The documents, given to FOX 13 on Friday by Washington’s Department of Social and Health Services under a public records request, reveal the inner turmoil the children were under in the face of their mother’s disappearance and losing their father after their grandfather was arrested
He reported that to both CPS and West Valley City police in an e-mail included in the massive file.

Josh Powell wrote his children almost daily, telling them that he loved them and could not wait to be together with them again. West Valley City police expressed deep concern about the children being in Powell’s custody.
 
But in notes, CPS caseworkers appeared to be pushing to reunite Josh with his sons. They noted that because of Susan’s disappearance, her parents would most certainly oppose it.

I think the Coxes should sue and I think they would win.  Anyone with common sense can see that the guy was twisted and trying his best to manipulate those poor kids.  The social workers should have been looking out for the best interest of the children.

On Nov. 29, 2011, Forest Jacobsen, the Washinton Department of Social and Health Services  worker assigned to the case, asked the woman who supervised the visits for more details about the children’s comments about their mother.

In the months before their murder, Charlie and Braden starting talking about their mom a lot, including during a brief stay with foster parents. One of the foster parents said one of the boys  talking about a graveyard, saying, “Of course they’re going to find bones there. I’m talking about Susan."

There is also evidence DSHS had growing concerns about the children’s safety, saying Powell's home was becoming unstable because law enforcement officials in Utah were clear they were going to arrest Powell soon.

DSHS also showed frustration with the West Valley City, Utah, Police Department over its failure to immediately relay word about finding computer-generated sexual images of cartoon characters and incest drawings on Powell’s computer during a search of his Utah home in 2009.

"I can’t fathom how they’ve had those computers for almost two years and suddenly bring this up,” DSHS said.

On Feb. 1, a Pierce County judge ordered Powell to undergo a psychosexual evaluation before deciding whether he could regain custody of his boys.

On Feb. 3, Jacobsen sent an email to staff, saying, “I feel as though the work of this case is pretty much done barring any new developments, and the case will resolve based on the newly ordered evaluation and any action or inaction by law enforcement.”

Two days later, Powell killed his children and himself in an inferno.

Josh's father, Steven Powell, is set to stand trial on child pornography charges later this month, on March 20.

I could not agree more!!! WHY is there a prejudicial bias toward parents based solely on biology??? IF there has been no evidence of poor parenting or endangerment, then OK, the parents are the parents and of course they possess a primary vested interest in the children. HOWEVER....... once the children have been removed for any reason and agencies have found it in the best interest of the children to place them elsewhere, even temporarily, then I think that any bias toward re-unification should be out the window. At that point, I believe that the kids are all that matters and that special parental rights are forfeited.

Those kids should have been adjusting to their Mom's absence in a home that they knew was there home; period. They should never have had to even consider that their circumstances would be jerked out from under them again.

As with most things, if you want to get to the "reason" for an unreasonable action, follow the money.  While children placed with relative are not directly compensated by the state, they are able to get healthcare and, often, food staps, and child care tuition.  Children placed with foster families, which is the majority of the cases, are compensated by the State.  Get the kids back to their worthless parents at any cost, pun intended.

As with most things, if you want to get to the "reason" for an unreasonable action, follow the money.  While children placed with relative are not directly compensated by the state, they are able to get healthcare and, often, food staps, and child care tuition.  Children placed with foster families, which is the majority of the cases, are compensated by the State.  Get the kids back to their worthless parents at any cost, pun intended.   
And sadly, that is what it all boils down to...the almighty dollar.  I don't know how some of those CPS workers sleep at night.

TACOMA, Wash. — Attorneys for Steven Powell are asking a judge to throw out the images seized from his home that are the basis for voyeurism charges against him, claiming the evidence was collected illegally.

In newly filed court documents, Steven Powell's defense attorneys claim a search warrant conducted by West Valley police on Josh and Steven Powell's Puyallup, Wash., home in August 2011 went "overboard" and was nothing more than an "exploratory, random, 'fishing expedition' style search" to look for evidence against Josh Powell in the case of his missing wife, Susan Cox Powell.

"The search here was without probable cause, the warrant was illegal and all the evidence must be suppressed," attorneys argued in court documents.

ITA! Reading the documents are so hard on the heart. But then one can imagine how hard it must be for children to have to go from the hate camp to the Cox home. Those children had a nice safe happy home and they wanted to stay there. They had adjusted and what kid couldn't adjust in a home where you're loved. Their happiness should have came first.

A battle is underway for the insurance payouts for killer dad Josh Powell and his two young sons - and now the insurer has asked the courts who, if anyone, should get the money.

It comes after the killer's sister and brother filed claims on insurance policies worth $1.5 million just nine days after he blew up his Washington home, killing himself and Braden, seven, and Charlie, five.

The New York Life Insurance Company also wants the U.S. District Court to decide who should get the $1 million policy for Susan Powell, Josh's wife who went missing from Utah in December 2009.

To add yet another complication, the company wants to know whether changes Powell made to his policy in 2011 should stand, questioning his competency at the time, the Salt Lake Tribune reported

IMO, there will be no payout for Josh, as most policies don't cover suicides.

In the case of the benefits for the boys, imo, that should go to whomever had custody of the boys at the time of their deaths. And that would be the Coxes.

NOTHING should go to the Powells, imo, regardless of the named benefactor.

But, unfortunately, I am not the court.

NOTHING should go to the Powells, imo, regardless of the named benefactor.

But, unfortunately, I am not the court.

Nothing should go to the Powells and there can't be any payout on Susan's until she is found or declared dead which usually takes about 7 years.  Also, if a spouse, such as JP, takes out a policy and names anyone other than his spouse, Susan, as beneficiary, the spouse being left out has to sign off on the the policy.  So he couldn't have changed to beneficiary of his policy without Susan around to sign off on it.

Among the company’s questions is whether those changes are valid. Susan Powell may have had a community-property interest in the policy, so it’s not clear that her husband could cancel her as the beneficiary without her consent, the lawyers wrote.

Furthermore, given his suicide, it’s not clear that Powell was legally competent to make those changes when he did so last October and December, the company’s lawyers wrote. 

Many life insurance policies contain wording that renders them void in the event of suicide. It wasn’t immediately clear whether Josh Powell’s policy contained any such language; the complaint made no reference to that issue.

Alina Powell did not immediately return an email from The Associated Press seeking comment Wednesday.
