Freeh Report Released: Joe Paterno, Penn State Leadership 'Failed To Protect' Children

The Freeh Report on Penn State's response to claims made against Jerry Sandusky in 1998 and 2001 has been released, painting a very unpleasant picture of the decisions made by Joe Paterno and other school leaders.

Jul 12, 2012 - The independent report by former FBI director Louis Freeh into Penn State leadership's coverup of the Jerry Sandusky sex assault investigations is now public right here. It's more than 200 pages long, so if you'd prefer a shortened version, you might just want to read the press release by Freeh, which summarizes the findings and methodology.

Basically, nobody did what they should have done to stop Sandusky from abusing children and to ensure justice was delivered. Former head coach Joe Paterno, former president Graham Spanier, former athletic director Tim Curley and and former vice president Gary Schultz are all named repeatedly and damningly, as "four of the most powerful people at Pennsylvania State University" who "failed to protect against a child sexual predator harming children for over a decade."

According to Freeh, Paterno and the others knew about the 1998 investigation into Sandusky, and didn't do anything even when told by Mike McQueary in 2001 that Sandusky had struck again.

It's alleged that the four men "did not even speak to Sandusky" about his 1998 sexual assault of the prosecution witness known as "Victim 6," which received more serious attention from law enforcement than his previous assaults did. Their choice to allow Sandusky to retain use of the campus "essentially grant[ed] him license to to bring boys to campus facilities for 'grooming' as targets for his assaults," finds Freeh.

At one point during the 1998 investigation, Schultz wondered whether looking into the allegation was "opening of Pandora's box? Are there other children?" He followed that a month later with, "I think the matter has been appropriately investigated and I hope it is now behind us."

A team led by former FBI Director Louis Freeh releases its findings into Penn State University’s handling of the Jerry Sandusky child sex abuse scandal today. It alleges that Penn State officials, including coach Joe Paterno and President Graham Spanier, worked to cover up Sandusky's crimes.Report highlights:

-- Joe Paterno followed the 1998 police investigation closely, contrary to his grand jury testimony and public statements before he died.

-- Vice President Gary Schultz wrote in notes questioning an opening of "Pandora's Box" and  "More children?" in 1998.

-- Penn State had more than 350 policies for reporting crimes, but the structure was uneven.

-- The board of trustees had no known knowledge of the 1998 report, but that's inexcusable, Freeh said, because it means they put too much power in Spanier's hands.

-- The board should have started an internal review in 2011, when it became public there was an investigation. The report makes no mention of Erickson's defense of not knowing that Penn State was involved in the Sandusky investigation.

-- Before 1998, several staff members witnessed Sandusky showering with boys, but never reported it.

Keep in mind, this wasn't a criminal investigation, and not everyone was interviewed.  I wonder how much we don't know/wasn't reported/we'll never know? Perhaps there will be more answers in the Curley & Scultz trials.  But what about Spanier?  And of course, if Joe Paterno were alive...  I think there are now a lot more questions than answers.  JMHO

PHILADELPHIA — Persuaded by former head football coach Joe Paterno, Penn State officials covered up a 2001 child-sex abuse allegation against ex-defensive coordinator Jerry Sandusky, an internal university investigation has found.
They also failed to take action on a 1998 allegation, which led to a brief police investigation but no criminal charges and no university discipline, a report on the internal probe said.

Paterno, the investigation found, was aware of a 1998 child-sex abuse allegation Sandusky, as were athletic director Tim Curley and vice president Gary Schultz, both of whom face criminal charges stemming from the alleged cover up, and university president Graham Spanier.

“In order to avoid the consequences of bad publicity, the most powerful leaders at the university — Spanier, Schultz, Paterno and Curley — repeatedly concealed critical facts relating to Sandusky’s child abuse from the authorities, the University’s Board of Trustees, the Penn State community and the public at large,” the report said.

Spanier, Curley and Schultz revealed the change in their strategy in handling the February 2001 charge via e-mail, an investigative report said. The e-mail was uncovered in March by investigators, the lead investigator, former F.B.I. director Louis J. Freeh, said.

Freeh, at a press conference here, called the e-mails “the most critical evidence” in the case.

The Freeh report on Penn State's handling of the Jerry Sandusky child sex abuse scandal found that despite Graham Spanier, Gary Schultz, Joe Paterno and Tim Curley's knowing of the criminal investigation -- that dated to 1998 -- they "failed to control Sandusky's access to the University's facilities and campuses."
Sandusky continued to work out in the Lasch football building until November 2011, and had keys to other Penn State facilities. Even after the attorney general's investigation went public in March 2011, former Penn State General Counsel Cynthia Baldwin said Sandusky's access to university facilities could not be terminated because of his emeritus status and the fact that he had not yet been convicted.

Sandusky used his office in the Old Lasch building to store personal notes and documents, and university officials were unaware that there were numerous boxes of Sandusky's possessions in Old Lasch until the Attorney General's Office and Special Investigative Counsel found these documents in April 2012. They included communications between Sandusky and Victim 4 and several other victims.

One of these documents was a "contract" between Sandusky and Victim 4 that proposed rewards including a possible bowl trip "for personal and school achievements."

Collegian Staff Reports
State College attorneys Andrew Shubin and Justine Andronici, who, along with the Philadelphia catastrophic injury law firm Ross Feller Casey, LLP, represent 'Victims 3, 7, 10, Matt Sandusky and other Sandusky victim' released the following statement with regard to the release of the report by former FBI director Louis Freeh about his internal investigation of Penn State in relation to Jerry Sandusky:

"The Freeh report is absolutely devastating to Penn State. It confirms that at the highest level, Penn State officials, including the University President and head football coach, knew that Sandusky was a child predator, but made the deliberate and reprehensible decision to conceal his abuse. They chose to protect themselves, Penn State’s brand and image, and their football program instead of children. The report shows that in 1999, Penn State agreed to provide Jerry Sandusky with a retirement package that specifically included Penn State credentials and access that enabled him to continue to groom and sexually abuse boys. Although the Freeh report focuses on isolated incidents of abuse in 1998 and 2001, as the criminal convictions clearly establish, Jerry Sandusky was abusing boys before 1998. We intend to demonstrate that Penn State and The Second Mile were aware of the abuse decades earlier and failed to take action to stop it."

I have been deeply saddened by the news coming out of this investigation at Penn State. It is a terrible tragedy that children were unprotected from such abhorrent crimes.   With the findings released today, I have decided to change the name of our child care center at our World Headquarters. My thoughts are with the victims and the Penn State community.

Other than my parents, my college coach, Bill Bowerman, was the biggest influence in my life. Bill Bowerman and Joe Paterno shared some great qualities. Throughout Joe Paterno’s career, he strived to put young athletes in a position to succeed and win in sport but most importantly in life. Joe influenced thousands of young men to become better leaders, fathers and husbands.

According to the investigation, it appears Joe made missteps that led to heartbreaking consequences. I missed that Joe missed it, and I am extremely saddened on this day. My love for Joe and his family remains.

Thanks Muffy for all the updates.  I watched it on InSessions, so heard most of it, other than when they break to commercials. Aaarrgghh!

I believe there will be more fallout and will wait to see what happens.

Prayers to those victims. I have no doubt this has went on for alot longer than what they could use for the conviction.  Sadly, there is a statute of limitations. We'll probably never know how many and how long this disgusting event has occured, or how many true victims are out thier.  But at least some justice was provided to them. I only pray they will eventually be able to heal as best as they can.

Sandusky's real conviction will come upon his death and facing God's wrath!

BBM - Good for Mark Parker, for making a the right statement and doing the right thing.  I hope others do as well, especially tearing down the statue of Paterno and doing something for the victims in it's place!
