Jerry Sandusky hearing to address jury, bail issues
February 9, 2012

Retired Penn State defensive coordinator Jerry Sandusky and his attorney are to be in Centre County court tomorrow morning so a judge can begin hashing out out several issues for his upcoming trial, including where the jury will be picked.
Sandusky, who faces more than 50 counts of sex abuse of 10 boys, is expected to face trial by the end of the year.

But before that, Judge John M. Cleland will have to rule on a frenzy of pretrial issues brought by both Sandusky's defense team and prosecutors with the state Attorney General's office. Follow @PatriotNews or @sganim for live updates on Twitter.

February 10, 2012

WILLIAMSPORT — The insurance company that is seeking a court order so it can avoid paying Jerry Sandusky’s legal fees does not want one of his alleged victims to intervene in the case.

Federal Insurance Co., which represents The Second Mile charity founded by Sandusky, cites other court decisions in arguing against intervention.

The alleged victim’s only interest in this matter is protecting a potential monetary source to help fund the payment of any settlement or judgment he might obtain, the insurance company states in a document filed this week in U.S. Middle District Court.

Federal Insurance argues courts have held mere economic interest is not “sufficient interest” to intervene.

BELLEFONTE, CENTRE COUNTY—
The court hearing for accused child molester Jerry Sandusky is underway. The judge has laid out five different issues that the two sides will be addressing today. The issues include:

1. Early release of grand jury testimony 2. Bill or particulars 3. Pretrial discovery 4. Modify bail- testimony 5. Change venire


As of 10:55 a.m., the judge has not made any decisions on four of the five points that are being discussed in court. The first three matters went very quickly however, prosecutors and the defense teams spent nearly 30 minutes on modifying bail.

"And finally, to address their concerns about me being on my deck. Our home has been open for 27 years to all kinds of people, people who have stayed there, hundreds of people who stayed there, more than that who have visited there. I've associated with thousands of young people over the years. And, now, all of a sudden, because of allegations and perceptions that have been tried to be created of me, I can't take our dog on my deck and throw out biscuits to him. Now, all of a sudden, these people turn on me when they've been in my home with their kids, when they've attended birthday parties, when they've been on that deck, when their kids have been playing in my yard, and when their kids have been sled riding when they've asked to sled ride in our home. It's difficult for me to understand, to be honest," Sandusky said.

The judge will now rule on the motions but he has not said when his decision will be announced.

The judge will also have to decide on a trial date for Sandusky. The trial could start as early as May 14.

He hit the nail on the head...the problem is that people have been coming to his house, just like he said.  What does he not get?

Yeah, you'd think after having been charged with 52 counts and 10 victims reality would start sinking in for Jerry.  The authorities aren't kidding, and I think all the horseplay, fun and games have come to a screeching halt.  JMHO

Sandusky was in a Centre County courtroom and asked a judge to let him see relatives, including supervised visits with his grandchildren, and friends. He denies the criminal allegations.

The judge could rule early next week on Sandusky's request.

Sandusky also said he felt people who had been welcomed in his home were now trying to keep him confined indoors.

"I've associated with thousands of young people over the years," said Sandusky, 68, the former Penn State defensive coordinator charged with 52 criminal counts involving 10 victims over 15 years. "And now, all of a sudden, because of allegations and perceptions that have been tried to be created of me, now I can't take our dog on my deck and throw out biscuits to him."

State investigator Anthony Sassano testified that children had noticed Sandusky from their classroom, and that his presence was disrupting school activities.
Sandusky cannot walk the dog because of his bail restrictions, Amendola said.
Sandusky said after the hearing that his neighbors have changed toward him.

"Now all of a sudden, these people turn on me when they've been in my home with their kids," he said. "They've attended birthday parties when they've been on that deck. When their kids have been playing in my yard. When their kids have been sled riding when they've asked to sled ride. It's difficult for me to understand."

I think Rich Hofmann hit's the nail right on the head about Sandusky painting himself as the victim.  And I choose option #2 (bolded in blue), as for the reason the prosecution's motive to have a jury brought in from another county.  JMHO

Sandusky spoke for a time during the hearing and then made a statement to the press afterward. He did not take questions, instead painting himself as a victim and his neighbors as hypocrites who allowed their children to attend birthday parties in his home in the past but who now say they fear him.

He sounded pathetic, talking about how he is unable to see his friends and those grandchildren, and "now I can't take my dog on my deck and throw out biscuits to him."

Of course, to try to get Sandusky or Amendola to see that the neighbors are not hypocrites, but merely thinking people who have read a newspaper, is a waste of breath. And given that Amendola said that there have been no negotiations for a plea bargain, and the quick trial date set by Judge John Cleland, this whole terrible mess is officially on a fast track.
Cleland promised a quick ruling on the issues raised yesterday, which included the change in bail conditions and the prosecution's motion to continue to hold the trial in Centre County but to have a jury brought in from another county.

The people in charge of this prosecution, having seen the assignment of a judge from out near Pittsburgh, have now determined that it is just too risky to pick a jury from among the citizens of Centre County. Perhaps they have done research at the local Walmart and determined that the sales of blue-and-white boxer shorts are just too high around here to take a chance.

There are two main theories about the prosecution's motives.

One, that even though thinking human beings know that Paterno had nothing to do with the allegations against Sandusky, the concern might be that the emotions people feel for Paterno could somehow complicate their view of what did or did not happen.

Or, two, that they wanted to take away any chance of a post-conviction appeal by Sandusky on the grounds that a local jury could not possibly be impartial. The judge made it clear to Sandusky that he was losing a chance at that kind of appeal if he insisted upon a Centre County jury despite the prosecution's motion to import some jurors.

For years, Pennsylvania gave up federal money because it was the only state not in compliance with federal child abuse laws.

It remains the only state that doesn’t allow experts to testify at trial about the behavior of child victims, such as why they might wait years before coming forward to police, continue a relationship with the abuser, or why they might not immediately tell police about all of the abuse.

There also is no state training for mandatory reporters in Pennsylvania.

And child abuse is defined in such a way that you could walk up to a 5-year-old on the street, punch that child in the face, get convicted by a jury and still not be listed in the state child abuse registry.
If convicted, Jerry Sandusky, the former Penn State coach accused of sexually abusing 10 boys, probably won’t have to register either, simply because child abuse here hinges on a relationship between child and abuser. A family member or a teacher, for example.

On the surface, statistics appear to show that Pennsylvania has a far lower rate of child abuse than comparable states like Ohio, Virginia and New Jersey.

But part of the reason is because Pennsylvania is limited in what it classifies as child abuse.

Only parents, a paramour of a parent, a caregiver or someone older than 14 and living with the child can be considered a perpetrator.

That does not mean police can’t investigate, charge and eventually convict anyone of abusing a child. What it means is that ChildLine, the state hotline and abuse registry used for things such as background checks, would not recognize that person as an abuser.

“From the judiciary down, historically, there’s been concerns about how child abuse is investigated,” said Jason Kutulakis, a Chambersburg attorney.

And there’s another reason Pennsylvania needs to deal with this first: It’s directly linked to mandatory reporting.

“Because even if I’m a mandated reporter calling ChildLine, ChildLine might say, ‘That’s not child abuse,’ ” Palm said. “There’s a whole lot of steps until someone really gets connected to a real investigation, if someone even gets connected to a real investigation.”

On the federal level, U.S. Sen. Bob Casey Jr. proposed legislation that would require all states to give up federal money unless they pass a mandatory reporting law for every adult. Casey introduced the Speak Up to Protect Every Abused Kid legislation one week after Penn State fired head football coach Joe Paterno and President Graham Spanier in the wake of the scandal.

Jerry Sandusky can visit with his grandchildren while out on bail on sex-abuse charges

Centre County Judge John M. Cleland ruled this morning that Jerry Sandusky can leave his home and see most of his grandchildren -- under certain conditions. Cleland also denied a proprietorial motion to confine Sandusky to the interior of his home.

He will be able to see his grandchildren at his home provided a parent is in attendance at all times. Sandusky will also be able to talk to them on the telephone, exchange emails or video chat through the computer.

However, his contact with three of his grandchildren will be contingent upon the decision of another judge, who is arbitrating a custody dispute between those children's parents.

Cleland also ruled Sandusky can leave the confines of his home to assist his defense team, provided he alert Centre County probation at least 36 hours in advance and provide a detail itinerary of when he will be leaving, where he will be going and who he will be with.

Sandusky will also be able to continue to go outside the confines of his house and onto his back porch, a habit prosecutors objected to, as his property is adjacent to an elementary school. On the school playground just feet from Sandusky's yard and from inside classrooms, children can see Sandusky when he's outside, and it's been disturbing to classes, prosecutors said in a hearing on Friday.

Cleland denied prosecutors' request to select a jury from outside Centre County because the Attorney General's office had not proved a Centre County jury could not be impartial.

The prosecutors' concerns -- the influence of Penn State and The Second Mile on Centre County, plus media coverage -- are valid, Cleland wrote. But they have not been shown to taint the jury pool. Since Sandusky requested a Centre County jury, Cleland will allow it.

In addition to his grandchildren, Sandusky will also be able to receive adult visitors, Cleland ruled, although again, he will have to comply with certain conditions. In his ruling, the judge said Sandusky can provide the probation office with a list of 12 people -- excluding members of his family -- whom he would like to see.

If approved by the county, they may visit Sandusky at his home, although the number of visitors may be limited. The total time for visits will also be capped at two hours three times a week. Cleland said that in addition to the 12 people named by Sandusky, he may be visited by religious, medical or similar professionals.

Cleland denied Sandusky's request to release the transcripts of witnesses who testified before the grand jury that recommended charges, saying the judge overseeing the grand jury would have to approve such a motion.

Tim Curley asks court to throw out perjury charge

Penn State's former athletic director, Tim Curley, wants the Court of Common Pleas to throw out the perjury charge against him.

Curley’s attorney, Caroline Roberto, filed a petition in Dauphin County today, arguing that without the availability of Joe Paterno to testify there isn’t enough evidence to establish corroboration.

Paterno, who died Jan. 22, had testified to the grand jury investigating the Jerry Sandusky child sex abuse charges. Curley and former Penn State administrator Gary Schultz are both facing charges of perjury and failure to report in the case.
