Van der Sloot asks for more time to decide plea in 2010 murder, trial postponed
The Associated Press
Jan 06, 2012 12:10:00 PM

<snipped>

Flores' father, Ricardo Flores, told the AP Friday that the family would participate in the trial in hopes of ensuring that Van der Sloot is also accused of robbery in connection with the killing,

Prosecutors are seeking a 30-year prison sentence on murder and theft charges.

But Jimenez has said he would argue that his client was in a state of emotional distress when he killed Flores and "seek to reduce the charge from first-degree murder to simple homicide." The latter carries a prison sentence of from eight to 20 years.

Police and Flores' family dispute Van der Sloot's version of her death. They say the defendant was hard up for cash and knew the Peruvian business student had been winning at the casino.

"We hope that throughout this process our attorneys can demonstrate the true motives for the killing of my daughter," Ricardo Flores said.

I was reading Insessions FB, I read a post from a person, who knows of a heroin user and what she said made sense to me.  With his attitude, smiling, acting oblivious, nonchalant and nodding off, etc. are signs of drug use, especially in heroin users.  I do believe drugs come easily in that prison and widely used, so wouldn't be surprised if that was the case while in court.  He probably went their higher than a kite, for the same reason some said here, his is a COWARD!

I most certainly pray the judges take his lack of respect of them and the court system seriously and use that to give him the max possibleI

 ::boxingjoran::

Sounds like something he would do, if for no other reason...to brag about doing it.

He has no respect for authority and he's a coward; through and through.

Joran Van Der Sloot Seeks Murder Deal in Peru

<snipped>

Today’s hourlong courtroom session appeared to set up a situation where van der Sloot will plead guilty by reason of temporary insanity, which, under Peruvian law, carries a sentence of three to five years.

If he pleads guilty to temporary insanity and the court accepts that plea, he could be set free, according to statements his lawyers have made to ABC News.

They state that Peru has a two-for-one stipulation in its judicial system, meaning a prisoner’s time spent in jail awaiting trial is computed doubly. Van der Sloot has completed more than three years of jail time — the minimum of the three- to five-year term if found guilty.

If given the maximum sentence of five years, he would finish that term in less than two years.

I didn't get to watch the trial live today.  I'm watching Vinnie Politan and just saw where the judge made Joran stand up and reminded him that he IS in a court of law and that he needed to sit up and behave appropriately.

Anita and Mary Hamer must be so proud.

Seems like Mary could have spent some time at the goodwill looking for him something decent to wear to court.  Blue jeans?  Seriously?

But I guess if he wasn't going to behave with any respect it doesn't matter what he wears either.

Have to wonder if he would have been so disrespectful if the three judge panel had been made up of men?

They say that honest confession does not apply to Joran Van der Sloot
Friday, January 6, 2012 | 8:20 pm

Family Lawyer Stephany Flores, Jose Camarena said the Dutchman can only accept the charges of the prosecution or continue oral proceedings.

At this stage of proceedings against Joran Van der Sloot for the murder of Stephany Flores can not speak of sincere confession and why the Dutch only have until next Wednesday January 11 to decide whether to accept the charges prosecutors.

"I think at this stage of the process, talk about sincere confession technically no longer applies. We must not forget that he has had all the stage-level statements and tried to provide and clarify the facts, "said Jose Camarena, a lawyer for the Flores family.

Speaking to RPP News, noted that Van der Sloot requested time to assess whether early termination welcomed the process, but "more than a foregone conclusion he would have to do is to accept the charges Mr. (...) or else not accept the charges and proceed to trial. "

"The room has raised these alternatives and asked him the time to coordinate details and Wednesday will give its final opinion," he said.

Camarena said that if the Dutch can accept the charges that the College "B" of the Third Criminal Court reduced the 30 years requested by the prosecution, but if you continue with the trial "runs the risk that vary the type and therefore go to life imprisonment. "
 ::snipping2::
Finally, if the room reflected that imposes the maximum sentence of 30 years on Van der Sloot would go to jail for 52 years, not counting prison benefits, and "will remain a very dangerous not only for Peru but for humanity ".

Thanks Grace.  This makes sense.  It was my understanding until today when various articles implied that Joran could plea a lesser charge than the prosecution put on the table.  However ... I don't comprehend why the judge afforded Joran another five days to think about whether he was going to plead guilty or non-guilty to the Prosecution's charges.  He and the world have known about those charges for over two months.

Van der Sloot trial scheduled to begin this Friday in Peru
PeruthisWeek.com
January 5, 2012

<snipped>

Prosecutor Miriam Castellares is asking for 30 years in prison, on charges of murder and simple theft; however, Flores’ family is asking the public prosecutor to amend the charges to “robbery followed by murder.”

According to Edwar Alvarez, the Flores family’s lawyer, under these charges Van der Sloot could receive life imprisonment.

"We aim to present evidence during the trial that will lead the prosecutor to change the classification of the crime, so that it becomes robbery followed by murder. This will not be 30 years in prison, but life imprisonment,” he said to El Comercio.

The prosecution is scheduled to present its case in court on Friday, and will present the evidence and inform Van der Sloot of the charges against him.

The hearing will take place at the courtroom of the Lurigancho prison.

If Van der Sloot declares pleads guilty, the judiciary would issue a ruling in about 48 hours, according to El Comercio.

If he pleads not guilty, the trial would proceed with the presentation of evidence and witnesses.

That's it, TxMom.  Joran is totally incapable of showing respect to women.  I have to wonder what in his life caused him to hate women so.  I wonder if Anita wonders the same thing.

The hearing was January 3rd and they are given 5 days (I suspect normal court days) so that would be until Jan 10th I believe.  We won't know if they complied (which I highly doubt) until some time after January 10th.

Van der Sloot to "sincerely confess" to murder in Peru
11:24 a.m. CST, January 6, 2012

 ::snipping2::

On the first day of his trial in Lima, he told the court he should not be charged with aggravating circumstances of the murder that could lengthen his sentence.

Under Peruvian law, a prison term for a "sincere confession" to a murder is normally much shorter than one for an outright guilty plea. Prosecutors have said Van der Sloot robbed and killed Flores before fleeing the scene of a crime toChile.

If Van der Sloot formally enters a "sincere confession" to the judges on Wednesday, the trial would quickly enter a sentencing phase and he could spend less than a decade behind bars.

His defense lawyer had said earlier on Friday Van der Sloot would plead guilty.

Van der Sloot's plea strategy prompted the panel of three judges to suspend the trial, which started on Friday, until Wednesday, when his defense team will provide a detailed response to charges presented by prosecutors.

The defense has complained that the panel of three judges is made up exclusively of women and might be biased against him.

Van der Sloot smiled nervously as the trial opened, at times closed his eyes, snoozed or yawned, and stumbled over his own words in Spanish as he told the judges of his plea plans.

 ::snipping2::

And then he would come to Alabama to face Federal Extortion Charges.

No matter how it turns out, I do believe Joran's life for all practical purposes is pertty much over.  I mean his life of freedom.

It couldn't happen to a more deserving lout.

I hope Joran remembers that whatever the length of time he ultimately serves for Stephanie's death, he will be headed to Alabama.

He really doesn't want to come here.  No matter how old he is.

I agree!  No, Joran doesn't want to come to Alabama at all.

And federal crimes carry huge penalties like this one I think is 25 years.  That is also about the penalty for robbing an armoured car.  I don't think they get breaks for good time and so forth in federal prison.  At least not so much as lesser ones.

I, on the other hand, want very much for him to come to Alabama.

I wonder if Joran's demeanor in court today wasn't intentional as just another part of his crazy helper's plan to try to get him out of everything he's done.

She has already claimed that he is being drugged by the prison officials.

I wouldn't put anything past him, to try to get this trial overturned down the road.

I hope they're testing him regularly.
