Jerry Sandusky convicted: His lawyers hint at appeal case basis

June 24, 2012 10:19 PM

CBS/AP) BELLEFONTE, Pa. - One of Jerry Sandusky's lawyers, Joe Amendola, says he will not lead the appeals process because he intends to testify as a witness in their ineffective counsel appeal, CBS News has learned.

Earlier, Amendola and others on Sandusky's defense team said they tried to quit at the start of jury selection in his child sex abuse trial because they weren't given enough time to prepare, raising an argument on the trial's speed that could become the thrust of an appeal.
A day after Sandusky's conviction, his lawyers disclosed Saturday they felt too unprepared to adequately defend him because of how quickly the case was brought to trial. Experts have said the seven months between Sandusky's November arrest and trial was fast-paced by Pennsylvania standards.

Sandusky's attorneys raised other issues that could be part of the future appeal, saying a mistrial was sought and denied over a repetition at trial of a brief part of a November interview Sandusky had with NBC's Bob Costas.

 ::snipping2::

Jurors in the two-week trial convicted Sandusky of 45 of the 48 counts against him, meaning Sandusky, 68, likely will die in prison.

In addition to raising the likely grounds for their appeal case, Amendola also told CBS News Sandusky's wife Dottie and his other adopted children were prepared to testify against Matt Sandusky, the adopted son who claimed he had been molested by his father but never took the stand.

Amendola, who said he was going to visit Sandusky in jail sometime this week, also claimed he never prepared his closing arguments. He says he literally stood in the shower and said: "God, help me find the words to defend Jerry as best I can." He says it was all from the heart.

    My question for AG Kelly continues to be, when the basic details of the Sandusky grand jury were leaked publicly in the Patriot News for all to read in March 2011, why did you wait until November 2011 to formally announce? If we all agree that Sandusky was a predatory monster, why did you allow him to walk freely among the good people of this area for another seven and a half months when you could have announced much earlier? Still waiting for an answer to that question. To me that is unforgivable...

Jerry Sandusky's Wife Faces More Time in Court
June 25, 2012

 ::snipping2::
While the verdicts are in, and even though the defense has suggested it might appeal, Dottie Sandusky may find herself in another courtroom, a civil court.

"I think criminally she's probably in the clear. Civilly, people are going to be suing Jerry Sandusky," says ABC News legal analyst Dan Abrams.

The burden of proof in a civil case is generally considered less than a criminal case. With 45 guilty counts, victims have a lot of proof on their side. "I expect that family will walk away with almost no money after all of this is said and done," Abrams told ABC's World News.

And it's not just Dottie Sandusky that will be sued. Penn State University is well aware that it will be targeted by victims. It hoped to pre-empt some of the legal action by reaching out to victims. In a statement after Friday night's verdict, the university said it "wants to provide a forum where the university can privately, expeditiously and fairly address the victims' concerns and compensate them for claims relating to the university."

Is Dottie Sandusky guilty of child sexual abuse, too?
By Dr. Keith Ablow
June 25, 2012

June 19, 2012: Dorothy Sandusky, wife of former Penn State University assistant football coach Jerry Sandusky, arrives at the Centre County Courthouse in Bellefonte, Pa. (AP)

Jerry Sandusky has been found guilty of dozens of charges relating to him sexually abusing boys he was supposedly mentoring.  His adopted son claims that he was victimized, too. Yet Sandusky's wife Dottie has testified she never suspected her husband was hurting anyone, ever. And the abuse occurred, in part, inside the Sandusky home, while Dottie was reportedly there.

After harrowing, painful testimony from a victim was presented in court, Dottie Sandusky  even shared a chuckle with her husband Jerry, the pedophile and serial rapist who anally raped boys and wrote them love letters.

Presuming that Dottie Sandusky is not a pedophile herself, who enjoyed listening in on the suffering of rape victims (something that would require extensive investigation of Mrs. Sandusky, criminally and psychologically), then she lived with a serial rapist and never consciously suspected him of wrongdoing.

How can that be?

Will Amendola's comments to media be grounds for appeal for Jerry Sandusky?
Lawyers say 'unusual' remarks to media could be part of appeal, but probably wouldn't sway appellate court.

By Matt Assad, Of The Morning Call
June 24, 2012

It started with the decision to give Bob Costas an interview that ended up fueling the prosecution case against Jerry Sandusky and continued right through the verdict, with Sandusky's attorney Joe Amendola chuckling on the courthouse steps Friday night as he tried to explain how his client was just convicted on 45 of 48 counts.

Amendola's unorthodox approach to dealing with the media in his defense of the former Penn State assistant football coach has his legal peers wondering how it will play out as Sandusky faces life in prison for charges relating to 10 victims over 15 years.

"I don't know if [Amendola] was doing all this crazy stuff to raise an appeal issue, but he's certainly planted the seed," Allentown attorney John Waldron said Sunday. "Some of the stuff is pretty out there."

Police ready to patrol, but report no activity on Jerry Sandusky's street
Published: June 25, 2012 Updated 3 hours ago

While reporters and gawkers traveled the quiet, shady Grandview Road after Jerry Sandusky’s arrest last November, police did not respond to any calls there this weekend, after his conviction on child sexual abuse charges.
 ::snipping2::
State College Police Lt. Keith Robb said Sunday they also have not increased patrols in the area.

“Everybody’s been leaving them alone,” Robb said. “There haven’t been any issues whatsoever.”

Sandusky was placed in the Centre County Correctional Facility after the announcement of the verdict Friday, where he will remain until sentencing.

While residents gathered around the courthouse Friday night to hear the news, cheering when reporters emerged and announced the verdict, State College has remained quiet.
Thousands of students flooded downtown streets in a riot the night of last Nov. 9, following a press conference in which Penn State’s Board of Trustees announced the firing of Joe Paterno as head football coach and university President Graham Spanier.

Police Chief Tom King said late Friday that officers were standing by, if needed.

“We’re having no issues whatsoever,” he said.  ::snipping2::

Jerry Sandusky to stay on suicide watch in jail as precaution, see counselor
June 25, 2012

BENNER TOWNSHIP — Jerry Sandusky will remain on suicide watch as a precautionary measure until a doctor sees him this week and determines it is not necessary, according to a county official.

Denise Elbell, acting prison administrator, also said Sunday that Sandusky will see a counselor this week.

Sandusky is being held in isolation at the Centre County Correctional Facility while he awaits sentencing on 45 counts related to child sexual abuse. He was convicted by a jury late Friday night following a two-week trial.

Elbell said Sunday that Sandusky’s attorneys may visit him, but not family members.

“He has no interaction with other inmates,” she said.

Pa. gov: 2-year Sandusky investigation necessary
Published: June 25, 2012 Updated 1 hour ago
PHILADELPHIA — Prosecutors needed about two years between the first report of child sexual abuse involving Jerry Sandusky and the filing of charges because authorities needed to build an "ironclad case" against him, Gov. Tom Corbett said Monday.

Corbett, then the state attorney general, oversaw the start of the Sandusky investigation after the former Penn State assistant coach was barred from a high school in 2009 when a mother complained about Sandusky. Charges were filed last November.

"I think it surprises some people, the length of time it took," Corbett said. "But having been an assistant DA, an assistant U.S. attorney and handling cases like this, I understood that you have to do a complete investigation and get as many witnesses as you possibly can."
 ::snipping2::
While defending the slower pace of the investigation, Corbett also defended the speed with which Sandusky's case went from grand jury presentment to trial - seven months. Defense attorney Joe Amendola has said he and fellow attorney Karl Rominger didn't have enough time to prepare their defense and even asked to withdraw from the case because they weren't prepared.

"I'm not surprised that they would say that," Corbett said.

"Obviously it will be the subject of an appeal at some point in time. ... But in this case the jury had the opportunity to hear the compelling testimony of these now young men who were young boys who suffered at the hands of this pedophile."

The current state attorney general, Linda Kelly, told NBC's "Today" show that all parties involved knew the judge intended to move quickly. She said prosecutors supported that decision because Sandusky was on house arrest while awaiting trial.

"We were anxious just to bring the case to a conclusion and move to have his bond revoked and taken into custody," Kelly said.
 ::snipping2::
Kelly said Sandusky's sentence will be up to the judge, but she believes the severity of the charges merits a harsh punishment.

"Our prosecution team will ask the judge to fashion a sentence that reflects the horrific acts Mr. Sandusky committed, that takes into account the number of victims that are involved here and the fact that he really does represent a clear and present danger to the community," Kelly said.
 ::snipping2::
Corbett said Penn State trustees are still awaiting the results of an internal investigation by former FBI director Louis Freeh into the school's handling of the Sandusky case.

Sandusky juror recalls trial in her own words

(CBS News) A juror who helped convict former Penn State coach Jerry Sandusky of sexually assaulting 10 boys over a 15-year span has come forward to discuss the case.

Juror No. 11, Ann Van Kuren, told "CBS This Morning" the jury watched Sandusky when the verdict was handed down. "We watched him to see how he would react and there was very little reaction," Van Kuren said. "I think that we felt that he knew what he had done."

Sandusky Ordered to Submit to Megan's Law Assessment
June 25, 2012 4:07 PM

 ::snipping2::
Thomas Young, Director of the Centre County Probation and Parole Department, said the assessment is conducted whether Sandusky continues to maintain his innocence or falls in line with the jury of his peers that found him guilty on enough charges to put him in jail for at least a lifetime.

"Some offenders choose not to participate in the interview," Young said. "They'll do the assessment based on documentary evidence."

Typically, the evaluation takes about 90 days – the conclusion of which Sandusky will return to the Centre County Courthouse for his sentence. Young said "some time" given the amount of information the investigators have to assess.

Young said generally, when someone pleads guilty to a sexual offense and an assessment is mandated, demographic information including where the offender can be located and contacted is forwarded to the Sexual Offenders Assessment Board in Harrisburg, where the an evaluator will be assigned to the case.

Sandusky's information has been sent to Harrisburg, Young said, but it could be "some time" before he's logged in the Megan's Law registry.

    At the time, Dr. Darnov (McQuery friend) and the child psychologist 2nd Mile president, Jack Raykovitch knew of suspicions, yet they did not contact police. At that time, they were both responsible to report. They work with children; they did not report suspicions. Yet Penn State, who was not legally responsible to report at that time, should have. And it is not about the $?!

     So if this is only about justice, then why are you suing the University?  Didn't the Second Mile enable Sandusky more so than PSU?  The Second Mile gave him access to the kids.  The civil suits are clearly about money, and you sir are no better than Mr. Amendola.

Sandusky Ordered to Submit to Megan's Law Assessment
By Laura Nichols
June 25, 2012

Jerry Sandusky is headed for the Megan's Law List.

Judge John Cleland signed an order when the former Penn State defensive coordinator was convicted on 45 of 48 counts of abusing 10 boys over a 15-year period, remanding him to submit to an evaluation by the State Sexual Offender Assessment Board.

Thomas Young, Director of the Centre County Probation and Parole Department, said the assessment is conducted whether Sandusky continues to maintain his innocence or falls in line with the jury of his peers that found him guilty on enough charges to put him in jail for at least a lifetime.

Jerry Sandusky ‘wants people to know he’s not guilty’
June 25 '12

BELLEFONTE, Pa.— Jerry Sandusky wants “people to know that he’s not guilty,” a lawyer for the retired Penn State assistant football coach said Monday.

usky — once considered Hall of Fame coach Joe Paterno’s heir apparent — was convicted Friday of 45 counts for sexually abusing 10 boys over 15 years.

Karl Rominger, who helped defend the 68-year-old retired defensive coach, visited him at the Centre County jail, where he is being kept under observation and away from other inmates pending a psychological review that will help determine the next step toward his sentencing, which is in about three months.

“He’s defiant and wants the truth to be told. He wants people to know that he’s not guilty,” Rominger said. “That would be his hope.”   ::snipping2::

Advocates for those affected by sexual abuse weigh in on Sandusky trial

June 25, 2012

 ::snipping2::
The trial has already helped raise awareness, St. John said. After charges against Sandusky were filed, MaleSurvivor.org, a website designed to help boys seek recovery from sexual abuse, saw an increase in traffic by 66 percent, he said.

Other anti-sexual abuse organizations, like Rape, Abuse and Incest National Network, saw a dramatic increase in awareness as well, RAINN Spokeswoman Katherine Hull said.

In the days and weeks after news of charges against Sandusky broke, Hull said the demand for RAINN’s online hotline saw a 54 percent increase from sexual abuse survivors.

“We heard from survivors nationwide, men and women, and girls and boys, who were very encouraged by the outpouring of support for the alleged survivors,” Hull said.

Hull said those who experience sexual abuse often feel alone, but when there is a high-profile case like Sandusky’s, they realize that there is help available.

“It’s very important that people are now finding out about this,” St. John said. “People all over the world are getting help.”

Unfortunately, this is not always the case for those who have been sexually abused, Pennsylvania Coalition Against Rape Vice President of Communications and Development Kristen Houser said.

Houser said the 24-hour news sources can be an upsetting reminder for some individuals who have been sexually abused.

“Whenever there is a high-profile case like this some [individuals who have been sexually abused] are inspired to come forward seeking help,” Houser said. “Other people end up in a real crisis because they can’t get away from the stories of sexual abuse.”

Houser said the important thing to take away from the trial is that everyone needs to learn how to recognize the signs of sexual abuse and understand what to do if they suspect a child is being abused.

Fifty four percent of sexual assaults and rape cases are not reported to the police, based on a five year study found on RAINN’s website.

“[RAINN] helps survivors every day. You can get help even if it’s decades later,” Hull said. “It’s never too late to get help.
