Del Sobonya will Introduce Caylee's Law in WV
July 8, 2011

HUNTINGTON, WV (HNN) – Cabell County Delegate Kelli Sobonya, along with Del. Carol Miller, will sponsor a “Caylee’s Law” bill at the opening of the January 2012 West Virginia legislative session. The bill would make it a felony for parents or guardians to not report a missing child to law enforcement in a timely manner.

Following a seemingly shocking jury verdict in the Casey Anthony case, Delegate Kelli Sobonya, a Republican representing West Virginia’s 16th district, plans to introduce “Caylee’s Law” to the Legislature in the 2012 session.

Anthony was charged in the 2008 murder of her 2-year-old daughter, Caylee. On July 5, a jury in Orlando found her not guilty of first degree murder and aggravated child abuse, but guilty on four counts of providing false information to law enforcement. Anthony also failed to report her child missing for a month. Sobonya said Caylee’s Law would make it a felony for a parent or guardian to not report a child missing in a timely manner. “Its very important that (missing children are) reported as soon as possible so law enforcement can issue an Amber Alert,” Sobonya said.

I got an email from Del. Jonathan Miller and www.LarryKump.us, both from WV, and both said they were seriously considering the bill.

Casey Anthony's July acquittal has West Virginia lawmakers considering a new criminal charge for failing to report missing children.

It proposes a 12-hour deadline to report when the child is under age 12, and 24 hours for older children.

Penalties hinge on the child's age. They would become more severe if failing to report endangers the child's health or is meant to conceal a crime.

The draft bill is meant for next year's regular session. Similar proposals have emerged in other states since a Florida jury acquitted Anthony in the death of daughter Caylee.

CHARLESTON — West Virginia lawmakers appear ready to stage a renewed effort to make it a felony to not let police know within 24 hours when a child 11 years old or younger turns up missing.

Known as “Caylee’s Law,” the proposal is in response to the celebrated case in Florida when Caylee Anthony died.

A lengthy trial that mesmerized the nation resulted in acquittal of the mother, triggering waves of protest and efforts in some states to tighten the law on reporting missing children.

Soon afterward, the Select Committee on Children, Juveniles and Other Issues unanimously approved a bill that would specify failure to report missing children by a parent, guardian or custodian as either a misdemeanor or felony offense, depending on the child’s age.

The panel’s chairman, Delegate Virginia Mahan, D-Summers, was unable to attend Tuesday’s interims meeting.

But counsel Joe Altizer left no doubt the issue Mahan strenuously pushed will be again on the agenda in this year’s interims.

One panelist, Delegate John O’Neal, R-Raleigh, strongly endorsed the measure, after Altizer’s presentation.

“The basic concept is that if an adult has knowledge that a child is missing, has been kidnapped, or taken from a parent, for some reason or another, that adult should be required to report that to the proper law enforcement authorities,” O’Neal said.
