Christopher Tiensch was fatally shot on Texas coast.

Far from his hectic corporate life, Christopher Tiensch was enjoying full-time fatherhood in 2006, taking a long sabbatical in Boulder, Colo., after a string of successes in the international wireless technology business.

Then he got an offer that lured him back into that world: A business in New Zealand wanted him to serve as its chief executive, promising financial enticements and a chance to live abroad again.

"They said, 'We need you. We need you to come and take this company,'" said Dané Tiensch, the wife of Christopher Tiensch (pronounced "Tench").

But the excitement proved short-lived. Within two years, Tiensch had moved back to Austin, where he lived after college, resigned as CEO and mounted a full-scale legal crusade in U.S. District Court seeking millions from his former employer.

Now he is dead.

The end of his life came three years to the day that he announced he was leaving his previous employer, and police have begun an investigation that extends from Austin to New Zealand. Police have said they are looking into whether Tiensch's legal case is related to his death but stressed that they are also investigating a number of other scenarios.

I'm going to post a link over in Tibrogargan's thread, since it appears the investigation into Christopher Tiensch's murder extends to New Zealand, in regard to Plus SMS Limited.    She may find some information from that end and might be able to update us on any articles that would be published.

A memorial service for slain former Christchurch chief executive Christopher Tiensch has been held in Texas overnight (NZT).

More than 300 family and friends farewelled him at the Exotic Game Ranch and Pavilion in his home city Austin, five days after his body was found floating face-down in the surf in a remote area of St Josephs Island on the Gulf of Mexico.

United States police are treating his death as murder.

The Port Aransas police department says it will involve New Zealand police authorities in its search for answers about Tiensch's death.

Chief of police Scott Burroughs said this morning that no progress had yet been made in the case but the investigation was ongoing.

New Zealand police would be contacted to help assess the situation "in the next week to 10 days or so".

Long-time friend Dinah Welsh, who met Tiensch more than 20 years ago, said friends flew in ''from all over the world'' to attend the memorial, including his Mt Everest climbing team.

''They had chairs set out for 260 ... more people came than anticipated,'' she said.

Welsh said the safari-based memorial was a fitting tribute to Tiensch, whose adventurous lifestyle saw him climb six out of the seven highest mountains in the world.

The minister-led service included readings from religious texts and tributes from friends and family.

''At the end his children had hoped to be able to speak. We were all a little concerned if they would be able to do it, but his son and daughter made beautiful tributes to their dad.

''His son told us about their travels around the world, especially climbing Mt Kilimanjaro last year and what a great memory that was.''

But the hardest time for his family was yet to come, Welsh said, as they were not able to cremate Tiensch.

''Chris wanted to be cremated, but the authorities advised that with the ongoing investigation, that may not be the best course of action at this time.''

His family hope to scatter his ashes when the investigation is completed.

Texas police are keeping an open mind on the cause of death of a former Christchurch chief executive and say an "ugly" legal fight with his former employer is part of their investigation.

United States-based Christopher Tiensch, 43, was shot dead in Port Aransas, Texas. His body was found on Thursday (Friday NZT) floating face-down in the surf in a remote area of St Josephs Island.

The Coroner ruled Tiensch was shot before he died, and it did not appear to be self-inflicted.

Police chief Scott Burroughs said the death was likely to be ruled a homicide, and police had interviewed about a dozen people, but had not listed any suspects yet.

In June Tiensch won a long-running legal battle against Plus SMS and several of its directors and officers, who were found to have defamed him and were ordered to pay him US$425,408, plus interest.

Austin-based Tiensch, who had climbed Mt Everest and Mt Kilimanjaro, spent some time in New Zealand during his tenure with Plus SMS. The company had a number of disputes and its practices were called into question.

Those associated with Plus SMS in Christchurch were hard to track down yesterday.

Former non-executive director Murray Allott did not return a phone call to his Christchurch accountancy office. Plus SMS's Australian founder Garry Donoghue did not return calls.

Former chairman Jim Bracknell said he was in Thailand and read about the death through a New Zealand-based website.

He said it was unfortunate that Tiensch left behind a family including two young children, and did not want to speculate on how such a thing would have happened, or comment on Tiensch as a person.

"You don't speak bad of the dead, so I have absolutely no comment."

Thursday's court hearing was part of an ongoing legal battle between Tiensch and the text messaging company.

His lawyer, Karen Burgess, could not be contacted yesterday.

In court Tiensch argued the directors pressured him to misrepresent the company to the public to "pump and dump" the stock (a scheme to inflate the stock price so insiders could sell their shares). When Tiensch refused, the defendants defamed and ousted him, he argued.

Forty-three-year-old Christopher Tiensch was found shot dead in the Texas town of Port Aransas, South Jetty News reported.

Local police chief Scott Burroughs said in a statement the gunshot wound did not appear to be self-inflicted.

Mr Tiensch was chief executive of Christchurch-based text messaging company Plus SMS from June 2006 until September 2008, when he was forced out along with chief financial officer Les Coats – a situation contested in the US courts.

Plus SMS was plagued by scandal until the NZX finally threw the company off the exchange last year.

Lawsuits involving Plus SMS and Mr Tiensch were still active in Texas when he went missing, KRIS-TV in South Texas has reported.

The legal fights were described as ugly with some unsavoury wording between parties.

In April last year Plus SMS was forcibly removed from NZAX, where shares in smaller companies are traded.

The NZX's regulatory arm advised the market that it would be removed after repeated rules infringements, failure to comply with a ruling from its disciplinary tribunal, and its inability to meet its financial obligations to the NZX.

Plus SMS backdoor-listed in 2005 using the shell of failed retailer RetailX but it didn't take long for it to come under the eye of the regulators.

The Securities Commission began investigating the company in September 2006 after Plus SMS admitted making false statements to investors. Founder Garry Donoghue resigned and handed back $10 million.

In 2009 the entire board accidentally resigned and then reinstated themselves. The company failed to file its half-year results and blamed it on the departure of its chief executive officer and chief financial officer.

Christopher Tiensch is known among his family and friends as an avid outdoorsman and adventurer who has climbed some of the world's tallest peaks.

But now they are worried where the latest adventure may have led the 43-year-old former telecom executive who recently won $430,000 in a business-related lawsuit.

Tiensch disappeared Sunday night during a fishing excursion in Port Aransas, spurring a search that involves local police in the beachside community, the Texas Rangers and the Travis County sheriff's office.

"We have no idea what has happened to him," said family friend Dinah Welsh, who spoke Wednesday on behalf of the Tiensches. "It is extremely out of the ordinary for him to not be in contact with his wife and family."

The Tiensches moved to Austin in the early 1990s, Welsh said. He was a legislative aid for a U.S. senator and worked as a Texas Capitol staffer and on several political campaigns alongside Karl Rove, according to an executive bio.

In the mid-1990s, Tiensch worked as executive director for the European division of SBC Communications, overseeing international operations until 2001, when he joined startup BMD Wireless, the bio said.

The Tiensches left Austin, living in Europe as he pursued his career. He eventually was made chairman at BMD and, by 2006, headed up New Zealand CRE8 Limited, formerly known as Plus SMS Limited.

By 2008, the Tiensches returned to Austin, where he was consulting, Welsh said. She said the family was financially comfortable and active in the community.

CORPUS CHRISTI — Authorities are looking into an Austin man's lawsuit against his former company after he was found shot and killed near Port Aransas last week.

Christopher Tiensch, 43, had been in a legal battle with the telecommunications firm where he once worked as CEO, according to court filings.

A hearing in the case involving a possible financial settlement in Tiensch's favor was set for Thursday in Austin, Port Aransas Police Chief Scott Burroughs said.

While investigators are reviewing the case and planning to interview some of the parties involved, Burroughs said there is no indication that the lawsuit has any connection to Tiensch's death, which is under investigation by Port Aransas police, the Texas Rangers and the Travis County Sheriff's Office.

In 2008, Tiensch filed a wrongful termination suit against the company, North America Cre8 Inc., and its parent company, New Zealand-based Plus SMS Holdings, described in the lawsuit as a leading instant messaging software vendor for Microsoft.

Tiensch claimed he took a poorly managed company and turned it around, only to be ousted when he exposed securities violations by its senior managers. He claimed they made misleading statements to inflate the company's stock price for their benefit, then blamed him for the company's troubles. Company representatives could not be reached for comment.

In April 2010, Plus SMS was removed from the New Zealand Alternative Exchange, where shares in smaller companies are traded, according to the New Zealand Herald.

Regulators who delisted the company cited repeated rules infringements. The country's Securities Commission began investigating the company in September 2006 after Plus SMS admitted making false statements to investors, the Herald reported. Founder Garry Donoghue resigned and handed back about 10 million New Zealand dollars.

What conclusions can be drawn from the Plus SMS debacle?

Was it blatant share-price hyping or just a bad case of investor naivety?

Should back-door listings be banned or are they an acceptable feature of the NZX?

Will the Securities Commission undertake a comprehensive investigation or will it issue another one-page press release declaring all is sunshine and roses as far as New Zealand investors are concerned?

The Plus SMS saga began on March 8 last year when RetailX, the struggling NZAX listing, announced it would acquire the SMS messaging company for $12 million.

At the time of the announcement, RetailX's share price was 8c and its total market capitalisation only $248,560. The stock was rarely traded and only 4000 shares had passed through the market during the first nine weeks of the year.

The deal was announced six weeks after 600,000 new shares were issued to Brett Wilkinson at 5c each and eight days after Jim Bracknell and David Stubbs were appointed directors, the former as chairman.

Bracknell and Stubbs were previously involved with Newcall, the vehicle for Blue Chip's back-door listing.

On May 11, the company revealed a loss of $4.5 million for the March 31 year, with not a single dollar of trading revenue.

A month later, Christopher Tiensch was appointed chief executive but Bracknell continued to make positive announcements and, in June and early July, a further 10.9 million options were exercised at 10c.

But the charade came to an end on August 30 when the company requested a trading halt and, two days later, issued a statement that Bracknell and Donoghue had resigned.

The former chief executive had agreed to give back all the shares beneficially held by him , it said, and "the company has made what in hindsight appears to be a number of unrealistic statements".

An appendix at the end of the statement listed three significant incorrect statements by the company. These appeared in either the 2006 interim or annual reports above Bracknell's signature.

Thank you so much for all the articles you've posted Tib.  You've found so much!  I was really curious if it was making the news in New Zealand and that's why I asked for your assistance. 


 

I will stop posting company profiles now, but I do find it interesting that a company has so many changes in just a few years, together with all the problems with their Stock Exchange listing.  Not very reassuring for any stock holders.
