Jerry Sandusky's son, Matt, takes part in film on Penn St. case
January 21, 2014

STATE COLLEGE, Pa. (AP) -- The son of former Penn State assistant football coach Jerry Sandusky participated in a documentary about his father's sexual-abuse case and hopes to become an advocate for child victims.
Matt Sandusky told the Centre Daily Times that he took part in "Happy Valley" because he has become strong enough to tell his story and wants to speak out to help other survivors. The 100-minute film, debuting this week at the Sundance Film Festival, explores whether it was an open secret that Sandusky was molesting boys.
"For me and all survivors it is important to have control over the timing and setting of (the) disclosure," Matt Sandusky told the newspaper.

Sandusky's son takes part in film on Penn St. case
January 20, 2014

STATE COLLEGE, PA. — The son of former Penn State assistant football coach Jerry Sandusky participated in a documentary about his father's sexual-abuse case and hopes to become an advocate for child victims.

Matt Sandusky told the Centre Daily Times (http://goo.gl/YGc0dH) that he took part in "Happy Valley" because he has become strong enough to tell his story and wants to speak out to help other survivors. The 100-minute film, debuting this week at the Sundance Film Festival, explores whether it was an open secret that Sandusky was molesting boys.

"For me and all survivors it is important to have control over the timing and setting of (the) disclosure," Matt Sandusky told the newspaper.
Sandusky had been listed as a defense witness at his father's 2012 trial, but he instead disclosed through lawyers that he had also been abused and didn't take the stand. Jerry Sandusky, convicted on 45 counts involving 10 boys, maintains his innocence and is appealing his conviction. He is serving a 30- to 60-year prison term.

Matt Sandusky declined to elaborate on his comments in the film, but he said he discusses his childhood, the abuse and his relationship with family. He is one of six children adopted by Jerry and Dottie Sandusky. He petitioned last year to legally change his name, and that of his wife and four children.

"I hope that people will begin to understand what I have gone through," he told the newspaper. "My role in the film was to share the perspective of a survivor, to give survivors a voice."

An online synopsis advertises the film, made by "The Tillman Story" director Amir Bar-Lev, as a "complicated and tragic tale." Matt Sandusky watched the film in a recent private screening.

The film, which debuted Sunday, has a few more Sundance screenings scheduled this week. It's not yet clear if or when it will come to Pennsylvania.

Matt Sandusky praised the victims who went public.

‘Time-consuming challenges’ slow Attorney General Kathleen Kane’s review of Jerry Sandusky investigation
February 5, 2014

Pennsylvania Attorney General Kathleen Kane’s review of her predecessors’ investigation of Jerry Sandusky has been slowed by unforeseen issues of recovering emails, and the report will need judicial approval before it can be released, the prosecutor said Wednesday.

Kane’s remarks came in a written statement one year after she appointed H. Geoffrey Moulton Jr. to probe why it took three years to investigate and charge Sandusky, a question that was focal point of her campaign and resulted in a landslide victory in 2012.

Moulton has been investigating how previous attorneys general Tom Corbett, who is now governor, and Linda Kelly handled investigating abuse allegations against Sandusky from 2009 to 2011. Kane said Moulton does not have subpoena power but has interviewed a “wide range of witnesses.”

“The release of the review findings will be determined only by the time necessary to complete a comprehensive review,” said Kane, who’s never committed herself to a firm date of when the long-awaited, high-interest report would be released. “Pennsylvanians deserve the full and true story, and I will not permit a rush to judgment to interfere with a thorough review.”

Kane said a few factors have slowed the investigation, and among the most “significant and time-consuming challenges” were getting written documents, particularly emails in the system of the Office of the Attorney General. She said she thought emails from the time period in question had been permanently removed, but since then, she has been able to start a process to recover them.

Kane did not elaborate on the reasons behind the delays getting the documentation, though she said that would be described with more detail in the report.

Another reason for the delay has to do with the grand jury, which has heard matters that will be in the report but are not yet public. Kane said she will need to have the grand jury judge approve the release of the report because it would contain those secret matters.

In addition, the report will not be released until people who are discussed in it can review and comment on the parts that pertain to them, Kane said. She said she is affording them that opportunity out of “due process and fairness.”

Kane said she hopes to take care of that part quickly, but she did not give any indication which people are identified in the report and she said her office will not discuss the report until it is released.

Penn State added as defendant in Paterno v. NCAA
February 5, 2014

HARRISBURG, Pa. (AP) - The family and estate of Joe Paterno and others are adding Penn State as a "nominal defendant" in a lawsuit against the NCAA over the university's penalties for the Jerry Sandusky child molestation scandal.

The amended complaint filed Wednesday in county court near State College also provides details about the difficulties Paterno's son and another former Penn State assistant coach have had in finding work.

A statement by Paterno family lawyer Wick Sollers says the lawsuit isn't seeking anything from Penn State.

The filing comes after a judge said the lawsuit's breach-of-contract claims couldn't continue unless Penn State was named as a party. A Penn State spokesman offered no immediate comment.

State Police Taking Over Ray Gricar Disappearance
February 11, 2014

BELLEFONTE, Pa. – It's a mystery that has puzzled investigators in the Centre region for years and has been the highlight of several documentaries and television specials: The disappearance of Centre County District Attorney Ray Gricar. Now, after nine years, the Pennsylvania State Police is now taking over the investigation from local authorities. State police announced the changes in the case Monday, stating troopers will be taking over as the lead agency to receive new tips and oversee a task force that was formed to investigate the disappearance. Gricar was last seen in 2005 at an antiques business in Lewisburg, Union County. Gricar's family had him legally declared dead in 2011, seven years after his disappearance. The task force was formed by current Centre County District Attorney Stacy Parks Miller and up until Monday, the Bellefonte Police Department was the lead department on the case. State police said the Troop G Major Case Team, comprised of Troop G criminal investigators, will continue to work on the investigation with the assistance of the task force and Bellefonte police. The team will be reviewing the investigation status and looking at ways to further the case, police said. State police asked anyone with information relating to the case to call their tip line at 1-800-472-8477 (1-800-4patips). Gricar's disappearance has resurfaced in the headlines over the past couple years, mostly surrounding the Jerry Sandusky child sex abuse case and a story that Gricar was killed by a member of a motorcycle club. Case related documents showed Gricar declined to prosecute Jerry Sandusky when initial reports about alleged abuse first surfaced in the late 1990s. Sandusky was convicted in 2011 on 45 counts related to child sexual abuse.

6 News reporter Gary Sinderson said investigators familiar with the case maintain they don't know if Gricar is dead or alive, and have no evidence to show either way.

State Police Take Over Search for Missing DA Connected to Sandusky
February 11, 2014

State police are assuming a lead role in a decade-long search for a missing central Pennsylvania prosecutor who declined to prosecute former Penn State assistant football coach Jerry Sandusky.

Former Centre County District Attorney Ray Gricar has not been seen since leaving work in 2005, seven years after he decided against charging Sandusky following a woman's complaint to State College police that Sandusky had showered with her son. Gricar was declared legally dead in 2011.

Cpl. Lucas Rankin with the state police's Rockview station said Tuesday that his agency was taking over all of the evidence and reports and determining which witnesses need to be re-interviewed.

The county's current district attorney, Stacy Parks Miller, formed a task force in 2010 to investigate Gricar's disappearance.

Rankin said state troopers from Hollidaysburg, Rockview and Lewistown will be handling the investigation, taking over at the request of police in Bellefonte, where Gricar had worked as county prosecutor.

Sandusky scandal: Alum fights for PSU records; $15,000 donated to help release sealed documents
February 14, 2014

A Penn State graduate’s campaign to raise money to pursue open-records lawsuits for information about the Jerry Sandusky scandal has resulted in donations of $15,000 from 161 people, he said this week.

Middleton, Wis., resident Ryan Bagwell is fighting for access to records such as email exchanges between the state secretary of education and Freeh investigators and a Sandusky case prosecutor and the investigators. The agencies at the other end of the open-records cases are the Department of Education, the state Attorney General’s Office and the Philadelphia District Attorney’s Office.

“Alumni still want to know how Penn State’s leaders handled the Sandusky scandal,” said Bagwell, who is also running for a seat on the university’s board of trustees. “Even as the university continues to move forward, questions remain.”

Bagwell has raised $15,215 of his goal of $50,000. He’s received 191 donations, and the average contribution is almost $80.

Bagwell said one person sent in a $10 donation and included a note why he thought former head football coach Joe Paterno could have done more.

“But since Penn State spends tax dollars, he wants the university to be transparent,” Bagwell said. “The desire for transparency transcends the Sandusky scandal.”

Bagwell has two outstanding cases against the Department of Education for records of email exchanges that former Secretary Ron Tomalis had with Freeh investigators and Penn State trustees. Tomalis was a Penn State trustee at the time because of his Cabinet position and was also on the task force that hired Freeh.

In one of the cases, Bagwell scored a win last year when a state court reversed the Office of Open Records’ denial for Tomalis’s emails.

Late last month, the Office of Open Records began reviewing the records, which consist of about 300 pages that Penn State lawyers have said should be protected by attorney-client privilege.

In the other case, Bagwell is seeking access to more than 500 emails between Tomalis and Freeh investigators. In this case, Penn State filed paperwork to intervene earlier this week.

Bagwell is also trying to get access to email exchanges that Sandusky prosecutor Frank Fina had with Freeh investigators while he worked for Philadelphia District Attorney Seth Williams in late 2012 and the first half of 2013. Also being sought were emails between Fina and Barry Feudale, the judge who presided over the grand jury, and Randy Feathers, who worked in the State College bureau of the Attorney General’s Office.

In court papers, Williams’ office said it did not have the records, and Bagwell sued.

Williams tweeted in January that he was also seeking nominations for a spot on the trustees’ ballot.

Bagwell’s is trying to get emails that Fina and other Attorney General’s Office staff had with Freeh investigators. The office denied the request, and Bagwell has appealed it.

One donor was Tom Schneider, a 1971 Penn State graduate in northern Lycoming County, who said he’s supporting Bagwell’s efforts to see if the emails and documentation will add to the public record of the Sandusky scandal.

Kane: Predecessor changed email rules
February 15, 2014

HARRISBURG — Attorney General Kathleen Kane said one of her predecessors changed office policy to shorten the period before emails are deleted in the midst of the grand jury investigation into allegations against Jerry Sandusky.

Prior to the February 2011 rule change, employees in the Office of Attorney General had been keeping emails for five years, according to a timeline provided to CNHI on Friday.

But in February 2011, a month after Penn State officials appeared before the grand jury, employees in the attorney general’s office began to delete emails after six months.

That decision came while the office was being led by Acting Attorney General William H. Ryan, who had served as then-Attorney General Tom Corbett’s first deputy attorney general. By the time Ryan made that decision, Corbett was serving as governor.

Ryan is now serving as chairman of the Pennsylvania Gaming Control Board, a position that pays $150,006 a year.

Ryan said the decision to change to a six-month retention period was done to save money. The move came after consulting with senior staff and information technology experts in the attorney general’s office, he said.

“It had nothing to do with the Sandusky investigation,” he said.

The governor did not direct the policy change, according to Ryan.

“I doubt the governor even knows I did it,” he said.

A spokesman in Corbett’s office agreed, saying the governor had no role in the decision.

“The attorney general is an independent office,” Corbett press secretary Jay Pagni said.

Kane has said the practice of deleting emails significantly slowed her office’s review into the timing of the Sandusky investigation.

After Kane was elected, running on a platform in which she pledged to re-examine the handling of the Sandusky allegations, the attorney general’s office halted the six-month deletion policy at Kane’s request.

The attorney general’s office now requires that emails must be kept for two years.

Kane has said she’s limited in what she can say about the case because information must be vetted by the supervising judge for the grand jury that recommended charges against Sandusky and three Penn State administrators. Her office said Friday that no information beyond the timeline could be provided.

Ex-acting AG: Jerry Sandusky wasn't the reason behind scaled back email retention
February 15, 2014

HARRISBURG, Pa. (AP) — A former acting Pennsylvania attorney general says his decision to shorten the period before emails were deleted had nothing to do with the Jerry Sandusky child sex abuse investigation.

Bill Ryan said Friday that he shortened the retention period in February 2011 from five years to six months because storage was expensive. Both Ryan and a spokesman for Gov. Tom Corbett say the governor hadn't suggested the policy change.

Attorney General Kathleen Kane is reviewing how the office handled the Sandusky criminal case. She says her office now keeps emails for two years.

Former Sandusky lawyer Rominger subject of probe
March 11, 2014

HARRISBURG — One of the two defense lawyers who represented former Penn State assistant football coach Jerry Sandusky at trial is being investigated for the potential theft of money from his clients, a prosecutor said Monday.

Cumberland County District Attorney David Freed released a statement that said he learned last week about allegations against Karl Rominger that concern a divorce case. Freed said Rominger’s defense lawyer, Bill Costopoulos, provided additional information and expressed a desire to cooperate.

“My office is leading an investigation into the potential misappropriation of a significant amount of client funds by Rominger,” Freed said.

Rominger told The Associated Press on Friday that he’s “cooperating completely” and referred further questions to Costopoulos, who was not immediately available for comment after Freed’s statement was released.

Norris Gelman, the lead lawyer in Sandusky’s pending appeal of his 45-count child molestation conviction, said Monday that Rominger’s representation of Sandusky ended some time ago. Gelman said the allegations regarding Rominger were highly unlikely to affect Sandusky’s case.

Jerry Sandusky's ex-lawyer surrenders law license
March 13, 2014

CARLISLE, PA. — One of two defense lawyers who represented former Penn State assistant football coach Jerry Sandusky at his child sex abuse trial has voluntarily surrendered his license to practice law in Pennsylvania. The move comes amid an investigation into allegations of misappropriation of client funds.

The Cumberland County Bar Association said Thursday that Karl Rominger had surrendered his license. It says the effective date of that surrender will be determined by the state Supreme Court.

Rominger's law firm is based in Carlisle. It's the subject of a probe into possible misappropriation of funds from a client's divorce settlement.

The Internal Revenue Service recently filed nearly $310,000 in tax liens against Rominger.

Penn State Spends More Than $129.5 million on Jerry Sandusky Scandal
March 14, 2014

Penn State University has released the latest calculations for the cost of the Jerry Sandusky scandal, which is now more than $129.5 million.
The university updated the figures Friday on its website after StateCollege.com made multiple requests for the figures. Fees and costs totaled more than $69.8 million as of Dec. 31. The figure does not include the $59.7 million settlement Penn State reached with 26 Sandusky victims in October. Combined, total expenses reach more than $129.5 million.
