New court documents reveal a major unanswered question in the Holly Bobo murder investigation.

Channel 4 obtained the new indictments handed down Wednesday after Dylan Adams was charged with murder.

The indictments appear to indicate investigators may not know when Bobo died.

The paperwork states Dylan Adams, his brother Zach Adams and Jason Autry kidnapped, raped and murdered the nursing student sometime between the date she went missing in April 2011 and the date her skull was found more than three years later

Holly Bobo Case: Prosecutors Will Seek Death Penalty for 3 Murder Suspects


The state of Tennessee plans to seek the death penalty against three men charged with the kidnapping and murder of nursing student Holly Bobo, prosecutors told a judge Wednesday.

The suspects — Jason Wayne Autry and brothers Zachary Rye Adams and John Dylan Adams — were Indicted last month on charges of first-degree murder, rape and kidnapping.

They pleaded not guilty in Decatur County court on Wednesday, NBC affiliate WSMV reported.

Defense Attorneys Receive Full Access To Evidence In Holly Bobo Case

NASHVILLE, Tenn. - All of the evidence in the Holly Bobo murder case is finally on the table. Defense attorneys now have full access to the criminal file completing a big step toward setting a trial date.

There is said to be an entire room at Tennessee Bureau of Investigation headquarters dedicated to evidence collected in the Bobo case over the past four years. The evidence is the heart of the capital cases now pending against three murder suspects.
 
A status hearing is set for August and it's expected defense attorneys will ask for at least four months to review the discovery with an eye toward a possible December trial.

The case has been quiet over the last few months since charges were brought against Dylan Adams in May.

There had been complaints against the district attorney’s office from the defense, saying they had not turned over any evidence in the case.

DECATUR COUNTY, Tenn. -- A hearing originally set for next week for the suspects in the Holly Bobo case has been canceled.

Judge Creed McGinley says he doesn't have a new date for Dylan Adams, Zach Adams and Jason Autry because no motions are set to be heard at this point in the case.

Court officials say the defense is going through a lot of information.

McGinley says a teleconference will be held next Friday to determine a hearing date.

An important hearing in the Holly Bobo murder case has been postponed.

FOX13 has learned the reason is defense attorneys have now received lot of material they have been waiting on for a long time.

The judge said his office has received the evidence prosecutors collected from investigators.  All of that evidence is supposed to be turned over to the lawyers representing the defendants charged in Bobo's murder.

The evidence has been described as "a voluminous case file" by Special Prosecutor Jennifer Nicholas.

A conference call has been set for September 30 to determine if all the lawyers are ready to file motions in the case.  No trial date has been set

New Development In Holly Bobo Case Could Fast-Track Trial

The evidence in the Holly Bobo case is so voluminous that the attorneys may need help to get through it all. A proposed plan would hire one person to review and organize it for all the defense teams.

A new development could help fast-track a trial for the three accused murderers and jumpstart prosecution of this high-profile case.

A key issue is the sheer amount of evidence in the case collected after the past four years.

"It's my understanding the state's evidence is extremely voluminous," said NewsChannel5 Legal Analyst, Nick Leonardo.

The sheer volume of it all may be the single largest barrier keeping this case from moving forward. Prosecutors have charged three men: Zack Adams, his brother Dylan and Jason Autry with the kidnapping and murder of Holly Bobo in 2011.

It's been more than a year since the first arrest. They wait behind bars, but still have no trial date.

"If you have 30-thousand pages of documents to review it takes some time," said Leonardo.

There's more than just documents. There's photographs and forensic test results on everything from a skull prosecutors say belongs to Holly Bobo to hair fibers found in Zack Adams' home.

Leonardo said it is also death penalty case, which means even more lawyers are on board reviewing the case.

It's an incredibly slow process, but a proposal could speed it all up. One person would be hired to review and organize the evidence for all the defense teams.

Trial for murder of Holly Bobo won’t be heard in 2016

DECATURVILLE — Attorneys representing the suspects charged in the murder of Holly Bobo met with a judge Wednesday to talk trial dates. Judge Creed McGinley said the case will not be heard in 2016 due to a voluminous amount of discovery, including a potential witness list of more than 600. “I did not anticipate this being tried before 2017,” McGinley said. “I want to try this case once and do it correctly.”
 
The next status hearing in the case has been set for 10 a.m. March 2.

Bobo disappeared in April 2011. She was 20.

DECATURVILLE, Tenn. - The State has filed a motion to sever the cases against three men charged in the kidnapping and murder of Holly Bobo. 

If granted, the motion would separate the trial of Zach Adams and Jason Autry from Zach's younger brother, Dylan. The younger Adams would be tried separately from the other two men.

Defense attorney in Holly Bobo case suspended

John Herbison, a Montgomery County attorney who has represented Jason Autry on charges related to Holly Bobo's death, has had his law license suspended for two years, according to the Board of Professional Responsibility.

Herbison was suspended Tuesday, according to the board's website.

Herbison will not be allowed to practice for 60 days, according to a release by the Board of Professional Responsibility. For the remainder of the suspension he will be able to practice but a monitor must observe his work.
 
Autry's former attorney Fletcher Long lost his law license in September 2015.

It is currently unknown if Herbison's suspension will impact the Holly Bobo case.

Autry is also represented by James Simmons, an attorney in Hendersonville, in Sumner County.

Autry is charged with premeditated murder, and murder in the perpetration of aggravated kidnapping and aggravated rape in the death of Holly Bobo. Zachary and Dylan Adams are co-defendants in the case.

DECATUR COUNTY, Tenn. — Five years ago Wednesday, a nursing student from Decatur County went missing. Investigators said hunters found Holly Bobo’s remains more than three years later. The three men accused of killing Bobo now face the death penalty.

“It still seems not real,” Angie Britt, a friend of the Bobo family, said. “You know, you can’t imagine that five years ago today everything was OK.”

Pink and green ribbons line the court square in downtown Decaturville. “It’s just a reminder that we won’t ever forget what happened five years ago today,” Britt said.
 
Don Franks, pastor of Corinth Baptist Church in Darden, said the family takes it one day at a time. “It’s a tough day,” Franks said. “It’s tough on the family and the whole community.”

People in Decatur County said Bobo’s disappearance is something that changed their community. “Nobody in this community was untouched,” Britt said.

Brothers Dylan and Zach Adams along with Jason Autry are charged with kidnapping, raping and killing Bobo. They are expected to go to trial in 2017.

“We’re going to wait patiently,” Franks said. “Whatever it takes, however long it takes, we’re in it for justice for our beloved Holly.”
 
Judge Creed McGinley said in March he expects the three men charged with killing Bobo to go to trial April 3, 2017. The clerk’s office said the court is expecting a status update on June 1.
