Okay, I totally get what he is saying.  However, isn't viewing pictures and video the same thing.  Does using their vision to inspect evidence make them a witness?  Just saying, everyones experiences are different.  I think the jurors should be able to use all of their senses to make a decision and the decision should be made by them.

There is carpet from the trunk in the cans with the decomp and they have been brewing anaerobically for 3 yrs   

I'm pretty sure I wouldn't want to smell it if I was a juror- what do you guys think?
Not me. I think only those who have smelled human decomp should smell the cans. Others wouldn't know what they are smelling.

I think they should ALL smell the cans, whether or not they are familiar with decomp or not. Each juror brings a background to the jury, including personal experience, education, knowledge and a thought process. I suspect for some jurors, the computer forensics may have been confusing and many here have said the IT guy on the jury can help explain that to them should questions arise during deliberations....They probably never killed anyone, but they're there to decide, based on facts whether or not KC did.

If the cans don't get in, I think it's because JP fears it would become an appeal issue...

if i was a juror and had never smelled death, i wouldn't have anything to compare it to so even though i guess it would smell really really bad i wouldn't know it was necessarily death unless someone who had smelled it told me that it was.  does that make sense.  i wouldn't want to really b/c it wouldn't tell me anything.

Ya, I would hate to have to.  They might need to air out the room for awhile if they do it....    Just thinking about what they would be smelling crushes my heart!!!!

I would smell it.  I would want access to all evidence to make a fair decision especially a DP case. 

But I understand the state's position as well.  What if a juror is traumatized for life in our sue me sue you world it happens.

but if they haven't smelled it and one juror has, they would all look to that person and say is that it - and that juror would tell them yes.  The juror would thus be testifying about the evidence and the defense couldn't question him about it.  I think it was a really really good ruling.

He wasnt rude, he realized Ashton thought he was going to ask him something. 

He never tells Bozo to sit down though. 

we've noticed that over here too and I wish JP would tell bobo just one time! Just once! he is disrespectful to the judge and interrupts and does all kinds of crap and gets away with it over and over. 

I can't put my husband off anymore...off we go swimming.

grrrrrrrrrrrrrr..........why can't it be opened and ask them if it smells like trash! It does not, so they can simply say among themselves, it is not trash/garbage and move on. This pisses me off.
