Penn State bylaws say the university president cannot buy property over $1 million, borrow money or authorize people to sign documents without first getting approval from the board of trustees.

So how did Rodney Erickson have the authority to commit the Penn State to a $60 million NCAA fine, plus crippling sanctions for the cash cow football program?

It’s a question many blue-and-white blooded alumni, supporters and faculty are asking, including Baltimore attorney and Penn State graduate, Dan Clements, who posed it to the state attorney general’s office.

Based on more than a month of correspondence with the head of the unit that oversees charitable organizations, Clements says he believes the attorney general is investigating the university board of trustees and whether they’ve failed to protect the university in the fallout of the Jerry Sandusky scandal.

Members of the Penn State community, in their first turn at addressing trustees during a board meeting, blasted university leaders for accepting the findings of the Freeh Report on the university’s handling of the Jerry Sandusky scandal.

The public comment period debuted at Friday’s meeting, one in a series of steps that board leaders say shows their commitment to being more open and responsive to their constituents.

Board members said they will not spend time walking back through the report, adding it was their independent look into who knew what about the Sandusky allegations and what steps were taken in response.

“We haven’t carte blanche accepted everything in the report,” board member Mark Dambly said, adding the board has not taken a formal position on anyone’s guilt or innocence.

He also said later that the board never accepted the report. It received it and took responsibility for the wrongs that occurred that need to be addressed.

Rally at Penn State calls for President's resignation

University Park, Pa. -- A crowd of about 350 packed the lawn of Penn State's administration building Saturday as alumni, faculty and students demanded the resignations of Gov. Tom Corbett, President Rodney Erickson and members of the Board of Trustees.

The Old Main building was the site for Saturday morning's "Rally for Resignation," which was organized by a group of alumni who are unhappy with the university's handling of the events surrounding the Jerry Sandusky child sexual abuse scandal, as well as the board's firing of football coach Joe Paterno last fall.

A few protesters held signs with messages such as "Resign Now!!" and "Remember, remember the ninth of November," the day Paterno was fired. Nearly every person in the crowd also sported T-shirts containing messages such as "Fire 'em all" and "The Freeh report is a lie."

Standing next to a cardboard cutout of his former coach, former Penn State star running back Franco Harris asked the crowd why the board of trustees wasn't present at the morning's rally. In response, one man shouted, "We're not press worthy,' which drew a round of applause from the group.

Trial for Penn State administrators set for 2013
September 15, 2012

The trial for the two former Penn State administrators accused of lying to the grand jury investigating Jerry Sandusky won't go on during football season.

Instead, the case for former athletic director Tim Curley and former senior vice president Gary Schultz is scheduled for January 2013, with jury selection starting Jan. 7 and the trial to follow immediately.

The scheduling order from Dauphin County President Judge Todd Hoover comes a day after Curley and Schultz's attorneys were in court arguing that the perjury charges should be thrown out.

The judge also issued an order today directing the state to save the notes and reports from all witness interviews. Attorneys for the defendants argued in court Thursday that they should be able to review that material.

The case is being tried in Dauphin County because that is the location of the grand jury proceedings where Curley and Schultz are alleged to have lied under oath. Jurors will be picked from Dauphin County.

Curley and Schultz are also charged with failure to report abuse.

(Reuters) - Convicted child sex offender Jerry Sandusky will face sentencing immediately after an October 9 hearing to determine if the former Penn State football coach is a sexually violent predator, a judge said on Monday.

The hearing will be held at the Centre County Courthouse in Bellefonte, Pennsylvania, Judge John Cleland said in an order. A sentencing conference will be held on October 8.

Former Penn State assistant football coach Jerry Sandusky will be sentenced on Oct. 9, immediately following a 9 a.m. hearing to determine whether he will be labeled a sexually violent predator.

Judge John Cleland signed the order that scheduled the hearing and subsequent sentencing on Monday.

He ruled that any "memoranda or other written statements" submitted on behalf of the prosecution or the defense must be filed in Centre County court no later than 3 p.m. on Oct. 5.

A sentencing conference will be held with counsel and Cleland in chambers at 2 p.m. Oct. 8.
