Judge: Zachary Adams to be treated same as other inmates; Prosecutors to begin turning over evidence to defense
June 5, 2014

DECATURVILLE — Judge Charles Creed McGinley said Wednesday that he expects Zachary Adams to be treated like any other inmate in the Chester County Jail.
 
Adams, who was not wearing a bullet-proof vest as he had for other hearings, was in Decatur County Circuit Court for a status hearing Wednesday.

The judge also heard motions filed by Adams’ attorney, Jennifer Lynn Thompson, who asked for the judge to consider granting Adams “standard access to jail visitation” including jail telephone privileges, and access to a pencil, paper, postage and “basic mail services.”

The motion said Adams has had only limited access to the front desk telephone to talk to his attorney. Adams, who is being held without bond, also has only been able to visit with family at the request of his attorney, Thompson said in her motion.

Chester County Sheriff Blair Weaver said, according to the motion, that Adams has been held under the rules of the Tennessee Bureau of Investigation, which has been investigating Bobo’s disappearance since she was abducted in April 2011.

“I don’t want him treated any differently,” McGinley said during Wednesday’s hearing.

Prosecutors argued that Adams should not have the requested privileges in part because he has been charged with trying to coerce a witness in the case. Prosecutors allege Adams communicated a message to his brother to keep quiet about the Bobo case or “he will be in the hole beside her.”

Josh DeVine, spokesman for the TBI, said, “The District Attorney’s office requested, through TBI, that the sheriff not allow phone or mail privileges (for Adams).”

McGinley clarified after the hearing that he didn’t rule one way or another, just that Adams should be treated the same as the other inmates in regard to phone, visitation and other privileges.

“I don’t know what the rules are” at the Chester County Jail, McGinley said. “He just needs to be treated like any other inmate.”

Weaver could not be reached for comment Wednesday.

Adams has been placed in solitary confinement since his arrest. Weaver previously said this was to ensure Adams’ own safety.

The judge also ruled that Adams’ attorney will no longer be required to be present when his family visits him at the jail.

Thompson explained after court that being present for every visit is not only a burden for her, but if any comments were made that could incriminate Adams, she would then have to be a witness and couldn’t be his attorney, too.

Thompson also filed motions asking McGinley to make prosecutors give her any favorable evidence that pertains to her client’s guilt or innocence, including witness statements and search warrants. Thompson also wants the state to tell her what punishment may be imposed if Adams is found guilty at trial. Prosecutors have not ruled out the death penalty.

Prosecutor Beth Boswell said she is working to assemble the evidence, and she will disclose all that she must under the law.

Schedule
McGinley set a case schedule for Adams on Wednesday.

The same schedule was given last week to Jason Autry, 39, who is also charged with aggravated kidnapping and felony first-degree murder in Bobo’s disappearance. Autry also has pleaded not guilty.

McGinley reminded the court that Adams and Autry are not co-defendants and will be tried separately, as of now.

McGinley said he wanted the prosecution to give both defendants the prosecution’s evidence within 90 days.

The defense will then have 60 days to make pretrial motions, and the state will have 30 more days to respond.

He said there will then be 30 days for judicial review.

McGinley said this is a longer schedule than normal due to the “unusual complexity” and length of the investigation.

McGinley also told prosecutors not to wait until the end of a court-ordered 90-day period to hand over evidence they have already gathered.
 
Prosecutors and the TBI has released few details about their investigation. Bobo’s body has not been found, but TBI investigators have said they believe Adams and Autry were involved in kidnapping and killing her. The TBI has said it has witnesses who saw Bobo alive with the two men after she was abducted from outside her home in Darden.

ding, ding ding!   

   These scum just refuse to get it, they lost their rights to a certain extent when they abducted, murdered (God knows what else) a young beautiful woman along with all their other crimes that had put them in the hole countless times before.   I mean, what does he expect to happen after he threatened someone or for that matter Autry who is constantly acting out.   If I were in charge of the jail, Id take the same strict restrictions according to the law available to me as well....they are dangerous & cannot be trusted.

Is Adams's attorney a nitwit who cheated to pass her bar, does she really have to ask what his possible punishment is lol, come on now.   Hello, earth to Thompson, your client as been charged with aggravating kidnapping & felony first degree murder....read the statutes!

@ .50 is john dylan adams, i thought i had seen his face b4, in
the search footage vids of holly, but couldnt find it, but did find
an older vid about the search and the evidence found, wonder
if the perps left dna or prints on any of the evidence

On Monday, Officials would not say to which case that video was connected.

Jeffrey Kurt Pearcy was currently being held in Henderson County without bond.

NewsChannel 5 also obtained court documents from Decatur County, which suggested another man, Mark Lynn Pearcy, may have also appeared in that video.

The Tennessee Bureau of Investigation has said two more men have been arrested and charged as accessories in connection with the kidnapping and murder of Holly Bobo.

The brothers were arrested on May 29.

Mark Pearcy and Jeffrey Kurt Pearcy have been charged with tampering with evidence and accessory after the fact, according to TBI spokesperson Josh DeVine.

DeVine wouldn’t comment further on what the evidence is or the circumstances around the charges.
 
Investigators believe that Jeffrey Pearcy has possession or has knowledge of where the video is, according to the affidavit.

The affidavit states that Jeffrey Pearcy is an “accessory after the fact due to his conduct concerning the concealment of evidence into the investigation.”

Tampering with evidence is a Class C Felony and accessory after the fact is a Class E Felony.

Jeffrey Pearcy, 42, is currently being held in Henderson County without bond.

Mark Pearcy was transferred from Decatur County to Carroll County last week and is also being held without bond.

Mark Pearcy is not being represented by Baker.

According to online records, Mark Pearcy registered as a sex offender in 2000 for statutory rape.

Both men are expected to be in court tomorrow morning for their arraignments.

NASHVILLE, Tenn. - Two men from Henderson County have been arrested in connection to the Holly Bobo case, NewsChannel 5 confirmed on Tuesday.
 
On Tuesday his attorney, Olin Baker, confirmed the arrests are connected to the kidnapping and murder investigation of nursing student Holly Bobo. He said the charges are related to the possible existence of a video which shows Holly after she was taken from her home in Decatur County three years ago.

"They’re saying there’s either a recording or audio or something on an electronic device that relates to the Holly Bobo case," Baker told NewsChannel 5 on Tuesday.

Baker said his client denies such a video exists.

"He (Jeff) says there’s no truth to it, no video, he’s been questioned on it by TBI and they’re out on hearsay making arrests. This is a warrant based largely on hearsay it looks to me like a police tactic to try to make an arrest and they are trying to rattle some evidence loose... the TBI is on a fishing expedition," he added.

Jeffrey Kurt Pearcy, 42, was currently being held in Henderson County without bond.

"At the end of the day there’s probably no evidence that exists. (Jeff) never met her, never met Holly Bobo. I don’t think he has any connection to the Bobo case," attorney Baker said.

NewsChannel 5 also obtained court documents from Decatur County which suggested Mark Lynn Pearcy, may have also appeared in that video.

We continue our work to follow the leads wherever they might lead. We won’t stop until we find a sense of justice and closure for the family and friends of Holly Bobo.”

what the ____ is going on, was this a case of drunken boasting or ??

i ran across another img of one of the perps Jason Wayne Autry, 
this img looks like someone i saw in the search footage too
maybe over wknd i can get time, to look at some old footage of the
searches, just to see if im seeing things

The Tennessee Bureau of Investigation said two men have been arrested and charged as accessories in connection with the kidnapping and murder of Decatur County nursing student Holly Bobo.

Jeffrey Kurt Pearcy and Mark Pearcy, who are brothers, are charged with tampering with evidence and accessory after the fact, said TBI spokesman Josh DeVine. The brothers were arrested on May 29.
 
According to an affidavit filed in Henderson County court, investigators believe Jeffrey Pearcy has “shown a visual recording on an electronic device to an individual. According to the witness, this visual recording shows information that will prove to be beneficial in the prosecution of a current ongoing investigation being conducted by the Tennessee Bureau of Investigation.”

Investigators believe that Jeffrey Pearcy has possession or has knowledge of where the video is, according to the affidavit. The affidavit does not describe the contents of the video.

The affidavit also doesn’t mention Bobo by name, but Pearcy’s attorney said the ongoing investigation referred to is the Holly Bobo investigation.

Jeffrey Pearcy’s attorney, Olin Baker, said the charges and claims against his client are untrue.

“The allegations against Mr. Pearcy are absolutely untrue, and we look forward to our day in court,” he said in an email statement to The Jackson Sun.

The affidavit states that Jeffrey Pearcy is an “accessory after the fact due to his conduct concerning the concealment of evidence into the investigation.”

Tampering with evidence is a Class C felony, and accessory after the fact is a Class E felony.

Jeffrey Pearcy, 42, is being held in Henderson County without bond.

Mark Pearcy, 38, faces the same charges. He was transferred from Decatur County to the Carroll County Jail last week and is also being held without bond.

Mark Pearcy is not being represented by Baker, and it was unknown Tuesday if he has an attorney.

According to online records, Mark Pearcy registered as a sex offender in 2000 after being convicted of statutory rape. He lives in Decaturville, according to the records.

Both men are expected to be in court this morning for their arraignments.

The TBI says brothers Mark Pearcy and Jeffrey Pearcy have been charged with tampering with evidence and accessory after the fact in connection with the case.

According to the affidavit, the TBI says Jeffrey Pearcy showed a visual recording on an electronic device to someone and that this recording "will prove to be beneficial in the prosecution of a current on-going investigation being conducted by the Tennessee Bureau of Investigation."

Jeffrey Pearcy is believed to have possession of the recording or knows where it is, according to the affidavit.


Jeffrey Pearcy is being held in Henderson County and his arraignment is set for Wednesday morning.
