Jerry Sandusky will return to Centre County, albeit for a short period, when he appears in Bellefonte on Jan. 10 for his post-sentencing hearing.
Judge John Cleland signed an order Thursday that the Centre County Sheriff's Department transport Sandusky from the State Correctional Institution at Greene in southwest Pennsylvania to the Centre County Courthouse for the hearing.
The hearing is part of Sandusky's appeal, built around the premise that his defense team did not have adequate time to prepare for June's trial.

BELLEFONTE, Pa. - Reporters won't be allowed to bring laptops or cellphones into the courtroom during next week's hearing on Jerry Sandusky's post-sentencing motions.

Judge John Cleland announced the decorum order Friday, saying it was required because reporters violated the rules when Sandusky was sentenced in October by tweeting.

Cleland says a "disheartening number of reporters" violated his order that no communications be made from inside the courtroom while court was in session. He says so many reporters ignored the order that it's impractical to attempt to punish them all for it.

Judge: Ex-Penn State President Graham Spanier ordered not to have contact with trustees

Former Penn State President Graham Spanier has been ordered not to have contact with any former or current university trustees.

The mandate was part of some changes Harrisburg-area District Judge William Wenner made Friday to the bail for Spanier, who is accused of covering up abuse allegations against Jerry Sandusky and obstructing prosecutors’ investigation. What prompted the judge to impose the no-contact provision is not known, as there were no written motions to that effect by the prosecuting or defense attorneys in the case.

Spanier, of State College, had been prohibited from leaving the state as part of the original bail conditions Wenner set in November. But Spanier’s attorneys asked the judge to loosen the travel restrictions, saying Spanier wanted to visit family in the Midwest over the holidays and go to Europe in the spring.

Wenner refused to budge on the international travel ban, but the district judge did allow Spanier to travel in the United States as long as he gives the court his travel itinerary five days before he goes out of town.

In addition, Spanier has been barred from contacting any of the prosecution’s witnesses in the case, for which the preliminary hearing has not been rescheduled since it was postponed in December.

Spanier’s attorneys have vowed to fight the charges and maintain that their client is innocent.

When the case does go to the preliminary hearing stage, former university lawyer Cynthia Baldwin is expected to be a prosecution witness. But Spanier’s attorneys have asked the judge to keep her from taking the stand on the grounds she violated attorney-client privilege when she testified at the grand jury against Spanier.

HARRISBURG, Pa. — Pennsylvania’s attorney general said she granted Gov. Tom Corbett the authority to file a federal antitrust lawsuit against the NCAA because the litigation could present a conflict of interest as her office prosecutes three Penn State administrators.

Attorney General Linda Kelly told The Associated Press on Thursday that “an actual conflict of interest could, and likely would, arise if this office were involved in both cases.”
Her office is prosecuting Graham Spanier, Gary Schultz and Tim Curley on charges of endangering the welfare of children, obstruction, conspiracy, failure to report suspected child abuse and perjury. Prosecutors claim they illegally covered up complaints and suspicions about Sandusky, a former defensive coordinator who was convicted last summer of 45 counts of child sexual abuse, including attacks inside campus facilities.

Corbett sued the NCAA in federal court on Wednesday, saying a set of penalties imposed against Penn State over its handling of the matter should be thrown out on antitrust grounds. The school agreed to a $60 million fine, a four-year ban on post-season play, a reduction in scholarships and the elimination of more than 100 wins under former coach Joe Paterno.

The size and scope of the criminal case made it “untenable” for the attorney general’s office to sue the NCAA, Kelly said.

“Given the serious nature of both these cases, keeping these matters separate is the best course of action for the people of Pennsylvania,” she said.

Penn State asks that McQueary’s suit be dismissed
January 15, 2013

Pennsylvania State University on Tuesday denied a defamation and wrongful termination claim made by a former assistant football coach who testified against Jerry Sandusky.

In filings in Centre County court, the university asked a judge to throw out a state whistle-blower lawsuit brought by Mike McQueary, arguing that any damage he endured as a result of his role as a prosecution witness was not caused by Penn State.

So far, McQueary has failed to provide any evidence suggesting Penn State officials publicly questioned his character, wrote university counsel Nancy Conrad.

Penn State challenging McQueary whistleblower suit

BELLEFONTE — Penn State is challenging former assistant coach Mike McQueary’s whistleblower lawsuit, and the university filed court papers Tuesday asking the judge to dismiss it with prejudice.

Penn State attorney Nancy Conrad wrote in the suit that McQueary was not defamed when former university President Graham Spanier issued a statement in November 2011 in support of then-administrators Tim Curley and Gary Schultz.

Conrad also wrote that McQueary’s claims were not specific enough for a whistleblower suit.

Sandusky and his wife, Dottie, whose name also is on the homeowners policy, withdrew claims against the insurance company, a court document stated.

The parties entered into a consent decree that U.S. Middle District Judge Yvette Kane signed Tuesday. It eliminates any obligations on the part of State Farm.

State Farm had sought a court declaration that the homeowners policy did not provide coverage for Sandusky’s defense in the criminal case, in which he has been convicted on 45 counts and is serving a prison sentence for 30 to 60 years.

The insurance company also had rejected Sandusky’s claims for payment of his defense in two civil cases filed in Philadelphia.

State Farm contended Sandusky’s homeowner’s policy provided only limited liability coverage and it excluded acts intentionally caused by or the result of any willful or malicious conduct by the policyholder.

While the consent order ends that case, still pending is a similar suit brought by Federal Insurance Co. with which The Second Mile had a policy. Sandusky founded that charity.

UNIVERSITY PARK — The two newly elected leaders of Penn State’s board of trustees still think it is not the time to consider honoring former head football coach Joe Paterno.

But some people, such as trustees Anthony Lubrano and Alvin Clemens and Penn State alumni such as Cecelia Masella, disagree.

It’s been almost a year since Paterno died, and many supporters maintain that Paterno’s name continues to be disgraced in the aftermath of the Jerry Sandusky scandal fallout. Friday’s board of trustees meeting on campus became another forum where Paterno supporters spoke out in defense of the coach.

Newly elected Vice Chairwoman Stephanie Deviney said the legal issues still outstanding — such as the criminal cases against former university leaders ex-President Graham Spanier, athletic director Tim Curley and retired administrator Gary Schultz — must be resolved first.

In addition, Paterno’s name was also among a list of deceased notable Penn State alumni and friends honored with a moment of silence to start Friday’s meeting.

The one-year anniversary of Paterno’s death is Tuesday and a vigil is planned for 7 p.m. at the mural on Hiester Street in downtown State College.

Victim 6 testified Sandusky called himself “the Tickle Monster” and grabbed him inside a university shower in 1998. His mother’s complaint triggered a police investigation but no charges.

It claims Penn State and The Second Mile "turned a blind eye to Sandusky's sexual exploitation" of children and "fostered a culture and/or code of silence" that kept abuse allegations from being reported.

The lawsuit says Sandusky used The Second Mile, which he founded in the 1970s, as a "'hunting ground' for victims of his perverted desire to sexually abuse minor boys." The charity, in an email from official David Woodle, said it would respond to the lawsuit "through the legal process."

Franco Harris doesn't believe the NCAA sanctions against Penn State will stand, nor is he convinced that the trials of former Penn State officials will occur. Further, the former Penn State running back said, he sees opinions shifting about his alma mater's role in the Jerry Sandusky scandal.

"The narrative is starting to change," Harris said Friday. "The [grand jury] presentment and the Freeh Report are falling apart. The NCAA [sanctions], that will fall apart. There will be no trials for [Tim] Curley and [Gary] Schultz. There's no case. We're starting to find the truth."

More than 200 turned out Friday in King of Prussia for an event Harris hosted and funded, presenting a defense of Penn State and late football coach Joe Paterno. "Upon Further Review: Penn State One Year Later" offered a critical look at the Sandusky investigation, former FBI Director Louis Freeh's findings and the media's coverage of the entire scandal.

It was the second of three such sessions, and Harris said he hopes to schedule more in the future. The first was held last December in Pittsburgh. Another is scheduled for Saturday night near Washington, D.C.

A Pennsylvania judge on Wednesday rejected a bid for a new trial by Jerry Sandusky, the former assistant football coach who was convicted of sexually abusing young boys.

In a 27-page ruling, Judge John Cleland, who presided over Sandusky’s high-profile trial last year, rejected a bid seeking a new trial on seven grounds, including that the defense wasn’t given enough time to prepare. Sandusky’s lawyer indicated he would appeal to a higher court.

Sandusky, 69, is serving a 30- to 60-year sentence in state prison after he was convicted of 45 counts involving the sexual abuse of 10 boys. Sandusky, who was part of Penn State’s football dynasty under the late head coach Joe Paterno, found and groomed his victims through a charity for disadvantaged children that Sandusky had helped start.

The case roiled the Penn State campus and led to the ouster of Paterno and the school’s president. The school is currently targeted in a series of civil cases from some of the victims, who were molested in the showers at the school’s football training facility.

Though the volume of court material was large, Cleland noted, the defense conceded at a recent hearing that it had found no material that would have changed the way it defended Sandusky.

“Counsel conceded, having reviewed the discovery material after the trial, he could find nothing that would have changed his trial strategy if he had had the benefit of it before trial,” Cleland wrote. “There was, in other words, no prejudice to the defendant.”

In all, Cleland rejected seven motions, each arguing a different set of grounds for ordering a new trial. In addition to the lack of preparation time, Sandusky’s appeal also alleged that there were problems with instructions to the jury and with allowing hearsay testimony, among other issues.

But Cleland rejected all of the claims, ruling that Sandusky presented a viable defense.

“I do not think it can be said that either of the defendant's trial counsel failed to test the prosecution's case in a meaningful manner,” Cleland wrote.

“The defendant's attorneys subjected the commonwealth's witnesses to meaningful and effective cross-examination, presented evidence for the defense and presented both a comprehensive opening statement and a clearly developed closing argument.”

Sandusky lawyer Norris Gelman said the decision means the defense will appeal to mid-level Superior Court within the next 30 days.
