Could it be that intitially the financial backers of the defamation lawsuit anticipated a settlement for the alleged manipulation of the Dr. Phil recording which falsely implied that Deepak confessed to sexually assaulting Natalee Holloway.
 
However ... rather than settling ... McGraw's attorneys took a different approach.  The defence strategy would be to prove to the court through various documentation that the defamation of Deepak occurred prior to the September, 2005 Dr Phil Show.  In other words the manipulation of the Dr. Phil recording would be a non-issue.

I could be wrong but it is my understanding that the Kalpoes' financial backers are responsible for legal costs incurred by Phil McGraw whether they drop or lose the lawsuit.  To avoid the costs of a trial ... why has the lawsuit not been dropped?

That picture above of Julia Renfro looks so scary.  Something happened to her face which made it even worse than what it was.  Did she have plastic surgery.

Remember a while back, it did seem like she'd had some work done...so I dunno.

But definitely too much sun, booze, and pure meanness imo.  Her skin looks horrible, worse than leather.

Did I miss something about that?  Maybe the foundation only helps in the early days of the disappearance or something like that?  I know they help the family with contact information, posters, press releases, etc.

Robyn Gardner Donation Fund Attracts Negative Attention

Robyn Gardner vanished three months ago while on an Aruban vacation with the only suspect in the case, Gary Giordano. Since her disappearance, interest in this case have dwindled as Aruban authorities keep Giordano behind bars. In some of the latest developments related to this case, it seems that the former boyfriend of the missing Maryland woman has set up a sort of donation fundraiser in the woman's name.

Richard Forester, the former boyfriend of the missing Maryland woman, set up the following donation application, where you can donate as much or as little as you want to supposedly aid in the search for Robyn Gardner. This isn't to question the man's motives by any stretch, because it's obvious that he has feelings still for the woman who left him behind for a man at least 20 years older than she.

Should you donate your money to Richard Forester?

It's rumored that the man has been living in his car, and doesn't have a dime to his name. It's also been reported that the Natalee Holloway Resource Center stopped working with the family of Robyn Gardner. So it doesn't appear that they are receiving any help in the search for the missing woman. It's up to you to make the decision of donating money to someone online, especially if you think it's to lend a hand in such a high-profile missing persons case. Practice wise judgement, though, and don't be taken for a ride. It can't be commented on whether or not RadarOnline writers think Richard's donation page is on the up-and-up.

The former boyfriend of the missing Maryland woman claims that he's upset with people who seem to accept that she may be dead. He's convinced that she's still alive even though the small bits of evidence obtained by Aruban authorities indicate otherwise.

Janet, you would think that they knew the tape wasn't manipulated.  So now they move forward with the lawsuit without really knowing that they were lied to about the tape being manipulated.  So once the wheels were in motion and the lawsuit filed was there any turning back.  They should have dropped this lawsuit from the beginning to save themselves from being embarrassed more than they have already.  They have now let this go on for a couple of years now. They made the decision to go forward in hopes that Dr. Phil would settle with the Kalpoes and at the same time help Aruba get some of it's reputation back of being one friendly island.  He didn't settle and in my opinion this is a win win for Dr. Phil.  They will win the case against the Kalpoes and at the same time the world will get to see the Kalpoes take the stand under oath.  Dr. Phil's lawyers will eat the Kalpoes up alive.

Dr. Phil knew what he was doing when he aired this tape on his show.  Too bad Aruba fell for it.

Kermit ... this is what bothers me.  The Kalpoes and their attorneys must believe that the defamation lawsuit is derived from a solid foundation or ... they would have dropped the lawsuit long ago when the realization set in that Phil McGraw's attorneys were not about to settle.

No. The Kalpoe attorneys are trying to hide behind a wall and not hand over documents to Dr. Phil attorney's because they know if those documents are handed over - their goose is cooked.

I trust in "Chip" Babcock! The man is an amazing attorney as I have read through a lot of these documents and he knows exactly what he is doing and how to do it. Amazing study he is. I might put on the kermit suit and show up in court. Heh Heh

I wish I could be as confident as you that the outcome of the defamation case will be positive.  I hope with all my heart that the Kalpoes lose big time but ... I have so many unanswered questions.

Could it be that the Kalpoes will be granted a trial by judge?  Think about it.  The Kalpoes' attorneys have failed time and time again to comply with the court's request to produce case documents and ... time and and time again the judge has failed to rule in favor of motions to dismiss for not complying filed by Phil McGraw's attorneys.

The judge has known from the getgo that no case documents would be forthcoming.  It is my worst fear that the Kalpoes' attorneys have convinced the judge that a manipulated Dr. Phil recording can stand alone.

I also question why McGraw's attorneys required case documents to prove defamation did not occur.  If the Dr. Phil recording was not manipulated ... it should speak for itself.  Deepak was not defamed!  He defamed himself!

I realize that the Dr. Phil recording was tested privately and submitted into evidence but ... I was hoping that FBI confirmation of no manipulation would have been where it was it.

KELLY: I believe David Koch (ph), one of the attorneys for the Kalpoes actually signed a declaration at the court indicating that even if the court ordered the documents be turned over, they were not going to turn them over, which was sort of, for lack of a better word, arrogant on his part. The court did not necessarily like that.

But I can't see them both using the courts as a sword and then a shield. They can't bring this action, they can't seek damages and not obey the orders of the court and expect their case to go forward.

AND she stated in her deposition that she got rid of documents in the Natalee case. She claims attorney-client privlege trying to dupe the Dr. Phil attorney's into believing she does not have to hand over the case documents they requested and the California court has upheld.

The whole purpose of the lawsuit is to try to protect Aruba's image. If the world thinks big ol' doctor phil has somehow been a tricky shrink who defamed some island boys, then Aruba might get more American's to travel and spend money in that shite-hole.

We are in agreement with Mr. Bob DiLella, political consultant of the MEP party, who declared in an article published on November 21, 2005 in Amigoe, that we have to become more aggressive.

To take away Beth Twitty’s strength, her defamation campaign has to be attacked as much as the media who support it as with elected officials, for example governor Bob Riley of Alabama.

Litigation is underway now, where a lawsuit has been initiated, given that among others, Dr. Phil indicated that he is NOT interested in giving the opportunity for ‘rebuttal’, and he isn’t either interested in ‘fair and accurate news coverage’.

GRETA VAN SUSTEREN:  Dr. Phil and his staff stand by the tape they aired and claim Deepak admitted — and not denied — to having sex with Natalee. A representative for the "Dr. Phil" show specifically said that the show 1) Did not manipulate the Deepak tape in any way; 2) Did not alter what Deepak said in any way and 3) That they would give us [today] the tape they worked from so that we could inspect it to verify what they were claiming …

The representative also said the show stands by its position that Deepak said on tape, "You would be surprised how simple it was...." The implication of that quote is that Deepak had sex with Natalee.

We are also curious what the FBI has to say about the content of this interview. I was told by Jamie Skeeters on the phone the other night that he originally "taped" this interview directly to his computer hard drive and that he gave the hard drive to the FBI. Of course this hard drive — the "original" — is what will tell us exactly what was said or not said  — provided it can be adequately enhanced and analyzed. We don't have access to that hard drive so even after evaluating all the tapes and CD's given us, there could still remain in my mind some question.
