Just a friendly reminder regarding the charge against Joran as explained by a Peruvian lawyer specializing in criminal law.

Quote
Mario Amoretti, a Peruvian lawyer specializing in criminal law, said the public had expected prosecutors would try for a stiffer sentence against Van der Sloot but had to scale back their plans because of sentencing guidelines for murders in which robbery could be the primary motive.

"In the Van der Sloot case, the Supreme Court has arranged the following - that he be tried and get no more than 30 years for premeditated homicide. And that he not be tried for aggravated robbery resulting in death, which would merit life in prison. Because under our laws, something incredible, says that if I kill someone to rob them the penalty carries minimum of 15 years and a maximum of 35. If I rob someone and as a result of the robbery someone is killed [by accident], the penalty is life imprisonment. It is unbelievable but that is how our legislation is. And, according to the investigation that has been carried out, it concludes that Van der Sloot only did what we call a premeditated homicide. He killed in order to rob," Amoretti said.

Van der Sloot trial: the key process that begins tomorrow
The Flores family's lawyer said the strategy used against the Dutch. There are five tests to sink shafts poker player
Thursday January 5, 2012 - 8:28 a.m.
SEBASTIAN MARTINEZ ORTIZ @ Shebas07

 ::snipping2::

Although the fiscal Miriam Castellares Riveros, head of the Ninth Criminal Lima Senior Prosecutor, asked for 30 years in prison for crimes Dutch homicide and simple theft, the defense of Flores Ramirez's family asked the Public Prosecutor in the last part of the process to amend the definition of robbery followed by death.

Under these charges, said Flores' lawyer, Edward Alvarez, Van der Sloot would receive life imprisonment. "We aim to present evidence after the trial, the prosecutor change the definition of the crime and murder becomes robbery followed by death. This will not be 30 years in prison, but life imprisonment, "he said in a conversation with elcomercio.pe.

Alvarez said that they as the aggrieved party can not require you to school "B" of the Third Criminal Court for Inmates in Jail, now presiding Judge Victoria Montoya Peraldo, life imprisonment for the Dutch, but this is in the hands of the Attorney General .

"According to our criminal justice system, the role falls to pursue the prosecution. What we do is help presenting evidence, but not for me to call penalties. We'll give inputs to the fiscal and she should also take into account these items so you can modify the charge, "he said.

WHAT WILL HAPPEN IN THE FIRST HEARING?
At the hearing on Friday, marking the beginning of the trial, both parties, the aggrieved and the Van der Sloot, present new evidence in their possession and then the room will inform the accused of the charges against him by asking if accept it.

If assumed, the judiciary ruling issued in about 48 hours, but the Dutchman denies the charge, will be moved to stage presentation folders, witnesses and allegations, all this will develop in different sessions.

EVIDENCE AGAINST THE DUTCH
The defense of the Flores family has based its strategy on five tests in shafts and key testimony considered. Alvarez explained that the pillar of his argument are the images of the hotel security camera Tac, showing van der Sloot leave and return to her room scene, with two cups of coffee to simulate continued Stephany life when he was already dead.

Another point, perhaps the most important part of the evidence, are the conversations held poker player over the Internet with his friend Stan Pluijmen, who said he was in Lima without money and would be capable of anything, even prostitution, to get some money to allow him to return to their country.

Analysis Division of the Police High Technology held at the defendant's laptop will also be taken into account, because this indicates that searches the case of Natalee Holloway, who disappeared in Aruba in 2005, took place a day before the murder of Peruvian student, so the Dutch hypothesis violent crime fell by emotion.

The fourth axis, according to Alvarez told us is that the poker player during his escape to Chile confided to the three drivers who transported them he was running because he had killed someone and the last test is the statement that Van der Sloot gave in which he confessed to the murder.

"These statements (confession) have not been crossed in the process. His lawyers have not taken even the work of applying for annulment of that document, so you have any legal validity and use it at the trial, "he added.

THE KEY WITNESS
Among the witnesses to be cited by the Third Criminal Court to Jail Defendants include Atlantic City casino workers and the Hotel Tac and friends of the victim, including Carola Sanguinetti Espinosa, who was with Stephany hours before he lost life at the hands of Van der Sloot.

In his statement to the judiciary, she said Flores Ramirez possessed a day before his death the 7 thousand suns that had won at the casino this week.

"In the afternoon, when we went to the cookout and Markham going to get off the car, gave me my wallet and I saw that it was a big wad of money, all notes of 100 soles, then when exiting of this activity put it in your car and remained there throughout the time that we stayed together in the hotel Pacific to 11 at night, "said the girl.

For Alvarez this testimony is crucial to determine the motive of the murder of Flores Ramirez was the money and not a backlash, as it tries to make believe Van der Sloot.

Finally, counsel stated that the Flores family will not exert any pressure on the judges who will be in charge of the trial, but said that its members expect the judiciary and especially the Attorney General to meet a responsible role "allows them to obtain justice ".

Van der Sloot trial scheduled to begin this Friday in Peru
PeruthisWeek.com
January 5, 2012

<snipped>

Prosecutor Miriam Castellares is asking for 30 years in prison, on charges of murder and simple theft; however, Flores’ family is asking the public prosecutor to amend the charges to “robbery followed by murder.”

According to Edwar Alvarez, the Flores family’s lawyer, under these charges Van der Sloot could receive life imprisonment.

"We aim to present evidence during the trial that will lead the prosecutor to change the classification of the crime, so that it becomes robbery followed by murder. This will not be 30 years in prison, but life imprisonment,” he said to El Comercio.

The prosecution is scheduled to present its case in court on Friday, and will present the evidence and inform Van der Sloot of the charges against him.

The hearing will take place at the courtroom of the Lurigancho prison.

If Van der Sloot declares pleads guilty, the judiciary would issue a ruling in about 48 hours, according to El Comercio.

If he pleads not guilty, the trial would proceed with the presentation of evidence and witnesses.

Joran van der Sloot to Begin Peru Murder Trial
Published January 05, 2012

<snipped

Prosecutors are seeking a 30-year prison sentence for Van der Sloot on murder and theft charges in a trial that will be held at Lima's Lurigancho prison. He is accused of murdering Flores with "ferocity and great cruelty," and prosecutors say he also stole 600 soles, about $220, from the victim.

<snipped>

The defense will argue that Van der Sloot killed Flores in a state of emotional distress.

"We will challenge the aggravating factors (charged by the prosecution) and seek to reduce the charge from first-degree murder to simple homicide," Jimenez said. That charge carries a prison sentence of from eight to 20 years.

He said his client, whose prominent lawyer father died of a heart attack on an Aruba tennis court in February 2010, was in a fragile state from years of being under suspicion for Holloway's presumed death and other legal problems stemming from that case.

"The killing was impromptu. There was no planning to carry it out," Jimenez said.

Lawyers for Flores' family, who are allowed to participate in the trial under Peruvian law, will try to show that Van der Sloot killed the woman to steal money she won at the casino.

If the court finds that to be true, a conviction could result in Van der Sloot being sentenced to life in prison.

"This guy wanted to take the money of the girl because he, in communications he had with his friends in Holland through Facebook and email, stated that he had no money, that he had no money or food, that his stay in Peru was hard and he told them: 'I am on the verge of prostitution,"' family lawyer Edward Alvarez said in an interview.

Alvarez predicted Van der Sloot would plead guilty Friday in an effort to get a reduced sentence.

Jimenez, the defense attorney, ruled out that possibility.

Joran van der Sloot's Defence in a Nutshell?

Van der Sloot to go on trial for murder of young woman in Peru
By the CNN Wire Staff
January 5, 2012

<snipped>

Van der Sloot was charged last September with "qualified murder" and simple robbery, which together could carry a sentence of up to 30 years in prison. Flores' family later tried -- unsuccessfully -- to convince three judges from the superior court of Lima to impose an even more serious slate of charges that could have included a life sentence.

His attorney, Luis Jimenez Navarro, told InSession on Wednesday that his client "will accept at trial the charge of simple homicide.... What he will not accept are the aggravated charges."

"We are sure that -- with support from ... experts -- it will be determined that Joran was living in a post-traumatic state during the attack," Navarro said, adding that "psychologists and psychiatrists" will testify at van der Sloot's upcoming trial.

He pointed to the Holloway case, noting that the fatal attack on Flores occurred exactly five years after the Alabama girl went missing. It has been widely reported that van der Sloot killed the woman after he believed she saw something on the Internet relating to Holloway.

"He is a young man ... who has practically lived persecuted for a crime he says he did not commit ... or for a disappearance that he cannot explain," the lawyer said of van der Sloot. "Movies and books have been made ... At that age, and with other characteristics of his psychological profile,... in that moment, he felt threatened and reacted in a brutal manner."

Jimenez said that he' and his client will ask the judges for a 7- to 20-year sentence, "which are the legal sentencing parameters for homicide." He contended his client never planned to "entrap ... the future victim in a casino where there are more than 30 cameras" while he was staying in a room registered under his legal name, and then kill her.

"There was no premeditation," the lawyer argued.

The Trial Proceedings?

Van der Sloot to go on trial for murder of young woman in Peru
By the CNN Wire Staff
January 5, 2012

<snipped>

Three judges will preside over Van der Sloot's trial, starting Friday, and there is no jury.

The proceedings will begin with the prosecutor stating the "facts" that have been proven in the case, as well as detailing the alleged crimes committed, according to Peruvian lawyer and University of Oklahoma professor Giovanna Gismondi. Then the lead judge will talk generally about the crime, after which van der Sloot's side will have the floor.

This round of the case could include testimony from the accused, though Navarro said that van der Sloot likely wouldn't give a statement Friday though he may answer questions from judges. The other scheduled trial dates are next Tuesday and Thursday, though the judges could adjust the plans at any time.

Two macabre ironies....Flores' corpse was found in van der Sloot's Lima hotel room on the fifth anniversary of Natalee's disappearance.  And many believe he traveled to Peru on money he got from Natalee's family after promising information on her fate.  A federal grand jury here in Birmingham indicted him on fraud and extortion charges when no information was given

Van der Sloot ought to be acquitted. Gary Giordano was in Aruba when both Holloway and Gardner went missing. Flores is collateral damage in the persecution of an innocent man.

Joran van der Sloot - In His Own Words

Confession: Joran van der Sloot describes killing Stephany Flores

Asked for a detailed description of the killing:

"She was on the bed when I hit her hard with my right elbow and I think her head went back and hit the wall, then she begins to bleed, immediately I get on top of her and with both hands I begin to strangle her, keeping her that way for a minute. After that, I throw her to the floor but she keeps breathing. At that moment I take off my shirt and put it on her face, pressing on it. I don't remember for how long but she stops breathing, in this way I think I caused her death."

Drowned Aruba tourist was a Wake Forest University staffer

By Kitty Bean Yancey, USA TODAY
Updated 8h 20m ago Comments

Jing Wei, who drowned in late December while snorkeling with her husband in Aruba, has been identified as employee of North Carlina's Wake Forest University, according to a Thursday report in the Winston-Salem Journal.

China-born Wei, 48 and a well-regarded instructional technology staffer at the university, died as a tour group ended the day at Baby Beach, which is the same place U.S. tourist Robyn Gardner was reported missing in August.

Yaochun Zhang, Wei's husband, told the Journal his wife's drowning is unexplained, though he said she was not a strong swimmer. He said she was in 15-foot water when she was discovered to be in trouble.

Two friends, a doctor and a physician assistant, assisted Aruba paramedics in trying to revive Wei, Zhang said. They couldn't. "We were shocked. We couldn't believe it," he told the newspaper.

I'm pretty sure the KIA prison is also near where Robyn Gardner supposedly disappeared.

Police conduct search for woman screaming for help

Monday evening around 8 o'clock KIA prison personnel heard a woman screaming for help. Police found a Chevy Aveo with the key in the ignition, but no sign of the woman. Witnesses heard the screams and what sounded like a few gunshots immediately thereafter. The helicopter was used in the search.

Police did find a man "under the influence" and detained and took him to the precinct since there is an ongoing search and investigation. The woman was not found; the car was confiscated pending investigation.

"I can look back over the past 10 years and there were no steps wasted, and there are no regrets,'' she said. "I did all I knew to do and I think that gives me greater peace now." "I've lived every parent's worst nightmare and I'm the parent that nobody wants to be," she said.

Natalee Holloway case: Federal authorities in Alabama have a hold on Joran van der Sloot if he's released after his trial in Peru

BIRMINGHAM, Alabama -- If Joran van der Sloot is released after his trial on charges of killing a young Peruvian woman, which begins Friday, federal officials in Alabama have a plan in place that could give them a chance to bring him to the state to face charges related to the investigation into the 2005 disappearance of Mountain Brook teenager Natalee Holloway while she was on a trip to Aruba.

"For months the government has had a detainer filed through Interpol that would result in van der Sloot being held if, for any reason, he were to be released on charges in Peru," according to a statement emailed from Peggy Sanford, spokeswoman for the U.S. Attorneys Office in Birmingham.
