Victim asks court to bar charity from moving assets

Accused child molester Jerry Sandusky, the former Penn State defensive coordinator who has been charged with 40 counts of sexual abuse, may have molested a relative, a Pennsylvania newspaper reported on Wednesday.

The Patriot-News of Harrisburg said that Joe Amendola, Sandusky’s attorney, told the newspaper that one of the two new cases opened by Children and Youth Services in the last 60 days involved a family member.

Amendola said the alleged assault took place before Sandusky’s arrest on Nov. 5, but that authorities did not learn about it until after Sandusky was charged.

The Patriot-News said it will withhold Sandusky’s relationship to the child because it wants to protect the victim’s identity.

My son-in-law is a pilot.  The airline that he flies for offers many benefits for his immediate family ... benefits that are taken advantage of regularly.  If he were to quit or be fired those benefits would cease immediately.

Anyways ... it makes sense that Sue Paterno was aware of what her husband was aware of and did nothing.  That awareness would be that a little was observed being raped by Jerry Sandusky.  What action would this woman have taken if that little boy was her grandson.

Lawyers want a youth charity established by a former Penn State football assistant coach at the heart of a child molestation scandal to stay solvent so they can file future lawsuits for victims.

The Second Mile shouldn’t be allowed to dissolve its assets, according to a lawsuit filed late Wednesday on behalf of someone who claims to be a victim of Jerry Sandusky, the charity’s founder. The complaint also suggests some of the future legal strategies that may be used in civil lawsuits.

Lawyers Benjamin Andreozzi and Jeffrey Fritz are seeking an injunction to stop The Second Mile from dissolving or transferring its assets. Nonprofit corporations that cease operations are generally allowed to transfer assets to other charitable groups with a similar mission.

“We felt it was necessary to take this action after learning the organization was considering transferring its programs and not continuing its operations,’’ Andreozzi said, referring to reports last week that the charity was mulling several different options for its future, including the possibility of shutting down.

“We believe it is in the best interest of our clients, as well as the other victims, to ensure that the organization is being financially responsible. The injunction would not interrupt the everyday operations of The Second Mile or its existing programs.’’

Fifty people of all ages gathered Saturday to support Penn State’s alleged child sex abuse victims, unaware that “Victim 1,” as the high school boy was identified in a grand jury presentment, was inside a parked car a short distance away watching them.

The mother of the high school boy who said he was abused by Jerry Sandusky, told ABC News that she and her son watched the vigil Saturday night in Lock Haven, Pa., after hearing about it online and that it “meant a lot to him and his family.”

Victim 1, who according to his testimony, was 11 or 12 years old when he was first sexually abused by the 67-year-old former defensive assistant coach, endured such intense bullying following Sandusky’s arrest that he had to withdraw from his school.

The boy’s mother, who spoke exclusively to “Good Morning America,” said students at her son’s high school blamed him for triggering the sex abuse scandal that led to the firing of Joe Paterno, the beloved head coach who oversaw the university’s Nittany Lions football team for 46 years.

Legal experts say the Pennsylvania definition of the two crimes overlap considerably, but the legal definition of involuntary deviate sexual intercourse, which pertains to anal and oral sex, any type of sex with an animal, and penetration with foreign objects, covers behavior different from a rape involving vaginal sex between an adult man and woman.

Forced anal sex can be charged as rape. It's not unusual for the two offenses to be lodged together for a single criminal act.

The decision about whether to charge rape or IDSI, as it is often referred to, can be a matter of courtroom tactics. Prosecutors sometimes worry that in scenarios such as the Sandusky allegations, where there has not been male-female vaginal sex, jurors can balk at declaring it rape.

"The layperson considers rape in terms of ordinary sexual intercourse," said northwestern Pennsylvania District Attorney Francis J. Schultz, president of the state prosecutors' association. "In Crawford County, we would choose the more specific offense if we were talking about anal or oral. We're going to charge IDSI. And it probably varies from prosecutor's office to prosecutor's office."

Gary Asteak, a criminal defense lawyer in Easton, prefers the term rape to involuntary deviate sexual intercourse for clarity's sake.

"Let's call it what it is," Asteak said. "IDSI is kind of a long term. ... It's a whole lot easier to say rape."

(CNN) -- Jerry Sandusky, the former Penn State assistant football coach accused of sexually abusing boys over a 14-year period, is working with a private investigator in his quest to prove his innocence, his lawyer said Monday.

Attorney Joe Amendola said his client, who is free on $100,000 bail, is conducting his own investigation.

Besides the original attorney general's criminal inquiry, several other investigations have been launched tied to various aspects of Sandusky's case, including by Penn State and the U.S. Department of Education.

STATE COLLEGE, Pa. -- Accused child molester Jerry Sandusky has hired a private investigator to look into the slew of sexual abuse allegations against him, The Harrisburg Patriot-News reported Monday.

Since the former Penn State defensive coordinator's arrest Nov. 5, there have been several more victims who have come forward, prompting him to initiate his own probe into the charges, his attorney Joe Amendola told the paper.

Meanwhile, attorneys for The Second Mile, the children's charity founded by Sandusky, asked a judge Wednesday to throw out a request to have the organization's assets frozen.

Lawyers for one of the eight alleged victims -- referred to as Victim Four in the grand jury report in the case -- filed an injunction last week requesting the freeze while their client and other alleged victims prepared to file a civil suit against the charity.

The Second Mile had roughly $9 million in assets as of the end of its fiscal year in Aug. 2010.

HARRISBURG, Pa. - A charity for at-risk children founded by a former Penn State assistant football coach now charged with molesting boys has asked its donors to give their money to the Pennsylvania Coalition Against Rape instead.

The Second Mile made the recommendation Monday in the latest sign its days may be numbered. But the charity said its December programs will continue as scheduled.


The Second Mile was founded in the 1970s by Jerry Sandusky, who was charged this month with sexual abuse of eight boys over a 15-year period. Prosecutors say Sandusky met victims through the charity. He denies the allegations.
Last week, the charity said it was considering restructuring, transferring programs to other organizations or ceasing operations.

Lawyers for one of the people described in a grand jury report as a victim of repeated sexual attacks by Sandusky are seeking a court order to prevent the charity from unloading its assets.

Also Monday, a team with the U.S. Department of Education arrived in State College as part of the federal investigation into whether the school violated reporting mandates for campus crime.

The federal investigation centers on whether reporting provisions of the Clery Act were complied with in the Sandusky case. State prosecutors also charged athletic director Tim Curley and former vice president Gary Schultz with not properly reporting suspected child abuse and perjury before a grand jury.

Penn State spokeswoman Lisa Powers said the university was "pulling a lot of data and archival information" for the Department of Education investigators.

"They will either be meeting with a long list of people even beyond the police force or reviewing their data, areas like student affairs, human resources, counseling services, residence life, athletics and senior administrators," she said.

Penn State President Rodney Erickson, who took the post after Graham Spanier was forced out in the aftermath of the arrests, said the school has been doing its best to provide the records the Department of Education has sought.

Violations of the Clery Act, named for a Lehigh University freshman who was raped and murdered in her dorm room by another student in 1986, can bring fines and a loss of federal student aid.

The student forum, planned for Wednesday at Heritage Hall on the University Park main campus, will be restricted to students who obtained tickets ahead of time by showing valid Penn State IDs. It will be broadcast by the Pennsylvania Cable Network and streamed over the Internet. Viewing areas also are being established at all of Penn State's other campuses.
