(CNN) -- The meter reader who discovered Caylee Anthony's remains could testify Tuesday as a defense witness in the murder trial of her mother Casey, his attorney said.

Roy Kronk has been ordered to report to court at the start of the day, according to lawyer David Evans.

In his opening statement, Casey Anthony's attorney Jose Baez pointed the finger of responsibility at Kronk, who discovered Caylee's body on December 11, 2008, according to a sheriff's detective.

According to the defense, Kronk actually discovered the remains months earlier, then manipulated them for his own selfish goals. Baez called Kronk "a morally bankrupt person who took Caylee's body and hid it ... he thought he had a lottery ticket. ... He can't be ignored in this."

Evans denied the accusations made by Baez.

Casey Anthony trial: After long day and variety of witnesses, defense to continue presenting case today

After calling an array of witnesses in what ended up being a nearly 11-hour workday Monday, Casey Anthony's defense team will continue presenting its case this morning.

It's unclear who the defense will call, but meter reader Roy Kronk, credited with discovering the body of Anthony's toddler daughter, may be called to testify today.

On Monday, the defense team called Sheriff's Office detectives, two private investigators who worked for the Anthony family, and a decomposition expert.

The defense team on Monday also filed a motion asking Chief Judge Belvin Perry to declare a mistrial, citing a recent federal court ruling on a South Florida case that said the state's death penalty statute is unconstitutional.

The defense wants Perry to hold a hearing on the issue, order the prosecution to file a memorandum of law on the issue and protect Anthony's due-process rights by declaring the statute unconstitutional.

i never heard this competency thing explaines as well as i did this morning...i think what has happened is Casey does want to testify and maybe mumbles didnt want her to so he ordered a competency hearing for her. i bet he doesnt want her to testify but bozo does and she does could be why mumbles is on the outs.

I had a different thought on that.  I think they were hoping she would be found incompetent so that she would have a good excuse for NOT testifying.  They would not need to explain their stupid opening statements then.  I'm probably wrong but that was my initial thought.  I rarely have rational thoughts so I thought I'd run with this one.  JMO

I thought tge reason they went late last night was bc of Finnell's schedule. I thought the Defense said she couldn't be there today?
