There is no change in law, a federal judge gave an opinion in one guy's case that the DP was unconstitutional & it is working its way up the ladder in appeal.

And I think it was over a technicality in his case.

There is no change in law, a federal judge gave an opinion in one guy's case that the DP was unconstitutional & it is working its way up the ladder in appeal.

And I think it was over a technicality in his case.

It is more to the instruction of what a judge can do in a DP case after a jury verdict.   Basically, that a judge cannot recommend death over the jury's majority not to but he/she can take it off the table if they did recommend it
