After reading this article, my question is:  If Joe Paterno treated the football players at Penn State any differently than other students in the sense they received less punishment when it came to discipline, how did that affect his dealing with Jerry Sandusky?

Paterno Clashed With Penn State Official Over Punishment of Players
November 22, 2011

STATE COLLEGE, Pa. –  Legendary Penn State football coach Joe Paterno clashed repeatedly with the university's former chief disciplinarian over how harshly to punish players who got into trouble, internal emails suggest, shedding new light on the school's effort to balance its reputation as a magnet for scholar-athletes with the demands of running a nationally dominant football program.

In an Aug. 12, 2005 email to Pennsylvania State University President Graham Spanier and others, Vicky Triponey, the university's standards and conduct officer, complained that Paterno believed she should have "no interest, [or business] holding our football players accountable to our community standards. The Coach is insistent he knows best how to discipline his players ... and their status as a student when they commit violations of our standards should NOT be our concern ... and I think he was saying we should treat football players different from other students in this regard.
"

The confrontations came to a head in 2007, according to one former school official, when six football players were charged by police for forcing their way into a campus apartment that April and beating up several students, one of them severely.

That September, following a tense meeting with Paterno over the case, she resigned her post, saying at the time she left because of "philosophical differences."

In a statement Monday, Triponey said, "There were numerous meetings and discussions about specific and pending student discipline cases that involved football players," which she said included "demands" to adjust the judicial process for football players.

The end result, she said, was that football players were treated "more favorably than other students accused of violating the community standards as defined by the student code of conduct."

Paterno's lawyer, Wick Sollers, said through a spokesman that "the allegations that have been described are out of context, misleading and filled with inaccuracies ... Penn State's record of producing successful student athletes under coach Paterno's guidance is unquestioned."

Sandusky lawyer: High bail would be tough to make
November 22, 2011

(CBS/AP)

HARRISBURG, Pa. - A legal expert says if more charges are filed against former Penn State assistant coach Jerry Sandusky, he'd have to go through another bail proceeding that might end up being set too high for him to meet it.

Central Pennsylvania criminal defense attorney Bill Costopoulos said Tuesday any additional charges would likely translate into a second arrest for the man accused of sexually abusing eight boys over a 15-year period. Sandusky maintains his innocence.

Sandusky's attorney Joe Amendola is telling ABC's "Good Morning America" he's concerned that if prosecutors bring new charges based on any additional accusers, Sandusky will end up in jail.

Police have confirmed that new accusers have come forward since the release of grand jury report that accused Sandusky of sexual abuse of eight boys and resulted in 40 sexual abuse charges and Amendola told ABC news that he "anticipates more charges to be filed against his client."

Amendola did not provide any specific evidence that new charges were forthcoming and did not return phone messages left Tuesday.

Penn State 'Victim' Was Retaliating Against a Tough Mentor, Lawyer Claims
November 22, 2011

This article should be read in it's entirety.  So big deal if more charges are brought and Sandusky has to go to jail because he can't make bail.  He should be in jail right now, imo, except for the fact he had a judge that has since been replaced because of conflict of interest.  Here comes smear the victims time.  From one of the articles I've read, Victim 1 wasn't pampered and isn't trying for attention, but the opposite.  It would appear he has a hellish life right now.

Penn State Home County Judges out of Sandusky Case
November 22, 2011

Pennsylvania court officials say all the judges in Penn State's home county have removed themselves from potentially presiding over the child sex-abuse case against former assistant football coach Jerry Sandusky.

The Administrative Office of Pennsylvania Courts announced Tuesday that out-of-county judges have been named to deal with any related court business in the Centre County case.
 ::snipping2::
Sandusky, whose preliminary hearing is scheduled for next month, has maintained his innocence.

The court system says the case will eventually be handled by McKean County Senior Judge John Cleland. Until he's able to assume jurisdiction, a different judge from Perry and Juniata counties is filling in.

Out-of-county trial judge appointed in Sandusky case
November 22, 2011

STATE COLLEGE, Pa. (WHTM) -

A senior judge from McKean County has been appointed to hear upcoming matters related to the case of former Penn State assistant football coach Jerry Sandusky.

McKean County Senior Judge John Cleland was appointed to the case after all Centre County Common Pleas Court judges recused themselves, according to the Administrative Office of Pennsylvania Courts.

The judges recused themselves to avoid any appearance of conflict of interest due to real or perceived connections to Sandusky, The Second Mile charity he founded, or Penn State University, court officials said.

Frankly, I suspect the tentacles of Penn State run a lot deeper than many may realize.  JMHO

Inquirer Editorial: Penn State probe's leadership encouraging
November 22, 2011

In tapping former FBI Director Louis J. Freeh to head the in-house probe of the Jerry Sandusky child-sex-assault scandal, Pennsylvania State University officials have turned to a veteran investigator with impressive credentials and a national profile.

There's little doubt that Freeh, 61, has the experience and expertise to peel back the layers of the Penn State bureaucracy where - according to a grand jury indictment - a child predator was sheltered from scrutiny for years.

Freeh's charge to "leave no stone unturned" in an internal investigation that will cover a nearly 35-year period is a strong statement that the Penn State trustee committee headed by Merck & Co. boss Ken Frazier intends to expose the scandal's roots.

With other former FBI agents and federal prosecutors joining Freeh in an inquiry that will call upon the public to phone in tips (855-290-3382) on other possible victims, the trustee-directed inquiry should shed more light on the key question of how the apparent Sandusky cover-up was allowed to unfold.

Can the Freeh investigation satisfy critics in the Penn State faculty senate who, on Friday, rightly questioned the trustees' ability to offer an objective and fair look at the scandal?

That will be determined, in part, by whether the inquiry proves to be truly arm's-length. Freeh must not allow his former business relationship with Penn State while a credit-card company executive to cloud his ability to conduct an objective probe.

Newest Alleged Jerry Sandusky Victims Are Still Minors, According To Report
November 22, 2011

Combining the Jerry Sandusky grand jury report and subsequent pieces from the New York Times and FOX's Philadelphia affiliate, the total number of alleged victims has approached 20 or so. Now, the Patriot-News' Sara Ganim reports two cases that have been opened in the past 60 days involve alleged victims who are still children.

Children and Youth Services is the investigating body, since the police only get involved if the victim is 18 or older at the time of the allegation.

Sandusky charity faced contempt motion over missing records
By Michael Isikoff
November 21, 2011

Pennsylvania state prosecutors filed a secret motion to hold The Second Mile children’s charity in contempt in July after the organization failed to turn over expense records of founder Jerry Sandusky in response to a grand jury subpoena, according to a source familiar with the investigation.

The contempt motion, filed under court seal, was withdrawn in October after some of the  missing Sandusky records were found and produced, said the source, who spoke on condition of anonymity. But the charity’s new lawyers are still looking for the rest of the subpoenaed material and seeking to determine whether the missing records were destroyed or removed in an effort to impede the investigation into Sandusky’s relationships with The Second Mile children, said the source, who has been briefed on some of the details of the investigation.

The move to hold The Second Mile in contempt, which has previously not been reported, is the latest indication that the investigation into the Penn State sex abuse scandal may have widened to include obstruction of justice. Asked Monday if obstruction was a focus of Pennsylvania Attorney General Linda Kelly’s investigation, her spokesman, Nils Frederickson, declined comment, citing rules covering the secrecy of matters before the grand jury. “This is a comprehensive, active and ongoing investigation,” he said.

Sandy Kranich Penn State Golf Benefit sponsors rethinking donations for Second Mile in light of Sandusky charges
Shipley Energy hasn't decided whether to sponsor the event benefiting The Second Mile, and Capital Blue Cross said it won't donate until the investigation is over.

By JIM SEIP
Daily Record/Sunday News
November 21, 2011

ork, PA - Jerry Sandusky could be seen motoring around Heritage Hills Golf Resort in a golf cart several years ago, young boys -- ages 9 and 5 -- sitting next to him as he drove. The retired Penn State defensive coordinator teased former players like running back Blair Thomas as golfers helped raise money for The Second Mile -- a charitable foundation Sandusky started in 1977.

The Sandy Kranich Penn State Golf Benefit became the highest profile sporting event for The Second Mile in York County. The event raised money for The Second Mile, a foundation that served more than 100,000 youth annually in Pennsylvania.

Named for Sanford "Sandy" Kranich, a 1940 Penn State graduate and booster who died in 2000, the tournament has been held for 18 consecutive years -- including a June 9 event in 2011.

More than 70 golfers, supporters and volunteers contributed to last year's event -- according to The Second Mile's website. But the child-sex-abuse scandal at Penn State could make it difficult for the event to continue. Two corporate sponsors confirmed Monday they have not yet earmarked any funds for the annual event.

Shipley Energy has been the event's "gold sponsor" -- or title sponsor.

"I know in the upcoming year we will make any future decisions," Shipley Energy communications coordinator Andrea Cote said. "We look at all organizations and decide on an annual basis."

The Second Mile has not contacted Shipley since Sandusky was charged, Cote said.

One of the event's "silver sponsors" -- Capital Blue Cross -- has taken a more firm stand. Dave Skerpon, the vice president of corporate communications and advertising, said Capital Blue Cross will not donate any money to The Second Mile until the investigation is complete.

Capital Blue Cross meets once every two weeks to discuss corporate giving. So it could donate in the future to The Second Mile, but it won't make any donations at this time, Skerpon said.

Capital Blue Cross has not been approached to sponsor this year's golf tournament. The Second Mile last contacted Capital Blue Cross to sponsor the golf tournament in York in October 2010, Skerpon said. And organization has not requested any donations from Capital Blue Cross since Feb. 25, 2011, Skerpon said.

Another "silver sponsor," York County Commissioner Doug Hoke, said he has a lot of questions about The Second Mile right now.

Judge bans Jerry Sandusky, attorney from using Victim One's name publicly
November 22, 2011

A judge has agreed to bar Jerry Sandusky and his attorney from identifying Victim One, who is among the alleged eight victims named in a child sex abuse investigation.

The order includes any mention of his identity at a preliminary hearing, now scheduled to happen in Centre County court Dec. 13.

The order also requires the court clerk and district court to keep "John Doe'' and his family's identities confidential.
Victims of sexual abuse are not named in most news accounts because of media policies designed to protect the victims. However, the names are made public in court documents and as part of the court record.

In this case, attorneys Andrew Shubin and Justine Andronici convinced a judge that their client deserves extra protection based on the scope of the case and the amount of media attention it has generated.

 ::snipping2::

Their concern is backed up by the hardships faced by Victim One. The Patriot-News first reported that the 17-year-old Clinton County boy had to change high schools because he was being bullied, called names, and blamed for the firing of football coach Joe Paterno.

Sandusky attorney says additional charges likely
November 22, 2011

In an interview with Good Morning America, Joe Amendola, the attorney representing former Penn State assistant coach Jerry Sandusky, said that Sandusky's accusers were "pampered" after being "labeled as victims" by the legal system, and that one's accusations were the result of tough love from Sandusky as a mentor.

"[P]eople when they're brought into the criminal justice system and they're labeled as victims, they're pampered, they're encouraged, they're treated specially. And particularly when you're dealing with maybe someone who hasn't had a great, the greatest of lives. Then a lot of times they start feeling more important," Amendola said in the interview.

Amendola's most specific comments about the alleged victims were directed at whom the Pennsylvania grand jury describes as Victim 1, saying those accusations were a negative reaction to Sandusky's demands for harder work toward unspecified goals.

"When you push and they don't want you to," Amendola said, "they react. And what Jerry believes happened is that this young guy got tired of Jerry pushing. Jerry believes that what happened was this young guy said, 'you know what, gee, if I say Jerry did something to me, that's the end of my relationship with Jerry.'"

Amendola also said that he is concerned that more charges will be brought against his client, and that his client may go back to jail before his trial as a result. Sandusky is free on $100,000 unsecured bail after facing 40 varying counts of sexual assault on underaged males, and the judge who set that bail was removed from the case after it was revealed that she volunteered for The Second Mile, the charity Sandusky formed in 1977 and allegedly used to meet all of his alleged victims.

Exclusive: Jerry Sandusky case sees two new child abuse investigations where alleged victims are under 18
November 22, 2011

Two cases of child abuse alleged against Jerry Sandusky have been opened by Children and Youth Services in Pennsylvania.

The cases were reported less than 60 days ago, and so they are still in the initial stages of the investigation.

If they are found to be credible, these would be the first known cases to be reported since Sandusky’s arrest that involve current children. All of the other publicly known cases of alleged victims coming forward have been adults.

In Pennsylvania, when an adult comes forward and alleges abuse -- even if it happened when that person was a child -- it’s solely a police matter. CYS only participates in the investigation if the victim is still under 18.

This new information could give credence to a growing debate over whether Sandusky should have been arrested more quickly.

When a 15-year-old Clinton County boy first alleged crimes against the former football legend and charity founder, police opted to open a grand jury investigation instead of making an immediate arrest.

It was a surprise move to the family of the boy, now known as Victim One.

And, it became a point of wonder for others in law enforcement when The Patriot-News first reported earlier this month that, for the first 15 months of the investigation against Sandusky, there was only one state trooper assigned to the case.

It wasn’t until the fall of 2010 that agents from the state Attorney General’s office got involved, and then when then-Attorney General Tom Corbett was elected Governor and took office in January 2011, he appointed state police commissioner Frank Noonan, who increased the number of investigators to eight.

That was when things really started to take off. It wasn’t until January 2011 that Joe Paterno, fomer athletic director Tim Curley and vice president Gary Schultz testified. It wasn’t until April that officials from The Second Mile testified.

None of the other seven cases of alleged abuse, outlined in the grand jury presentment, were known until more investigators joined the team.
The 1998 police report -- which never led to charges when investigated by missing district attorney Ray Gricar -- wasn’t found until late 2010. That file was found around the same time that assistant coach Mike McQueary was contacted for the first time by police.

McQueary testified before the grand jury that he’d witnessed abuse in 2002 and reported it to Schultz and Curley, but nothing ever came of that investigation.

As a result of his testimony, Curley and Schultz were charged with perjury and failure to report a crime.

But none of the cover-up investigation began until 2011. And it wasn’t until after The Patriot-News broke the story of the investigation in March of this year, that officials from the Clinton County school district where Sandusky had allegedly spent time with Victim One were subpoenaed.

Gricar’s former staff members were not interviewed until after March 2011.

And Jerry Sandusky’s home was not searched until this summer — two and half years after the investigation began.

In response to questions about the length of the investigation, Corbett said yesterday:

“The one thing you do not want to do as a prosecutor is go on one case. ... You want to show a continued course of action.”

If a first set of charges are filed early and “you were to lose that one case, it would be much more difficult to bring charges in other cases because it would be seen by you, by the public, as vindictive,” he added.

I can't believe that the lawyers are already attacking the underage victims.  That is usually done during court.  What a scumbag.  Maybe this genius lawyer can explain how all these different people managed to get together and plan this whole mess?  You've got underage boys, janitors, grad assistant, a mom, a bunch of cops with a recording.  I mean, please, this isn't going to go away by attacking kids.

ITA KittyMom. I think part of the plan of shaming the victims is two fold.  One, it discourages any potential new cases from coming forward, including minors (who would want their kids torn apart in public?) and two, it helps start casting doubt on the ones that have already come forward.  You'll notice he's also calling for those that have benefited from the Second Mile to come forward.  I can see how long and drawn out the legal proceeding might become, and they could die a death by being just plain worn out from being lawyered to death.  I can see this stretching out for years.

I don't want to appear harsh to an elderly lady, but Joe Paterno was fired.  When a person is fired from a job, don't they (and their spouses) usually lose such privileges?  If you aren't a student or an employee, why should you be able to use campus facilities?  Usually you have to have an ID card on campuses to use facilities.  I have a son in college, and some activities are part of the blanket fee he pays with tuition, but to use the work out facilities, he pays $35.00 a semester.  There was a time he was between enrollment in his bachelor program and his masters program, he couldn't use the facilities.  It's unfortunate for Mrs. Paterno not to be able to use facilities and I don't know if there's a way for her to be able to do that.  Pay fees?  Or must you be an employee or dependent or a student to do so?

Report: PSU bans JoePa's wife from pool
November 23, 2011

The wife of former Penn State head football coach Joe Paterno will have to find a new place to swim after school officials decided to ban her from the university pool.
A source close to the Paterno family told The Harrisburg Patriot-News that Sue Paterno was informed Wednesday she would no longer be welcomed at the school's facilities, adding that no reason was given.

When asked to comment by The Patriot-News, Penn State spokesman Bill Mahon said, "I have heard nobody discuss this."

According to the family source, the wife of the 84-year-old iconic head coach used the Penn State facilities daily to swim and workout.

The Paterno family has remained mostly out of sight since the child sex abuse scandal involving former assistant football coach Jerry Sandusky engulfed the State College campus earlier this month.

Paterno and university president Graham Spanier both lost their jobs in the immediate aftermath, while athletic director Tim Curley and vice president Gary Schultz were both charged with perjury for allegedly lying to a grand jury and for failing to report suspected child abuse.

Latest accusation says former Penn State coach Jerry Sandusky may have sexually abused a relative: lawyer

Victim asks court to bar charity from moving assets

NEW YORK DAILY NEWS

Accused child molester Jerry Sandusky, the former Penn State defensive coordinator who has been charged with 40 counts of sexual abuse, may have molested a relative, a Pennsylvania newspaper reported on Wednesday.

The Patriot-News of Harrisburg said that Joe Amendola, Sandusky’s attorney, told the newspaper that one of the two new cases opened by Children and Youth Services in the last 60 days involved a family member.

Amendola said the alleged assault took place before Sandusky’s arrest on Nov. 5, but that authorities did not learn about it until after Sandusky was charged.

The Patriot-News said it will withhold Sandusky’s relationship to the child because it wants to protect the victim’s identity.
