Judicial Corruption Is Worldwide
May 24th 2007

<snipped>

At the top of the list, more than 80 percent of those contacted in Paraguay, Peru, Cameroon, Macedonia and Bolivia perceived their legal systems to be corrupt.

At the other end, residents of Denmark, Singapore, Sweden, Finland and Norway least often reported their judicial systems as corrupt.

Most judicial corruption comes in the form of judges who are bribed to settle a case out of court or to rule in favor of a particular party. Court clerks also are bribed to direct cases to favorable judges.

In other instances, such as in Peru under former President Alberto Fujimori, leaders have forced out judges and replaced them with cronies.

Aruban Judge Declines Jail Extension for Giordano: Lawyers
Maryland man held since August disappearance of Robyn Gardner
Friday, Nov 25, 2011  |  Updated 11:10 AM EST

An Aruban judge declined prosecutors’ request to hold a Maryland man in jail another 30 days, his lawyers told NBC News.

Gary Giordano, who is suspected in the presumed death of his travel companion, Robyn Gardner, of Frederick, Md., could walk free Tuesday. Aruban Solicitor General Taco Stein plans to appeal, but if that appeal doesn’t happen before Tuesday, Giordano will be released and can board a plane back to the United States, News4’s Jane Watrel reported. Stein doesn’t know when the appeal date will be set.

In Aruba, charges can be filed only once. Stein said prosecutors need more time before filing.

Prosecutors do intend to charge Giordano eventually, Stein said. At that point, Giordano can be extradited back to Aruba, Watrel reported.

Original Ruling Reversed

The judge in the case issued two rulings: In the first, he agreed with prosecutors' request to extend the period of van der Sloot's pretrial detention by 30 more days.

But later Thursday, the judge issued another ruling that sided with the defense — an order to immediately suspend the execution of his earlier pretrial detention order.

Released with Restrictions

Suspects in teen’s disappearance released
updated 9/3/2005 7:30:04 PM ET

SAINT NICOLAAS, Aruba - All three suspects in the disappearance of an Alabama teenager were released from jail Saturday in a setback for the prosecution and the biggest blow yet to Natalee Holloway’s family.

Joran van der Sloot, an 18-year-old Dutchman, and two Surinamese brothers, Satish Kalpoe, 18 and Deepak Kalpoe, 21, were released on condition they remain in Dutch territory and be available to police for questioning.

Restrictions Lifted

Aruba court lifts curbs on three suspects in missing teen case
September 27, 2005

“An Aruban court has ruled that three suspects in the disappearance of Natalee Holloway can remain free without conditions.”

“Wednesday's ruling overturned an earlier decision that restricted the suspects' travel and required them to remain available to investigators. The appeals court said there was a "lack of sufficient grounds and serious suspicions" to keep the restrictions on the three men. Joran van der Sloot and two Surinamese brothers -- Deepak and Satish Kalpoe -- are suspects in the May 30 disappearance of the Alabama teen. They were released from jail on September 3rd on the condition they remain available for questioning.

THE RELEASE OF JORAN VAN DER SLOOT

Tears Fall Hard

Loving Natalee
A Mother’s Testament of Hope and Faith
By Beth Holloway

Page 182:
Helen is very positive.  "It looks good that they will remain in custody" she says.  Then just three hours after she tells me this encouraging news, a devastating call comes from an AP reporter.  Paulus van der Sloot and his attorney are bragging to everyone that all three suspects are getting out day after tomorrow!.  Then all the media start calling.  I call Helen, then FBI agent Bill and the U.S. vice-consul.  None of them have this information. So we tell the media it must be a rumor.  But the word is out all over the island from the defense side that all three suspects will walk.  Four and a half hours after this announcement is made to international media by Joran's father and his defense team, the FBI calls to tell me that it is indeed true.  So the three suspects who were last seen with my daughter, and who offered multiple versions of what happened that night, will go free.  And we are the last ones to find out.

Page 185: The last announcement I make on television is never seen.  Hurrican Katrina gives the island the cloak of cover it needs to let the suspects walk free and relieve itself of its media burden. ....

The island authorities originally planned to release the three suspects at two o-clock in the morning on Saturday, September 3.  The Strategic Communications Task Force undoubtedly helped them make a less conspicuous move and release them in the afternoon instead.

Curious to see the setup at the van der Sloot house for Joran's parade of victory, I drive by there, never in a million years expecting to see who is there.  It's the U.S. vice-consul.  At the van der Sloots' house.  Why is she here?   She spots me.  Jumps in her car and follows me to a resturant parking lot, waving, honking, calling on the cell phone.  I don't want to talk to her.  Who can we trust? ...

When Helen calls, I stand in a corner of the hotel room, phone to my ear, tapping my head against the wall over and over.  Tears fall hard.  "I'm done, Helen.  I'm done.  No justice for Natalee in Aruba.  I'm done."

Aruba Learned Nothing from Natalee Holloway: Like Joran Van der Sloot, Like Gary Giordano … Aruba Judge Orders Release of Murder Suspect in Death & Disappearance of Robyn Gardner

http://scaredmonkeys.com/2011/11/25/aruba-learned-nothing-from-natalee-holloway-like-joran-van-der-sloot-like-gary-giordano-aruba-judge-orders-release-of-murder-suspect-in-death-disappearance-of-robyn-gardner/

Quote
ARUBA, NO BODY NO CRIME … Oops, They Did It Again … ARUBA … THE NEW KILLING FIELDS.

Can anyone say that they are not surprised with the news out of Aruba and that they did it over an American long weekend Thanksgiving Day holiday? An Aruba judge has ordered the release of Gary Giordano without any conditions. Giordano is the 50 year old Gaithersburg, Maryland man who has been jailed in Aruba and the primary suspect in the death and disappearance of American travel companion Robyn Gardner.

ITS DEJA VU ALL OVER AGAIN. If this does not reeks of the Natalee Holloway case all over again. The Aruba LE and prosecutors have done it again. They have failed to make a case, in an obvious one that Giordano killed his travel companion and will profit from her death. First we were witness to Joran Van der Sloot, Deepak Kalpoe and Satish Kalpoe being released from jail in the case of the death and disappearance of Natalee Holloway. Now Aruba has a twofer, Giordano will be released in the death and disappearance of Robyn Gardner. UNREAL. No Body, No Crime … NO JUSTICE!

Some Caribbean islands are known as tax haven shelters due to their lax rules on taxes and privacy. However, Aruba now has to be known as the “killing fields” island. How can it not be thought that if one wants to kill their girlfriend, spouse or travel companion … just go to Aruba, take out a life insurance policy in advance, make yourself the beneficiary and then kill her.  In Aruba … NO BODY NO CRIME, get you off of murder charges. Imagine knowing that all one has to do is make sure a body of your murder victim never needs to be found, and you skate.

One safe island, eh?

Was there an Aruban/Dutch connection?  Was there a behind the scenes plea deal ... sparing Joran from a life sentence ... negotiated between Aruban/Dutch attorneys and Peruvian prosecutors/judges/defence attorneys ... a plea deal that would appease Joran van der Sloot and prevent him from exposing those who participated in the corrupt Aruban investigation that prevented justice from prevailing for Natalee Holloway.

Date set for van der Sloot murder trial

In September, the victim's family asked a three-judge panel for a more stringent charge akin to aggravated murder, which carries a maximum sentence of life in prison, but the panel of judges ruled on the prosecution's side.

Van der Sloot's defense attorney Luis Jimenez Navarro told CNN'S In Session this was a big win for his client. If Van der Sloot is found guilty and sentenced to the maximum penalty, under Peru's jail reduction credits, he may only serve a third of the time.

Thankfully Stephany Flores has an influential father for an advocate.

Ricardo Flores was the elephant in the room who Aruban/Dutch attorneys and the Peruvian "powers that be" had to take into considerations IF negotiations took place behind the scenes which resulted in charges that spared Joran van der Sloot from a life sentence ... charges that imply this "time bomb" could walk in 10 short years.

In other words ... Joran is not the only one that needs to be appeased.

Natalee Holloway Suspect Wanted in Peru
Last Update: 1:44 pm

LATEST DETAILS FROM CBS NEWS:

NEW YORK (CBS) Joran van der Sloot, the Dutch national who has been detained several times in the Natalee Holloway case, has now been named the prime suspect in the murder of a Peruvian girl, according to local reports.

Crimesider has been told that an Aruban prosecutor described van der Sloot as being on the run, but we have been unable to independently confirm it.

Early Wednesday morning, Stephany Flores Ramirez, 21, was found dead in a hotel room in Peru located on the avenue Miraflores district of Lima, Peruvian newspaper El Comercio reports. According to police reports, the girl was brutally stabbed and was found wrapped in a blanket in a pool of blood.

Ramirez was the daughter of racecar driver and well-known businessman Ricardo Flores.

According to Peruvian police, she was last seen with van der Sloot, who has not been located.

According to the Peruvian newspaper, the hotel room where Ramirez's body was found was registered under van der Sloot's name. Hotel employees also told police that they saw him with the girl over the weekend.

Five years ago, in May 2005, Alabama high school student Natalee Holloway disappeared during a senior class trip to Aruba. She was 18 when she was last seen leaving a bar with Joran van der Sloot, who was 17 at the time. He was detained in the case several times but Aruban authorities have said they don't have enough evidence to charge him.

UPDATE: BNO News is reporting the Prosecutor's Office in Aruba has confirmed that Joran Van Der Sloot is a suspect in the death of a Peruvian woman. Interpol has reportedly issued an international arrest warrant.

UPDATE: A police news conference is expected in Peru within the hour to confirm or clarify reports concerning Joran Van Der Sloot's alleged involvement in this murder case. CBS42 will update the story as soon as that information comes in.

An international news agency is reporting Joran Van Der Sloot is a suspect in the murder of a 21 year old woman in Peru. Van Der Sloot was the prime suspect in the disappearance of Natalee Holloway in Aruba five years ago.  According to BNO News the victim in this new case is Stephany Tatiana Flores Ramirez who was found dead this morning after disappearing Friday. Her family says she was last seen leaving a casino with Van Der Sloot.

CBS 42 News will continue to follow this developing story.

Peruvian murder trial for van der Sloot set for January
By the CNN Wire Staff
November 25, 2011 -- Updated 2319 GMT (0719 HKT)

(CNN) -- Joran van der Sloot will stand trial beginning January 6 on robbery and murder charges related to a 21-year-old woman's death, a Peruvian court announced Friday.

The timetable from the Superior Court of Lima came days after a panel of judges ruled against having the Dutch national face an even more stringent slate of charges, as the victim's family members had requested. Instead, he will face the original charges levied against him -- which, if he is convicted on all counts, could lead to a maximum sentence of 30 years in prison.

Van der Sloot is accused of killing Stephany Flores in his Lima hotel room last year. Police say he took money and bank cards from her wallet and fled to Chile, where he was arrested a few days later.

He was charged in September with "qualified murder" and simple robbery, which carry sentences of 28 years and two years, respectively.

Defense strategy by Joran's lawyer?

http://feeds.univision.com/feeds/article/2011-11-25/en-enero-inicia-juicio-a

 ::snipping2::

The Van der Sloot's lawyer, Jose Luis Jiménez, said Friday it had not been notified of the start of the process but said that the defense disputed the charge of murder facing Europe.

"We will challenge the aggravating effects subsisting (office of) the voluntary manslaughter, and on that basis to rule the room," Jimenez said in a telephone interview with The Associated Press.

The homicide is punishable by no more than 20 years in prison, said Jimenez.

The prosecution asked to be imposed on Van der Sloot 30 years in prison for murder.

According to the indictment, Van der Sloot killed Flores with "great cruelty." She was brutally beaten in the face and strangled in the hotel room occupied Van der Sloot in Lima after having been together playing poker at a nearby casino.

Jimenez said that Van der Sloot admitted killing Flores, but says he did when entering a state of rage when he realized she had been reading printed pages with information about the Holloway case the Dutch had taken from the Internet and kept in your room.

"No one can say that he may have planned before death (Flores), there is no premeditation, no one will kill (deliberately) to someone at the hotel where he is registered with his real name," he said.

The Flores family's lawyers argue that Van der Sloot planned the murder of Flores to steal money that days earlier she had won at the casino. None of the lawyers answered their phones on Friday.

Joran's trial date January 6, 2012  Wonder if Joran will offer some details into his past including the Kalpoe's involvement in the disappearance of Natalee?  It may come up since one defense he was originally using was that he killed Stephany because she saw stuff pertaining the Natalee case.

So should make it especially troubling that the Kalpoe vs. Dr. Phil trial has been postponed to April 23, 2012.  By then WHO KNOWS what information Joran will have given up  Monkey Devil!

Thanks Grace

In other words ... the defence is that Stephany has to take responsibility for her own death for being nosey and causing Joran to react with rage.  GMAB!

Klaas

Could it be that the charges that the Peruvian prosecutor/panel of judges finally agreed on at this late date is a negotiated plea deal that involved Aruban/Dutch attorneys ... a plea deal that implies that Joran could be released in 10 years for the murder of Stephany rather than serving a life sentence ... a plea bargain that has appeased and bought Joran silence regarding the happenings encompassing the morning of May 30, 2005 and those who participated.

If Joran is going to spill the bean regarding those involved in the happenings encompassing the morning of May 30, 2005 and ... those who participated in the corrupt investigation that denied Natalee Holloway justice ... I think he may wait and see what is the outcome of the defamation lawsuit.

Joran van der Sloot Goes 'On the Record' with New Natalee Holloway Story
Tuesday, November 25, 2008

<snipped>

VAN SUSTEREN: Do you have any contact with Deepak and Satish?

VAN DER SLOOT: Yes.

VAN SUSTEREN: What kind of contact?

VAN DER SLOOT: I have e-mailed back and forth with them a couple of times, called once.

VAN SUSTEREN: When did you call?

VAN DER SLOOT: Something -- three months ago.

VAN SUSTEREN: What was the conversation?

VAN DER SLOOT: It was about they had a lawsuit going, and that's really the only thing we talk about.

VAN SUSTEREN: And is there -- why is the lawsuit of interest to you?

VAN DER SLOOT: They said that if they won the lawsuit, that they'd give me a million dollars.

VAN SUSTEREN: And is that Deepak saying that, or Satish?

VAN DER SLOOT: It's Deepak. I have it on paper too.

VAN SUSTEREN: Deepak wrote it, or in an e-mail?

VAN DER SLOOT: No, I got it - just my computer. Like it's typed up.

VAN SUSTEREN: Do you know if his lawyer knows?

VAN DER SLOOT: Yes, for sure.

VAN SUSTEREN: What does it say on the paper? What's the deal?

VAN DER SLOOT: It's that if as long as I don't share anything that I know about the both of them with any money, and if they win the lawsuit, I will get a million dollars.

VAN SUSTEREN: Did that come from the lawyer or from Deepak?

VAN DER SLOOT: Both of them.

VAN SUSTEREN: Both the lawyer and Deepak?

VAN DER SLOOT: Yes. It's an official paper.

VAN SUSTEREN: Will you show us a copy of it?

VAN DER SLOOT: Yes.

I haven't seen anyone here at SM that believes 100% of what Joran says whether it be the Range Rover story or the most recent falling off balcony story.  I do believe many feel as though with every lie is a smidgen of truth.

It's clear to me that Joran is simply throwing stuff out there hoping it sticks and in the process making some $$.  He knows that he's already paid the consequence of unlawful disposal of a corpse.  Could be that the stories not involving K2 are in hopes of K2 getting a large settlement from Dr. Phil and sharing with Joran.

Aruba may or may not have closed the Natalee Holloway case but as long as Beth has breath she will continue to be a voice for her daughter ... her daughter who did not return home from a short Aruban getaway to celebrate her high school graduation ... her daughter who was denied justice by a corrupt Aruban investigation.

Aruba ends probe into Holloway disappearance

Holloway's mother, Beth Twitty, was "terribly disappointed" that the case was closed and has been on an emotional roller coaster in recent weeks, said Sunny Tillman of Birmingham, Ala., a spokeswoman for her.

"She was very hopeful the last couple weeks, and she went down there and met with the prosecutor," Tillman said. "He told her face to face that he had new and incriminating evidence and that made her hopeful."

"So now, in light of this today, it's just so perplexing," she said.

JUG TWITTY, NATALEE HOLLOWAY'S STEPFATHER:  Well, I`ll tell you, Holly, one thing, you know, Beth -- and of course it`s heartbreaking for her too, I know. And -- but Beth has a ton of speaking engagements. You know, she travels across the country. And she`ll continue to do that. And I hate it for the Aruban people because they`re going to hear this every time she speaks to the high schools and the colleges in the civic organizations out there. It`s just going to be, you know, over and over again what happened down there.

You may be right Klaas.

However ... considering Aruba/Holland's vested interest in the continued silence of Joran van der Sloot in regards to his knowledge of the truth encompassing the corrupt Natalee Holloway investigation ... I cannot comprehend that these two countries did not play a part in the Peruvian prosecution charges that implies that Joran can be released in 10 years rather than serve a life sentence for the brutal murder of Stephany Flores.  I could be wrong.

Also ... somewhere down the road ... I suspect that Joran will be transferred to Aruba or Holland to serve his sentence and then extradition would be an issue when it came to facing the extortion charges in the States.  Again ... I could be wrong.

Woman's family wants speedy trial for van der Sloot

Investigators delivered their case file to prosecutors in June for a decision on charges. Ricardo Flores said the prosecutor in the case, Miriam Riveros Castellares, is "not moving with the speed that a case of this magnitude merits."

"We're asking that either the prosecutor file charges or that authorities remove her from this case and name somebody else," he said.
