Aruba Murder Suspect Appealing Extended Jail Stay

Gary Giordano, the prime suspect in the disappearance of Robyn Gardner, plans to challenge an order by an Aruban judge to hold him in jail for an additional 60 days on the Caribbean island.

Giordano's attorney Michael Lopez plans to file the appeal by Monday, the Associated Press reported. An Aruban judge ordered that Giordano's stay in jail be extended on Wednesday.

If Giordano is forced to stay in jail, his time behind bars will be more comfortable than his first month. Giordano has a telephone, email, media and TV privileges. While he'll have no visitors, he is allowed two phone calls a day. It's a far cry from the unlimited use of his personal cell phone before he was arrested. His outgoing message still sounds upbeat.

Kyle Kingman:  Aruban divers deemed the cage to be not case related, and therefore Aruba had no interest in it.  At that point, I made the statement to all on board that we do have an interest and that we would recover the cage ourselves.  That is when Mos said they would dive on it but it would take 1 -2 weeks for a forensics team to arrive and that he would let Persistence know.

Kyle Kingman:  The FBI said they needed an invitation. I brought it up to Mos and Richardson and they were talking as if it were a possibility along with a Dutch forensic team. Mos said it would take about 10-14 days to have a Dutch forensic team on site. Never heard another word about it.

Grace-land touched on this and I have been thinking about it recently...

For arguement's sake, let's say she did drown.  He goes to get help and then LE is called in.  We all know he tried to leave the country and he said she was leaving on another plane (did I dream that?).  Anyway, where is her stuff?  If she really did drown, wouldn't he have packed it and returned it to her family or LE?  If he left her stuff at a hotel, doesn't that show lack of concern for her as well?  Were all of her bathing suits accounted for, if she WAS snorkeling (which we know she wasn't) but would not one of them be missing.  I bet her friend could account for that.

It just seems her personal belongings could reveal alot of clues.


I highly doubt that she drowned - they float back to shore in Aruba.

New plea for public's help in Aruba case

 (CBS News)

 ORANJESTAD, Aruba -- Authorities in Aruba made a fresh plea to the public late Friday night for any information on Gary Giordano, who is being held in the disappearance of his traveling companion, fellow American tourist Robyn Gardner.

 Though he's been detained for a month, reports CBS News correspondent Elaine Quijano, Girodano has yet to be charged with a crime, and has denied any wrongdoing.

 He is challenging the ruling of an Aruban judge this week that extended his incarceration in an Aruban jail by 60 days.

 His attorney, Michael Lopez, said he plans to appeal the ruling Monday before a three judge panel.

 Giordano, 50, a businessman from Gaithersburg, Md., says he was snorkeling on the island with Gardner, 35, of Frederick, Md. early last month when she vanished, apparently having been swept out to sea.

 Authorities believe Gardner is dead, but her body hasn't been found.  ::snipping2::

 On "The Early Show on Saturday Morning," famed defense attorney Rob Black, who isn't involved in this case but whose clients have included William Kennedy Smith and Rush Limbaugh, said prosecutors have their work cut out for them proving Giordano was responsible for Gardner's disappearance and presumed death.

 "It's just purely circumstantial evidence at this time," Black, speaking from Miami, told co-anchor Russ Mitchell, "and I say purely -- there obviously are some interesting facts leading up to the disappearance of this young woman. But the problem is, without a body, it is very hard to make a case like this, because how do you prove it's not accidental? So, while he has acted very strangely and there are some unusual circumstances, this is certainly not a slam-dunk case."

Birmingham, Ala (WIAT)  The Robyn Gardner disappearance on Aruba resonates here in Alabama because of eerie similarities to two other cases. 

The disappearance of Mountain Brook teen Natalee Holloway on a graduation trip to Aruba in 2005 became an international sensation as Aruban authorities questioned but never charged local teen Joran van der Sloot in the case.  Van der Sloot went on to years of notoriety punctuated by false "confessions" and wild claims on Dutch TV before surfacing again as the confessed murderer of a Peruvian student he met at a Lima poker tournament.  Van der Sloot was finally formally charged last week with killing 21 year old Stephany Flores.  Her corpse was found in his Lima hotel room five years to the day of Natalee's disappearance.

The other case with strange vibes to Gardner's disappearance is the drowning death of Tina Watson on her honeymoon in Australia.    Husband Gabe Watson was charged with murder in her death but did a guilty plea on manslaughter charges and served 18 months in an Australian prison.  He was extradited back to Alabama to face murder charges here.  State prosecutors claim he conspired to kill Tina for an insurance payout.  Watson is out on bail awaiting trial on those charges.

The male predator – none other than accused killer, Joran van der Sloot, who is currently residing in a Peruvian prison, formally charged with first-degree murder in last year’s killing of a university student (Stephany Flores) whom he met at a Lima casino. They are seeking a 30-year jail sentence.

The hit paranormal crime series, “Haunting Evidence,” (truTV) was my introduction to the island of Aruba, regarding the disappearance of a beautiful young, blonde teenage girl named Natalee, wide-eyed with wonder for what her future life may hold.

During our filming on this isle just off the coast of Venezuela, not only was the terrain rougher than expected … but we were not exactly welcomed by the authorities.

In fact, the final night of filming on the beach – 2 of our crew members were sitting in the local jail. The authorities even wanted to search our hotel rooms because they were paranoid about some customs paperwork apparently misplaced, documenting our production trunks shipped via Fedex. (It’s a super long story.)

I would now like to extend my sincerest gratitude to our amazing, loyal hotel staff for protecting all our rooms & all our private things from this invasive attempted room search.

We barely had 90 minutes to “get it all,” while officers who lined the beach location where we were filming prompted us with sidearms to move it along.

Yes, she is a tool. 

I'm sure a lot of people end up in situations they normally wouldn't have put themselves into after being slipped date rape drugs by predatory scumbags.

I'm also sure those predatory scumbags, and AHATA appreciate hodog "Glenda" blaming the victims.

Aruba Suspect Appeals Jail Ruling
UPDATED: 1:55 pm CDT September 5, 2011


ORANJESTAD, Aruba (CNN) -- A Maryland man, detained in Aruba in connection with the disappearance of an American woman, filed an appeal Monday to a recent ruling keeping him behind bars for another 60 days.

Gary Giordano's lawyer said the appeal hearing will be held Wednesday at 11 a.m.

A three-judge appellate panel will either affirm the earlier ruling and keep Giordano in custody or else set him free
