AG: Sandusky a predator; defense aims at accusers
June 11, 2012

 ::snipping2::
Senior Deputy Attorney General Joseph McGettigan III opened Sandusky's highly anticipated trial Monday by telling jurors that the 68-year-old retired coach was a pedophile who took advantage of fatherless children or those with unstable home lives and sexually abused them for years.

McGettigan, apologizing in advance for what he said would be disturbing and graphic testimony, said he would prove that the abuse included oral and anal sex involving boys Sandusky met through a children's charity and that it took place "not over days, not over weeks, not even over months, but in some cases over years."

Sandusky's lawyer, Joe Amendola, said the young men who would take the stand are accusers, not victims. He said jurors may find it odd that Sandusky acknowledged showering with children, but that it was innocuous, and part of Sandusky's upbringing.

"In Jerry's culture, growing up in his generation, where he grew up, he's going to tell you it was routine for individuals to get showers together," Amendola said. "I suspect for those of you who might have been in athletics, it's routine."
 ::snipping2::
McGettigan called The Second Mile, the children's charity Sandusky established in 1977, the "perfect environment for the predatory pedophile" and his way to get close to his victims.

The Second Mile and Penn State aren't on trial, McGettigan told jurors, many of whom have ties to the university.

"This defendant, for what he did, his acts, he is on trial," McGettigan said.

Among the items seized by investigators was a list of Second Mile participants whose names were marked with asterisks — including some of those expected to testify — that included notations about what they looked like and whether they lived with their parents, McGettigan said.

Six of the alleged victims had no father in their lives, McGettigan said.

"They are real people with real experience," McGettigan said. "You will know they were violated."

The first man to testify will detail how Sandusky plied him with gifts and trips and coerced him into sexual contact, including dozens of liaisons in a sauna, McGettigan said.

The prosecutor said the same man would tell the jury about how Dottie Sandusky inadvertently interrupted an encounter in a San Antonio hotel after Sandusky brought the youth with him when Penn State played in the Alamo Bowl in December 1999 — Sandusky's final game as a Penn State coach. Sandusky coerced him into engaging in oral sex in a hotel room bathroom, but was interrupted when the coach's wife entered the hotel room, McGettigan said.

Dottie Sandusky arrived in the courtroom Monday, but left when the judge sequestered witnesses.

The man, now 28, will be the oldest of the alleged victims to testify, said McGettigan.

So this is going to be Jerry Sandusky's defense?  Jerry doesn't qualify.  Look at what I've bolded.

http://www.minddisorders.com/Flu-Inv/Histrionic-personality-disorder.html
Histrionic personality disorder
Definition

Histrionic personality disorder, often abbreviated as HPD, is a type of personality disorder in which the affected individual displays an enduring pattern of attention-seeking and excessively dramatic behaviors beginning in early adulthood and present across a broad range of situations. Individuals with HPD are highly emotional, charming, energetic, manipulative, seductive, impulsive, erratic, and demanding.

Mental health professionals use the Diagnostic and Statistical Manual of Mental Disorders (the DSM ) to diagnose mental disorders. The 2000 edition of this manual (the fourth edition text revision, also called the DSM-IV-TR ) classifies HPD as a personality disorder. More specifically, HPD is classified as a Cluster B (dramatic, emotional, or erratic) personality disorder. The personality disorders which comprise Cluster B include histrionic, antisocial, borderline, and narcissistic.
Description

HPD has a unique position among the personality disorders in that it is the only personality disorder explicitly connected to a patient's physical appearance. Researchers have found that HPD appears primarily in men and women with above-average physical appearances. Some research has suggested that the connection between HPD and physical appearance holds for women rather than for men. Both women and men with HPD express a strong need to be the center of attention. Individuals with HPD exaggerate, throw temper tantrums, and cry if they are not the center of attention. Patients with HPD are naive, gullible, have a low frustration threshold, and strong dependency needs.

Cognitive style can be defined as a way in which an individual works with and solves cognitive tasks such as reasoning, learning, thinking, understanding, making decisions, and using memory. The cognitive style of individuals with HPD is superficial and lacks detail. In their inter-personal relationships, individuals with HPD use dramatization with a goal of impressing others. The enduring pattern of their insincere and stormy relationships leads to impairment in social and occupational areas.
Causes and symptoms
Causes

There is a lack of research on the causes of HPD. Even though the causes for the disorder are not definitively known, it is thought that HPD may be caused by biological, developmental, cognitive, and social factors.

NEUROCHEMICAL/PHYSIOLOGICAL CAUSES. Studies show that patients with HPD have highly responsive noradrenergic systems, the mechanisms surrounding the release of a neurotransmitter called norepinephrine. Neurotransmitters are chemicals that communicate impulses from one nerve cell to another in the brain , and these impulses dictate behavior. The tendency towards an excessively emotional reaction to rejection, common among patients with HPD, may be attributed to a malfunction in a group of neurotransmitters called catecholamines. (Norepinephrine belongs to this group of neurotransmitters.)

DEVELOPMENTAL CAUSES. Psychoanalytic theory, developed by Freud, outlines a series of psychosexual stages of development through which each individual passes. These stages determine an individual's later psychological development as an adult. Early psychoanalysts proposed that the genital phase, Freud's fifth or last stage of psychosexual development, is a determinant of HPD. Later psychoanalysts considered the oral phase, Freud's first stage of psychosexual development, to be a more important determinant of HPD. Most psychoanalysts agree that a traumatic childhood contributes towards the development of HPD. Some theorists suggest that the more severe forms of HPD derive from disapproval in the early mother-child relationship.

Another component of Freud's theory is the defense mechanism. Defense mechanisms are sets of systematic, unconscious methods that people develop to cope with conflict and to reduce anxiety. According to Freud's theory, all people use defense mechanisms, but different people use different types of defense mechanisms. Individuals with HPD differ in the severity of the maladaptive defense mechanisms they use. Patients with more severe cases of HPD may utilize the defense mechanisms of repression, denial , and dissociation.

Repression. Repression is the most basic defense mechanism. When patients' thoughts produce anxiety or are unacceptable to them, they use repression to bar the unacceptable thoughts or impulses from consciousness.
Denial. Patients who use denial may say that a prior problem no longer exists, suggesting that their competence has increased; however, others may note that there is no change in the patients' behaviors.
Dissociation. When patients with HPD use the defense mechanism of dissociation, they may display two or more personalities. These two or more personalities exist in one individual without integration. Patients with less severe cases of HPD tend to employ displacement and rationalization as defenses.
Displacement occurs when a patient shifts an affect from one idea to another. For example, a man with HPD may feel angry at work because the boss did not consider him to be the center of attention. The patient may displace his anger onto his wife rather than become angry at his boss.
Rationalization occurs when individuals explain their behaviors so that they appear to be acceptable to others.

Sandusky defense files three motions to add further evidence
Published: June 11, 2012 Updated 4 minutes ago

 ::snipping2::
The defense team for Jerry Sandusky has filed three motions on Monday aiming to include more evidence in the trial: one to allow statements that Gary Schultz, Tim Curley and Graham Spanier made to the grand jury investigating the case; one to allow a psychologist to testify that Sandusky exhibits symptoms of histrionic personality disorder; and one to admit the entirety of Sandusky's autobiography into the record.
 ::snipping2::
The third motion, allowing the Penn State administrators' statements to the grand jury to be admitted as evidence, reveals the least about the defense's intentions. Curley and Schultz are expected to invoke their Fifth Amendment right against self-incrimination, according to the motion, and Spanier is likely to do the same. Therefore, their testimony to the grand jury could be used to "exculpate the defendant from the crime for which he is charged.

All three motions were filed between 10 and 11 a.m. Monday.

Penn State gives emails regarding shower incident to AG
By Moriah Balingit / Pittsburgh Post-Gazette
June 11, 2012 1:42 pm

Penn State officials said today that they have turned over emails discovered by an independent investigator looking into the Jerry Sandusky scandal to the state attorney general's office.

In a statement, spokesman David La Torre said: "In the course of former FBI Director Louis Freeh's independent investigation, emails were discovered and immediately turned over to the State Attorney General."

The statement came in response to a report by NBC today that investigators had uncovered an email exchange between top university officials in which they discussed whether or not to report to outside authorities that Mike McQueary, then a graduate assistant for Penn State's football team, had allegedly witnessed Mr. Sandusky sexually assaulting a boy in a locker room shower. The exchange -- between former President Graham Spanier, former Athletic Director Tim Curley and Gary Schultz, the former Senior Vice President for Finance and Business -- reportedly included information about legal research the university had done. One of the men concluded it would be "humane" to Mr. Sandusky to not report the matter.
Both Mr. Curley and Mr. Schultz face trial on charges that they failed to report what Mr. McQueary saw and lied to a grand jury about it. Mr. Spanier was fired, but has not been charged.

The exchange raises questions about whether Mr. Spanier, whose knowledge of the Mr. McQueary's report remains unclear, will be charged.

Penn State declined to comment further, "in deference to the legal process," Mr. De La Torre wrote.

But in a lawsuit, Mr. Spanier sought copies of the emails from that time period, saying he wanted to refresh his memory for when he is called to testified in Mr. Sandusky's trial. The prosecution had stopped the university from turning them over, according to the suit.

'It freaked me out': 28-year-old alleged victim testifies in Jerry Sandusky trial
Published: June 11, 2012 Updated 22 minutes ago

BELLEFONTE — Editor's note: Contains some graphic sexual content from testimony.

The 28-year-old man who was the first to testify in the child sex-abuse trial of Jerry Sandusky said he spent years trying to bury what had happened to him, but that he came forward when he heard reports in 2011 of allegations against the former Penn State football coach.

The man, who remained calm and articulate while testifying for several hours, said he only came forward after hearing of other allegations against Sandusky.

"I feel responsible for what happened to other victims," the man said.

On questioning from Sandusky's attorney, Joe Amendola, he explained why he hadn't said anything about the alleged abuse before. He gave a combination of reasons, saying he was picked on in school and would never have admitted to the sexual abuse, and that he was getting things that he said he wouldn't otherwise have gotten, including going to football games and getting out of his town .

His parents were divorced and he had problems with his step-father, he said.

"I didn't want to lose this," he said. "I didn't want to lose the good things I had."

The man, known in court documents as alleged victim No. 4, said he was an elementary school student when he met Sandusky through The Second Mile. He testified the two showered together and that eventually Sandusky began lathering him, wrestling and eventually putting his penis near his mouth.

The man described how the behavior played out over time. According to his testimony, the two spent a great deal of time together, with Sandusky picking him up at home, then taking him to the Sandusky house, to Penn State football games and playing sports with him in campus facilities — followed by showers.

Jerry Sandusky Trial Hears Victim 4 Testify to Years of Sex Abuse
June 11, 2012

What began as soap battles in a Penn State locker room advanced over a period of several years to more aggressive sexual attacks that included insistent demands for oral sex from former Penn State assistant coach Jerry Sandusky, a 28-year-old man testified today.

The witness, who ABCNews.com is identifying only as Victim 4, told the jury on the first day of the trial that he had to resort to hiding in his bedroom closet to avoid Sandusky trying to prey on him at his home.

"I'd come home from school and look out the window and he' d be there and I'd grab the phone and hide in the closet," the man, who was 13 when the alleged abuse began, testified.

He said the alleged assaults became as frequent as two to three times a week and lasted for about three years.

The man's testimony was the first of what is expected to be a series of wrenching and sexually graphic witnesses detailing what they claim that Sandusky, now 68, did to them when they were young boys.

Sandusky is charged with 52 counts of sexual abuse involving 10 boys over a period of 15 years. The trial is expected to last three weeks.

Victim 4 riveted the courtroom with his stories of how he was allegedly coerced into sex with Sandusky through brute strength, lavish presents and his access to the Penn State football team. Sandusky even suggested that he could some day play for the nationally ranked team, even though he only weighed 90 pounds at the time.

His testimony also described how Sandusky's wife, Dottie, once walked in on them during sex. He was sharing a hotel room with Sandusky and his wife on a trip to an away football game in which Sandusky tried to force him to have oral sex in the bathroom.

"He came in and started to push down on me to motion me to go down there. I resisted but didn't say anything but was hesitant, and he said, 'You don't want to go back to Snow Shoe do you?'" Victim 4 said, referring to the town where he was living at the time. "He was trying to get me to give him oral sex and threatening me if not."

"What happened then is literally 10 seconds later, the bathroom door is not shut completely... and the other door is open, and I heard Dottie say 'Jerry' and he ran out. And she said, 'What are you doing in there?'" Victim 4 testified.

Sandusky accuser recounts abuse, "creepy" letters
June 11, 2012

CBS/AP) BELLEFONTE, Pa. - The first witness in Jerry Sandusky's trial said the former Penn State assistant football coach sexually abused him as a young teenager on campus and in hotels and later sent him "creepy love letters."

The witness, dubbed Victim No. 4 by prosecutors, said what began as "soap battles" in the shower escalated into inappropriate touching and oral sex. He said under cross-examination that he feels responsible for what happened to other alleged victims because he didn't come forward earlier.

The man, now 28, was the first of eight alleged victims expected to testify during the trial, which began Monday with opening statements.

Jerry Sandusky trial: Alleged victim says PSU coach Tom Bradley might have been 'suspicious' of pair showering
By SARA GANIM, The Patriot-News

During intense cross-examination by Jerry Sandusky's attorney at the former coach's child molestation trial today, alleged Victim 4 testified that former assistant football coach Tom Bradley once saw him showering with Jerry Sandusky and refused to leave the two alone.

"I think he was suspicious," Victim 4 said in court, during testimony that lasted all afternoon on the first day of Sandusky's trial.

He said Bradley stayed in the shower and talked to the two until they both left. It happened sometime during several years of abuse that Victim 4 has alleged -- many times in those same showers, where Sandusky would wrestle him into positions where he couldn't stop sex acts, he testified.

Court recessed for the day at 5 p.m. And will come back in session tomorrow morning.

Victim 4 and Sandusky attorney Joe Amendola went at each other at times, as Amendola questioned him about his finances, his civil attorney and whether he is pursuing a civil suit.

Victim 4 said he has no financial difficulty, isn't paying his attorney Ben Andreozzi, and hasn't talked to him about a civil suit.

It got a bit tense.

But at one time, while he was being questioned about "contracts" that Sandusky drew up, Victim 4 left Amendola speechless when he pointed out that the contracts were written only when he started pulling away, and always included mandatory contact with Sandusky and workouts several times a week.

"Clearly that is a contract of him trying to get me to be around him more often. He was encouraging me to come over," he said.

Amendola had been pressing him about why he wasn't forceful about cutting off contact.

As the last witness of the day, prosecutors called a former Second Mile program director who said he had never seen such contracts, and didn't think one could exist under the charity.

Those contracts called for Victim 4 to be paid about $60 a week-- $20 in his pocket and $40 for college -- if he did activities with Jerry Sandusky.

The witness, Mark McCann, said no children were paid for their activities.
