LEXINGTON, Tenn. – One of two new suspects charged in connection with the disappearance of nursing student Holly Bobo has appeared in court for the first time.

Jeffrey Kurt Pearcy, age 42, was charged with tampering with evidence and accessory after the fact. He appeared before a judge in Henderson County Wednesday morning.

He was seen walking into court in a pink prison jump suit, with his hands and feet shackled.

The judge entered a plea of not guilty on his behalf. Bond was set at $25,000, with a requirement that Pearcy wear a GPS tracker on his ankle at all times.

A second court appearance was scheduled for July 1 at 1 p.m.

Court documents obtained by NewsChannel 5 from Henderson County showed that Pearcy was arrested on May 29.

The affidavit said he has a video on an electronic device, "that will prove to be beneficial in the prosecution of a current on-going investigation being conducted by the Tennessee Bureau of Investigation."

Pearcy was told not to have any contact with a witness who reported he had seen video evidence.

Pearcy was told not to have any contact with a witness who reported he had seen video evidence.

Also charged was Pearcy’s brother, Mark Lynn Pearcy.

Attorney Olin Baker said the charges were related to the possible existence of a video which shows Holly after she was taken from her home in Decatur County three years ago.

"They’re saying there’s either a recording or audio or something on an electronic device that relates to the Holly Bobo case," Baker told NewsChannel 5 on Tuesday.

Baker said his client denies such a video exists.

"He (Jeff) says there’s no truth to it, no video, he’s been questioned on it by TBI and they’re out on hearsay making arrests. This is a warrant based largely on hearsay it looks to me like a police tactic to try to make an arrest and they are trying to rattle some evidence loose... the TBI is on a fishing expedition," he added.

NewsChannel 5 also obtained court documents from Decatur County which suggested Mark Pearcy, may have also appeared in that video.

Mark Pearcy was arrested on May 29 and also charged with Accessory After the Fact and Tampering with evidence. Those documents showed that, according to a witness, Mark Pearcy was identified as being in that video when it was recorded but officials would not comment on the content of the video.

Mark Pearcy was transferred from Decatur County to Carroll County last week, where he has been held without bond.

DECATURVILLE — An affidavit filed in Decatur County General Sessions Court against Mark Lynn Pearcy says that a witness who knows Pearcy has seen a video connected to the Holly Bobo case. The witness who watched the video believes a voice on the recording is Mark Pearcy’s, according to the affidavit.

Mark Pearcy and his brother Jeffrey Pearcy are both charged with accessory after the fact and tampering with evidence in the Holly Bobo murder and kidnapping investigation, according to the TBI.

The affidavit does not mention Bobo by name but says the video referred to “shows information that will prove to be beneficial in the prosecution of a current ongoing investigation being conducted by the Tennessee Bureau of Investigation.” A TBI spokesman confirmed that the charges are related to the Bobo investigation.

The affidavit does not describe the content of the video.

The witness who spoke to TBI investigators has known Mark Pearcy for about 17 years, according to affidavit.

The court document states that Jeffrey Pearcy told the witness about the video, and that Jeffrey Pearcy then left the witness’s home and went to see Mark Pearcy. Jeffrey Pearcy returned to the witness’s home with the video, and used an electronic device to show the video to the witness, the affidavit says.

The witness made a statement to the TBI on May 29 that led to the arrest of the Pearcy brothers, the affidavit says.

Investigators believe the two men have possession of the video or know where it is, according to court documents.

Jeffrey Kurt Pearcy, 42, was arraigned this morning in Henderson County General Sessions Court. At this morning’s hearing, Pearcy pleaded not guilty. His bond was set at $25,000, and he was ordered to wear a GPS ankle bracelet if released on bond from the Henderson County Jail. His preliminary hearing has been set for 1 p.m. on July 1.

Nothing was said during today’s court hearing that alluded to the contents of the video.

Mark Pearcy, 38, was charged in Decatur County but was being held in the Carroll County Jail. He was arraigned earlier this week, and his bond was set at $65,000. He also has pleaded not guilty.

The court did not have a record of whether Mark Pearcy has an attorney.
 
According to online records, Mark Pearcy registered as a sex offender in 2000 after being convicted of statutory rape. He lives in Decaturville, according to the records. Jeffrey Pearcy does not appear to have a prior record in Henderson or Decatur counties.

Authorities have made two additional arrests in the ongoing investigation into the disappearance and murder of nursing student Holly Bobo.

Jeffrey Pearcy, 42, was arrested in Henderson County on May 29 on charges of tampering with evidence and accessory after the fact. His brother, 38-year-old Mark Pearcy, was arrested on the same charges two days later, on May 31, in neighboring Carroll County.

Neighbors told Nashville’s News 2 investigators searched an RV and property where Mark Pearcy was living prior to his arrest.

A warrant obtained by News 2 states that Jeffrey Pearcy “had shown a visual recording on an electronic device to an individual.” The recording “has information that will prove to be beneficial in the prosecution of a current ongoing investigation” by the TBI.

Witnesses said Mark Pearcy’s voice can allegedly be heard on the recording.
 
Jeffrey Pearcy’s lawyer, Olin Baker, told News 2 the affidavit is inaccurate and his client’s position is that he has neither seen a video with Holly in it nor does one exist as far as he knows.

He added as far as he knows, his client does not know Zachary Adams or Jason Autry, the two other men charged in the case.

"He's not guilty," Baker said. "I'm just interested to see what their theory is or what evidence they think exists."
 
Mark Pearcy is in custody at the Carroll County jail on a $65,000 bond. He appeared in court on June 9.

News 2 learned Mark Pearcy also has other charges unrelated to the Holly Bobo case for unlawful possession of a weapon and sex offender registration violation. He was convicted of statutory rape with a prior conviction in October of 2000 and recently failed to update the registry with a new address, resulting in the violation charge.

He is scheduled to appear in a Decatur County court for a preliminary June 16.

(WMC) - Two additional men have been charged in connection to the case of missing Tennessee nursing student, Holly Bobo.

Brothers Mark and Jeffrey Pearcy have been charged with tampering with evidence and accessory after the fact. Authorities are not releasing information about the evidence that led to the charges.
 

Jeffrey Pearcy, who has to wear an ankle monitor, went before a judge Wednesday, and he pleaded not guilty. According to his attorney, Jeffrey was asked if he was forwarded or emailed a video of Holly Bobo. The attorney says his client has never seen a video of Bobo.

At age 24, Mark Pearcy pleaded guilty to having sex with a 14-year-old and is now on the state sex offender registry.


It's unclear why, after three years, this alleged video is now being acknowledged. It's also not known if the Pearcys knew Zachary Adams and Jason Autry, who have already been charged with kidnapping and murder in connection with Bobo's disappearance from her Darden, TN, home she shared with her family in April 2011.

Both Mark and Jeff Pearcy have pleaded not guilty and both have bonded out of jail. Jeff Pearcy has to wear an ankle monitoring system while out on bond. His bond was set at $25,000.

My bolded blue.  I think this is a mistake.  I believe Mark Pearcy is still in custody and hasn't bonded out.  He has a $65,000.00 bond.
