The teleconference between Sandusky defense attorneys Joe Amendola and Karl Rominger, prosecutors Joseph McGettigan and Frank Fina and judges John Cleland and Barry Feudale was prompted by media leaks of evidence, including a recording of an interview with Matt Sandusky.

In many ways, the issues in a Curley-Schultz trial will be more compelling than the issues in the Sandusky trial.  With the jury's “guilty” verdict in Sandusky's case, we can now identify him as a pedophile without undermining any presumption of innocence.  He was driven by warped motivations. A psychosexual disorder with a focus on adolescents -- a diagnosis the Commonwealth's expert opined may apply to Sandusky -- is by definition a disorder. 

But what about those rational people who allegedly facilitated him?  What signs were they willing to ignore rather than risk Penn State's reputation? The Freeh Report characterized Curley and Schultz -- as well as then-University President Graham Spanier and the beloved Paterno -- as being fully aware of the threat Sandusky posed to young men on the campus.  The defense of Curley and Schultz will necessarily challenge this characterization and will no doubt be a welcomed voice to this national conversation by staunch Paterno supporters still reeling from the NCAA's invalidation of the school's football victories after 1998.

HARRISBURG—
Attorneys for Penn State administrators Gary Schultz and Tim Curley were in a Harrisburg courtroom this morning for a pre-trial hearing. The hearing set the table for a possible trial date which could come as early as this fall. Curley and Schultz are charged with perjury and failure to report. The Attorney General claims the two lied to a grand jury and tried to cover up what they knew about Jerry Sandusky's molestation of boys.

Retired Vice-President Gary Schultz and Athletic Director Tim Curley did not make an appearance but their attorneys argued on their behalf, asking for more information be released from the Attorney General's office ahead of the possible trial.

HARRISBURG, Pa. - Attorneys in the case of two Penn State administrators accused of perjury and failing to report child sex abuse allegations have wrapped up arguments on pretrial motions.

The judge overseeing the case made no immediate rulings Thursday in the case connected to former assistant coach Jerry Sandusky.

Dauphin County President Judge Todd Hoover did not say when he would rule on motions, including requests by Athletic Director Tim Curley and retired Vice President Gary Schultz to dismiss charges.

HARRISBURG – Judge Todd Hoover made no ruling Thursday after counsel for two former Penn State administrators sought the dismissal of perjury charges against their clients.

Attorneys for former Penn State athletic director Tim Curley and former Penn State vice president Gary Schultz, Caroline Roberto and Tom Farrell said during the hour-long hearing perjury charges should not be applied to cases where there is so much room for interpretation.

Meanwhile, the defense did not discuss the summary charge of failure to report, as it will be rescheduled for a later date.

Before Sandusky went to trial, the Commonwealth amended the date when Mike McQueary reported seeing Sandusky abusing a boy in the shower from some time in 2002 to Feb. 1, 2001.

The nine-month time difference means the statue of limitations would have run out and Curley and Schultz would not have been able to be charged with failure to report.

Neither Curley or Schultz was in court Thursday, as was announced Wednesday. The defendants have not appeared in court since their preliminary hearing in December. Curley, who announced in January he is battling lung cancer, has made no public statements regarding the Freeh report.

Roberto only commented on Curley's condition as far as saying it is a private matter and that "it is being monitored."

Court adjourned around 10:30 a.m. Hoover could file an order in the coming days, further directing the course of the case, though no trial date has been set.

'Highly Incriminating' Evidence in Jerry Sandusky Case Could Lead to New Charges
August 16, 2012

 Prosecutors in the Jerry Sandusky child sex abuse case said they had a "great deal" of "highly incriminating" evidence they never brought up during Sandusky's trial, evidence that could be related to pending criminal charges.

The statements are part of a transcript released Thursday from a closed-door meeting held in June, after Sandusky had been found guilty of 45 counts of child sex abuse.

In the meeting, Frank Fina, Pennsylvania's deputy attorney general, said that the state had investigative reports as well as testimony from unnamed victims in the case that were not brought up in trial and should remain secret because of the ongoing investigation.

A graduate of Brown University with studies in Latin, a practicing Catholic (kept up with the news of the church at all?!) and a vocabulary that includes use of the word "omniscient" but has to have someone explain to him what "sodomy" means?!   I just don't believe it.  Never heard of Sodom and Gomorrah?  Never studied the Greeks?  No, I just don't believe Joe Paterno couldn't understand sodomy nor rape of a male child by a male adult. As much as the family would like to protect him and his reputation after his death, it just doesn't work for me at all.

Joe Paterno had to be prodded by his family to read the grand jury report regarding Jerry Sandusky and did not understand some of its graphic terminology, according to a new book.

The book, “Paterno,” written by Joe Posnanski, was purchased yesterday by The Associated Press in advance of its release next week.

In the book, Posnanski describes a scene at Paterno’s home two days after Sandusky had been charged with child sex abuse last November. Paterno’s family and a close adviser were trying to explain to the Penn State coach that there was a growing sentiment that Paterno must have known for years about the accusations against Sandusky.

The book quotes Paterno as shouting, “I’m not omniscient!”

The book also indicates Paterno didn’t comprehend all the terms in the report, asking his son what sodomy meant.

ID Card Required to Access Recreational Facilities Under New Policy in Wake of Sandusky Scandal
August 19, 2012

A new policy has been implemented in the wake of the Jerry Sandusky child sex abuse scandal that restricts most members of the public from using on-campus recreational facilities such as Rec Hall and the IM Building.

A Penn State student or faculty/staff/retiree ID card is required to gain access to these facilities. One additional guest is permitted. According to Penn State, the policy was implemented July 11, two days before the release of the university-commissioned Freeh Report.

"The University's new facilities policy is an important part of an overall plan to provide the safest environment possible to our constituents, and also re-emphasizes our commitment to offer athletic and recreational space for the use of our students, faculty, staff and their guests," Steve Shelow, assistant vice president for University Police and Public Safety, said in a press release. "It's important to note that we will continue to honor prior agreements with outside organizations to use these facilities."

According to Penn State, any exceptions to this policy must be given in writing, and approved by the facilities office responsible for athletic and recreational facility access.

Penn State trustees plan open meetings at campus retreat
August 19, 2012

STATE COLLEGE — The board of trustees at Penn State University plans to hold some open meetings next weekend as part of an on-campus retreat.

University spokesman Bill Mahon confirmed meetings are scheduled for Aug. 25-26, but didn't immediately have details.

The Centre Daily Times on its website Saturday night reported it had obtained a copy of the agenda for next weekend's retreat, which is not a normally scheduled meeting. The schedule included sessions on board structures and governance; team-building exercises; and seminars.
