NEW YORK – The 2011-12 NBA season could be over before it starts.

The National Basketball Players Association, saying the collective bargaining process has "completely broken down," served notice to the NBA on Monday that they plan to dissolve and pursue antitrust lawsuits against the league for the 137-day lockout.

"The players feel they're not prepared to accept any ultimatum," NBPA executive director Billy Hunter said. "We think it's extremely unfair to give (players the ultimatum) that they accept (the owners') proposal or roll back to 47%" from a 50-50 split of basketball-related income.
We have negotiated in good faith for over two years," Hunter said. "But the players just felt they have given enough, that the NBA was not prepared to negotiate, that things were not going to get better."

Hunter said there was a "high probability" there won't be a season.

The NBA has informed teams that all games through Dec. 15 have been canceled, according to a tweet from Adrian Wojnarowski of Yahoo! Sports.

The most recent collective bargaining proposal sent to the players detailed a 72-game 2011-12 NBA season that would begin on Dec. 15. Yesterday the NBPA made the decision to reject that offer from the owners, and have begun to make efforts to disband their union. In doing so, they plan to try to take talks of a new collective bargaining agreement out of the negotiating room and into the courts.

Until now, NBA commissioner David Stern had only officially only canceled NBA games through Dec. 1
. During an interview Monday on ESPN, he made it clear that with the NBA players’ recent actions, the possibility of any season in 2011-12 is becoming increasingly unlikely.

Some December NBA games lost; players file suits


NEW YORK – As the NBA and the dissolved players union hand off the impasse that is the 138-day lockout, a look at the calendar says the cancellation of those highly valued, nationally televised Christmas Day games is just around the corner.
Tuesday, the players would have received their first paychecks of the season — if they had a season.

Instead, through their attorneys, they filed a lawsuit against the league for the lockout in northern California, an employee-friendly jurisdiction, and another group filed suit in Minnesota.

Newly hired players attorney David Boies said the suits were filed "in order to try to restore competitive, free-market conditions."

"It's in everybody's interest to try to resolve this promptly," said Boies, speaking in New York. "The longer it goes on, the greater the damages teams will face. The right way to address the players' damages is to ask the owners to pay for it."

Plaintiffs named on the lawsuit filed in the northern district of California are Carmelo Anthony, Chauncey Billups, Kevin Durant, Leon Poew and Kawhi Leonard.

Plaintiffs named on the lawsuit filed in Minneapolis include Caron Butler, Ben Gordon and and rookie Derrick Williams.

That will not enhance the possibility of games any time soon.

Two antitrust lawsuits filed by players against the N.B.A. were merged on Monday in the hope of bringing a swifter judgment against the league, and a swifter end to the lockout.
The decision was announced by David Boies and Jonathan Schiller, whose law firm was hired last week by the National Basketball Players Association. Boies and Schiller will remain the lead lawyers in the case.

Locked-out players filed two lawsuits in federal court last week, in separate jurisdictions, by independent legal teams. The courts would have eventually combined the complaints, because they were similar and sought the same remedy. Merging them now removes one obstacle.

“If we had not done this, at some point the courts would have done this,” Boies said in a news conference at his Manhattan office.

He added: “If we’d waited, it would have taken 6, 8, 12 weeks. This solves that issue now and allows us to move forward.”

NBA and players resumed talks on Tuesday to try and end the lockout before the cancellation of Christmas games, two sources told Y! Sports.

Talks were expected to continue today, sources said, and one league source tells Y!: “We should know more by later this evening.”

Derek Fisher isn’t a part of the talks now, sources say.

NBA fans will receive quite a gift this Christmas: a season. At around 3:30 AM Saturday morning, the NBA’s owners and players announced that they have reached a handshake agreement on a new collective bargaining agreement, after a 149-day lockout threatened to wipe out the entire 2011-2012 season. The season will tip-off on Christmas Day, and will feature a rematch of last year’s NBA Finals meeting between the Dallas Mavericks and Miami Heat. A majority of the NBA’s owners and players must approve the agreement, and although some people on both sides are not happy – “We (bleeping) caved,” one veteran player, who said he would not vote for the new deal, texted Yahoo! Sports – the deal’s approval is a mere formality. There will be pro basketball this year.

Teams began talking to agents Wednesday as the lockout inched closer to its end, and basketball moved back into focus. Dwight Howard and Chris Paul were linked to trade speculation, while free agents such as Tyson Chandler and Nene were in the news after months of attorneys getting all the ink.

Now, the players are taking over and the league was set to reopen its facilities for workouts Thursday.

Some may arrive out of shape, just as was the case in January 1999 after the NBA's only other shortened season. But they're anxious to get back, with a little more than three weeks until they start playing games.

"The guys are going to come in and I'm sure they're going to be in good shape. They want to play," new Houston coach Kevin McHale told reporters.

"These guys have played basketball their entire lives. They love to play basketball and they're excited to get after it."

The league still hopes to open training camps and free agency next Friday, leaving both sides scrambling to get business finished in time.

The lawsuits have been settled, contingent upon the ratification of a new collective bargaining agreement by Dec. 9. Players are in the process of collecting the signatures needed to approve the reformation of the union, which must be done before the sides can resume bargaining on the remaining issues that must be settled before each side can vote.

NBA officials are working to complete a two-game exhibition schedule for each team that will lead to a 66-game regular season, starting with a five-game slate on Christmas.
