TACOMA, Wash. — Authorities investigating the 2009 disappearance of a Utah woman found her blood in the family home and a hand-written note in which she expressed fear about her husband and her potential demise, according to documents unsealed Friday.

The files raise further questions about why Susan Powell’s husband was never charged in her disappearance before he killed himself and their two young sons in a gas-fueled inferno in Washington state earlier this year. Investigators in West Valley City, Utah, never arrested Josh Powell or even publicly labeled him as a suspect in Susan Powell’s disappearance.
A prosecutor in Washington state who was getting a first look at the files Friday said if it was his case, he would have charged Josh Powell with murder.

“There is direct evidence. There is circumstantial evidence. There is motive,” said Pierce County prosecutor Mark Lindquist. “There is everything but the body.”

The documents, used as justification to search the home where Josh Powell was staying last year, detail a widespread case that investigators had built against him.

Shortly after Susan Powell disappeared, authorities found blood evidence on a floor next to a sofa and determined that it was Susan Powell’s. The sofa appeared to have been recently cleaned and two fans had been set up to blow on it.

They found several life insurance policies on Susan Powell that totaled $1.5 million. The documents describe Josh Powell as unwilling to help in the investigation.

A safety deposit box used by Susan Powell had a hand-written letter titled “Last will & testament for Susan Powell,” according to the documents. She wrote in that letter that she did not trust her husband and that they’d been having marital troubles for four years.

The letter also said that “if Susan Powell dies it may not be an accident, even if it looks like one,” according to the documents.

One of the children, Charlie, told investigators in an interview shortly after Susan Powell disappeared that she had gone on the camping trip with them but did not come back home and did not know why, according to the files. A few weeks later, he told a church teacher with no emotion: “My mom is dead.”

Investigators had found a gas can, tarps and a shovel in Josh Powell’s vehicle shortly after the investigation began. Susan Powell’s cell phone was also found in the car, and Josh Powell “did not have an answer as to why,” according to the documents. One person interviewed by police said Powell had once made comments about how to kill someone and dispose of the body.

Susan Powell’s purse, keys, credit cards and other belongings were found in the couple’s master bedroom.

Letter found in Susan Powell's safe deposit box was addressed to family, asking that it now be shown to Josh. She wrote she didn't trust him. Letter was Susan's last will and testament. Susan's letter requested reader to speak with Jennifer Graves, her sister in law, if something were to happen to her.

Susan Powell wrote that if she died, "it may not be an accident, even if it looks like one," warrant states.

Josh Powell to Susan's coworker: The west desert is so full of mine shafts , tunnels you would dispose of a body and no one could find it.

Susan Powell's blood was found on the tile floor adjacent to the sofa in Josh and Susan's West Valley home.

West Valley police have talked to more than 300 people, but only spoke to Josh once.

After police seized Josh Powell's van, he rented a car and bought a new cell phone that was activated in Tremonton. He traveled 800 miles.

Josh withdrew all of Susan's IRA accounts 10 days after she was reported missing.

One month after Susan went missing, Charlie told primary teacher "my mom is dead." He told another that his mom went camping with them but didn't come home. He did not now why.

Police also found photos of Susan Powell in her underwear, appearing unaware her picture was being taken.

ITA  That was my first thought when I read the article.  I wonder if they felt they had enough for an arrest, but not a conviction?  I just don't know.     No wonder Josh Powell acted so cocky. He was getting away with murder!  JMHO

Why was Josh Powell never arrested? Were they hoping Susan's body could be found?  Or perhaps they figured with the search of Steve Powell's home and his arrest that  more evidence could be uncovered?

Pierce County Sheriff's Department spokesman Ed Troyer said his detectives would have arrested Powell "a long time ago" if this had been their case. He said a detective in Washington state was aware of the details gathered and that authorities here had been anticipating that Utah investigators would pursue an arrest.

"Obviously, it's frustrating," Troyer said. "We were always waiting for the phone call to go arrest him."

The search warrants contain information, including:


•West Valley police say murder, kidnapping and obstruction of a public servant occurred on Dec. 6, 2009 in West Valley City. The last phone call made or received from Susan Powell's cell phone was at 2:29 p.m. on Dec. 6, 2009, when she called a friend.


• The documents reveal that Josh Powell last used his phone on Sunday, Dec. 6, 2009, at 12:14 p.m. when he called his father. Josh Powell's next mobile phone activity was not until Monday, Dec. 7, at 3:02 p.m. when a neighbor asked Josh Powell where he was. Soon after, he left a voicemail message on Susan Powell's phone asking if she needed a ride home from work.


• Josh Powell's sister, Jennifer Graves, called him at 5:27 p.m. that Monday and asked him where he had been. Josh Powell told her he had been at work.


"When Jennifer Graves told Joshua Powell she knew he was lying, Josh Powell then changed his story, telling her that he was camping," the warrant states.


Police made contact with Josh Powell through Jennifer Graves' cell phone at 5:45 p.m., but Powell didn't arrive at his residence until 6:40 p.m.


Susan Powell's cell phone was found in the center front console of Josh Powell's car, the warrant states. It was missing the digital SIM card and Josh Powell did not have an answer as to why his wife's cell phone was in the car. The phone had been turned off.


Police also found a generator, tarps, a shovel, a gas can and blankets in the vehicle.


• On Dec. 8, 2009, Josh Powell rented a rental car at the airport after police seized his family's van. When he returned it, it had 800 miles on it. He also purchased a new cell phone that was activated in Tremonton, Utah.


• Police state that their investigation revealed the couple was having marital problems and that Josh Powell "was the beneficiary of several life insurance policies totaling one and a half million dollars on Susan Powell."


• Police also found a safe deposit box containing a letter Susan Powell had written to her family dated January 2008 that she did not trust her husband and that "if (she) dies it may not be an accident, even if it looks like one."


She asks in the letter that if something were to happen to her, Graves should be contacted.


• Susan Powell's blood was found on the tile floor adjacent to the sofa in Josh and Susan's West Valley home.


• One month after Susan went missing, the couple's oldest son, Charlie Powell, told a primary teacher "my mom is dead." He told another that his mom went camping with them, but didn't come home. He did not now why.


• In the days after his wife's disappearance, Josh Powell called the daycare provider for the couple's two children and told her the children were not coming back "and she probably will not ever see them again." He canceled all of Susan Powell's future chiropractor's appointments and provided a power of attorney to Wells Fargo that allowed him to empty Susan Powell's IRA accounts.

• The warrant states police were seeking journals belonging to Susan Powell and digital media that could be related to Susan Powell's disappearance. The journals detailed the couple's marital strife beginning in 2005 through to a final entry on Oct. 26, 2009. The woman wrote about Steven Powell beginning in 2002.


"Susan states how she does not want Steven Powell involved in her life, her children's life and how she wishes Joshua Powell would eliminate Steven Powell from his life," the warrant states.


Attorneys for Powell were in a Pierce County Superior Court courtroom Friday afternoon seeking to have the search warrants served on Powell's house and vehicles unsealed. Their motion went uncontested and the hearing lasted only a minute.

Unbelievable, yet Josh was allowed to keep custody of the kids until his Father's arrest. Many gov't entities dropped the ball with the 2 children's best interests.

Yes, that part stood out to me as well cw618.

 

I don't understand WHY either!   

The only even close to reasonable explanation for me is that they wanted to seal a conviction before they charged him...they wanted to find Susan's remains?  I wouldn't have needed that if I'd been on a jury and heard what I've read from Susan's own hand, the blood found in the house, and the rest of the circumstantial evidence.  But who knows how much of that would have been kept from a jury if they had charged him with what they had???

I just don't know, it's making me sick to even think about it.

I KNOW his sick sadistic POS father was part of Susan's murder, I JUST KNOW IT!

If only Seattle CPS/Police Department had been informed.  The Utah investigation knew but ... allowed those boys to live in an environment that put them at risk.  Why did the Utah investigative records remain sealed for two years?  What about justice for Susan Powell!  What about the well-being of two little boys!  There needs to be an investigation into the investigation.

Despite all of the information, investigators with West Valley City police continued to say Friday that they are treating the case as a missing-persons matter. Court documents related to the disappearance of Susan Powell show police had "everything but a body" to build a case against Powell's husband, leaving the woman's father to question why Josh Powell was still free last month, when he killed himself and his two sons.

"When I heard them [the new evidence], it was like, well, why didn't you arrest him already?" said Chuck Cox, Susan Powell's father. "Had he been to jail, my grandchildren would still be alive."

Josh Powell, who had been the primary person of interest in the case almost from the time his wife went missing in December 2009, set off an explosion in his Graham, Wash., rental home last month, moments after a Child Protective Services worker had dropped off his sons, Braden, 5, and Charles, 7, for a supervised visit.

The explosion, seconds after Powell pulled the boys inside the house and locked out the social worker, killed him and his boys.

Powell had moved back to Washington from Utah after his wife's disappearance, initially to live with his father, Steven Powell. He moved out of his father's house after the older man was charged with voyeurism and child pornography.

The newly released documents show that investigators had a lot of evidence linking Josh Powell to his wife's disappearance, according to a Washington State prosecutor who handled the charges against Steven Powell.
 
"There is direct evidence. There is circumstantial evidence. There is motive," Pierce County prosecutor Mark Lindquist told ABC News Seattle affiliate KOMO-TV. "There is everything but the body."

He said that had the Susan Powell case happened in his jurisdiction, he would have charged her husband with murder.

"The West Valley [Utah police] had a lot more evidence than we were ever led to believe," said Greg Skordas, Josh Powell's defense attorney and a former prosecutor in Salt Lake City, Utah. "We had a lot of statements, for example, from Josh that were clearly lies."

According to the documents, the last time Susan Powell was seen alive, a friend had been at her house, and told police that Susan suddenly "became tired after eating a meal that was prepared by her husband."

Susan then went to bed, and was never seen again.

The documents reveal that Susan's blood had been found on what had appeared to be a spot on the floor next to a sofa where Josh Powell had set up two fans.

Detectives also found a letter Susan had left in a secret safety deposit box in which she said her husband had "threatened to destroy her if they get divorced" and that if she were to die, "it may not be accident, even if it looks like one," KOMO-TV and The Associated Press reported.

After Susan Powell disappeared, her husband emptied her IRA accounts, KOMO reported.

The new documents say that Josh once bragged to a friend about "how to kill someone, dispose of a body and not get caught."

The documents opened Friday pertained to a case against Steven Powell, who last September was arrested and charged with using a telephoto lens to take photos of two young girls in the bathroom of a neighboring house. There reportedly were thousands of photos, and Powell was charged with 14 counts of voyeurism and one count of child pornography.

Jurisdiction for the case against Steven Powell falls within Pierce County.

According to the new documents, Steve Powell had taken photos of Susan Powell in secret, some in which she was fully clothed, others in which she wore only her underwear, one in which her legs were "slightly open, exposing her underwear."

Could the West Valley "authorities" involved with this case be charged with any crime or are they protected because they are law enforcement, well that's what they are supposed to do anyway?  It seems to me that with all that was just revealed, manslaughter would be a good charge.
