Considering Beth Holloway and John Q. Kelly only had less than three weeks notice of the hearing regarding Natalee's father to have her declared legally dead ... could it be that an appeal be forthcoming ... an appeal of the judge's denial of Beth's request for delay in proceedings?

The petition to have Natalee officially declared dead was filed in June by her father, Dave Holloway. The father has continued to pay his daughter's insurance and other expenses and wants to transfer to Natalee's brother, Matt, some $2,000 Dave Holloway had set aside for his daughter's college education.

A lawyer for Beth Holloway, Natalee's mother, asked Probate Judge Alan King for a continuance on the initial hearing set for today on the father's petition. King denied the request for a 30-day delay.

BIRMINGHAM, AL (WBRC) - Beth Holloway will oppose the petition filed by Dave Holloway to declare their daughter Natalee legally dead, said Beth Holloway's spokesperson Sunny Tillman on Thursday.

Dave Holloway filed a petition in a Jefferson County probate court in June 2011 to have his daughter declared legally dead. The petition will be heard in probate court in Birmingham tomorrow.

"Beth intends to oppose Dave's inexplicable effort to have Natalee declared dead," her attorney John Q. Kelly said today, according to a release sent by Tillman.

"Beth gave birth to and raised Natalee, and will always hope and pray for Natalee's safe return. If Dave seeks closure on such a personal and sensitive matter, it should be respected, but not imposed upon Beth in such an adversarial and public manner," Kelly said

Judge rejects delay in Natalee Holloway case

(AP)  BIRMINGHAM, Ala. — A judge has refused to delay a court hearing on a request by Natalee Holloway's father to have her declared dead six years after she disappeared in Aruba.

An attorney for Holloway's mother, Beth Holloway, sought the delay Friday because she could not attend the hearing. She was giving a speech in California.  But probate Judge Alan King said she had more than two weeks' notice about the hearing.

Page 231-232: I can't say for sure if we'll ever know that answer to whether my daughter is alive or not.  I know it doesn't look good.  But just as that old metal spiral staircase rose from the ashes when our lake house burned down, so too faith stands strong in the remains of this devastating loss.  And just as my Dad built another house around that staircase, I will build another life around hope and faith.  It won't ever be the same.  But I pray that it will, at the very least, be useful.

The hope that filled Natalee's heart fills mine, and I will press on.  Faith got me up this morning, and faith will see me through tomorrow.  And the next day.  And the next.  I love Natalee and miss her very much.  And still fantasize about the possibility that one day a call will come telling me that I need to go to the island.  To get her.  I want to always be prepared for that imaginary call.  So I keep my passport with me at all times.  And right next to mine is Natalee's.

Van der Sloot not eligible for get out of jail free card

Birmingham, Ala (WIAT)  Peru's prisons are clogged with foreigners...many doing time on drug possession.  Not surprisingly, Peruvian officials would like to ship those people back to their home countries.

Peruvian Justice Minister Francisco Eguiguren says about 2 000 foreign prisoners who have been detained for minor offenses, could have their sentences commuted or be extradited to their home countries to serve their sentence.

But they're making clear the proposal wouldn't include people charged with murder, terrorism or other serious crimes.  In other words, people like Joran van der Sloot.

The Dutch national is waiting trial on murder/robbery charges and there has been consistent speculation he's trying to do a deal to serve any sentence back in The Netherlands. 

The body of 21 year old student Stephany Flores was found in van der Sloot's Lima hotel room. Van der Sloot had fled to neighboring Chile where he was arrested and returned to Lima.  The subsequent investigation and interrogation prompted a variety of procedural appeals...all of which have been denied by local courts.  He claims he killed Flores in a fit of rage after she found material relating to Natalee Holloway on his laptop.  Police say it was robbery and murder...that the Holloway material was accessed a day before Flores died.

Palm Beach – A new Aruba Hotel & Tourism Association board was elected during the recent AHATA General Assembly, held at the Radisson Aruba Resort & Casino.
The new officers of the board were elected from a slate of candidates presented by a nominating committee headed by General Manager Paul Gielen, Renaissance Aruba Resort, and independent consultant Jaap Beaujon
The election process was overseen by Dr. Ryan Peterson of the Universidad di Aruba.
The new board of the Aruba Hotel & Tourism Association consists of the following eight members: Rick Zeolla, General Manager, Marriott Aruba Resort; Eduardo De Veer, Developer, Meta Corp; Scott Allen, General Manager, Hyatt Regency; Guillermo Valencia, General Manager Holiday Inn Sunspree Resort; Gary Jutz, General Manager, Radisson Aruba Resort & Casino; Matt Balcik, General Manager, Westin Aruba Resort; Peter Steinmetz, Director, Aruba Airport Authority; David Smith, VP Public Relations, Valero Aruba Refinery.

CAPS witness went to Helen LeJuez & she set up a meeting for him with Clyde Burke from ALE

ART WOOD: In August, the Diario tip line recorded an after hours call from a woman. She advised that there was a crooked cop, his name was Halley and he took a body from the sand prior to the search. The woman said that Halley knows Paulus Vandersloot. Art copied that tape and gave it to Helen Lejuez who in turn gave it to the prosecutor to be entered into evidence. In September, Dave Holloway questioned Dompig regarding this tape and the police vehicle that he had seen. Dompig and the investigative team acted like they never heard of either account.
