wouldn't there be a video of Judge Strickland sentencing Casey which would say about the probation starting after she was released from jail?

I would think there would be Cookie, everything I believe was streamed live, even the check charge things. I may be wrong though.

Sheaffer believes the Florida Supreme Court could be asked to settle the score, but he says the Supreme Court is clear on another issue pertinent to Casey's probation debate: double jeopardy.

"You can't be punished twice for the same crime. So to say that she may have completed her probation, but 'I didn't mean for her to start her probation,' well she completed her sentence," Sheaffer stated.

Casey left prison last month after a jury acquitted her of murdering her 2-year-old daughter, Caylee. She was convicted of lying to detectives but released from jail because of time served. She has since disappeared from public view.

The court order said Casey must report to a probation officer in three days in Orange County, where Orlando is located, unless otherwise instructed by her probation officer.

A spokeswoman for the Florida Department of Corrections said the arrangements for Casey's first meeting with a probation officer were being worked out with her attorneys and she didn't know if it would occur in the Orlando area.

No probation officer has been assigned to her yet, said spokeswoman Gretl Plessinger. "We're working now on that first reporting visit now," she said.

The probation order requires that Casey avoid any contact with her friend, Amy Huizenga, and prohibits her from switching addresses or jobs without permission from her probation officer. Under the terms of the order, she can't own a firearm without her probation officer's consent, is prohibited from getting drunk or going to places where illegal drugs are being used and has to find a job. Casey also would have to take regular drug tests and is prohibited from associating with criminals under the order's terms.

Sheaffer said if the Court of Appeals takes the case, the judge's order will be on hold.

Orange Circuit Judge Stan Strickland just signed amended court documents this morning that he says will have the effect of requiring Casey Anthony to serve one year of supervised probation as he originally intended back when he sentenced her in her check fraud case.

"From my reading of this, she should be reporting to probation in Orlando probably within 72 hours," Strickland said. "I suspect she's going to be required to report to probation."

Confusion lingered Friday over whether Casey Anthony should have to serve a year of probation in her check-fraud case now that she is out of jail.

Strickland said on Thursday that his intention in sentencing Anthony last year was that she should go on supervised probation if released from custody. But state Department of Corrections officials interpreted Strickland's order as meaning that Casey Anthony could serve her probation while still in jail awaiting trial in connection with the 2008 death of her daughter Caylee Marie.

remember when we were so relieved when Perry took over from Strickland because we thought that Perry would be the tougher judge? boy were we wrong! soooooo disappointed in Judge Perry...thank goodness Judge Strickland stepped up to the plate!

I knew nothing about either of these two jurists [ Strickland or Perry ], but was actually sorry that Strickland felt as though he had been placed in such a position by unforeseen circumstances, [ albeit innocent in my view ], to disengage himself from this case.  I was so impressed by his early, very candid and very clear statement for the world to hear, paraphrasing: "That Casey Anthony and the truth are strangers."   Wow---what a bulls-eye & gutsy summation!

I was thinking that even though I liked him that he might have been too pandering to the defense team...and that Judge Perry would be a lot tougher and stricter..boy was I wrong!

In documents filed Monday, Strickland amended the January 2010 hearing minutes to state that probation is to be served “upon release.” Probation officials had said last week that they would be able to supervise Anthony if such a clarification were filed, and according to the Orlando Sentinel, they have now been in contact with Anthony's attorneys about setting up her first meeting.

Strickland's amended order stated that Anthony must report to the probation office within 72 hours.

Case notes released by the Department of Corrections show that probation officials were in contact with Anthony in Orange County Jail throughout the year after her sentencing. Still, a DOC spokeswoman told the Sentinel Monday that under Strickland's new order Anthony might be considered in violation of probation if she does not report.

In a statement to In Session's Jean Casarez, defense attorney Cheney Mason said that her attorneys would move to have Strickland disqualified from dealing with Anthony—as they did at one point during the murder trial, leading to the appointment of Judge Belvin Perry to handle that case. They will also seek to have the amended order set aside and vacated.

“From what I can see, it is a fraud,” Mason told Casarez. “...There was no notice, no motion, no hearing. We will be addressing that with all due speed and with aggression as the law, procedures, ethics and judicial cannons will allow.”

Local legal analysts' opinions were split Monday on whether the court has the jurisdiction to order Anthony back under supervision at this point. WFTV analyst Bill Scheaffer said the case could also present double jeopardy issues if Anthony has already served a year of probation.

WESH analyst Roger Hornsby argued Anthony should still be on probation, as Strickland's statements in open court during the sentencing hearing indicated was his desire.
