anonymous letters in an attempt to thwart investigators.

During the six-week trial, prosecutors said McGuire, 34, organized William McGuire's 2004 slaying using her expertise as a nurse so she could begin a new life with her lover, her boss at a fertility clinic.

The Middlesex County jury was told that two days before her husband was last seen alive, McGuire bought a gun and bullets that matched those found in her husband's body.

The body parts of William McGuire, 39, a computer programmer, were found in matching Kenneth Cole luggage that washed ashore in Virginia in May 2004.

The verdict from the jury of nine women and three men came after about 13 hours of deliberations over four days.

McGuire's attorney, Joseph Tacopina, had argued that the petite nurse was physically incapable of killing her 6-foot-3-inch, 210-pound husband.

Assistant Attorney General Patricia Prezioso told jurors McGuire forged a prescription for a powerful sedative -- chloral hydrate -- using the name of a patient from her fertility clinic on April 28, 2004, the day her husband disappeared.

During his closing argument, Tacopina also said it also would be impossible to have carried out such a bloody crime in the couple's apartment without neighbors hearing something or without leaving behind physical evidence.

Prezioso told jurors that McGuire most likely had an accomplice, but no one has been named or charged. The prosecutor acknowledged that there were some unanswered questions, but said there was still "overwhelming" evidence to convict the mother of two.

Prosecutors also highlighted Internet searches made from the couple's apartment on topics such as "undetectable poisons" and "ways to kill people."

Tacopina said the defense did not to call McGuire to the stand because they felt the jury had heard the key elements of what she had to say when audio recordings made by two men close to her, who were cooperating with authorities, were played in court.

The recordings were made by Dr. Bradley Miller, with whom she was having the affair, and her good friend, James Finn. During the recordings, McGuire repeatedly says she had nothing to do with her husband's death.

The defense portrayed William McGuire as a man with gambling debts who might have been killed by a creditor.

Yes, I saw that on Court TV today!  However, that woman was so guilty, if he'd a won, I would be VERY concerned with OUR justice system....

So speaking of Joe Taco,  any news on the CA case with Dr. Phil?

A timeline relating to the disappearance of William T. McGuire, 39, of Woodbridge, whose body washed up in three suitcases in the Chesapeake Bay in May 2004.


1999: William McGuire and Melanie Slate are married in West Orange.

2002: While Melanie McGuire is in the 38th week of her second pregnancy, she and Dr. Brad Miller of Reproductive Medicine Associates begin a sexual relationship.

April 18, 2004: A user of a computer in the Woodbridge home of William and Melanie McGuire conducts Internet search on topics including chloral hydrate, gun laws and "How to Commit Murder."

April 26, 2004: Using a Pennsylvania drivers license, Melanie McGuire purchases a .38-caliber weapon at John's Gun and Tackle Room in Palmer Township, Pa.

April 27: Last day William McGuire reports to work at New Jersey Institute of Technology in Newark.

April 28: At about 8:45 a.m., a pharmacist at Walgreens on New Durham Road in Edison fills a prescription for chloral hydrate on a script with Miller's forged signature. The prescription is made out to an Old Bridge woman, who will testify she never received a prescription from Miller.

April 28: William and Melanie McGuire close on $500,000 house in Warren County. Later that night, William calls Elizabethtown Gas to have service transferred to the new home. It is his last known conversation.

April 29: Melanie McGuire reports the couple has a fight, and he leaves their apartment on Plaza Drive in Woodbridge at about 2:30 a.m.

April 29: A call is made on William's Blackberry at 6:17 a.m. informing his superior at NJIT, "I will be out sick." Moments later the message is returned, marked "undeliverable."

April 29: Melanie McGuire registers at the Red Roof Inn in Edison at 8:09 p.m., where she will stay for three nights.

April 30: Shortly after midnight, William T. McGuire's Nissan Maxima is parked in a lot behind a motel on Atlantic City's casino strip. Grainy security tape shows a person getting out of the vehicle and walking away. In a secretly taped conversation, Melanie McGuire admits to moving his car.

April 30: In taped conversations, Melanie McGuire says she took a cab from Atlantic City to Woodbridge, and then returned in a cab to Atlantic City to retrieve her Nissan Pathfinder.

April 30: Melanie McGuire seeks a temporary restraining order against her husband in New Brunswick, but does not tell the family court judge about the gun purchase, or the location of her husband's car in Atlantic City.

May 2: An E-ZPass transponder in Melanie McGuire's Pathfinder registers a hit on the Atlantic City Expressway at 12:54 a.m. At 1:10 a.m. a call is made on William's cell phone to the Woodbridge apartment.

May 4: Melanie McGuire tells friends in taped conversations that she goes to Delaware, to shop for furniture in a state without a sales tax. The state will argue she went to Delaware en route to the Chesapeake Bay.

May 5: The first Kenneth Cole-brand suitcase containing body parts is found by a fisherman on an island near Chesapeake Bay Bridge-Tunnel.

May 8: McGuire's Nissan Maxima is towed from the Flamingo Hotel, when hotel employees learn the car is not owned by any of its guests. Police later find a prescription bottle of chloral hydrate in the glove compartment in the name of an Old Bridge woman, and later investigators find bits of human tissue that matched William McGuire's DNA.

May 11: The second suitcase containing body parts is spotted on shore of Fisherman's Island, on Virginia's Eastern Shore.

May 16: Boater finds third suitcase floating in waters off a second island in the bay.

May 17: McGuire, due back at NJIT after a two-week vacation, does not show up. His wife calls to ask if the office has heard from her husband.

May 21: Police in Virginia Beach release sketch of murder victim found in suitcases. After a Navy buddy suggests the victim was William McGuire, his fingerprints match those on file with Virginia authorities.

May 25: Melanie McGuire files for divorce.

May 26: Barnegat Township Patrolman Richard Nowak notifies Melanie McGuire of her husband's death.

Late May: Friends help Melanie McGuire empty the Woodbridge apartment on Memorial Day weekend.

June 3: Two investigators from Virginia and two from Woodbridge meet with Melanie McGuire and her two attorneys at the Wilentz, Goldman & Spitzer law office in Woodbridge.

September: The New Jersey Attorney General's Office takes up the murder investigation after Virginia Beach detectives determine McGuire likely was killed in New Jersey.

March 12, 2005: Detectives confront Miller at his Morristown office, and inform him investigators are aware of his sexual relationship with Melanie McGuire.

June 2: Melanie McGuire is arrested and charged with first-degree murder in her husband's death.

June 7: McGuire is released on $750,000 bail.

Oct. 9: An American Express gift card is purchased at Rite Aid in Passaic, to be used for FedEx postage for a package sent from Clifton.

Oct. 11: The FedEx package, addressed to Assistant Attorney General Patricia Prezioso, includes keys, jewelry and a note marked "Set Her Up." A letter in the box says the items were found in a waste basket at the real estate office where William McGuire's sister Cindy Ligosh works, and implicates Ligosh.

Oct. 12: McGuire is indicted on charges of murder, desecration of a corpse, perjury and a weapons violation. She pleads not guilty.

Oct. 31, 2006: McGuire indicted on additional charges of hindering prosecution, tampering with evidence and filing false reports, but remains free after posting additional bail, for a total of $2.1 million. Authorities say McGuire wrote anonymous letters to throw detectives off her trail. She pleads not guilty.

March 5, 2007: McGuire's murder trial begins in state Superior Court in New Brunswick before Superior Court Judge Frederick DeVesa.

April 12: After nearly six weeks of testimony, the defense rests. Outside the presence of the jury, Melanie McGuire declines the opportunity to testify, telling the judge, "I wish to remain silent."

April 16: After six weeks of testimony two jurors are unable to reach the courthouse, due to extensive flooding in Middlesex County. Fourteen remaining jurors listen to Joseph Tacopina's closing argument. Time does not allow Prezioso to present her closing argument.

April 17: Prezioso presents her closing argument. Both the state and the defense agree having an extra night to prepare is an advantage for the state. Judge DeVesa gives his instructions to the jury, and pares the panel down to nine women and three men.

April 18: The jury deliberates for six hours.

April 19: The jury deliberates for four and a half hours.

April 23: Melanie McGuire is found guilty of murder, desecration of human remains, gun violations and perjury. She is found not guilty of four lesser charges. Bail is revoked by DeVesa and sentencing is scheduled for July 13. The defense will have 45 days following sentencing to file a notice of appeal.

In the GQ article Joe T. claims the following:

"I got the greatest case last night," says Joe, handing money to the toll clerk at the tunnell.  "Did you read about that woman who was in the papers yesterday?  She hired me last night." Pause for effect. "A 34 year old woman taking the Path train home from the city.  Office party.  She takes the train home, gets off, is drunk.  Goes to her car.  Two Jersey transit cops basically convinced her to follow them.  She says, "No, I'm just gonna sleep it off in the car."  They go, 'No, no we'll escort you home, don't worry about it, follow me.'  She follows the cop car.  They make her get into a car drunk, first of all....." He is building the case in his head.  "Then they say, 'Follow us.' And they make a left, and they turn into a lot, and they rape her.  Two cops.  This is a great case."

A New Jersey woman has been found guilty of killing her husband, and putting his body parts into three suitcases. Melanie McGuire was found guilty Monday of killing her husband Bill back in 2004.

Her husband's body was dismembered. The suitcases were found near the Chesapeake Bay Bridge-Tunnel.

Jon and Susan Rice were able to identify Bill's body after a sketch appeared on the evening news.  A month later, police arrested Melanie. The Rices went to New Jersey and Jon testified at the trial.

"I still to this day when I talk about it I get choked up," said Jon Rice.

Jon and Susan Rice were best friends for more than a decade. Jon was even best man and Bill and Melanie McGuire's wedding eleven years ago. When Bill disappeared, Susan recognized a sketch of Bill on the evening news. A month later, Melanie was under arrest.

"Melanie never wanted to know who did this who could have taken my best friend and cut him off at the knees," said Jon.

The Rices spent three days in New Jersey during Melanie's trial, with Jon providing testimony connecting Melanie to one of Bill's dumbells, a dumbell that he regonized from Bill's basement.

"Because one of the weights was in the suitcase. It was in the second suitcase," Susan Rice said.  

"He was number 59. In a whole list of people who were testifying. Finally he gets up on the stand. He's still emotional and finally she sheds a tear," Susan said.

Jon and Sue haven't spoken to the petite mother of two since Bill's funeral. But they were in the courtroom for closing arguments, and are happy that justice has been served.

"I wanted it so bad. I thought I'd be happy when the verdict came in, but it didn't make me happy," Jon said.  "Bill was a good guy who didn't deserve what he got. He was a truly good guy."

The McGuires two children now live with Bill McGuire's sister. Melanie will be sentenced in July. She faces thirty years to life.
