SD Legislature Considering 'Caylee Anthony Law'

"We've proposed to the legislature basically a notice to law enforcement that a caretaker, if there's a 13-year-old child or younger missing within a 48-hour time period, they need to report that to local law enforcement or it's a misdemeanor," South Dakota Attorney General Marty Jackley said.

Jackley is bringing the bill forward to the state legislature because his office handled a case last year where a woman deserted her young child and it died.

"It has happened in South Dakota and we think it's appropriate to at least have that discussion," Jackley said.

The South Dakota law would not only require someone to report a missing child within 48 hours, but it would also require caretakers to report the death of a child within six hours.

"We've seen a case develop last year alone, and there are other examples where we've had circumstances that certainly if we had this in place it would assist law enforcement and protect children," Jackley said.

Protect children in South Dakota with a law inspired by a high-profile case out of Florida.

The South Dakota bill is scheduled for its first hearing in the Senate Judiciary Committee Tuesday morning in Pierre.

SD's Caylee Anthony Law Has First Test

SIOUX FALLS, SD - This week’s arrests following the death of two-year-old RieLee Lovell are the first since a new South Dakota Law makes it illegal not to report a child's death.
The law went on the books officially July 1. Authorities believe Lovell died July 3. But, her body was not discovered until July 4.

While debated in Pierre last session, it was known as Senate Bill 43. But it's commonly known as South Dakota's Caylee Anthony Law, named for the Florida girl who went missing in 2008 and who's mother, Casey Anthony, didn't report the disappearance for 30 days.

SIOUX FALLS, S.D. (AP) — A defense lawyer for a South Dakota woman charged under the state's new child death reporting law says it's unconstitutional because it violates his client's right against self-incrimination.

It's one of the first attempts to question the validity of the new child death reporting laws that have been passed by several state legislatures following the high-profile death of 2-year-old Caylee Anthony in Florida.

Laurie Cournoyer and her husband, Taylor Cournoyer, 21, are charged with failing to notify police of the death of a 2-year-old girl found in a closet at their rural South Dakota home. They also face five counts of child abuse and drug charges. The Cournoyers are accused of using sleeping pills, methamphetamine and marijuana during the day and a half in July when the child's death still hadn't been reported.
