It doesn't make sense.

If it has been determined that Dutchcot ruled the conditions of Sandusky's release while possessing a conflict ... why does her ruling still stand?  Without electronic monitoring .... Sandusky still remains a risk to children.  Without the confiscating of his passport ... Sandusky still remains a flight risk.

New judge assigned in Penn St. sex-abuse case
Updated 02:08 p.m., Wednesday, November 16, 2011

<snipped>

The Administrative Office of Pennsylvania Courts announced Wednesday that it was bringing in a Westmoreland County senior district judge to preside over Sandusky's preliminary hearing. Robert E. Scott is taking over the hearing from Centre County District Judge Leslie Dutchcot.

Dutchcot has donated money to The Second Mile, a charity established by Sandusky for at-risk children and the place where authorities say he met his victims.

The office said Scott has no known ties to Penn State or The Second Mile. The hearing is scheduled for Dec. 7.

TRENT COPELAND, CRIMINAL DEFENSE ATTORNEY: .... This is molestation of multiple children, and the fact that this judge let this guy walk out of the courtroom without posting anything, without taking his passport, without shackling his leg, without putting electronic monitor on that leg is outrageous.

Lawyer calls on Penn State to 'free victims' souls'
November 16, 2011

As the Penn State abuse scandal blares in the news, hundreds of people around the country who were sexually abused as children will watch in legally imposed silence, says a Boston attorney and expert on such cases.
Each is sworn to confidentiality agreements that bind them to secrecy, says Mitchell Garabedian, the lawyer whose 2002 case blew open the Catholic Church abuse scandal worldwide.

Garabedian, who has represented 1,000 victims of clerical sexual abuse, says Penn State officials need to say publicly whether they have ever required victims to sign such agreements as a condition of settlements in sexual abuse cases.
All institutions, private and public, will try to persuade victims to sign confidentiality agreements that swear everyone — victims, perpetrators and enablers — to silence," he says. "Victims will often agree to silence because it's too painful for them to think about it or humiliating for them to be known publicly."

He called on Penn State officials to step up and "free victims' souls," as the Catholic Church did by releasing victims from silence.

In 2003, the U.S. Conference of Catholic Bishops announced that thousands of confidential settlement agreements signed by dioceses across the country for decades were no longer to be enforced.

Carmen Durso, also a Boston-based attorney who handled hundreds of abuse cases, says victims almost always sign such agreements.

"Frequently, the institution will insist on confidentiality or the victim will have to go to court to get resolution," Durso says. "In my experience, 99% do not want to go public. It's a rare 1% who are able to speak out."

The National Crime Victims' Bar Association in general opposes confidentiality agreements, Executive Director Jeff Dion says. "The client is in control of whether to consent to it," he says.

Franco Harris Splits With Casino After Supporting Penn State’s Joe Paterno
November 16, 2011

Hall-of-Fame running back Franco Harris is no longer working for a Pennsylvania racetrack and casino after expressing his support for fired Penn State University coach Joe Paterno.

Harris, who played for Paterno from 1969-71 before a 13- year career in the National Football League, visited his former coach at his home on Nov. 13, four days after Paterno was fired amid a child sex-abuse scandal involving former assistant coach Jerry Sandusky.

Harris, 61, told reporters that the school’s board made a poor decision in removing Paterno and that “they showed no courage, not to back someone who really needed it at the time,” according to the Pittsburgh Tribune-Review.

The Meadows, about 160 miles from of State College-based Penn State and near Pittsburgh, released a statement last night saying that it was parting ways with Harris.

“In light of the recent developments with Franco Harris regarding Joe Paterno’s dismissal, Franco and The Meadows have mutually decided to put their business relationship on hold at this time, while these matters are looked into further,” according to the statement.

Harris and former Steelers teammate Rocky Bleier were hired by the Meadows in October to assist with various outreach activities, charitable events and public appearances, according to the Pittsburgh Post-Gazette.

Officials at the Second Mile, the charity for at-risk children that Sandusky founded and that prosecutors say he used to target victims, reported that several years of the organization’s records were missing and had perhaps been stolen. The missing files, investigators worry, may limit their ability to determine if Sandusky used charity resources — expense accounts, travel, gifts — to recruit new victims, or even buy their silence, according to two people with knowledge of the case.

Prosecutors have said that Gary Schultz, the university official charged with overseeing the campus police, said under oath that he recalled being aware of some kind of incident involving Sandusky and a boy showering together, and the subsequent investigation.

What "subsequent investigation"?

I am cynical by nature but I think A LOT of people turned a blind eye to what was going on. A grown man sharing a hotel room with various young boys, red flag. Sorry to be gross but some telltale noises coming from the room next door. Only certain boys getting all those expensive gifts, JS isn't Trump. A brief hand on a knee at a restaurant, like in the car. Yes some were oblivious, but many must have seen and known. Just sickening.

http://www.pennlive.com/midstate/index.ssf/2011/11/jerry_sanduskys_victim_four_te.html

"Signs — like trips with boys and hotel room stays — might have been noticed sooner if Sandusky wasn’t viewed as being such a selfless, almost saintly community leader.

"Now we know it’s a little weird," Andreozzi said. "I think there are a number of instances, a number of people who were under the impression that Sandusky was an upstanding person in community."

Sandusky won the boy over through his generosity, according to the grand jury. He showered the boys with gifts, including clothing, a snowboard, Nike shoes, sports lessons, golf clubs, jerseys.
