Opening Statements in the Jerry Sandusky sex abuse trial began Monday morning with prosecutor Joe McGettigan telling jurors this is a case involving a serial predator.

One by one, McGettigan showed photos of eight smiling boys to the jurors, photos of the alleged victims at the age he says they were victimized by Jerry Sandusky.  McGettigan explained to the jurors that they will hear from young men who are now older than the photos on the screen before them.  But the prosecutor told the jurors they must remember when those victims testify, they will be telling the experiences they endured while they were kids.

McGettigan then put three words on a screen in front of the jury, what he says jurors must keep in mind about the state of mind of the boys as they were victimized.  Those words were “Humiliation,” “Shame” and “Fear.”  Then up on the screen went an equal sign and the word “Silence”.

McGettigan told jurors that those three elements added up to years of silence from the victims, until a teenager at Central Mountain High School in Clinton County got older, got a sense of self and spoke out to school officials about the abuse.

The prosecutor went through boy by boy with the jurors and told them the kind of abuse they endured.  He talked about that teenager from Clinton County having Sandusky perform oral sex on him dozens and dozens of times.  He said the boy had to perform the oral sex on Sandusky dozens of times too.

BELLEFONTE, Pa. — The lead prosecutor opened former Penn State assistant football coach Jerry Sandusky's trial Monday by introducing the jury to each alleged victim and giving a graphic description of the abuse they say he perpetrated on them.

Senior Deputy Attorney General Joseph McGettigan III showed the jury of seven women and five men pictures of the accusers and said that prosecutors will show that the longtime assistant to football coach Joe Paterno was "a serial predator" whose activities took place "not over days, not over weeks, not even over months, but in some cases over years."

McGettigan told the jury that Sandusky put his hands in one victim's pants and engaged in oral sex with another. He said prosecutors will show a pattern in which Sandusky groomed boys and then abused them.

"Each of these victims met the defendant through The Second Mile," McGettigan said, referring to the charity to which Sandusky had founded for children.

Describing the alleged abuse's effect on the children, McGettigan displayed a slide to the jury with the words "Humiliation Shame Fear" and "Silence" in bold, black letters.
Sandusky, 68, faces 52 criminal counts that he sexually abused 10 boys over 15 years, allegations he has denied. Sandusky's lawyers were not able to get the judge to delay the trial, and on Friday Judge John Cleland rejected their request to have some or all of the counts dismissed.

They were to offer their opening statement later Monday morning.

A pair of scathing grand jury reports allege Sandusky sexually abused young boys he met through The Second Mile, a charity he established in 1977. Sandusky allegedly used his connection to the football program and gifts to groom boys for sexual contact that the grand jury said occurred at his home or in the team facility's on Penn State's campus.

Sandusky hunched slightly his seat at the defense table as Judge John Cleland outlined the charges to the jurors. He looked pale and blinked a lot, then he looked away after McGettigan referenced an alleged 2001 attack in a Penn State shower.

Cleland opted not to sequester the jury, saying he trusted the panel to avoid reading or watching reports about the case.

Many of the alleged victims are expected to take the stand for the prosecution, and their credibility in jurors' eyes could prove to be the decisive factor in determining the verdict.

However the criminal case ends, when it comes to getting to the bottom of what happened, the trial will not be the final word.

The state attorney general's office has repeatedly indicated it has an "active and ongoing" related investigation, and the mere existence of the open investigation suggests additional criminal charges could result.

There also clearly is a federal investigation, but there are few details beyond the fact that Penn State said that in February it had been issued a wide-ranging subpoena from the U.S. attorney's office in Harrisburg, seeking computer records and other information.

Two Penn State administrators are awaiting trial on charges they failed to properly report suspected abuse and lied to the grand jury investigating Sandusky. The pending charges raise the prospect that investigators under the attorney general's office may be continuing to look into that matter, which commonly occurs after charges are filed and before trial.

Several of Sandusky's alleged victims have retained attorneys, although only one has so far filed a civil complaint. That case is on hold until Sandusky's trial wraps up, and other lawyers also have indicated they are holding back until a verdict is reached.

Hi KittyMom    I'm hoping there will be some justice for the victims.  I realize Jerry Sandusky is presumed innocent until proven guilty, but to me, there are so many victims.  If he sexually assaulted even one of them, he should do time.  I'm concerned how the trial will go, because of the years that have passed and the problem with what I think may be lack of hard evidence.  Pedophiles are tricky after all.  I still feel even if somehow Jerry walks, there will be the civil suits.  And those will follow him and they will drain his resources.  Whatever works, imo.

BELLEFONTE, Pennsylvania (CNN) -- Opening statements in the trial of Jerry Sandusky, the former Penn State assistant football coach charged with child rape, were under way Monday.

Joseph McGettigan, prosecutor for the Commonwealth of Pennsylvania, began speaking at about 9:45 a.m. He called Sandusky a "serial predator," telling jurors they would hear evidence of alleged abuse that in some cases went on for years.

Sandusky, 68, has been under house arrest since being charged with sexually abusing 10 boys for at least 15 years. Prosecutors allege that he met some of his accusers through Second Mile, a charity he created for underprivileged children.

As McGettigan spoke Monday, childhood pictures of eight of the 10 alleged victims were shown on a projector screen, and the alleged victims were identified by their first names.

The prosecutor reminded jurors that Sandusky, not Second Mile, was on trial.

McGettigan's opening statement followed about 20 minutes of jury instructions from Judge John Cleland. "You are the conscience of the community," he told the panel.

Prosecutors plan to call more than 50 witnesses, and the defense plans to call about 100. Witnesses during the trial are expected to include Jay and Sue Paterno, coach Joe Paterno's son and widow; and former university President Spanier, among others. Defense attorneys have said their list will also include seven Sandusky family members.

Several of Sandusky's alleged victims asked to have their identities protected during the trial. But Cleland ruled against that request, saying "courts are not customarily in the business of withholding information."

However, the judge noted, "It is also to be hoped that various news organizations that will report on the trial will use what has become their professional custom to protect the privacy of alleged victims."

CNN generally does not identify alleged victims of sexual assault.

Cleland also told members of the jury pool that jurors in the case will not be sequestered, saying he will trust them not to read newspapers or follow the case online.

"It's important nobody in the world will know as much about this trial as the people sitting in that jury box," he said last week.

"BELLEFONTE -- The earliest spectators arrived at the Centre County Courthouse in Bellefonte around 5 a.m., a half-hour before sunrise,  to get a seat this morning in one of the most historic trials in Pennsylvania history.


From as far away as Palm Coast, Fla., people lined the right side of the courthouse entrance, some decked out in suits, others in jeans and crocs. There were lawyers, students, a caretaker, a massage therapist. In all, there were 85 seats available for the public to view the Jerry Sandusky trial."

Bellefonte — The attorneys for Gary Schultz and Tim Curley have responded to news reports today that former Penn State President Graham Spanier exchanged emails with the former administrators regarding a decision to report allegations of Jerry Sandusky's child sexual abuse to police.

NBC news issued a national report citing legal sources who said more charges in the Jerry Sandusky child sex-abuse case are likely and could include Spanier.

Investigators told NBC the emails show that Spanier and Schultz decided it would be "humane" to Sandusky to not involve legal authorities.

In response to that report, Penn State spokesman David La Torre released the following statement:

"In the course of former FBI Director Louis Freeh's independent investigation, e-mails were discovered and immediately turned over to the State Attorney General. In deference to the legal process, the University cannot comment further on specifics of the ongoing legal case as it unfolds. We continue to work with the State Attorney General, the US Attorney and Judge Freeh in their investigations into this matter. We will continue to cooperate fully with all legal processes to determine what happened and ensure personal accountability."

Caroline Roberto, the attorney for Tim Curley, and Tom Farrell, who represents Gary Schultz, released a joint statement Monday in which they acknowledge their clients discussed with Spanier allegations of Sanduksy's inappropriate conduct.

"The information confirms that as they testified at the grand jury, Tim Curley and Gary Schultz conscientiously considered Mike McQueary's reports of observing inappropriate conduct, reported it to the University President Graham Spanier, and deliberated about how to responsibly deal with the conduct and handle the situation properly," the statement said.

The Second Mile is not on trial, prosecutor Joseph E. McGettigan said in his opening arguments to jurors in the Jerry Sandusky child sex abuse case this morning.

Neither is Penn State University, he said.

It is Sandusky -- who sat in a wrinkled green suit and turned his chair and faced a 12-foot projection screen as McGettigan showed pictures of each of his accusers as boys.

One juror shook her head as the prosecutor explained the abuse that each allegedly endured.

All 16 -- 12 jurors and four alternates -- were listening intently, wide-eyed, as McGettigan and defense attorney Joe Amendola made their opening arguments in the historic child sex abuse case against the 68-year-old football great.

Sandusky’s wife, Dottie, and adopted son Matt, both left right before opening arguments when the judge ordered that all witnesses be sequestered.

Almost flush up to the jury box, and in a soft-spoken voice, McGettigan did a rundown of the 10 cases against Sandusky, calling it the “systematic behavior ... of a serial predatory pedophile.”

The young men who will testify are from all walks of life, he said. One is a father himself. Two are recent high school graduates.

One struggles with drug and alcohol dependency.

Another serves in the military.

Three of them were in foster care as children.

Two were allegedly abuse only once, McGettigan explained.

“Stopped in one instance by a vigilant mother, and in another by the extreme reaction of the child himself,” he told jurors.

Many of the allegations of abuse happened on Penn State’s campus.

Most of the accusers met Sandusky though his charity, The Second Mile.

There are even asterisks on Second Mile lists with these children’s names, McGettigan said.

Jurors will hear Sandusky’s own words: From 1998 when he was interviewed by police, and from 2008, when he allegedly told CYS officer that he would sleep in the same bed with and lay with Victim One, kiss his cheeks and forehead and couldn’t remember if he kissed him on the lips, McGettigan said.

Bob Costas’ interview with Sandusky after his arrest will also be played for jurors, McGettigan said.

During his arguments, McGettigan outlined the course of the investigation.

It started with alleged Victim One -- a 14-year-old Clinton County teen who told authorities that his mentor had become sexually abusive, McGettigan said.
