ARUBA: It's all about Natalee...we won't give up!

« Reply #460 on: November 21, 2011, 02:04:13 PM »

I sound like a broken record, but since I'm not the only one...WTH!

Joran was not going to "walk", no way.

I remember when Joran was brought to Lima and the outrage of the citizens there.  IF a trial doesn't start within the allowed time, the Peruvian authorities will extend the detention; if for no other reason...to prevent riots in the streets!  jmo

Van der Sloot release "unlikely"

 ::snipping2::

Quote
The family is pushing hard for faster action by the Peruvian legal system.  The Flores family’s lawyer, Edward Alvarez, has raised the alarm that van der Sloot could be released if not indicted within 18 months. Legal expert Amoretti says that 18 month limit is flexible.

The Peruvian justice authorities have confirmed that Van der Sloot’s remand can indeed be extended as Mr Amoretti says, but stress that there’s as yet no question of that being necessary. The Public Prosecutor is said to have received the file in July and to be dealing with the case.

I just want them to try him on charges that will bring a conviction.

And from my understanding they can still decide to upgrade the charges once the trial starts.

Thoughts and prayers with Stephany's family today, I know they must be disappointed with this news.

And I'm sure Anita will be thrilled to know that one Scared Monkey's day was made and is turning cartwheels with her.  Good grief!

Ricardo Flores was concerning that the passing of time without the prosecutor presenting her case to the Peruvian judge implied that Joran would walk ... concerned to the point that he wanted the prosecutor removed.  Considering a deadline extention was not a given ... so was I.

Today's update may not all that the Flores family and the Holloway family longed for but ... it does give hope if a measure of Peruvian justice prevails ... there will be assurance that Joran van der Sloot is not going to be a risk to other Natalees and Stephanys for a long time.

Woman's family wants speedy trial for van der Sloot
By the CNN Wire Staff
August 17, 2011 -- Updated 2200 GMT (0600 HKT

(CNN) -- The family of a slain Peruvian woman is urging prosecutors to file their case against murder suspect Joran van der Sloot, warning that he may be released by December unless the case goes ahead.

"We are worried because Peruvian law says that if a suspect's trial doesn't begin within 18 months after his arrest, authorities are obligated to set the suspect free," Ricardo Flores, the dead woman's father, told CNN.

Van der Sloot faces charges in the May 2010 killing of Stephany Flores, who was found dead in his Lima hotel room. Police say van der Sloot took money and bank cards from her wallet and fled to Chile, where he was arrested a few days later.

Investigators delivered their case file to prosecutors in June for a decision on charges. Ricardo Flores said the prosecutor in the case, Miriam Riveros Castellares, is "not moving with the speed that a case of this magnitude merits."

"We're asking that either the prosecutor file charges or that authorities remove her from this case and name somebody else," he said.

There was no immediate response to the family's concerns from the prosecutor's office.

Ricardo Flores wants justice for his beloved daughter.

He has every right to expect the Prosecution to proceed in a timely manner.

However, I doubt very seriously that he was turning cartwheels from the ruling today.

JMO, for what it's worth...I'm not in his shoes and hope to goodness I never am.

I apologize.  I scanned you post too quickly.  I agree.  I don't think Joran will be "walking" for a long time.  Twenty to thirty years in a Peruvian lockup and ... then it is extradition to the States to face extortion charges.

Peru sticks to murder charge in Stephany Flores case
Published on 21 November 2011 - 10:43pm

The public prosecutor in the Peruvian capital Lima says he will maintain the original charge of murder against Dutch citizen Joran van der Sloot. He characterised the charge as ‘clear and coherent’.

Van der Sloot is accused of the ‘murder followed by robbery’ of Peruvian Stephany Flores. The charge carries a maximum jail term of 30 years.

The decision by public prosecutor Pablo Sánchez Velarde means he has rejected the Flores family’s request to charge Van der Sloot with robbery with murder, which is punishable by life imprisonment.

Van der Sloot is accused of killing Stephany Flores in his Lima hotel room on 30 May 2010 after meeting her four days earlier in the Atlantic City casino in the Peruvian capital.

The next month will prove to be very interesting.  Will the trial be televised?  If not; will reporters be in attendance providing updates each day?

I do believe I may begin my Christmas shopping and decorating.

Considering there is still a chance the charges could be raised ... I am soooo relieved ... sooo thankful ... so happy ... that the case against Joran van der Sloot was presented to the judge prior to the deadline ... the deadline that concerned Ricardo Flores ... the deadline that concerned me ... the deadline that may have been extended but ... may not have.

I don't think that the trial will be televised, but we'll hear about the preceedings one way or the other.  There is nothing in the way for the court to set a date--hopefully by the middle of December.  Stephany will get some measure of justice--and in an indirect way, so will Natalee.

Go and decorate and start your Christmas shopping, Janet.

Prosecutor rejects beefed up charges against van der Sloot

Birmingham, Alabama (WIAT)  Peruvian prosecutors have rejected a plea by Stephany Flores' family to have Joran van der Sloot charged with "robbery with murder" which would have carried a possible life sentence.  Instead, the prosecution wants to stick with "murder followed by robbery" which carries a 30 year max.

The public prosecutor in the Peruvian capital Lima says he will maintain the original charge of murder against Dutch citizen Joran van der Sloot. He characterised the charge as ‘clear and coherent’.

The semantics mean decades less sentence for the Dutchman who has already admitted he killed Stephany, a 21 year old student he met at a poker tournament.  Her corpse was found in van der Sloot's Lima hotel room five years to the day of Natalee Holloway's disappearance on a graduation trip to Aruba.  The Mountain Brook teen was last seen leaving an Oranjestad bar with van der Sloot and two other local teens.

Van der Sloot told investigators in Peru that he killed Stephany Flores after she found material about Natalee on a laptop in his hotel room.  He's claiming the equivalent of a crime of passion.  Police investigators say he killed and robbed her because he was broke and desperate.

Cheers greet former prosecutor Jeff Ashton at Orlando library as he discusses Casey Anthony book

Susan Jacobson, Orlando Sentinel
9:44 p.m. EST, November 21, 2011

Rarely has losing a big legal case been such a good career move.

Jeff Ashton, the former prosecutor turned author, has become a celebrity in the wake of the Casey Anthony murder trial.

On Monday night, a standing-room crowd of more than 300 fans showed up at the Orlando Public Library's main branch downtown to cheer Ashton and listen to a brief talk, followed by a question-and-answer session.

Many of them clutched copies of Ashton's book, "Imperfect Justice: Prosecuting Casey Anthony," which went on sale last week. The shop at the library sold all 98 copies it received and had to turn people away.

 ::snipping2::

Ashton used his characteristic humor and bite to answer several questions, including one about whether Anthony could be held accountable if she confessed to killing Caylee. No, he replied, because of the double-jeopardy rule.

"But she's not going to do that," he said. "Don't even think about it. She couldn't lie straight in bed."

(now who does that sound like?)

 ::snipping2::

"Imperfect Justice" was co-written by Lisa Pulitzer, a former New York Times correspondent who has written other true-crime books, including "Portrait of a Monster," about Joran van der Sloot, a suspect in the 2005 disappearance of American Natalee Holloway in Aruba.

Fox Television Studios has optioned the rights to Ashton's book. If a movie is made, it will be shown on the Lifetime TV channel, a Fox spokeswoman said.
