FBI changes definition of rape to include men as victims
By Kevin Johnson, USA TODAY
January 6, 2012

WASHINGTON – The FBI is changing its long-standing definition of rape for the first time to include sexual assaults on males following persistent calls from victims advocates who claim that the offense, as currently defined in the agency's annual crime report, has been undercounted for decades.
Under the current definition, established 85 years ago, many of the sex crimes alleged in the ongoing prosecution of former Penn State assistant football coach Jerry Sandusky would not be counted in the bureau's Uniform Crime Report, one of the most reliable measures of crime in the United States. Sandusky is accused in alleged assaults and sexual misconduct involving 10 male victims.

Rape is currently defined as the "carnal knowledge of a female forcibly and against her will."

The new provision will define rape as any kind of penetration of another person, regardless of gender, without the victim's consent.

Justice Dept. Revises Definition Of Rape To Include Male Victims
By Mark Memmott
January 6, 2012

Quote
According to the Justice Department:

"The new definition of rape is: 'The penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim.' "...

"The revised definition includes any gender of victim or perpetrator, and includes instances in which the victim is incapable of giving consent because of temporary or permanent mental or physical incapacity, including due to the influence of drugs or alcohol or because of age. The ability of the victim to give consent must be determined in accordance with state statute. Physical resistance from the victim is not required to demonstrate lack of consent. The new definition does not change federal or state criminal codes or impact charging and prosecution on the local level."

Until now, according to USA Today, the FBI has defined rape as the "carnal knowledge of a female forcibly and against her will."

Alumni group seeks new PSU trustees over Paterno
January 6, 2012

STATE COLLEGE, Pa. (AP) — A group of Penn State alumni unhappy about the firing of football coach Joe Paterno said Friday it hopes to field a slate of candidates to serve on the Board of Trustees.

Penn Staters for Responsible Stewardship said it hopes to endorse people to run in the spring election for three seats on the board that are reserved for alumni. The group has a website and about 2,000 members on a Facebook page devoted to replacing the board.

Group spokeswoman Maribeth Roman Schmidt says members believe the board mishandled the November firing of Paterno and the ouster of president Graham Spanier after the Nov. 5 arrest of former assistant coach Jerry Sandusky on child sex-abuse charges.

One would hope that the main concern would be making sure this type of abuse never happens again.  What a disappointment these people are.

How the Sandusky Scandal Has Changed Youth Sports in America Forever
January 6, 2012

I see this happening already.  Parents are questioning the volunteer coaches in rec centers.  I know personally, I NEVER leave my son alone at his practices.  But now, I've got the company of other moms that are concerned that 'something' might happen if they aren't watching like a hawk.

I can also tell you many volunteer coaches are rethinking what they do.  They don't want to be in any situation that anyone might second guess.  I really can't blame them either.

Sandusky and Penn State have ruined children's sports programs.  That is the legacy being left behind.

I've read a number of articles about how upset and angry some of the alums and former players are. Some are mad because a coach wasn't found within, but I can understand why the need to separate from that, nor was a Penn State Alum hired.  Bill O'Brien isn't a big name coach, but I don't think a big name coach would want to leave their program and take this on.   I don't know what Bill O'Brien's salary is, but he will have earned every penny of it.

The lawyer leading the state attorney general's office case against two university officials in the Penn State child sex-abuse case is a former local high school basketball star who earned top ratings as a homicide prosecutor in Allegheny County.

Deputy State Attorney General Bruce R. Beemer, 43, a 1986 Abington Heights graduate, is handling the case against former athletic director Tim Curley and former senior vice president Gary Schultz. They are accused of lying to a statewide grand jury investigating alleged sex abuse by former Penn State assistant football coach Jerry Sandusky.

This is a very interesting read, imo.

West Chester Criminal Defense Attorney Michael J. Skinner Examines Sexual Offenses and Penalties in Pennsylvania Among Recent Sex Abuse Allegations
West Chester criminal defense lawyer Michael J. Skinner analyzes the recent sex abuse scandal at Penn State and the penalties an alleged offender could face if convicted of serious sexual offenses in Pennsylvania, such as rape or involuntary deviate sexual intercourse.
January 9, 2012

Penn State’s former football coach, Jerry Sandusky, was accused in November 2011 of sexually assaulting numerous boys over a 15-year period while employed at The Second Mile, a charitable organization for young people Sandusky founded. The 40 criminal charges brought forth by eight men involved allegations of forcible oral and anal sex.

Amid the recent sex abuse allegations at Penn State, West Chester criminal defense attorney Mike J. Skinner discusses the differences between the possible sexual offenses an alleged offender accused of these types of offenses can be charged with, including rape and involuntary deviate sexual intercourse, and the penalties an alleged sex offender in Pennsylvania could face if convicted.
 ::snipping2::
(Read the list in article of what Sandusky has been charged with so far-  )
“If Sandusky is convicted of all 40 counts of the various sexual offenses he has been charged with in Pennsylvania, a judge would have the option to run each count consecutively, i.e. one after another, or run them concurrently, which means at the same time. In addition, if Sandusky is convicted of numerous offenses for acts with the same victim, the convictions could possibly merge into the same sentence, which would result in a shorter prison term,” said Skinner.

Michael J. Skinner of the Skinner Law Firm is a West Chester criminal defense attorney who represents individuals that have been charged with sexual offenses throughout Chester Co

HARRISBURG, Pa. -- Former Penn State football coach Joe Paterno and his wife donated $100,000 last month to Penn State, money that was split between a library and an undergraduate fellows program that bear the family name.

Sue Paterno on Monday described the contributions to the Paterno Liberal Arts Undergraduate Fellows Program and the Paterno Library as an annual gift.

Penn State’s legendary football coach Joe Paterno donated $100,000 to the university, weeks after university trustees fired him amid allegations his former assistant coach Jerry Sandusky had molested children, The Patriot-News reported on Monday.

Paterno and his wife, Sue, made the donation in December. Sue Paterno on Monday said the donation had been an annual gift to the Paterno Liberal Arts Undergraduate Fellows Program and the Paterno Library.

Students in the fellows program receive $1,500 to $5,000 to help fund research, overseas study and internships.

English professor Jack Selzer, who runs it, said the $50,000 gift was the couple's second contribution to the program.

"It helps students who otherwise would never have a chance to study abroad (to) have a chance," Selzer told the Associated Press. "It really frees them up for experiences that they could otherwise never afford."

Over the years, the Paternos have donated more than $4 million to the university and have helped raised an additional $14 million for the library, according to Bloomberg News.

Penn State Board Explains Paterno Firing
January 12, 2012

(NewsCore) - Penn State University's board of trustees on Thursday moved to defend its decision to part ways with head football coach Joe Paterno amid the child sex abuse scandal involving former assistant coach Jerry Sandusky.

The board's statement came a day after university president Rodney Erickson fielded difficult questions from alumni about the handling of the controversy at a town hall-style meeting in Pittsburgh.

According to the statement, after Paterno announced Nov. 9 he would retire at the conclusion of the 2011 season, the board decided that "given the nature of the serious allegations ... and the extraordinary circumstances then facing the University, ... Paterno could not be expected to continue to effectively perform his duties and that it was in the best interests of the University to make an immediate change in his status."

"Therefore, the Board acted to remove Coach Paterno from his position as Head Football Coach effective as of that date," read the statement issued by board chairman Steve Garban and vice chairman John Surma.

The board said Paterno remains employed by the university as a tenured faculty member and that the details of his retirement are being worked out and will be made public when they are finalized.

The unidentified source also told The Patriot-News that the school's athletic director at the time originally did not want to give Sandusky tickets to the game, but Sandusky’s wife, Dottie, was so insistent that he eventually relented.

I have to say, Mrs. Sandusky seems to be pretty involved in this whole mess.  She's upstairs and can't hear a child's screams for help, she's pushing for tickets for hubby to attend a pretty important game.  This woman needs to answer some questions.  Really.
