Who should get Josh Powell's insurance benefits?

 ::snipping2::
Life insurance policies typically have a two-year "contestability period." If someone dies during the first two years of having the policy, the insurance company can contest making payments on certain grounds, for example, if the death was a suicide or if the person lied about being a smoker and then died of lung cancer. Because the two-year period had expired for Josh Powell, his suicide did not render the policy void.

I wouldn't put it past Josh to have known this and it was part of his sick plan.  As has been noted before, just when you think it can't get any worse, it does.

I believe you're right. Many years ago I knew a man who took out a large life insurance policy on himself. The day after the 2-year suicide clause ran out, he shot himself.

But why?  I agree that JP is manipulative enough to devise such a plan but who does it benefit?  He is the control freak/sociopath, and committing suicide does not benefit the most important person in his life -- Himself.  If he wanted to keep the Cox's from getting the money all he had to do was to quit making the payments on the policies and let them lapse.  And if the money is for his dad, how would he know two years ago that dad would be incarcerated.  Of course, I guess if he loved daddy dearest enough, maybe just knowing his father would get the money would be a possible motive.

I don't know -- JP is so crazy there doesn't seem to be even an illogical motive for his actions.

I believe you've hit the nail on its proverbial head. Normal people will never understand the machinations of a mind like this lunatic had. A former student of mine is in prison - been doing life without parole since he was 19, and he's now approaching 40. The hardest thing for me to understand is the fact that he isn't particularly bothered by the fact that he will never walk free again. It would drive me completely out of my mind, but Michael - from what I understand - is perfectly content right where he is. You and I will never understand that type of thinking, and thank God we don't.

Steve Powell: Voyeurism, porn trial postponed
Isabelle Zehnder
Missing Persons Examiner

TACOMA, Washington (Isabelle Zehnder reporting) -- It was reported Monday that the March 20 voyeurism and child pornography trial of Steve Powell, father-in-law of missing Susan Cox Powell, has been postponed.

Susan Cox Powell is the young West Valley City, Utah mom who vanished in Dec. 2009 and is still missing. Her 61-year-old father-in-law has recently been named a person of interest in her disappearance.

Sara Fleck, a criminal case manager for the Pierce County Superior Court in Tacoma, said Steve Powell's trial will be continued because his attorneys are handling a homicide case that conflicts with the trial date,The Salt Lake Tribune reports.

Powell’s eight-day trial was originally set to begin on Nov. 16, but that date was continued to March 20 to give attorneys in the case more time to prepare. Trial postponements are quite common in court systems, often a result of conflicting court appearances. Internet court records do not yet reflect the postponement of Steve's trial.

Washington judge sets May date for Steve Powell trial

The voyeurism and pornography trial for the father-in-law of missing West Valley City mother Susan Powell is now scheduled to take place May 7.

A Pierce County Superior Court Judge in Tacoma, Wash. on Friday granted a motion to continue the scheduled eight-day trial for 61-year-old Steve Powell. His defense attorneys are handling a homicide case that conflicted with Powell’s previous March 20 trial date.
 ::snipping2::
The Washington attorneys representing Powell earlier this month filed a motion to suppress evidence at the trial, arguing some evidence obtained by law enforcement — including a CD containing photos from a locked compartment in Powell’s bedroom — was gathered through an "overly broad" search warrant that violated his constitutional rights. An April 23 hearing has been scheduled on the motion.
 ::snipping2::
Steve Powell has declined multiple jailhouse interview requests from The Salt Lake Tribune. He is currently in the county’s main jail and, with the exception of his attorney, is allowed to meet with visitors for only one hour a week.

With the exception Jennifer Graves, several of Powell family members have defended their father.

"The arrest comes as a surprise to all individuals I have talked to, especially those closest to my father," wrote Michael C. Powell, 29, who is a student living in Minneapolis, in court documents. "Everyone is of course saddened by it. The charges are not consistent with the way I know my father to behave."

Michael Powell wrote that he and his siblings do not intend to post bail for their father.

This does not make sense.  If they defend their father, and claim it is inconsistent with his prior behavior, why would his kids leave him in jail?

I would bail my father out whether I felt he was innocent or guilty. After all, it's not up to me to judge him.

Maybe they know something they are not saying, and that is why they are leaving him in jail.

Whatever is going on, I'm glad SP is still in jail prior to his trial.

Cousin of Josh Powell Missing
March 27, 2012 12:40 AM EDT

A relative of Josh Powell has been reported missing out of Salt Lake City, Utah. 22-year-old Kathy Lynn Tarrant Martin reportedly suffers from Cerebral Palsy and has the mental capacity of a 12-year-old child. An Amber Alert wasn't issued for the missing woman as she is of age and has been left to her own devices, apparently.

The sister of Josh Powell, Jennifer Graves, said that she is afraid her cousin might be in danger. The young woman may be in the company of 20-year-old Skyler Perkins, who attends the same special needs school as her. It's reported that the man is homeless and is on probation, though it's not known for what.

Attorneys in the Steven Powell porn case due back in court Friday
By Pat Reavy, Deseret News
Published: Thursday, March 29 2012

TACOMA, Wash — Attorneys involved in the voyeurism and child pornography case of Steven Powell are scheduled to be back in a Washington courtroom Friday.

A Pierce County Superior Court judge is expected to consider a motion to unseal a search warrant served on the Puyallup home of Steven Powell and his son, Josh Powell, in August of 2011. Prosecutors said they didn't intend to contest the motion and expected the documents would likely be unsealed.
 ::snipping2::
Steven Powell's defense attorneys say the evidence collected from the Powell house should be thrown out because the search was unconstitutional. A hearing on that matter is scheduled for April 23. Powell's trial is scheduled to begin May 7.

Search warrant for Steve Powell’s home unsealed
Posted on: 7:24 am, March 30, 2012, by Ben Winslow, Brittany Green-Miner, and Aaron Vaughn, updated on: 04:32pm, March 30, 2012

TACOMA — The father-in-law of missing West Valley City mother Susan Cox Powell made an appearance in a Washington state courtroom this afternoon. And as of 3:30 p.m. the judge ordered a search warrant unsealed that could shed new light on the disappearance of Susan Cox Powell.

[Read the PDF of the Powell search warrant (WARNING: Graphic)]

Earlier court documents obtained by FOX 13 show that Steven Powell’s attorney requested a hearing to unseal the original search warrant that led to his arrest on voyeurism and child pornography-related charges. West Valley City police investigating the disappearance of Susan Cox Powell participated in the initial search of his home. Since then, the details of their findings have been kept from the public until now.

*FOX 13 will stream the West Valley City Police press conference regarding the recent decision and is scheduled at 4:45 p.m.

Court documents: Blood found at Josh Powell’s Utah home was that of his missing wife
March 30, 2012

TACOMA, Wash. — Authorities investigating the 2009 disappearance of a Utah woman found her blood in the family home and a hand-written note in which she expressed fear about her husband and her potential demise, according to documents unsealed Friday.

The files raise further questions about why Susan Powell’s husband was never charged in her disappearance before he killed himself and their two young sons in a gas-fueled inferno in Washington state earlier this year. Investigators in West Valley City, Utah, never arrested Josh Powell or even publicly labeled him as a suspect in Susan Powell’s disappearance.
A prosecutor in Washington state who was getting a first look at the files Friday said if it was his case, he would have charged Josh Powell with murder.

“There is direct evidence. There is circumstantial evidence. There is motive,” said Pierce County prosecutor Mark Lindquist. “There is everything but the body.”

The documents, used as justification to search the home where Josh Powell was staying last year, detail a widespread case that investigators had built against him.

Shortly after Susan Powell disappeared, authorities found blood evidence on a floor next to a sofa and determined that it was Susan Powell’s. The sofa appeared to have been recently cleaned and two fans had been set up to blow on it.

They found several life insurance policies on Susan Powell that totaled $1.5 million. The documents describe Josh Powell as unwilling to help in the investigation.

A safety deposit box used by Susan Powell had a hand-written letter titled “Last will & testament for Susan Powell,” according to the documents. She wrote in that letter that she did not trust her husband and that they’d been having marital troubles for four years.

The letter also said that “if Susan Powell dies it may not be an accident, even if it looks like one,” according to the documents.
 ::snipping2::
One of the children, Charlie, told investigators in an interview shortly after Susan Powell disappeared that she had gone on the camping trip with them but did not come back home and did not know why, according to the files. A few weeks later, he told a church teacher with no emotion: “My mom is dead.”

Investigators had found a gas can, tarps and a shovel in Josh Powell’s vehicle shortly after the investigation began. Susan Powell’s cell phone was also found in the car, and Josh Powell “did not have an answer as to why,” according to the documents. One person interviewed by police said Powell had once made comments about how to kill someone and dispose of the body.

Susan Powell’s purse, keys, credit cards and other belongings were found in the couple’s master bedroom.
