Penn State hires President Clinton's former special counsel
December 9, 2011

A man who served as Special Counsel to President Bill Clinton has been hired to advise Penn State's new president.

Lanny Davis, formerly a prominent Washington attorney who now heads a law and crisis management firm, has been engaged to provide legal advice and counsel to Penn State President Rodney Erickson, university spokeswoman Lisa Powers said Friday.

Sandusky, police chief were once neighbors
By FRANCO ORDONEZ AND MIKE DAWSON
McClatchy Newspapers
December 11, 2011

The head of Penn State University's police department who oversaw a 1998 investigation of possible sexual abuse by former Penn State assistant football coach Jerry Sandusky once lived three houses down from the defensive coordinator, property records show.

Chief Thomas Harmon took over leading the department just one month before a detective began looking into whether the chief's former neighbor sexually abused two 11-year-old boys in a campus shower. Harmon later ordered the case closed when the Centre County, Pa., district attorney decided not to file criminal charges.

Sandusky retired from Penn State a year later.

The personal connection between the chief and the architect of "Linebacker U" now has lawyers for Sandusky's alleged victims questioning what role those ties may have played in closing the 1998 investigation, which they argue was a missed opportunity to stop Sandusky from assaulting more children.

"It reflects how incestuous the cast of characters are," said Michael Boni, who represents the person identified as Victim 1 in the Pennsylvania grand jury report released last month. "It's circular. The fact that they were neighbors ought to be investigated. Did Harmon think 'I shouldn't pursue this matter' because he's a friend or neighbor? These things have to be looked at."
 ::snipping2::
According to the grand jury report, Harmon ordered his detective, Ronald Schreffler, to close the Sandusky case after then-District Attorney Ray Gricar decided not to file criminal charges.

In 1977, Harmon moved onto Norle Street, a small tight-knit community in Centre County where residents described neighborhood kids playing together, including Sandusky's and Harmon's children. They rode bikes together in the cul-de-sac. Sandusky also hosted kickball games in his backyard. Several neighbors said they were shocked by the allegations and described the Sanduskys as a loving family and great neighbors.

Colleagues said the two families attended the same church, St. Paul's United Methodist Church in State College.

Harmon had been director of Penn State police since 1990. In April 1998, he assumed more responsibilities when David Stormer, an assistant vice president who oversaw the department, retired and his position wasn't filled. Stormer couldn't be reached for comment.

Harmon, now retired, sold his home in August and moved to Pittsburgh. He declined to speak about the investigation, including his relationship with Sandusky, citing the state attorney general's ongoing investigation.

The Sanduskys moved from Norle Street in 1984 to the home they built on Grandview Road, less than two miles away.

The State College Police Department denied requests for copies of the 1998 investigation, including reports on two calls Sandusky had with a victim's mother that police were listening in on. Police cited the Pennsylvania Right-to-Know laws that exempt investigative records and information on juveniles.

On Thursday, the state Office of Open Records ruled that Penn State police do not have to release any records of the investigation.

Nils Hagen-Fredericksen, a spokesman for the Attorney General's Office, said the 1998 investigation is only one part of the substantial amount of evidence and testimony that has been presented to the grand jury, including "hundreds of interviews and thousands of documents."

"More of that information will become unsealed as that court process moves forward," he said.
The grand jury found that details of the '98 investigation include allegations that match many of those made by other alleged victims. And, according to people with knowledge of the 1998 case, only a fraction of what was uncovered during the two-month investigation is included in the grand jury report.

The full 1998 report is roughly 130 pages chronicling "down-to-the minute" details of Sandusky's interactions with two alleged victims.

The two 11-year-old boys at the center of the 1998 investigation are identified in the grand jury report as Victim 6 and B.K. The latter, the report states, was "subjected to nearly identical treatment in the shower as Victim 6."

This has got to be really difficult, given Joe Paterno's age and he's already undergoing treatment for lung cancer.

Former Penn State Coach Joe Paterno Fractures His Pelvis for Second Time
December 11, 2011

STATE COLLEGE, Pa.   Joe Paterno fractured his pelvis again following a fall at his home but will not need surgery, a person close to the family told The Associated Press on Sunday.

The former Penn State football coach was expected to make a full recovery after slipping Saturday and was admitted to the hospital the next day, the person added. The person spoke on condition of anonymity because of the sensitivity of the situation.

Paterno, who turns 85 on Dec. 21, is also undergoing radiation and chemotherapy for what his family has said is a treatable form of lung cancer. Son Scott Paterno has said doctors are optimistic his father would make a full recovery from the illness.

Prelim Primer: What Tuesday's Sandusky Hearing Will Hold
by Adam Smeltz Nate Mink
December 11, 2011

Jerry Sandusky, charged with 52 criminal counts, is due in Centre County Court on Tuesday for a preliminary hearing.

The proceeding in the child-sexual-abuse case is a standard step in the Pennsylvania court process.

But just what exactly is a preliminary hearing? Who is likely to appear?

Here's an overview of the process that will unfold Tuesday in Bellefonte:

 ::snipping2::
An official court transcript from the hearing will be posted on the Centre County government website once it's approved by involved parties. That transcript may not appear for some days after the hearing, court officials have said.

Sandusky "dreading" court date: lawyer
By Anna Werner
December 12, 2011

(CBS News)

At least five alleged victims in the Penn State sex abuse scandal are set to tell their stories in court for the first time Tuesday.

Former assistant football coach Jerry Sandusky will be there, too, to hear their testimony -- and his lawyer, Joe Amendola, says Sandusky is "dreading" the court date.

"And I'm sure, you can imagine, he's going to have to sit in a court room with a couple hundred people -- I understand it's going to be filled to capacity, including members of his family, and friends -- who are going to listen to these young men say horrific things occurred between them and Jerry," Amendola said.

Sandusky's accusers' allegations have been the subject of two grand jury reports, and hundreds of news stories, but Tuesday, his accusers are expected to answer questions themselves about their allegations that he molested them, CBS News' Anna Werner reports.
 ::snipping2::
One person who will not testify Tuesday will be Sandusky himself: This will be a probable cause hearing in which prosecutors have to establish the basic elements of the charges against Sandusky. No cameras will be allowed in the courtroom.

This would appear to be one of the few choices Joe Amendola has to attempt Jerry Sandusky imo.  It doesn't hold water for me though.  From what I've been reading in various articles, one of the victims has been horribly taunted and teased.

Sandusky is never going to admit that he's done anything wrong.  This will be explained away as a ploy for money, lies by troubled young men, envy, whatever to put the blame on someone other than Sandusky.  If they had videotaped evidence he'd say the kids asked for it.

Judge Eases Media Rules for Sandusky Hearing; Court Officials Looked to Other Cases
December 12, 2011

Reporters covering Jerry Sandusky's preliminary hearing Tuesday in Bellefonte will be allowed to distribute news via Twitter, text messages and e-mails immediately as the proceedings unfold, a judge ruled Monday.

Several news organizations, including The Wall Street Journal, The New York Times and CNN, asked the presiding senior judge, John M. Cleland, to amend his earlier decorum order for the hearing. In that order, issued Dec. 6, Cleland had banned all electronic communication from the courtroom and from an adjacent annex room where other reporters will see a live feed of the proceedings.

The altered, loosened guidelines apply only to credentialed members of the news media, according to a court announcement. Non-reporter members of the general public who attend the hearing will not be allowed to bring mobile phones or laptops into the courtroom, per Cleland's order.

Also, a longstanding Pennsylvania rule prohibiting cameras during court proceedings will remain in effect.

Cleland has put into place a number of other rules for the hearing. For one thing, anyone -- any reporter or member of the general public -- who leaves the courtroom for any reason will not be allowed to return until a break or a recess in the proceedings.

Also, no food or beverages will be allowed in the courtroom. Only those who've already received tickets or credentials will be allowed entry as observers. (Those allowed observers include about 300 people: 200 journalists -- split between the main courtroom and the annex room -- and 100 members of the general public. The selected members of the general public will be allowed access in the main courtroom only.)

Cleland crafted the guidelines with substantial input from the Administrative Office of Pennsylvania Courts (AOPC), court spokesman Jim Koval said.

Jerry Sandusky Arrives to Court
Quote
Sandusky, in a dark suit, entered the back door of the county courthouse Tuesday with his wife, Dottie, at his side. He looked straight ahead, ignoring questions from reporters. Defense attorney Joseph Amendola followed him into the courthouse.

About 50 members of the media awaited Sandusky's arrival. About 10 local residents were also on hand, a few of them waiting with cameras to take pictures.
