NASHVILLE, Tenn. (WTVF) — Jason Autry, the third and final defendant accused of murdering Holly Bobo has finished a federal prison sentence for a different crime. But he'll remain in prison for now -- waiting to see if a plea deal will set him free.

Before he was arrested in the murder of Bobo, Autry was in prison on a federal gun crime. His eight year sentence on that crime is up.
 
But it may not be until late next year when the three state appellate court judges finally hear the appeal.

In the meantime, it looks like Autry will remain in prison. Prosecutors don't want to set him free until they know whether a new trial will be ordered. They know if there is another trial on appeal, Autry again will have to be called as a witness.

Any plea deal won't kick in until the legal process is complete.

NASHVILLE, Tenn. (WZTV) — The Tennessee Bureau of Investigation has been called to investigate an officer-involved shooting in Decatur County on Monday night.

According to preliminary information from the TBI, members of the U.S. Marshals Gulf Coast Regional Fugitive Task Force were trying to take someone into custody when shots were fired by deputy marshals. The incident happened in the 100 block of Gilbert Street in Parsons.

Fortunately, no one was struck by the gunfire.

The individual that U.S. Marshals were trying to take into custody, Anthony Phoenix, has now been booked into the Decatur County Jail. Sheriff Keith Byrd said this is the same man who testified against Zach Adams in the Holly Bobo murder trial.

In a June 26, 2020 interview with Judge Creed McGinley, the judge said that he will hear the appeal of Zach Adams on August 11th. Adams was convicted of killing Decatur County nursing student Holly Bobo in 2011, and was sentenced to life plus 50 years. Adams’ attorney, Jennifer Thompson, has filed his initial appeal asking for a new trial.

NASHVILLE, Tenn. (WTVF) — It seems the prosecution is finally ready to move into the final stage of the high-profile Holly Bobo murder case.

Zach Adams was convicted of killing Bobo in 2017. Now, I've learned his long-awaited appeal will go before a judge in just two weeks.
 
Autry, who was a star witness against Adams, remains locked up. But word is he cut a deal for his testimony at trial against Adams and that he will be released after Adams' appeal is heard. That will be the last step for the prosecution in this long, tragic case.

So, what happens with the appeal?

It will finally be heard by Judge Creed McGinley the second week in August. I'm told it's highly unlikely he'll grant a new trial. So, Adams will then turn to the 6th Circuit Court of Appeals, and that could take a few years.

If that happens, a plea date will be set for Autry, who will then very likely look at an early release on time already served.

Hardin County Judge Creed McGinley denied all motions by Zach Adams' attorney Tuesday, all but ending his attempts to avoid spending the rest of his life in prison for the rape and murder of Holly Bobo.

Adams was convicted in September 2017 and sentenced to life without parole plus 50 years after a jury found him guilty of eight counts, including first-degree murder, aggravated rape and aggravated kidnapping.

Adams' attorney originally requested a retrial in November 2017. The attorney filed 56 reasons for appeal in February 2020, arguing the setting of the trial "wasn't fair."
 
Following the Hardin County court's decision, Adams can now appeal his case to the Tennessee Court of Criminal Appeals.

Autry testified against Zach Adams, leading to his conviction for the murder of Bobo. If you believe Autry, he was there and participated. However, the prosecution needed his testimony and cut a deal in the case.

HARDIN COUNTY, Tenn. — Jason Autry was escorted into the Hardin County Courthouse Monday morning, to plead guilty to two counts related to the kidnapping, rape and murder of Holly Bobo.

“If the court accepts your plea, you plead guilty to facilitating especially aggravated kidnapping, count two you’d be pleading guilty to solicitation of murder one,” Judge Creed McGinley told Autry.

As part of the plea agreement, Autry would serve eight years for each count, and those would serve concurrent to one another. But, after taking into account time already served, it meant Autry would be released from prison later this week.

“He has plans to show that he can be a productive member of society, he’s very remorseful for what happened, and he wants to lead a good life,” said Michael School, Autry’s defense attorney.

Autry testified in 2017 against Zachary Adams. Zach Adams was sentenced to life in prison, while Dylan Adams plead guilty.

Without Autry’s testimony, prosecuting attorneys say the trial may not have gone the way it did.

“I cannot stress to you how extremely crucial that was into getting us answers and being able to try Zach Adams, being able to get a substantial guilty plea on Dylan Adams,” said Paul Hagerman with the Shelby County District Attorney’s Office.

Autry’s plea agreement effectively closes the saga of the Holly Bobo case, almost a decade after her disappearance and murder.

HARDIN COUNTY, Tenn. (WMC) - The Tennessee Court of Criminal Appeals has denied an appeal by a man convicted in the death of Holly Bobo to have his sentence overturned.

Zachary Adams was convicted in 2017 for first-degree murder, aggravated kidnapping and aggravated rape.

He is currently serving life in prison without the possibility of parole.

Zachary Adams history involves violent assault against own mother

Holly Bobo was a nursing student who disappeared from her home in Darden, Tennessee, in 2011.

Her remains were found in 2014.

Adams’ attorneys claimed nearly a dozen errors during his trial as grounds for a new trial.

The appeals court sided with the original trial court.

(AP) — As the star witness in the Holly Bobo murder trial, Jason Autry spoke in a calm, deliberative manner as an attentive jury listened to him recreate the day the kidnapped Tennessee nursing student was wrapped in a blanket, placed in the back of a pickup truck, driven to a river and shot to death by his friend.
 
Autry’s reversal was revealed in two petitions seeking post-conviction relief filed by Adams’ lawyer in Hardin County, where the trial took place. Adams, 39, wants his conviction thrown out based on Autry’s latest statements about the case that grabbed national headlines and frightened residents of Bobo’s quiet west Tennessee hometown of Parsons, about 120 miles (193 kilometers) east of Memphis.

“The record will ultimately acquit Mr. Adams based on Mr. Jason Autry’s complete and total recantation,” one of the petitions says.
