Tribune asks WVC to release Susan Powell documents
Open records » Reporters contend that some info no longer needs to be withheld.

West Valley City • Citing public interest in the matter, Salt Lake Tribune reporters on Tuesday night asked the City Council to release records concerning the investigation into Josh Powell and the disappearance of his wife, Susan Powell.

Reporter Aaron Falk noted that the investigation into Susan Powell’s disappearance began two years and four months ago and said people are entitled to a general idea of how taxpayer money was spent. He also said that some records should no longer be protected from disclosure because Josh Powell, the lone person of interest in his wife’s disappearance, is dead.
Clint Gilmore, West Valley City assistant chief prosecutor and police legal adviser, countered that disclosure of the requested records could interfere with the ongoing investigation into Susan Powell’s disappearance. In addition, he said, records can be withheld if release would create a danger of depriving someone of a right to a fair trial or reasonably could be expected to disclose the identity of a source.

Under questioning from council members, Gilmore said he did not know how many documents were covered in the newspaper’s GRAMA request and that no one had gone through them page by page to determine what information should not be disclosed and what information should be withheld.

Didn't LE have some of JP's computer files that were encrypted?  I pray the FBI is working overtime to hack those.  He was so anal about keeping his documentation, let's hope he held on to the 'trophies' from the night he murdered Susan and disposed of her.

Evidence against Steven Powell was collected legally, prosecutors argue
Investigators feared Susan Powell's journals would be altered
Published: Thursday, April 12 2012 1:40 p.m. MDT

TACOMA, Wash. — Evidence collected against Steven Powell in his voyeurism case was done so legally because police at the time were investigating the possible murder of Susan Cox Powell, attorneys argue in new court documents filed Thursday.
 ::snipping2::
In March, attorneys for Steven Powell filed a motion seeking to have the evidence collected against him during that search thrown out, claiming the search violated his Fourth Amendment rights because it went "overboard" and was nothing more than an "exploratory, random, fishing expedition."

Thursday, prosecutors filed their response. In it, they noted that one of Susan Powell's diaries was found at her work after she disappeared. The diary started on Jan. 3, 2002, and ended on Oct. 26, 2009. She was last seen on Dec. 6. Powell noted in her diaries that she had been keeping journals since she was 8 years old and the other volumes were packed away.
 ::snipping2::
Prosecutors noted in the court filing that Josh Powell was considered the "prime suspect" in his wife's disappearance.

Decision on Tribune’s Powell records request expected Wednesday

The West Valley City Council on Tuesday deliberated a Salt Lake Tribune records request to release documents related to the investigation of Josh Powell, a person of interest in the case of his wife, Susan Cox Powell, who disappeared Dec. 6, 2009.

A response on whether the records will be released is expected Wednesday, following Tuesday night’s discussion, Councilman Corey Rushton said.

West Valley denies Tribune records request in Powell case
First Published 1 hour ago • Updated 1 hour ago

The West Valley City Council on Wednesday denied a Salt Lake Tribune records request to release documents related to the investigation of Josh Powell, a person of interest in the case of his wife, Susan Cox Powell, who disappeared Dec. 6, 2009.

"The council decided to uphold the city manager’s decision not to release the records," Councilman Corey Rushton confirmed Wednesday.

The council held a Tuesday night discussion on whether or not to release the records, he said. The council unanimously agreed on their decision to deny the request, Rushton said.

In a four-page document outlining the reasoning behind the denial, West Valley City officials wrote that Utah law allows the city to classify records as protected if the records "reasonably could be expected to interfere with investigations undertaken for enforcement, discipline, licensing, certification or registration purposes."

The city also stated that releasing the documents may "create a danger of depriving a person of a right to a fair trial or impartial hearing," among other reasons cited.

Dispatcher in Powell murder-suicide reprimanded

SALT LAKE CITY –  A news report says a Washington state dispatcher who took a 911 call from a social worker just before Josh Powell killed his children and himself has been reprimanded.

The Salt Lake Tribune reports that dispatcher David Lovrak was reprimanded after 22 minutes elapsed before help arrived. The reprimand letter says nearly seven minutes went by before deputies were sent.

 ::snipping2::

The letter says Lovrak violated four policies. It also says he asked seemingly unimportant questions and failed to grasp the situation.

The paper says the written reprimand -- obtained via a public records request -- will be placed in his personnel file.

The untold story
Powell records should be opened

 ::snipping2::

As long as these records remain closed, the only people being protected are West Valley City officials who might be embarrassed by information that would — admittedly in hindsight — portray them in a bad light. And that is not the kind of information the law is intended to protect.

Steven Powell returns to court Monday fighting evidence against him
Published: Sunday, April 22 2012 6:12 p.m. MDT

TACOMA, Wash. — A Pierce County Superior Court judge Monday will listen to oral arguments concerning the evidence collected in Steven Powell's voyeurism and child pornography case.

In March, the 61-year-old father of Josh Powell filed a motion seeking to have the evidence collected against him during a search of his home in August thrown out, claiming the search violated his constitutional rights.

West Valley police had traveled to Powell's Puyallup, Wash., home with a search warrant seeking childhood diaries of missing Utah mother Susan Cox Powell. What they found were thousands of photographs of young children, mostly young girls, many in partial states of undress. Police say the pictures were taken secretly without the subject's knowledge or consent.
 ::snipping2::
The judge is expected to listen to oral arguments Monday, then make a ruling possibly as early as Tuesday.
